What it does
Mechanically, the Act does two things. First, it gives statutory authority and a statutory obligation for immediate payment of the monies forming The William E. Dorling Scholarship Fund from the Council of the Prahran College of Advanced Education and “all persons holding moneys forming part of The William E. Dorling Scholarship Fund under the direction of the said Council” to the Council of the Prahran Technical School in Hornby‑street, Windsor (s 2). Second, it re‑writes the operative references in William E. Dorling’s 1945 will so that every reference to “the Council or other governing body of the Prahran Technical School High‑street Prahran” and to “the Prahran Technical School” operates as a reference to “the Council or other governing body of the Prahran Technical School in Hornby‑street, Windsor” (s 3). The short title is supplied at s 1; the Act was assented to and came into operation on 22 April 1975 (Endnotes 1).
The preamble states the factual and purposive bases for these mechanical changes. It records that Dorling’s will created a scholarship fund to be administered by the council or governing body of the Prahran Technical School, sets the substantive conditions for the scholarships (tenure not longer than three years; value and award by examination; candidates must be Sunday school scholars or receiving religious instruction at a State school and must know the Ten Commandments in the Bible), and records that the original receipt by the President and Principal of the then‑Prahran Technical School would be a full and complete discharge to the Trustees. The preamble then chronicles institutional changes: the Prahran Technical School’s name changes and the existence of a Prahran College of Advanced Education holding the moneys, and the establishment of a Prahran Technical School in Hornby‑street Windsor. It records agreement between the two councils for the Windsor school to administer the Fund and records that the moneys were held by or under the direction of the Prahran College of Advanced Education; the Act declares it is “expedient” to make provision for transfer (preamble).
