- The Applicant submitted that on the scale of offences set out in schedule 1 of the Sentencing Act 1991, indecent assault is at the lower end of the range. It was submitted that this particular instance of indecent assault was furthermore at the lower end of examples of indecent assault
- Great emphasis was placed by the Respondent on the fact that SVP pleaded not guilty to the offence, which I was told showed a lack of compassion for the victim and a failure to accept responsibility. I was told that this fact distinguished the case from other cases previously determined by VCAT.
