CITATION: Hunt v Radio 2SM Pty Ltd (No. 4) [2010] NSWDC 67
(1) Jury discharged. (2) Exhibits remain with the file until further order. (3) Leave to the plaintiff to uplift Exhibit K. DECISION: (4) Parties are to attend mediation and while the matter remains in the District Court, no further steps may be taken in this litigation until the parties can satisfy the court that they have each taken such reasonable steps to have this matter mediated as may be considered appropriate by the proper officer of the ADR Centre 233 Macquarie Street, Sydney. (5) As an exception to order 4 above, leave to the plaintiff to file an Amended Statement of Claim in 21 days and a defence 21 days thereafter. (6) The defendant pay the plaintiff's costs of the application to discharge and of the trial. (7) Note: The parties have indicated an agreement that the matter be transferred to the Supreme Court and will seek orders from the Supreme Court accordingly.
