- These proceedings arise from two separate applications to the Victorian Civil and Administrative Tribunal (the Tribunal).
- One proceeding (B155/2010) is an application for a review of the decision of the then Director of Public Transport (now the Taxi Services Commission (the Commission)), to refuse to issue driver accreditation under the Transport Act 1983[2] (the Transport Act).
- The other proceeding (B306/2009) is an application for a review of the decision of the Secretary to the Department of Justice (the Secretary), to refuse the Applicant's application for an assessment notice under the Working with Children Act 2005 (the WWC Act) and to issue a Negative Notice.
- The proceedings remained as separate proceedings, but they were heard and determined together with evidence in one proceeding being evidence in the other.[3]
