The Applicant's pattern of filing multiple trade marks, including several that have lapsed or been opposed, suggests a deliberate strategy of misappropriating trade marks across different classes and industries rather than genuine commercial use. This repeated pattern of filings, failure to defend oppositions, and lapses suggests that the Applicant is not engaging in legitimate brand creation but is instead registering trade marks to obstruct competitors, gain unfair leverage over existing brands, or extract value from trade mark registrations without genuine commercial intent.
(1) Unless subsection (3) applies to the proceedings, the Registrar must, at the end, decide:
(b) to register the trade mark (with or without conditions or limitations) in respect of the goods and/or services then specified in the application;
having regard to the extent (if any) to which any ground on which the application was opposed has been established.
[1] Unless otherwise stated, each reference to a section is a reference to a section of the Trade Marks Act 1995 (Cth) ('Act') and each reference to a regulation is a reference to a regulation in the Trade Marks Regulations 1995 (Cth) ('Regulations').
