The Proceedings
- By an Amended Notice of Motion filed 30 June 2016, Butlers Business Lawyers Pty Ltd (Butlers) seeks declaratory relief in respect of a proposed transfer of a registered mortgage concerning a property located on Kent Street, Sydney (the Property) in circumstances in which this Court made a restraining order under the Proceeds of Crime Act 2002 (Cth) (the Act). The application is to be considered in the context of relevant factual matters and having regard to the terms of orders that have previously been made pursuant to the Act.
- In this judgment, I will refer to the parties as follows: 1. The Commissioner for the Australian Federal Police: "the Commissioner"; 2. Robert Francis Agius: "the defendant"; 3. Butlers Business Lawyers Pty Ltd: "Butlers" or, alternatively, "the applicant"; and 4. Zenith National Pty Ltd: "Zenith" or, alternatively, "the respondent".
