REASONS FOR DECISION
- This is an application by Mr Adam Kanaan ("applicant") for review of a decision of the Commissioner for Fair Trading ("respondent") to refuse the grant of an "Individual contractor licence" in the category of "general building work" ("the licence") pursuant to s 33D(1)(b) of the Home Building Act 1989 (NSW) ("the Act") because the applicant did not demonstrate that he had met the experience requirement, that is "at least two years' relevant industry Experience" at 2-36 Church Street Lidcombe ("the Lidcombe project") which was "in a wide range of building construction work". The decision was made on 22 January 2024.
- The issue between the parties was whether Mr Kanaan had over two years of wide ranging building construction work experience. Based on material before the Tribunal, I am satisfied that Mr Kanaan has over two years but not in a wide range of building construction work as set out in the "Qualification requirements for an endorsed contractor licence or qualified supervisor certificate for building Work" ("the Instrument").
Name of the respondent
- The Tribunal raised with the parties whether the respondent's correct name is Building Commissioner NSW, Department of Customer Service. The respondent provided a written submission which stated that the respondent's correct name was "Commissioner for Fair Trading". The respondent also consented to this question being dealt with on the papers pursuant to s 50(2) of the Civil and Administrative Act 2013 (NSW) ("CAT Act"). No submissions were received from the applicant.
