JURISDICTION IN RESPECT OF REVIEW OF MATTERS UNDER S 100 OF THE ART ACT
a decision on review of a decision, irrespective of whether the decision on review is taken under this Act.. or under another Act.
CONSIDERATION OF THE EXTENSION OF TIME APPLICATION
s 477 Time limits on applications to the Federal Circuit and Family Court of Australia (Division 2)
(1) An application to the Federal Circuit and Family Court of Australia (Division 2) for a remedy to be granted in exercise of the court's original jurisdiction under section 476 in relation to a migration decision must be made to the court within 35 days of the date of the migration decision.
(2) The Federal Circuit and Family Court of Australia (Division 2) may, by order, extend that 35 day period as the Federal Circuit Court considers appropriate if:
(a) an application for that order has been made in writing to the Federal Circuit and Family Court of Australia (Division 2) specifying why the applicant considers that it is necessary in the interests of the administration of justice to make the order; and
(b) the Federal Circuit and Family Court of Australia (Division 2) is satisfied that it is necessary in the interests of the administration of justice to make the order.
(a) the focus in considering whether to grant the extension of time is not on the interests of the applicant, but on the broader interests of the administration of justice; and
(b) the Court must be satisfied not just that an extension of time is desirable, but that it is needed in the interests of the administration of justice.
Lodgement of application for judicial review of the Dismissal Decision
1. I came to know about the decision of ART on 8 May 2025. This was the date on which ART informed me via an email to my representative.
2. 35 days after 8 May 2025 will end on 12 June 2025.
3. I made initial application to the court on 02 June 2025.
4. I realised only after the court rejected my application and commented about considering the "out of time application option" that the actual date of decision is 17 March 2025. This is very unfortunate that I was informed by ART 52 days after 17 March 2025.
5. I believe that I was at disadvantage because I was informed 52 days after the decision was by ART.
6. I request the Honourable Court to accept my application and proceed my case according to the court's procedures.
Necessary in the interests of the administration of justice
The extent of the delay and explanation for it
Any prejudice to the respondent if an extension were granted
1. The Tribunal did not communicate the matter to me.
4. The Tribunal failed to conduct a hearing despite of the fact that I asked the tribunal to do not give any decision without conducting a hearing.
5. The Tribunal Failed to truly recognise the merits of the application.
6. I request the honourable Court to set aside the decision and instruct the Tribunal to deal the matter according to the applicable law..
You may apply to us, in writing, for reinstatement of the application by 14 April 2025.
(1) The Tribunal may, by order, give directions in relation to the procedure to be followed for a proceeding in the Tribunal.
(a) require a party to the proceeding to give information or documents to the Tribunal or another party to the proceeding for the purposes of the proceeding;
By order under section 79 of the Administrative Review Tribunal Act 2024...
The Tribunal has, by order, given a direction about the procedure to be followed in your review. The Tribunal's direction is enclosed...
Did the Tribunal correctly notify the applicant of the Direction?
(a) the direction must be given to the applicant in writing; and
(b) the ART must give the direction to the applicant:
(i) except where subparagraph (ii) applies - by one of the methods specified in section 379A; or
(ii) if the applicant is in immigration detention - by a method prescribed for the purposes of giving documents to such a person
Did the Tribunal comply with s 100(b) of the ART Act and was the decision to dismiss was reasonable?
The Tribunal may dismiss an application made to the Tribunal if the applicant fails to do either of the following within a reasonable time:
(b) comply with this Act or an order of the Tribunal in relation to the proceeding in relation to the application.
Parliament is taken to intend that a statutory power will be exercised reasonably by a decision-maker.
... the applicant will need to provide sufficient information to satisfy us that they meet both of these visa requirements and they are now invited to give, in writing, all relevant information about the course(s) of study they are undertaking and their entry and stay in Australia as a student. Specific details about the information requested is set out in the Request for Student Visa Information Form which the applicant can print by clicking this link: Request for Student Visa Information. The information requested may be given by printing, completing and returning the form to us.
If the applicant is unable to access the Request for Student Visa Information form by clicking on the link above, please contact us as soon as possible.
If an applicant for a review of a decision fails within a reasonable time:
(b) to comply with a direction by the Tribunal in relation to the application;
the Tribunal may dismiss the application without proceeding to review the decision.
The discretionary power in s 42A(5)(b) of the AAT Act is only enlivened if the applicant fails "within a reasonable time" to comply with the direction. Thus, before the Tribunal exercises the discretion, it must consider and determine not only whether there has been a failure to comply with the direction; it must also consider and determine whether a reasonable time has elapsed since the relevant failure. An omission to do so would constitute a misapplication of s 42A(5).
It is important you comply with the Tribunal's direction by the date specified. If you don't, the Tribunal may:
a. dismiss your application for review without further consideration of the application or the information before us [with a reference to s 100], or
b. make a decision on the review without holding a hearing [with a reference to s 106].
If you are unable to comply a due date or any other aspect of the tribunal's direction, you may ask the tribunal for an extension of time to comply or for a variation of the direction.
The Tribunal failed to conduct a hearing despite of the fact that I asked the tribunal to do not give any decision without conducting a hearing.
The Tribunal Failed to truly recognise the merits of the application.
I request the honourable Court to set aside the decision and instruct the Tribunal to deal the matter according to the applicable law
Is an extension of time needed in the administration of justice?
Was there jurisdictional error in the Confirmation Decision?
