Introduction
- The essential questions for us are whether the Tribunal below: 1. erred in law in considering the Appellant's costs application under s 60 of Civil and Administrative Tribunal Act 2013 (NSW) (the Act), rather than under s 88 of the Administrative Decisions Tribunal Act 1997 (the former Act); and if not, did it err 2. in deciding not to make any order for costs.
- For the reasons which follow, we answer each question 'no', and dismiss the appeal.
