Introduction
- By application filed 19 February 2024 the appellant appeals the decision of the respondent (Council) of 16 February 2024 (Decision) to suspend his registration as a pharmacist pursuant to s 150(1)(a) of the Health Practitioner Regulation National Law (NSW) (National Law).
- The appeal is brought under s 159 of the National Law. Accordingly, the appeal is to be dealt with by way of a new hearing and fresh evidence, or evidence in addition to or in substitution for the evidence that was before the Council, may be given: National Law, s 159(3),
- For the following reasons, we have decided to allow the appeal, set aside the Decision and to place conditions on the appellant's registration as a pharmacist.
