Nature of proceedings
- On 1 February 2023, the Defendant, Grant Wesley Turnbull (the Defendant) pleaded guilty to an offence that from about 1 January 2014 to 20 August 2014, he committed an offence against s 12(2) of the now repealed Native Vegetation Act 2003 (NSW) (the NV Act) by clearing native vegetation otherwise than in accordance with a development consent granted in accordance with the NV Act or a property vegetation plan (PVP).
- By Amended Summons filed 8 February 2023, the Prosecutor, the Chief Executive of the Office of Environment and Heritage (OEH or the Prosecutor) seeks the following orders: 1. That the Defendant be dealt with according to law for the commission of the offence; 2. An order that the Defendant pay the Prosecutor's costs; and 3. Such other orders as the Court in its discretion sees fit to make.
