REASONS FOR DECISION
- This is an appeal from a decision to summarily dismiss an administrative review application for want of prosecution.
- For the reasons set out below, we have decided that the appeal should be allowed and the administrative review application redetermined on the papers. There will also be a direction that the appellant is to provide to the Tribunal and the respondent any submissions and evidence he seeks to rely upon in the application within 6 weeks of the date when these reasons are published.
- At the end of these reasons we also set out our reasons for refusing the appellant's application to adjourn the hearing of the appeal.
