(a) Serve a copy of the application for review on those persons who lodged an informal objection with the responsible authority. In the case of a petition, it is sufficient to serve only one person in accordance with section 57(4) of the Planning and Environment Act 1987.

1. The above notices must be accompanied by a prominent written statement advising that the application for review is listed for hearing at the Victorian Civil and Administrative Tribunal 55 King Street, Melbourne for 2 days commencing 4 June 2009 at 10.00am.
2. This matter is listed for hearing for 2 days commencing 4 June 2009.

1. At the time when the planning permit application in this matter was lodged with council, the land was in a Development Plan Overlay (DPO1). As such, it was exempt from third party notice and review rights.[1] Notwithstanding this, the council gave informal notice of the permit application. A number of objections were received.
2. Subsequent to this application for review being lodged with the Tribunal, Amendment C99 to the Casey Planning Scheme has removed the Development Plan Overlay from the subject land. This means that the permit application is no longer exempt from third party notice and review rights.
3. An application must be determined in accordance with the planning controls as they exist at the time a decision is made. Accordingly, I consider it is appropriate that notice of this application for review be given pursuant to section 83B of the Planning and Environment Act 1987 to those persons who lodged an objection with the council pursuant to the informal advertising process undertaken by the council.
