Western Australian Photo Card Regulations 2014

The Regulations hinge on a small set of recurring legal and administrative concepts that determine entitlement, duration, fees, information flow and enforcement. Those concepts appear repeatedly in the text and organise how the scheme operates.

1. CEO discretion and satisfaction. The CEO is repeatedly the decision-maker whose "satisfaction" authorises issuance and exemptions. Examples: the CEO may issue a replacement card if "satisfied" as to theft, loss, destruction or other good reason (reg 4(2)); may issue an additional card to enable holding one with an address and one without (reg 5(2)); and "the CEO may reduce, waive or refund" replacement fees (reg 7D(1)). Those are exercise points for administrative decision-making and likely trigger administrative law standards where judicial review is sought.

2. Linked card expiry logic. Duration is not always a simple five-year term. A new card issued before expiry preserves the original expiry timeline in a particular manner (reg 6(3)). Replacement cards cease the replaced card on issue and adopt the same expiry that the replaced card would have had (reg 6(4)). Additional cards issued after another card adopt the expiry day of the other card (reg 6(5)). These linkages control synchronisation and avoid multiple staggered expiry dates for a single holder.

3. Fee structure and concessions. The Regulations set specific dollar fees (reg 7 Table) and create categorical exemptions and reductions based on Commonwealth concession cards, WA Seniors Card holdings and the Veterans’ Entitlements Act definitions (regs 7A-7B). They also provide for emergency waivers (reg 7C) and CEO discretionary waiver/reduction/refund (reg 7D), including publication/notification requirements (reg 7D(2)-(3)).

4. Reporting obligations with time limits. Cardholders must notify the CEO in writing or by a CEO-approved manner within 21 days of becoming aware a card is stolen, lost or destroyed (reg 8(2)), and must notify any change of residential address within 21 days (reg 9(2)). The Regulations attach a fixed monetary penalty for non-compliance (each $250).

5. Information management and prescribed recipients. Part 3 prescribes a long list of recipients to whom identifying information or photo card information can be disclosed under the Act (reg 10(2)), and specifies the authorised purposes for certain disclosures including automated identity verification (reg 10A). It also prescribes who counts as a "law enforcement official" for photograph disclosure (reg 11), narrowing that class to certain commissioners and to the Public Sector Commissioner when acting under a particular Act (reg 11).

6. Technical and administrative definitions. The Regulations define "current photo card", "Department’s website" and other terms (reg 3). They also regulate nominations and revocations for prescribed persons (reg 10(3)-(4)), creating a written-nomination channel for agencies to gain prescribed status.

These concepts structure the trade-offs the Regulations implement: they make card issue and replacement relatively routine but subject to CEO discretion; enable privacy-preserving additional cards without addresses; link expiries to reduce administrative churn; create targeted concessions and emergency relief to reduce fees in certain classes; and enable broad official access to cardholder data through a specified list of agencies and through digital verification systems, subject to nomination procedures and prescribed authorised purposes.

The Regulations affect five distinct groups of stakeholders by name or function: cardholders, applicants for replacement or additional cards, the CEO and Department administering the scheme, prescribed recipients of identifying information (including law enforcement and agencies), and the public/organisations relying on verification services.

1. Cardholders and applicants. The primary affected individuals are citizens or residents who hold or seek a Western Australian Photo Card. They are subject to:

   • Duration and expiry rules (reg 6), including synchronisation rules where replacement or additional cards are issued (regs 6(3)-(5)).
   • Reporting obligations with fixed penalties if they do not notify the CEO within 21 days after loss/theft/destruction (reg 8) or a change in residential address (reg 9).
   • Fee liabilities on application, unless they qualify for concession or exemption under regs 7A-7C, or receive relief under reg 7D.

2. The CEO and Department. The CEO plays multiple decision roles: deciding satisfaction for issuance of replacement and additional cards (regs 4(2), 5(2)); approving methods of notice under regs 8(2) and 9(2) (“in writing or in any other manner approved in writing by the CEO”); exercising discretion to reduce/waive/refund fees (reg 7D); and administering the publication requirement for fee waivers (reg 7D(3)). The Department also maintains the Department’s website, used to publish notices (reg 3 and reg 7D(3)).

3. Prescribed persons and agencies. A very broad set of officials and agencies is prescribed to receive identifying information or photo card information: principal State and Commonwealth law enforcement heads (Commissioner of Police, AFP Commissioner, ABF Commissioner, interstate police commissioners), heads or nominated officers of public sector agencies (Public Sector Management Act agencies, LG CEOs), Commonwealth agencies (Comptroller‑General of Customs, Centrelink), specialist regulators (ASIC Chairperson), insolvency offices (registered liquidators and trustees) and a set of named university vice-chancellors and port authority CEOs (reg 10(2)(a)-(z)). These recipients can receive information under the Act where the Act allows disclosure to a "prescribed person". The Regulations create a nomination route (reg 10(4)) and permit revocation of nominations (reg 10(3)).

4. Entities using identity verification. The Regulations enable automated identity verification through a "digital identity exchange" and specify authorised purposes for such verification in reg 10A. This directly affects both relying agencies (relying chief executive officers per reg 10A(1)) and the Department/CEO who verifies and discloses "relevant information" through the exchange.

5. The broader public and businesses that rely on ID. Entities that accept the Photo Card as proof of identity will face the practical effects of expiry synchronisation, replacement/duplicate card rules, and the availability of an addressless card (reg 5(2)). They may also be affected by how verification services are used (reg 10A) and by what information is disclosed to prescribed persons for official purposes.

Geographic and legal scope. The Regulations apply within Western Australia and frequently cross-reference Commonwealth and interstate statutes (e.g. Emergency Management Act 2005; Public Service Act 1999 (Cth); Australian Border Force Act 2015; Corporations Act 2001) when prescribing recipients or defining approved emergencies (reg 7C(2)). Those references expand who is affected beyond purely State agencies.

Who decides. The CEO makes eligibility and process decisions; specified agency heads decide nominations for their staff to be prescribed persons (reg 10(2) and (4)); and the CEO publishes fee-relief decisions on the Department’s website (reg 7D(3)). Cardholders must act (notify, apply, supply concession evidence) to secure fee reductions or to comply with reporting obligations.

Who pays. Cardholders pay the prescribed fees in reg 7 Table unless they meet exemptions or reductions in regs 7A-7B or obtain relief under regs 7C-7D. Failure to notify loss or address change attracts a $250 fine (regs 8 and 9).

This section focuses on concrete obligations placed on cardholders and powers granted to the administering authority, with precise references to the Regulations.

Cardholder duties (express and primary)

• Report stolen, lost or destroyed photo card. A cardholder of a current photo card must inform the CEO in writing or in a manner approved in writing by the CEO within 21 days of becoming aware the card has been stolen, lost or destroyed (reg 8(1)-(2)). Failure carries a specified penalty: a fine of $250 (reg 8(1) penalty).
• Notify change of residential address. If the residential address most recently given to the CEO ceases to be current, the cardholder must give notice in writing or by a CEO-approved written manner within 21 days and include the current residential address (reg 9(1)-(2)). Penalty: fine of $250 (reg 9(1) penalty).
• Apply for replacement or additional cards. The Act provides the statutory application pathway; the Regulations specify the circumstances in which the CEO may issue replacement or additional cards: replacement if the CEO is satisfied as to theft, loss, destruction or any other good reason (reg 4(2)); additional cards to hold one with the residential address and one without (reg 5(2)).

Administrative powers and duties of the CEO

• Issue replacement/additional cards. The CEO may issue replacement photo cards under reg 4 and additional photo cards under reg 5, conditioned on the CEO’s satisfaction as to the stated criteria (regs 4(2), 5(2)).
• Approve methods of notice. Notices for loss/theft or address changes must be in writing or "in any other manner approved in writing by the CEO" (regs 8(2)(a), 9(2)(a)), giving the CEO control over the permitted communication channels.
• Fee management. The CEO must accept fees prescribed by the Table in reg 7 but also has statutory discretion to reduce, waive or refund replacement-card fees (reg 7D(1)). The CEO must give written notice to individuals affected by a fee reduction/waiver/refund (reg 7D(2)) and publish class-wide decisions on the Department’s website (reg 7D(3)). The CEO also determines satisfaction for concessions under regs 7A-7B (those regs require the CEO to be "satisfied that the person making an application" holds the specified concession card).
• Emergency exemptions. Under reg 7C the fee in item 2 of the Table (replacement photo card fee) is not payable where the replacement card replaces one lost/damaged/destroyed as a direct result of an "approved emergency" (reg 7C(1)). The Regulation lists approved emergencies by reference to the Emergency Management Act 2005 sections and allows CEO approval for hazards (reg 7C(2)).

Rights and entitlements available

• Right to an addressless additional card. The CEO may issue an additional card that does not contain the applicant’s residential address so the applicant can hold both an addressed and an addressless card (reg 5(2)). That is a substantive entitlement enabling privacy choices.
• Fee relief and exemptions. Cardholders who hold specified Commonwealth or WA concession cards or certain veterans’ cards are exempted from fees (reg 7A) or eligible for 50% fee reduction (reg 7B). Cardholders affected by approved emergencies are exempted from replacement-card fees (reg 7C). The CEO may also exercise discretion under reg 7D to reduce or refund fees.
• Data access and verification rights. Prescribed persons and nominated officers of prescribed agencies are authorised to receive cardholder information under the Act through the prescription mechanism in reg 10(2) and the authorised-purpose rules in reg 10A. The Regulations therefore confer rights on nominated officials to obtain information for particular verification and official purposes.

Procedural requirements

• Nominations must be in writing and signed by the nominator to become effective for the CEO as a "prescribed person" under reg 10(4). Revocation of a nomination removes prescribed status when it takes effect (reg 10(3)).
• Where fee relief is granted or varied for an individual, the CEO must notify that individual in writing (reg 7D(2)); where it applies to a class, the CEO must publish the decision on the Department’s website (reg 7D(3)).

Limitations and linkages

• Duration linkages between original, replacement and additional cards limit how long a new card will be current (reg 6(3)-(5)). A replacement card does not necessarily reset the five-year clock; it may inherit the original expiry date (reg 6(4)). An additional card issued after another card is current until the expiry of the other card (reg 6(5)).

These duties and rights create a discrete administrative architecture: cardholders have timely notification duties and access to concession relief but must meet CEO satisfaction tests for discretionary entitlements; the CEO controls key procedural modalities and must publish or notify certain fee decisions.

The Regulations set a narrow, specific enforcement framework that primarily relies on fixed monetary penalties and administrative controls rather than criminal sanctioning or broad regulatory offences. Enforcement mechanisms include monetary penalties for specified contraventions, CEO administrative powers, and information disclosure controls.

Specified offences and penalties

• Failure to notify loss/theft/destruction. Reg 8 creates a specific obligation: a cardholder must give the CEO notice in writing or in another CEO-approved manner within 21 days of becoming aware that a current photo card has been stolen, lost or destroyed. The Regulation prescribes a penalty of a fine of $250 for breach (reg 8(1)).
• Failure to notify change of residential address. Reg 9 requires a cardholder to inform the CEO of a changed residential address within 21 days, in writing or by a CEO-approved method, and prescribes a fine of $250 for non-compliance (reg 9(1)).

Administrative enforcement levers

• CEO discretion to approve notice methods (regs 8(2)(a), 9(2)(a)) channels enforcement through the manner of communication; the CEO can make particular channels mandatory (for example by approving an online form in writing) and thereby control compliance pathways.
• CEO power to decide whether to issue replacement or additional cards (regs 4(2), 5(2)) gives the CEO an operational control point for enforcing card integrity: issuance is conditioned on the CEO’s "satisfaction" as to stated criteria, allowing vetting of claims.
• Fee waivers, reductions and refunds (reg 7D) are subject to CEO administrative action and must be notified or published, giving the CEO discretion to provide administrative relief or to deny it.

Information disclosure controls and oversight avenues

• The Regulations prescribe which persons can receive identifying information or photographs (regs 10 and 11). That prescription channels lawful disclosure and provides legal cover for transfers to named agencies; improper disclosure outside those pathways could engage other statutory prohibitions (for example privacy or secrecy laws), but the Regulations themselves limit authorised recipients.
• The nomination and revocation process for prescribed persons (reg 10(3)-(4)) creates an auditable paper trail: nominations must be in writing and signed, and revocations act to remove prescribed status when effective. That written-nomination requirement supports administrative oversight of who is authorised to receive information.

Limits to enforcement contained in the Regulations

• The Regulations do not prescribe criminal offences beyond the specified fines for failure to notify loss or address change. They do not create separate criminal penalties for misuse of disclosed information; such matters would fall outside these Regulations and be subject to other statutory regimes.
• The Regulations vest substantial administrative discretion in the CEO,satisfaction tests, approval of notification methods, fee waivers, without prescribing detailed procedural safeguards or internal review mechanisms in the Regulations themselves. Judicial review or statutory review rights under the Act or general administrative law would be the likely remedies for adverse administrative decisions, but those remedies are not detailed in the Regulations.

Practical enforcement note

• The fixed monetary penalties are relatively modest ($250), and their effect as enforcement levers will be shaped by detection and enforcement resourcing which the Regulations do not address. The CEO’s control over notification methods may make compliance easier to monitor if the Department requires electronic reporting channels and retains logs.

In short, enforcement under the Regulations is a hybrid of specified monetary penalties for narrow conduct (non-reporting) and administrative controls exercised by the CEO to ensure integrity and manage access to information, with disclosure pathways limited to a prescribed list of public authorities and nominated officers.

The Regulations expressly cross-reference a large number of Commonwealth and State statutes and administrative instruments, using those laws to define prescribed recipients, emergency situations, and the classes of officials who may receive information. The interactions are operational and definitional rather than substantive changes to those other statutes.

Key interlinked statutes and interactions found in the text

• Emergency Management Act 2005. Reg 7C(2) designates as "approved emergencies" an emergency declared under section 50 and a state of emergency declared under section 56 of that Act, and allows the CEO to treat a hazard (as defined in s 3 of that Act) approved by the CEO as an approved emergency. This creates an operational crosswalk: emergency declarations under the State’s emergency management statute trigger fee waivers for replacement photo cards (reg 7C(1)).
• Public Service Act 1999 (Cth). The Regulations use definitions from the Public Service Act to define "APS employee" (reg 10(1)) and "Agency Head" nominations (reg 10(2)(i) and 10A). That ties Commonwealth public service personnel to the list of prescribed persons eligible to receive photo card information.
• Australian Border Force Act 2015, Australian Federal Police Act 1979, Defence Act 1903, Corporations Act 2001, Bankruptcy Act 1966, Australian Securities and Investments Commission Act 2001, Child Support (Registration and Collection) Act 1988, Commonwealth Electoral Act 1918, Fire and Emergency Services Act 1998, Human Services (Centrelink) Act 1997, Port Authorities Act 1999, Taxation Administration Act 1953, University Acts (Curtin, Edith Cowan, Murdoch, University of WA). The Regulations directly prescribe heads or nominated staff from each of these statutes’ agencies as recipients of cardholder identifying information (reg 10(2)(a)-(z)). This provides a mechanism for cross-agency data sharing within the scope authorised by the Act.

Technical interoperability and identity services

• Digital identity exchange. Reg 10A(1) defines "digital identity exchange" and reg 10A(2)(a) authorises the Department of the Premier and Cabinet, or a nominated employee prescribed under reg 10(2)(h), to verify and disclose a cardholder’s "relevant information" to relying chief executive officers through a digital identity exchange. That expressly permits automated, system-to-system verification of cardholder data for authorised purposes.
• National Document Verification Service (DVS). Reg 10A(2)(b) authorises, in relation to the Secretary of the Attorney‑General’s Department of the Commonwealth prescribed under reg 10(2)(i), the verification of the authenticity of a photo card using the national DVS. The Regulations thus provide a specific channel for Commonwealth-level document authentication to interact with the State photo card data.

Nomination and revocation linked to statutory office-holders

• Reg 10(2) permits a wide range of statutory office-holders to nominate officers to the CEO; nominations must be in writing (reg 10(4)) and revocations remove prescribed status (reg 10(3)). The mechanism links statutory accountability (agency head signatures) with delegation of data-reading powers to particular officers under the Act and Regulations.

Administrative law and other legal frameworks

• The Regulations embed administrative decision points,CEO satisfaction tests, fee waivers, approval of notification methods, that will operate against general administrative law standards (procedural fairness, reasonableness), though these standards are not restated in the Regulations. External privacy regimes, secrecy provisions in other statutes, and the Commonwealth’s privacy framework may interact where information is disclosed to Commonwealth agencies. The Regulations do not displace or summarise those other statutory obligations.

Labelling and definitions imported from other laws

• Several defined terms are imported from other statutes to identify who can receive data: "Comptroller‑General of Customs" (Australian Border Force Act 2015), "Chief of Defence" (Defence Act 1903), "LG CEO" (Local Government Act 1995) and so on (reg 10(2) and Defined terms list). This makes the Regulations dependent on the definitions and role structures in the referenced statutes.

Net effect of interactions

• The Regulations function as a node connecting the State photo card scheme to a web of State and Commonwealth officials and services for verification and official use. Operationally, this creates interoperability with Commonwealth verification services (DVS), enables automated identity exchange for State agencies, and allows a wide range of law enforcement, regulatory, insolvency, electoral and university officials access to cardholder data where the Act permits disclosure to a "prescribed person" (reg 10). The Regulations also tie emergency fee-relief to declarations under the State emergency management statute (reg 7C).

The Regulations include a compilation table that traces amendments from the original 2014 Regulations through to 2025. The main amendment milestones in the text are as follows, each grounded in the compilation table and amendment notes within the Regulations.

Initial commencement

• The Regulations were originally published on 18 June 2014 and commenced 1 July 2014 (compilation table).

2015 amendments

• Multiple amendments in 2015 (Gazette entries dated 12 June 2015 and 26 June 2015) are recorded; reg 10 and reg 11 were amended in June 2015 (see notes to reg 10 and reg 11). These early amendments adjusted prescription lists and other operational details.

2016 amendments

• On 14 June 2016 the Regulations were amended to insert regs 7A and 7B (see reg 7A and reg 7B inserted: Gazette 14 Jun 2016). Those regulations created fee exemptions and reduced fees for specified seniors, pensioners and veterans, including criteria tied to Commonwealth concession cards and WA Seniors Card holdings.

2017-2019 amendments

• Fee adjustments continued through Transport Regulations Amendment (Fees and Charges) instruments in 2017 and 2018 (Gazette entries referenced in reg 7 amendments), and an amendment in March 2019 (Transport Regulations Amendment (Information) Regulations 2019) updated Part 3 information provisions (reg 10 amended Mar 2019).

2020 amendments

• Two 2020 instruments affected the Regulations. The Transport Regulations Amendment (Fees and Charges) Regulations (No. 2) 2020 updated fees (SL 2020/74), and Transport Regulations Amendment (Document Replacement) Regulations 2020 (SL 2020/123) inserted reg 7C concerning no fee payable for replacement photo cards in certain approved emergency situations (reg 7C inserted SL 2020/123).

2021 amendments

• The Transport Regulations Amendment (Fees and Charges) Regulations (No 2) 2021 adjusted fees (SL 2021/92). More substantively, the Transport Regulations Amendment (Digital Identity Exchange) Regulations 2021 (SL 2021/203) inserted reg 10A establishing authorised purposes for disclosure of photo card information to prescribed persons including digital identity exchanges (reg 10A inserted SL 2021/203).

2022 amendments

• The Transport Regulations Amendment (Fees and Charges) Regulations (No. 2) 2022 and Transport Regulations Amendment (Fee Waiver and Refund) Regulations 2022 (SL 2022/181) produced fee changes and inserted reg 7D, which authorised the CEO to reduce, waive or refund replacement-card fees and required written notification or publication of such decisions (reg 7D inserted SL 2022/181).

2023-2025 amendments

• Transport Regulations Amendment (Fees and Charges) Regulations 2023 and 2024 updated fees, and Transport Regulations Amendment (Identity Matching Services) Regulations 2023 (SL 2023/166) amended reg 10A (noted as amended: SL 2023/166 r. 8). The latest fee amendment recorded in the compilation table is the 2025 instrument (Transport Regulations Amendment (Fees and Charges) Regulations 2025), with commencement 1 July 2025 for fee changes (SL 2025/65).

Specific insertions and their dates (as stated in the Regulations)

• Reg 7A and 7B (no fee/reduced fees for seniors/pensioners/veterans): inserted 14 June 2016 (Gazette 14 Jun 2016).
• Reg 7C (no fee for replacement in approved emergencies): inserted 29 July 2020 (SL 2020/123).
• Reg 7D (CEO reduction, waiver, refund of replacement fee): inserted 4 Nov 2022 (SL 2022/181).
• Reg 10A (authorised purposes, digital identity exchange, DVS): inserted 3 Dec 2021 (SL 2021/203), amended 1 Nov 2023 (SL 2023/166).

Practical amendment consequences

• The amendment history shows a trajectory from establishing the basic scheme in 2014 toward greater administrative flexibility and digital interoperability: fee concessions (2016), emergency fee relief (2020), digital identity exchange and DVS links (2021-2023), and CEO fee-refund powers and publication duties (2022). Fee figures in the Table have been adjusted across years (reg 7 amended repeatedly; see compilation table).

Where to locate authoritative versions

• The Regulations include a reprint note (Reprint 1 as at 6 Jan 2017) and the compilation table cites all amending instruments through SL 2025/65. For compliance and current fee levels practitioners should consult the most recent consolidated text and the Department’s website as required by reg 7D(3).

The Regulations as provided contain no reported litigation history, judicial decisions, or citations to cases. The text of the Regulations and the compilation table do not list any cases. Where litigation might arise, parties and courts would rely on the text of the Act and these Regulations together; the Regulations themselves contain no judicial gloss or cited authorities.

Potential litigation risk areas indicated by the Regulations

• Administrative discretion. The CEO’s repeated use of subjective "satisfaction" and the power to reduce, waive or refund fees (regs 4(2), 5(2), 7D(1)) present likely grounds for judicial review challenges if a person can show maladministration, unreasonableness, procedural unfairness or failure to follow statutory requirements. The Regulations do not prescribe review procedures or internal merits review; regulation text indicates administrative discretion without internal constraints.
• Privacy and disclosure. Part 3 prescribes a wide list of persons who may receive identifying information and photographs (regs 10 and 11). Potential litigation could involve claims that disclosure exceeded authorised purposes under the Act, or that data handling violated statutory privacy provisions in other laws. The Regulations themselves authorise disclosures only to named or nominated persons for authorised purposes (reg 10A), so litigation would focus on whether disclosures conformed to those limits.
• Penalty enforcement. The fixed fines for failing to notify loss or address change (regs 8 and 9) could be the subject of dispute in enforcement proceedings, particularly regarding when a cardholder "becomes aware" or whether an alternative notice method was "approved in writing by the CEO". Challenges might examine procedural fairness and the evidentiary basis for imposing fines.
• Interoperability and system-based verification. Use of digital identity exchanges and the national Document Verification Service (reg 10A) raises questions about accuracy, reliance and statutory authority for particular verification methods. Litigation might arise from false negatives/positives in automated verification systems and from disputes about whether authorised purposes were correctly applied.

No cases named in the Regulations

• The Regulations do not name any cases nor do they reference decisions; any litigation history would need to be sought in court databases and is not supplied by the provided text.

Practical note for counsel

• Since the Regulations provide numerous administrable discretions and reference other statutes for definitions and approval mechanisms, litigants challenging agency decisions should be prepared to frame arguments in administrative law terms (reasonableness, legality, procedural fairness) and to trace statutory authority for information disclosure through both the Act and these Regulations. The Regulations’ written-nomination and publication requirements (reg 10(4), reg 7D(3)) create documentary hooks that litigants may use in judicial review or disclosure challenges.

The Regulations are compact, but several non-obvious operational consequences and traps for practitioners or administrators arise directly from the text. These "gotchas" are concrete, statutory features that can produce unintended outcomes if overlooked.

1. Expiry sync means replacement or additional cards may not reset the five-year clock. A replacement card issued under reg 4(2) ceases the replaced card on the day the replacement is issued, and the replacement is current only "until the day that would have been the expiry day of the replaced card" had it not ceased to be current (reg 6(4)). Similarly, an additional card issued after the other card is current takes the expiry day of the other card (reg 6(5)). Practitioners sometimes assume replacement restarts the five‑year term; the Regulations do not. Check expiry dates carefully when advising clients about validity and renewal timing.

2. CEO "satisfaction" is a subjective threshold. Multiple entitlements hinge on the CEO being "satisfied" (regs 4(2), 5(2), 7A, 7B). That is not circumscribed in the Regulations. There is a risk of inconsistency or administrative delay where evidence thresholds are unclear. Clients should be advised to present documentary proof at application to reduce discretionary refusals.

3. Notification methods must be approved "in writing" by the CEO. Regs 8(2)(a) and 9(2)(a) allow notice "in writing or in any other manner approved in writing by the CEO". Where the CEO has not published or otherwise formalised approved alternative channels, the default is writing only; an oral report to a counter staffer may not suffice. This can create surprises for cardholders who assume phone or in-person reports are acceptable.

4. Fee concessions depend on specific concession cards and combinations. Reg 7A requires combinations (e.g. WA Seniors Card and Commonwealth Seniors Health Card) or precise Commonwealth concession cards; reg 7B covers other pensioner concession cards. Advice or applications should verify the exact card type and currency, regulatory language requires the CEO to be "satisfied" the applicant holds the specified card(s).

5. The "approved emergency" waiver is limited and CEO‑defined. Reg 7C exempts the replacement fee when a replacement card is required due to loss/damage/destroyed as a direct result of an "approved emergency", cross-referring to specific Emergency Management Act declarations (reg 7C(2)(a)-(b)) or a hazard approved by the CEO (reg 7C(2)(c)). This is narrower than a general disaster relief rule: it depends on declared emergencies or CEO approval of a hazard. Lawyers advising clients post-disaster should confirm whether a particular event was declared and whether the CEO has approved a hazard.

6. Many official recipients can be nominated to receive data; nomination procedure is essential. Reg 10(2) lists a wide set of statutory office-holders who can nominate staff to be "prescribed persons". Those nominations must be in writing and signed (reg 10(4)). Organisations seeking access must not assume automatic access; they must follow formal nomination processes.

7. Disclosure authorisations are purpose-limited and tied to definitions in the Act. Reg 10A sets out authorised purposes for disclosure to prescribed persons including digital identity exchange verification and a narrow DVS usage by the Secretary of the Attorney-General's Department (reg 10A(2)). Recipients and relying agencies must ensure uses align with the authorised purposes; otherwise statutory authorisation may be absent.

8. Publication and notice obligations for fee waivers. Where the CEO reduces/waives/refunds in relation to a class of persons, the CEO must publish the decision on the Department’s website (reg 7D(3)). Organisation representatives should check the Department’s website for up-to-date waiver classes rather than relying on verbal statements or informal notice.

9. Photographs disclosure limited to narrow list of officials. Reg 11 prescribes specific persons treated as "law enforcement officials" for photograph disclosure. The list omits other potential law enforcement actors; reliance on broad "law enforcement" categories without checking reg 11 could lead to over-disclosure.

10. Fees table is periodically amended and must be checked. Reg 7 has been amended multiple times; the dollar amounts in the Table (e.g. $49.70; $33.30 as shown) reflect the latest consolidated text provided here but are subject to future amendment (see compilation table). Confirm current fee levels against the most recent consolidated instrument and the Department’s published fee schedule.

Awareness of these statutory mechanics prevents procedural errors, particularly in timing for notice, evidence for discretionary decisions, and in aligning information sharing with expressly authorised recipients and purposes.

Compliance under these Regulations requires attention to procedural timings, documentation, evidence of concession entitlements, nomination and publication processes, and the authorised-use boundaries for disclosures and verification. Below are concrete steps and checks grounded in the Regulations.

For cardholders and applicants

• Keep proof of identity and concession cards ready. If you seek fee exemption or reduction (regs 7A-7B), supply reliable documentary evidence proving the specified Commonwealth concession card, WA Seniors Card, Commonwealth Seniors Health Card, or relevant veterans' gold card, since the CEO must be "satisfied" of entitlements (regs 7A-7B).
• Report loss/theft/damage promptly. If a current photo card is stolen, lost or destroyed, give notice to the CEO in writing or in a CEO‑approved method within 21 days (reg 8(2)). Doing this also avoids the $250 penalty (reg 8(1)). Consider using registered post or the Department’s online channel if published as an approved method to create evidence of compliance.
• Notify address changes within 21 days. Where the residential address you most recently supplied ceases to be current, you must notify the CEO in writing or via an approved format within 21 days and include your new residential address (reg 9(1)-(2)). Keep receipts or confirmation of the filing.
• Understand expiry linkage before applying for replacement. When applying for a replacement or additional card, check the expiry rules (reg 6) to confirm whether issuance will inherit the replaced card’s expiry or align with another card’s expiry. If continuous validity is critical (for licences or contractual purposes), plan renewal timing accordingly.

For agencies and prescribed persons

• Use formal nomination procedures. Agencies that are listed in reg 10(2) must nominate specific officers in writing to the CEO to become "prescribed persons" (reg 10(4)). Ensure nominations are signed and recorded, and maintain revocation mechanisms if staff roles change (reg 10(3) deals with revocation).
• Limit use to authorised purposes. Where you receive "relevant information" via digital identity exchange or other channels, only use it for the authorised purposes in reg 10A(2). For example, verification via the national Document Verification Service is authorised specifically in relation to the Secretary of the Attorney‑General’s Department (reg 10A(2)(b)).
• Establish secure digital exchange practices. If your agency will rely on digital identity exchange (reg 10A(1)), ensure system-level agreements and technical safeguards are in place, and document reliance chief executive officers and data flows.

For the administering CEO/Department

• Publish fee waiver and reduction policies. If the CEO exercises reg 7D to reduce, waive or refund replacement-card fees in relation to a class, publish the decision on the Department’s website as required by reg 7D(3) and provide written notice to individuals as required by reg 7D(2).
• Maintain and publish approved notification channels. Given the requirement that notices be in writing or in another method "approved in writing by the CEO" (regs 8(2)(a), 9(2)(a)), publish the list of approved channels on the Department’s website and ensure they are reasonably accessible to cardholders.
• Create clear application checklists. To reduce the friction of CEO satisfaction tests for replacement and additional cards (regs 4(2), 5(2)), publish documentary requirements and evidence examples (e.g. police reports for theft, statutory declarations for loss, proof of entitlement for concession reductions).
• Log nominations and revocations. Keep an auditable record of nominations made under reg 10(4) and any revocations under reg 10(3), and confirm nominated officers’ access privileges in the Department’s systems.
• Track and align expiry timings. Ensure internal systems apply the expiry synchronisation rules in reg 6 so that issuance and cancellation logic correctly sets current-card status and expiry days, avoiding mistaken validity periods for cardholders.

Record-keeping and audit trails

• Retain copies of notices and written approvals. Under the Regulations, many rights and obligations turn on the existence of written notices and approvals (reg 10(4) nominations, reg 7D(2) written notice to individuals). Securely store these records for audit and legal compliance.
• Maintain logs of digital identity exchanges and DVS lookups. Reg 10A contemplates automated verification; maintain logs indicating the relying chief executive officer, the time/date of verification, and what "relevant information" was exchanged, to support accountability and to demonstrate compliance with authorised purposes.

Risk management and dispute handling

• Prepare a procedural channel for disputes about CEO satisfaction and fee waivers. Given the discretionary wording, set out internal review or merits review mechanisms and communicate them to applicants so they know how to raise disputes.
• When in doubt, require written confirmation. Because many obligations and rights require writing or CEO-approved written methods, favour written processes for applications, notifications and nominations.

Checking updates

• Verify current fees and published waivers on the Department’s website. Fees in reg 7 have been amended periodically; the Department’s website and the consolidated Regulations should be checked for the current fee schedule and any published class-wide fee waivers per reg 7D(3).

In practice, compliance is procedural: ensure timely written notifications, collect and present documentary evidence for CEO satisfaction and concession entitlements, secure formal nominations if seeking prescribed person status, and ensure digital verification uses are strictly purpose-limited and logged.
