1 The applicants are taxi drivers working within the Perth metropolitan area who each hold several taxi plates (required to operate a vehicle as a taxi), issued by the second respondent pursuant to the provisions of the Taxi Act 1994 (WA). They ask the court to issue a writ of mandamus to the respondents commanding them to cause prosecutions to be commenced, alternatively to consider the commencement of prosecutions, against companies and individuals involved in the service known as UberX for breaches of provisions of the and a related Act, the (WA) (TCA). The applicants approach the court in their own right and as representatives of a wider group of taxi drivers and owners of taxi plates.
