What it does
This instrument prescribes the minimum workplace gender equality standards that count, for the purposes of subsection 19(1) of the Workplace Gender Equality Act 2012, as the baseline policies or strategies an Employer must have in place. It is the Workplace Gender Equality (Minimum Standards) Instrument 2014 (s 1) and comes into force on the day after registration (s 2). The instrument is made under subsection 19(1) of the Act (s 3), and its operative provisions are contained in section 5.
Mechanically, section 5 performs three functions. First, it fixes the temporal application: the standards apply to an Employer for the reporting period commencing 1 April 2015 and each subsequent reporting period (s 5(1)). Second, it back-fills the immediately prior reporting cycle so that, in relation to the reporting period that commenced on 1 April 2014, the minimum standards in s 5(3) apply to the discrete period 1 October 2014 to 31 March 2015 (s 5(2)). Third, it specifies the substance of the minimum standards that Employers must have in place for the reporting periods identified (s 5(3)). Those standards require that Employers have policies or strategies to support one or more specified gender equality indicators, and that the policies or strategies must aim to achieve the corresponding objectives set out in the table in s 5(3)(a)-(b).
The instrument does not itself create a new statutory penalty regime, nor does it set out a required form, content checklist, or minimum level of implementation for the stated policies or strategies. It expressly ties definitions to the Act, including the defined term Employer, which in this instrument means a relevant employer that is the employer of 500 or more employees in Australia (s 4). The instrument therefore functions as a delegated-standard instrument that defines what "minimum standards" means for reporting and compliance purposes under the Act, leaving operational detail such as enforcement and reporting mechanism to the Act and related administrative processes.
