sec.29 Meaning of controlled and watertight delivery system for a water bore
A water bore is controlled if it is— a subartesian bore; or an artesian bore that has permanent headworks controlling the flow of water from the bore; or an artesian bore and water from the bore no longer flows naturally to the surface. A water bore has a watertight delivery system if— the bore is controlled; and water taken from the bore is distributed by a pipeline to a trough that contains the water; and the following are maintained in a way that minimises the loss of water— the bore, pipeline and trough; and any cooling pond or storage tank mentioned in subsection (3) . For subsection (2) (b) , water taken from the water bore may be held temporarily in either of the following before being distributed to a trough— a cooling pond for the purpose of cooling the water to a temperature that is suitable to be distributed for its intended use; a storage tank. (sec.29-ssec.1) A water bore is controlled if it is— a subartesian bore; or an artesian bore that has permanent headworks controlling the flow of water from the bore; or an artesian bore and water from the bore no longer flows naturally to the surface. (sec.29-ssec.2) A water bore has a watertight delivery system if— the bore is controlled; and water taken from the bore is distributed by a pipeline to a trough that contains the water; and the following are maintained in a way that minimises the loss of water— the bore, pipeline and trough; and any cooling pond or storage tank mentioned in subsection (3) . (sec.29-ssec.3) For subsection (2) (b) , water taken from the water bore may be held temporarily in either of the following before being distributed to a trough— a cooling pond for the purpose of cooling the water to a temperature that is suitable to be distributed for its intended use; a storage tank.
- (a) a subartesian bore; or
- (b) an artesian bore that has permanent headworks controlling the flow of water from the bore; or
- (c) an artesian bore and water from the bore no longer flows naturally to the surface.
- (a) the bore is controlled; and
- (b) water taken from the bore is distributed by a pipeline to a trough that contains the water; and
- (c) the following are maintained in a way that minimises the loss of water— (i) the bore, pipeline and trough; and (ii) any cooling pond or storage tank mentioned in subsection (3) .
- (i) the bore, pipeline and trough; and
- (ii) any cooling pond or storage tank mentioned in subsection (3) .
