Introduction
- The Commissioner of the Australian Federal Police ("the plaintiff") applies pursuant to s 116 of the Proceeds of Crime Act 2002 (Cth) ("the Act") for a Pecuniary Penalty Order ("PPO"). The application follows the convictions of Robert Francis Agius ("the defendant") in relation to an ongoing conspiracy to defraud the Commonwealth.
- The defendant concedes that it is appropriate for a PPO to be made but disputes the quantum sought by the plaintiff.
