West Beach Recreation Reserve Regulations 2018

The Regulations directly affect all persons who enter, use, or wish to use the West Beach Recreation Reserve. That includes casual visitors, picnickers, swimmers, walkers, and cyclists; campers (including those sleeping in vehicles); dog owners; drivers and riders of motor vehicles; persons wishing to make commercial sales, distribute printed matter, erect structures for events, or collect donations; and persons wishing to use sound amplification equipment or light fires. The Regulations also bind businesses, clubs, charities, and political or religious groups that might wish to hold events, sell goods, fundraise, or display signs on the Reserve. The Trust itself is affected as the entity responsible for granting permissions, issuing exemptions, appointing authorised persons, and managing confiscated and impounded property. Employees and officers of the Trust are affected as they may be appointed as authorised persons and must comply with identity card requirements and return of identity cards upon cessation of appointment. Police officers may become involved when an authorised person detains a person and hands them over to police custody (r 5(1)(e)). The Regulations do not explicitly address the position of contractors, volunteers, or agents of the Trust; presumably they are not covered by the exemption in r 15 unless they are “in the course of employment by the Trust”. Third parties such as vendors, ticket sellers, and charity collectors are particularly affected because the prohibition on selling or offering anything, conducting a business, providing a service, selling raffle or lottery tickets, or taking up a collection (r 11(k)-(l)) applies broadly and requires prior Trust permission. This has the effect of channelling all commercial and fundraising activity through a Trust-controlled permission regime, imposing transaction costs and potential fees on market participants.

Duties on users. A person must enter the Reserve only by an authorised entrance (r 9). While on the Reserve, a person must not behave in a disorderly or offensive manner, use threatening or indecent language, create a disturbance, or wilfully obstruct others (r 10). A person must not engage in any of the restricted activities listed in r 11 without the Trust’s permission: carrying or using weapons; depositing litter except in provided receptacles; camping outside designated areas; lighting fires except in designated fireplaces; leaving a fire unextinguished; leaving property unattended for over 24 hours; erecting marquees, booths, gazebos, or similar structures not intended solely for camping or personal use; using sound amplification devices or other noisy equipment; distributing printed matter; displaying advertisements or signs; selling anything or conducting a business; or selling raffle tickets or taking up a collection. A person bringing a dog must ensure the dog does not enter a prohibited area (as marked by signs) and must exercise effective control at all times (r 12). Effective control includes a leash or chain not exceeding two metres, or by command with the dog in close proximity and visible at all times (r 12(3)). Assistance dogs under the Dog and Cat Management Act 1995 are exempt from the dog-prohibited area restriction (r 12(4)). A person driving or riding a motor vehicle must not exceed 15 km/h unless otherwise signed, must pay parking fees where indicated, must obey traffic signs and directions, must not drive on the foreshore, must drive only on roads or areas set aside for that purpose, must not cause undue noise, must not obstruct, and must not drive dangerously or without reasonable consideration (r 13).

Duties on authorised persons. An authorised person must carry an identity card and produce it upon request before exercising powers (r 4(4)). A person who ceases to be an authorised person must immediately return the identity card (r 4(5)). An authorised person must not ask a question that might incriminate a person or make them liable to a penalty (r 8(2)).

Rights of users. A person subject to a request for name and address under r 5(1)(a) must provide it, but the person has a right not to answer questions or produce documents if doing so would tend to incriminate them or make them liable to a penalty (r 8(2)). A person against whom an authorised person intends to exercise powers has the right to first request production of the identity card (r 4(4)). A person who has had property surrendered or confiscated should have it returned when leaving the Reserve, unless the Trust reasonably believes it may constitute evidence of an offence (r 6). A person whose vehicle or property is impounded may recover it by paying any costs within three months of written notice, or if the owner’s identity is unknown, the Trust may sell after three months (r 7). A person may apply to the Trust for permission or authorisation to engage in restricted activities (r 14), though there is no obligation on the Trust to grant it, and the Trust may impose conditions including fees. A person may seek an exemption if they are undertaking official functions or duties in the course of employment by the Trust (r 15).

The Regulations create a tiered system of maximum penalties and expiation fees. The highest maximum penalty is $1,250, applicable to offences under rr 8 (hindering authorised persons), 10 (disorderly behaviour), and 11 (restricted activities without permission). A maximum penalty of $750 applies to offences under rr 9 (unauthorised entry), 12 (animals), and 13 (motor vehicle offences). Expiation fees (the amount payable to avoid prosecution) are set at $105 for entry, animal, and vehicle offences, and $160 for behaviour and restricted activity offences. The expiation notice system is not detailed in the Regulations but is presumably governed by the general South Australian expiation framework, including the Expiation of Offences Act 1996. Failure to pay an expiation fee within the statutory period may result in court proceedings and the higher maximum penalty becoming applicable.

Enforcement is primarily in the hands of authorised persons. An authorised person who reasonably suspects an offence has been or is being committed may: require the person to state name and address; require evidence of name and address if suspected to be false; require the person to leave the Reserve for up to 24 hours; use reasonable force to remove the person; or detain the person and hand them over to police custody as soon as reasonably practicable (r 5(1)). An authorised person may also require surrender of any object, substance, or thing reasonably suspected to have been used in contravention of the Act or Regulations, and may give directions considered necessary for good order, prevention of interference, traffic regulation, or protection of Trust property (r 5(2)). Use of force is authorised for removal or exclusion (r 5(2)(c)). An authorised person may be accompanied by assistants (r 5(3)). Vehicles or other property left unattended for more than 24 hours without permission, or left obstructing access, may be seized and impounded (r 7). The Trust may recover associated costs from the owner. If the owner fails to pay costs or collect the property within three months of written notice, or if the owner is unascertained after three months, the Trust may sell or dispose of the property (r 7(4)). Sale proceeds first cover reasonable costs of sale, seizure, impounding, and storage, with any balance paid to the owner (if known) or to the Treasurer (r 7(5)). The offences of hindering an authorised person (r 8) cover a wide range of conduct including failing to answer a question, producing a false document, failing to comply with a requirement, using abusive language, and falsely representing oneself as an authorised person. The maximum penalty is $1,250. No provision is made for complaints against authorised persons, independent review, or compensation for wrongful seizure or removal.

The Regulations are made under the West Beach Recreation Reserve Act 1987 and must be read in conjunction with that Act. The Act is not reproduced, but it presumably establishes the Trust and sets out its functions, powers, and the property description of the Reserve. The definition of motor vehicle is cross-referenced to the Road Traffic Act 1961 (SA), meaning that the interpretation of ‘motor vehicle’ will track amendments to that Act and may exclude certain vehicles (e.g., motorised wheelchairs, bicycles with electric assistance, depending on the definition). The Regulations adopt the standard of effective control for dogs, but r 12(4) creates an exception for assistance dogs under the Dog and Cat Management Act 1995; that Act defines ‘assistance dog’ and imposes its own requirements regarding public access for such animals. The expiation fee regime interacts with the general South Australian expiation framework, particularly the Expiation of Offences Act 1996 and associated regulations, which govern the procedures for issuing expiation notices, the amounts, time limits, and enforcement of unpaid expiations. The use of force by authorised persons under rr 5(1)(d) and 5(2)(c) engages the common law of assault and defences, as well as any applicable criminal code provisions. The Regulations do not purport to override other laws; for example, environmental laws under the Environment Protection Act 1993 (SA) concerning litter, noise, or pollution remain separately applicable. The prohibition on weapons under r 11(a) interacts with the Firearms Act 2015 (SA) and other weapons legislation, which may require licences or permits independently of the Trust’s permission. The prohibition on selling anything and conducting a business (r 11(k)) does not override the Fair Trading Act 1987 (SA) or Australian Consumer Law; traders still need to hold appropriate business licences and comply with consumer protections. The Regulations do not address native title, the Crown Lands Act 1929, or local council bylaws; if the Reserve is managed by a Trust under the Act, it may not be subject to local government by-law jurisdiction, but this is not explicit. No provision in the Regulations incorporates the freedom of information laws or the Ombudsman Act; complainants would need to rely on general administrative law principles (judicial review for jurisdictional error or unreasonableness) if the Trust’s decisions are amenable.

The Regulations were made on 30 August 2018 (Gazette 30.8.2018 p3282) and commenced on that day (r 2). They revoked the West Beach Recreation Reserve Regulations 2003 (Sch 1). No subsequent amendments to the 2018 Regulations are recorded in the legislative history provided. Transitional provisions in Sch 2 allowed existing authorised persons under the 2003 regulations to continue for six months or until the Trust determines otherwise, and existing authorisations, permissions, and exemptions continued in force. The legislative history note refers readers to the Index of South Australian Statutes or www.legislation.sa.gov.au for further information, implying that any future amendments would be published there. The regulations appear to be a standard periodic remake of a statutory instrument, likely under a sunsetting or review provision in the Subordinate Legislation Act 1978 (SA) or similar. The absence of amendment history to date does not mean the instrument is static; the Trust could, under its general administrative powers, issue policies, guidelines, or administrative decisions that effectively alter how the Regulations are applied, though such changes would not be reflected in the legislative text. The Regulations are now over five years old; if no revisions have been made, they may be due for review depending on the sunsetting cycle. Practitioners should check the current version on the South Australian legislation website for any repealed or amended versions before advising clients.

The source text for the Regulations (the 2018 instrument as at the date of extraction) does not include any litigation history. No cases are cited within the Regulations, and no schedule of relevant judicial decisions is appended. The Regulations themselves do not create a private right of action, so litigation would typically arise as a challenge to the validity of a permission condition, an exemption refusal, a confiscation, an impounding, or a penalty, likely via judicial review in the Supreme Court of South Australia or a prosecution appeal in the Magistrates Court. Given that the Reserve is a defined geographic area with relatively low-intensity regulation, litigation is likely to be infrequent. However, potential legal issues include: (1) whether the Trust’s discretion to grant, condition, vary, or revoke permissions is unreasonably exercised or ultra vires the Act; (2) whether authorised persons have sufficiently reliable grounds for “reasonable suspicion” justifying exercise of powers; (3) whether the use of force for removal exceeds what is reasonably necessary; (4) whether the definition of camping (including sleeping overnight in a motor vehicle) is constitutionally or statutorily valid; (5) whether prohibitions on distributing printed matter and displaying signs infringe the implied constitutional freedom of political communication; and (6) whether the power to seize and sell property without a court order complies with common law protections against arbitrary deprivation of property. As of the date of the source text, no reported decisions involving these Regulations (or their predecessors) are recorded in the standard legal databases accessible to the public. The absence of litigation does not imply low impact; it may reflect the high cost of challenging regulatory decisions relative to the value of the interests at stake, or the fact that most persons subject to enforcement actions pay the expiation fee rather than contest the matter. A thorough search of Westlaw AU, LexisNexis, and AustLII would be necessary for a complete picture, but the Regulations themselves provide no leads.

Several provisions contain traps for the unwary. First, the definition of camping includes “sleeping overnight in a motor vehicle parked in the Reserve” (r 3). This catches anyone who parks a car and sleeps in it overnight, even briefly, and makes them a “camper” who must be in a clearly designated camping area (r 11(c)). A fatigued driver who pulls over for a sleep could be fined $1,250 (expiation $160) if not in a designated camping area. Second, the dog control rules (r 12(3)) allow a dog to be under effective control without a leash if it is “in close proximity to the person and the person being able to see the dog at all times”. There is no metric for “close proximity”, making compliance uncertain and leaving scope for subjective enforcement. Also, tethering a dog to a fixed object by a leash not exceeding two metres is permitted, but the dog may still be considered unattended if the person walks away; the Regulations do not require the person to remain with the tethered dog. Third, the unattended property rule (r 11(f)) applies to “property” left unattended for more than 24 hours without permission. This could include a parked vehicle, a tent, a picnic table left overnight, or a surfboard. The authorised person’s power to seize and impound under r 7 extends to “other property”, not just vehicles. The Trust may then sell the property after three months if the owner does not collect it and pay costs; there is no requirement for a court order. Owners may lose valuable items without judicial oversight. Fourth, the power to revoke permission “at any time” (r 14(d)) is unqualified. A person who has invested in setting up a stall, preparing an event, or distributing materials can have their permission withdrawn without reasons, notice, or compensation. Fifth, exemptions (r 15) are available only for persons “undertaking official functions or duties in the course of employment by the Trust or in the exercise of powers under the Act or regulations”. A volunteer organiser, a charity worker, or a contractor for an event is not eligible for an exemption, even if their activity serves the Trust’s purposes. Sixth, the sound amplification device prohibition (r 11(h)) applies to any “other noisy equipment”. This could cover a portable speaker, a musical instrument, a gas-powered generator, or a loud hailer; the threshold for “noisy” is not defined, and there is no decibel limit. Seventh, the prohibition on distributing printed matter (r 11(i)) is broad. It applies without exception for political, religious, or educational materials, raising potential freedom of political communication concerns. Eighth, authorised persons include any member, officer, or employee appointed by the Trust (r 4(1)). The identity card must state any conditions or limitations, but the authorised person may still attempt to exercise powers beyond their authority; a user who challenges them may risk hindering charges. Finally, the maximum 24-hour exclusion order (r 5(1)(c)) can be imposed for an offence, not necessarily only after conviction; it is an administrative action based on the authorised person’s reasonable suspicion. There is no right of appeal or request for review.

Any person or organisation intending to use the West Beach Recreation Reserve should adopt a systematic compliance strategy. First, ascertain whether a proposed activity falls within the list of restricted activities in r 11. If it does (e.g., selling goods, distributing flyers, erecting a marquee, using a loudspeaker, camping, lighting a fire, leaving property for more than 24 hours, displaying a sign), obtain prior written permission from the Trust. The permission must be in writing once given (or confirmed in writing if given orally) (r 14). When seeking permission, request that any conditions be clearly documented, including any fees, and consider the risk that the Trust may later vary or revoke that permission without notice (r 14(d)). For commercial operators, it may be prudent to negotiate a contractual term with the Trust that addresses compensation for revocation, though the Regulations do not oblige the Trust to agree. Second, for dog owners, ensure that the dog does not enter areas marked as prohibited. Off-leash control is permitted only if the dog is in close proximity and visible; a leash (maximum 2 metres) is the safer option to avoid ambiguous enforcement. An assistance dog user must still comply with subregulation (1) (no other animal) and subregulation (3) (effective control), but is exempt from area restrictions. Third, motor vehicle users must adhere to the 15 km/h speed limit unless signs indicate otherwise, pay any parking fees, and use only roads or areas set aside by the Trust. Driving on the foreshore is always banned (r 13(a)(iv)). Avoid causing undue noise from the vehicle (engine revving, loud exhaust, music). Fourth, campers must camp only in designated camping areas. Given that sleeping overnight in a motor vehicle constitutes camping, those planning to sleep in a vehicle must ensure they are in a designated camping area or obtain permission. Fifth, event organisers should apply for permission well in advance, specifying any structures (marquees, gazebos), sound equipment, food stalls, and signage. The Trust may impose conditions including fees. Organisers should also check whether any other licences are needed under local council or state laws (e.g., food safety, liquor licensing, public assembly permits). Sixth, concerning unattended property, do not leave any item (vehicle, tent, equipment) without Trust permission if it will be unattended for over 24 hours. If property is impounded, respond promptly to any written notice from the Trust; pay the required costs and collect the property within three months to avoid sale or disposal. Seventh, if approached by an authorised person, cooperate by providing your full name and usual place of residence if asked (r 5(1)(a)). However, you have the right to decline to answer questions or produce documents if to do so might incriminate you (r 8(2)). If you are directed to leave the Reserve, do so immediately; failure to comply is an offence and may result in force (r 5(2)(c)). The exclusion order lasts a maximum of 24 hours; note the time and request the authorised person’s name and identity card details for later complaint if the order was unreasonable. Eighth, challenge or complaints: if you believe an authorised person has acted beyond their power or unfairly, you may complain to the Trust or seek judicial review. There is no internal review mechanism specified, so a legal challenge would likely rely on administrative law remedies in the Supreme Court. Given the costs of litigation, obtaining legal advice before any activity that may require permission is strongly recommended.
