136 Making application for review of reviewable decision
(1) An affected person for a reviewable decision may apply to the ACAT
for review of the decision.
(2) If the reviewable decision is a decision mentioned in schedule 1,
items 1, 3, 5, 7, 9, 11, 13, 15, 17 or 19, an application must be made
not later than 5 days after the later of—
(a) the day the individual is given a copy of the relevant report; and
(b) the day the affected person making the application for review
becomes aware of the reviewable decision.
(3) If the reviewable decision is a decision mentioned in schedule 1,
items 2, 4, 6, 8, 10, 12, 14, 16, 18 or 20, an application must be made
not later than 28 days after the later of—
(a) the day the individual is given a copy of the relevant report; and
(b) the day the affected person making the application for review
becomes aware of the reviewable decision.
Reviewable decision notices and applications for review of reviewable
Division 10.2
relevant report means—
(a) for a decision mentioned in schedule 1, items 1 to 6—the first
assessment report for the individual; or
(b) for a decision mentioned in schedule 1, items 7 to 12—the
consulting assessment report for the individual; or
(c) for a decision mentioned in schedule 1, items 13 to 20—the final
assessment report for the individual.
