Dwelling has its ordinary meaning and it means existing dwelling
The dwelling did not exist at the time notice was given of the Permit Application, or, of this proceeding
Where there is no dwelling as a structure or dwelling as a use, it is difficult to see how the limited exception to the notice and review exemption should apply. As set out above, the purpose of clause 52.19 generally is to facilitate the provision of telecommunications infrastructure and the exemption at clause 52.19-3 was recently expanded in order to assist in that purpose. A permit for a dwelling with no current associated use or development functioning to trigger notice and review rights to protect amenity, which is not yet enjoyed, would frustrate that purpose.
The Dwelling Permit had expired at the time notice was given of the Permit Application
Dwelling means either an existing dwelling or an approved dwelling under a planning permit that is not yet constructed
When the Dwelling Permit was extended this retrospectively enlivened it from date of expiry, meaning exception applied at that date
If the exemption does apply, the respondents should be removed as parties under section 60A of the VCAT Act
AME was entitled to notice and is a proper party to this proceeding
Alternatively, AME should be joined as a party under section 60 of the VCAT Act
AME should not be removed as a party under section 60A of the VCAT Act
Interpretation of exception: 'dwelling' in land use sense or ordinary meaning? Existing dwelling only or also a permitted dwelling?_

The exposure limits set out in the Standard provide protection against all known adverse health effects from RF EME exposure and are set well below the level at which harm may occur. The limits in RPS S-1 are aligned with guidelines published in 2020 by the International Commission on Non-Ionizing Radiation Protection (ICNIRP), which is the international body recognised as leaders in non-ionising radiation protection.
