Veterinary Chemical Control Regulations 2006

The Regulations build on a handful of recurring legal concepts that determine when a product may be used, who may use it and what documentary controls apply. These concepts are defined and then operationalised across the instrument.

Key defined concepts

• Trade species animal and major trade species animal (reg 2(1)). Trade species animals are a broad class including cattle, sheep, pigs, domestic poultry, ostrich, emu, deer, goat, bees and aquaculture species, as well as any animal kept to produce hide, hair or fleece or otherwise used as food for humans or animals. Major trade species animals are the subset the Regulations single out , cattle, sheep, pigs, domestic chickens (meat or layer bird) or bee. These definitions control where stricter rules apply, for instance in what non‑veterinarians must record (reg 17).
• Registered vs unregistered veterinary chemical products (reg 2(1)). An unregistered veterinary chemical product is any product not registered as a veterinary chemical product, with examples given such as human pharmaceutical products or agricultural chemical products. This distinction drives prohibitions: non‑veterinarians cannot use unregistered products on trade species animals except in tightly circumscribed situations (reg 13).
• Label restraint and label precaution (reg 2(1) and 14(1)). The Regulations treat statements on an approved label differently, and expressly prohibit circumventing label restraints and certain label precautions when using a product under a veterinarian’s statement (reg 14(5)).
• Withholding period (reg 2(1) and Division 3). The concept ties use of a product to food safety outcomes. The withholding period is the minimum interval between last use and slaughter/collection to ensure residues fall to or below APVMA maximum limits. The instrument prescribes how withholding periods are identified and how conflicts between label and veterinarian statement are resolved (reg 18).

Operationalised duties and permissions

• Off‑label use: The Regulations permit limited off‑label administration of registered products but confine when this can happen. For veterinarians, reg 4 permits off‑label use on trade species animals only where either the label mentions instructions for a major trade species animal, or the use is on a single major trade species animal (see reg 2(4) for “single”), or the animal is not a major trade species animal, or the CVO has granted prior written authorisation (reg 4(1)(a)-(c), reg 7). For non‑veterinarians, off‑label use is permitted only if it is undertaken exactly in accordance with a written statement given by the prescribing veterinarian under reg 10(2) (reg 14(2)).
• Use by injection: Both veterinarians and non‑veterinarians are prohibited from injecting a registered product unless the approved label gives instructions for use by injection (regs 3 and 4(2), and reg 14(5)(b) as to non‑veterinarians).
• Use of unregistered products: Veterinarians may use unregistered products only on a single trade species animal, or where authorised by reg 6 (low‑risk chemicals) or with prior written CVO permission (reg 5 and reg 7). Non‑veterinarians are generally prohibited from using unregistered products on trade species animals, except where a veterinarian’s statement authorises such use (reg 13 and reg 14(6)).
• Veterinary written statement: Reg 10 prescribes the content of the written statement a veterinarian must give when prescribing or supplying off‑label or unregistered products to be used on trade species animals. The list of mandatory items (species; amount supplied; dosage; frequency; treatment period; manner of administration; withholding period if applicable; location and identification of the animal; identifying details; recipient’s name; and owner name/address) is exhaustive and its omission attracts a fine and a separate record retention duty.
• Recordkeeping and traceability: Persons who use or receive products in the circumstances envisaged must retain statements and treatment records for three years and produce them on request to an inspector (regs 10(3), 11, 16(1)-(3), 17(3)-(5), 19(4)-(6), 20(3)).

Allocation of decision rights and oversight

• Chief Veterinary Officer (CVO) has explicit authority to grant prior written permission to veterinarians for off‑label or unregistered uses (reg 7).
• The Director must give prior written approval for any use of antibiotics on bees, hives or apiary equipment (reg 9).
• APVMA permits operate as an exemption: a person compliant with an APVMA permit is not required to comply with Part 2 rules (reg 22(2)).
• Inspectors may require production of statements and records and may inspect and copy them (regs 11(1), 16(2), 17(4), 19(5), 20(2)). Certificates of appointment and analysis are prescribed forms (Forms 3 and 4, regs 49-50).

Tension points embedded in the concepts include the precedence rule for withholding periods , a veterinarian’s written withholding period prevails over the label if they differ (reg 18(2)), and the deliberate bar on using statements to override label restraints or precautions (reg 14(5)). The “single’’ animal concept (reg 2(4)) narrows when veterinarians can use unregistered products and affects the ability of farmers to treat individual animals in group contexts.

The remaining sections of this note explain who bears these obligations and costs, the details of duties and rights, enforcement, statutory interactions, amendments and transitions, litigation record (as provided in the instrument), common compliance pitfalls and practical steps to comply.

The Regulations allocate obligations across a small set of defined actors and implicitly affect markets for veterinary products and veterinary services. The principal groups impacted are:

Veterinarians

• Bear primary operational duties when prescribing, supplying or recommending veterinary chemical products, especially where use will be off‑label or involve unregistered products (see regs 3-11). They must provide written statements that contain detailed information (reg 10(2)), retain copies for three years (reg 10(3)), and comply with limits on injection (reg 3) and supply only “in the course of the practice of his or her profession and for the purpose of dealing with a particular condition’’ (reg 8). Failure to meet these requirements attracts fines (typically $5,000 for substantive breaches; $1,000 for failure to produce documents to an inspector , regs 3, 8, 10, 11).
• Decision authority: vets decide to prescribe off‑label or unregistered products but may need prior written permission from the Chief Veterinary Officer for certain departures from labelling for trade species animals (reg 7). Vets also determine withholding periods in their written statements (reg 10(2)(g)).

Non‑veterinarian persons who treat or handle animals (farmers, stockpersons, apiarists, lay animal carers)

• Face prohibitions on off‑label use of registered products (reg 12) and on any use of unregistered products on trade species animals (reg 13), unless they act strictly within the terms of a veterinarian’s written statement (reg 14). They must keep statements and treatment records for three years (regs 16(1), 17(3)) and may be fined for non‑compliance (generally $5,000 for substantive contraventions).
• Specific obligations attached to those who use products on major trade species animals include recordkeeping (reg 17(1)) and identifiability of animals subject to treatment and withholding (reg 19).
• Those who supply trade species animals when a withholding period applies must provide written notice to buyers, and both parties must retain copies for three years (reg 20).

Animal owners and persons in charge of animals

• Owners or persons in charge must ensure treated animals are identified during the treatment and withholding periods, and retain identification records for three years (reg 19(2)-(4)). If the recipient of a vet’s statement is not usually in charge of the animal, the recipient must give a copy to the person who usually is in charge (reg 15).

Regulators and administrative actors

• Chief Veterinary Officer: grants prior written permissions to veterinarians for off‑label or unregistered uses on trade species animals (reg 7). The instrument does not specify criteria or timeframes for decisions.
• Director: must grant prior written approval for any use of antibiotics on bees, hives or apiary equipment; using antibiotics without that prior written approval is an offence (reg 9).
• Inspectors: appointed and certified via Form 3 (reg 49 and Form 3). Inspectors may require production of statements and records, inspect and copy documents and records, and enforce compliance through notices and prosecutions (regs 11, 16, 17, 19, 20).
• APVMA: Commonwealth regulator; an APVMA permit removes the person’s obligation to comply with Part 2 in respect of a product possessed, used or supplied under the permit (reg 22(2)).

Market and service effects

• Veterinary services: The written‑statement requirement (reg 10) and the limits on non‑veterinary use (regs 12-14) create more transactional demand for veterinary input. Farmers and other animal holders who need off‑label or unregistered product access must seek veterinary prescriptions/statements, possibly increasing the role of vets as gatekeepers.
• Product suppliers and retailers: The label‑centric rules (regs 3-4, 12-14) increase the practical importance of accurate labelling and may affect sales practices; supply by veterinarians is limited to “in the course of practice’’ (reg 8), potentially constraining veterinary dispensing models outside clinical contexts.
• Users of human pharmaceuticals or agricultural chemicals for veterinary purposes face constrained legal pathways: they are treated as unregistered products and generally cannot be used by non‑veterinarians on trade species animals unless a vet’s statement allows it (reg 13 and reg 14(6)).

Who pays

• Monetary fines fall on the individual or entity that breaches the Regulations (amounts stated in each provision). There are also compliance costs: time and recordkeeping costs for vets and handlers (three‑year retention periods across regs 10, 16, 17, 19, 20), administrative overhead to obtain CVO or Director approvals where required (regs 7 and 9), and potential opportunity cost where a veterinary-only pathway increases the price and time required to access certain products.

Who decides

• The practical gatekeepers are veterinarians, the CVO (for authorised departures), the Director (for bee antibiotics), the APVMA (via permits), and inspectors who demand documentary proof (regs 7, 9, 22, 11, 16, 17, 19, 20). The Regulations centralise some discretion (CVO and Director permissions) while delegating monitoring and enforcement to inspectors and analysts (Forms 3 and 4).

Geographic and species scope

• The Regulations operate within Western Australia and apply to the categories of animals listed; trade species animals and major trade species animals are the focus, but the definitions cover a broad range of domestic, production and aquaculture species (reg 2(1)).

In short, the Regulations primarily affect veterinarians, animal owners and handlers, and suppliers, reallocating certain activities to veterinary oversight and imposing documentary and traceability burdens on those who use veterinary chemical products on trade species animals.

This section lists the main duties imposed on regulated participants, the rights those participants retain under the instrument, and the formal decision channels available to seek authorisations or exemptions. All duties are backed by specific regulation citations.

Veterinarians: duties, statements and limits

• Duty not to inject unless label permits: A veterinarian must not use a registered veterinary chemical product by injection, nor prescribe, supply or recommend such a product for use by injection on an animal unless the approved label gives instructions for use by injection (reg 3). Penalty for breach: $5,000.
• Duty to follow label on trade species animals: A veterinarian must not use, prescribe, supply or recommend a registered veterinary chemical product on a trade species animal other than in accordance with the approved label, unless one of the narrow exceptions in reg 4(1)(a)-(c) applies or the CVO authorises (reg 4(1)). Penalty: $5,000.
• Unregistered products: A veterinarian may generally only use unregistered veterinary chemical products on a trade species animal if used on a single trade species animal or authorised under reg 6 (low‑risk chemicals) or reg 7 (CVO authorisation) (reg 5). Penalty: $5,000.
• Written statement duty: Where a veterinarian prescribes or supplies (or recommends) either a registered product to be used off‑label or an unregistered product on a trade species animal, the veterinarian must give a written statement to the person for or to whom the product is prescribed, supplied or recommended. The statement must include a comprehensive list of items (species; amount; dosage; frequency; treatment period; method; withholding period if any; location/identification of the animal; identifying details; recipient name; owner name/address) (reg 10(1)-(2)). Penalty for failing to give a proper statement: $5,000. The veterinarian must also keep a copy for three years (reg 10(3)). Penalty: $5,000.
• Supply only in course of professional practice: A veterinarian must not prescribe or supply a veterinary chemical product unless it is done in the course of practice and for the purpose of dealing with a particular condition of an animal under the veterinarian’s care (reg 8). Penalty: $5,000.

Non‑veterinarian users: restrictions, records and statements

• Registered products: A non‑veterinarian must not use a registered veterinary chemical product on a trade species animal other than in the way stated on the approved label (reg 12(1)). The exception is where the use is authorised under reg 14 (for example, where a vet gives a written statement, reg 14(2)). Penalty: $5,000.
• Unregistered products: Non‑veterinarians are prohibited from using unregistered veterinary chemical products on trade species animals (reg 13(1)). Exception: use in accordance with a vet’s written statement under reg 10(2) as allowed by reg 14(6). Penalty: $5,000.
• Use under a veterinarian’s statement: Non‑veterinarians may use registered products in a manner other than on‑label if they do so in the way stated in a written statement given under reg 10(2) (reg 14(2)). They may also use a registered product intended for one major trade species on another major trade species if it is in accordance with a vet’s statement (reg 14(3)). However, a vet’s statement cannot authorise use contrary to a label restraint or label precaution, nor permit injection when the label does not permit injection (reg 14(5)).
• Recordkeeping duties: Persons who use veterinary chemical products on major trade species animals must keep treatment records (product used; animal identification; dosage; dates) and retain them for three years (reg 17(1) and (3)). Persons who use a product under reg 14(authorized use for non-major) must also keep such records (reg 17(2)-(3)). Inspectors may require production of these records and may copy them; failure to comply with an inspector’s requirement to produce attracts a $1,000 penalty (reg 17(4)-(5)).

Animal owner / person in charge duties

• Identification during withholding: The person in charge must keep written records to ensure treated animals are identifiable during the treatment and withholding period (reg 19(2)). It is sufficient that the animal is identifiable as one of a treated group (reg 19(3)). Records must be kept for three years (reg 19(4)). Penalty for failing to keep records: $5,000. Inspectors may require production and may copy them; non‑production attracts a $1,000 penalty (reg 19(5)-(6)).
• Buyer notification: A supplier who transfers a trade species animal to another person while a withholding period has not elapsed must give the buyer written notice specifying the withholding period or date it elapses, the product name or active constituent, animal identification details, and date of treatment (reg 20(2)). Both giver and recipient must keep a copy for three years (reg 20(3)). Penalty: $5,000.

Food safety / withholding observance

• Prohibition on slaughter/harvest before withholding: A person in charge must not slaughter a treated animal for human consumption, harvest wool, fibre, milk or eggs for human consumption, or release honey for human consumption before the withholding period has elapsed (reg 21(2)). Penalty: $5,000.

Exemptions and authorisations

• Low‑risk chemicals: A veterinarian may use an unregistered product made wholly of a low‑risk chemical (bicarbonate soda; common salt; or a reserved chemical product within the Agvet Code) where no pharmacologically equivalent registered product is reasonably available (reg 6).
• CVO authorisation: A veterinarian may, with the prior written permission of the CVO, use or prescribe a registered product otherwise than in accordance with its approved label or use an unregistered product on a trade species animal (reg 7).
• Director approval for bee antibiotics: No one, including veterinarians, may use or supply antibiotics for bees, hives or equipment without the Director’s prior written approval; doing so is an offence (reg 9).
• APVMA permits: Possession, use or supply in accordance with an APVMA permit exempts the person from Part 2 compliance requirements (reg 22(2)).

Inspector powers and statutory forms

• Inspectors can require production and copy statements and records and vets and other persons must comply (regs 11(1), 16(2), 17(4), 19(5), 20(2)). Failing to produce attracts a $1,000 fine (regs 11(2), 16(3), 17(5), 19(6)). Forms 3 and 4 provide the required form for inspector appointment certificates and certificates of analysis (regs 49-50 and Schedule 6).

Rights and practical recourse

• Administrative authorisations: Veterinarians have a procedural right to seek prior written permission from the CVO for departures from labelling and to seek Director approval for bee antibiotic use (regs 7 and 9).
• APVMA permits: Persons can obtain an APVMA permit, which has the statutory effect of exempting them from some Part 2 obligations (reg 22(2)).
• Production and certificate mechanics: The Regulations provide clear templates for forms (Forms 3 and 4), and inspectors’ power is limited to requiring production of documents required by these Regulations; that is the defined scope of inspection authority (regs 11, 16, 17, 19, 20).

Overall, duties emphasise adherence to approved labels, veterinarian oversight for off‑label or unregistered product use, rigorous written statements and three‑year retention of treatment and notification documents. Rights are confined to seeking prior written permissions and APVMA permits; the instrument does not provide statutory timeframes or appeal routes for administrative decisions within the text provided.

The Regulations create a layered enforcement regime combining criminal penalties (fines), inspection powers, and evidentiary mechanics that prosecutors and regulators can use to prove breaches. The instrument differentiates between substantive breaches attracting larger fines and failures to produce documents attracting smaller fines.

Monetary penalties

• Substantive contraventions: The majority of substantive offences carry a fine of $5,000. Examples include:
  • Using a registered product by injection without label instructions (reg 3).
  • Veterinarians using or prescribing registered products on trade species animals contrary to label except where permitted (reg 4(1)).
  • Veterinarians using unregistered products on trade species animals except when allowed (reg 5).
  • Veterinarians prescribing or supplying outside professional practice purposes (reg 8).
  • Veterinarians using antibiotics on bees without Director approval (reg 9).
  • Non‑veterinarians using registered products contrary to label or unregistered products at all (regs 12 and 13).
  • Non‑veterinarians failing to keep required statements or records or failing to notify buyers when supplying animals under a withholding period (regs 15, 16(1), 17(1)-(3), 20(2)-(3), 19(4)).
  • Observance of withholding periods: slaughtering or harvesting products before a withholding period elapses (reg 21).
• Production/inspection contraventions: Failing to comply with an inspector’s requirement to produce a statement or record attracts a $1,000 fine (regs 11(2), 16(3), 17(5), 19(6)). This gradation separates documentary non‑cooperation from substantive misuse.

Inspection powers and evidentiary framework

• Inspectors’ authority: An inspector may require a veterinarian to produce the written statement required under reg 10 and may inspect and take copies (reg 11(1)). Similarly, inspectors may require production of statements and records from other persons (regs 16(2), 17(4), 19(5), 20(2)). The Regulations impose a duty to comply and provide a penalty for refusal or failure to produce (reg 11(2), 16(3), 17(5), 19(6)).
• Certificates of analysis: Section 47 of the Act is given effect via Form 4, a prescribed certificate of analysis (reg 50 and Form 4). This creates an evidentiary route to establish chemical residue levels or other analytic results in prosecutions or compliance actions.
• Appointment certificates: Inspectors are to be appointed and certificated in the Form 3 prescribed by the Regulations (reg 49 and Form 3). This supports chain of authority and admissibility in enforcement proceedings.

Criminal process and enforcement discretion

• The Regulations set out offences and penalties but do not, within the text provided, prescribe the enforcement process, timeframes for inspector decisions (for CVO or Director approvals), or appeal mechanisms for administrative decisions. Enforcement will proceed by the relevant prosecuting authority under the Act and general criminal or regulatory enforcement processes of Western Australia. The Regulations give inspectors power to gather documentary evidence; this enables administrative or criminal action where evidence shows non‑compliance with labelling, statements, treatment records, withholding obligations or identification requirements.

Practical enforcement levers

• Compliance evidence: The combination of written statements (reg 10), records of treatment (reg 17), identification records (reg 19) and buyer notices (reg 20) creates a documentary paper trail that inspectors can gather to pursue prosecutions.
• Residue analysis: Form 4 certificates of analysis (reg 50 and Form 4) provide a mechanism for proving that residues exceeded permitted levels and thereby support offences tied to withholding period breaches or use of unauthorised products.
• Administrative authorisations as defence: Compliance with an APVMA permit (reg 22(2)) or possession of prior written authorisation from the CVO or Director (regs 7 and 9) provide statutoryly acknowledged permissions that can be asserted in response to enforcement action.

Enforcement costs and incentives

• Inspectors are empowered to inspect and copy documents but enforcement requires follow‑through: evidence collection, analysis (Form 4), charging and prosecution. The monetary penalties are fixed amounts rather than scaled by commercial benefit; the instrument therefore imposes fixed financial disincentives for non‑compliance (typically $5,000) while leaving proportionality and other sentencing considerations to the courts and enforcement agencies.
• The lower fines for failure to produce documents ($1,000) create an enforcement lever to compel cooperation with inspections, while larger substantive fines target misuse or failure to observe withholding periods that risk food safety.

Limitations and gaps relevant to enforcement

• The Regulations do not, in the text provided, detail administrative review processes for CVO or Director refusals or set timeframes for those decisions. They also do not provide express civil enforcement tools (such as infringement notices) within these provisions; enforcement is expressed through offences and fines.
• The instrument prescribes forms of certificates and appointment but does not prescribe the processes or evidentiary thresholds by which inspectors exercise discretion, nor does it specify appeal or review rights against inspectors’ actions in the text provided.

In summary, enforcement is document‑driven and regulatory: investigators will rely on statements, records and analytical certificates and can levy fines for substantive misuse and for refusing to cooperate. The design signals an emphasis on recordkeeping, traceability and veterinary oversight as the main compliance mechanisms.

The Regulations expressly link to several external legislative or regulatory frameworks and imply practical interactions with them. These interactions affect how obligations are complied with, who authorises certain uses, and what legal avenues are available to regulated parties.

APVMA and the Agvet Code

• APVMA: The Regulations define APVMA in reg 2(1) and recognise APVMA permits as an express exemption from Part 2 obligations: a person who possesses, uses or supplies a veterinary chemical product in accordance with an APVMA permit is not required to comply with the provisions of Part 2 (reg 22(2)). This makes Commonwealth permits a direct authorising pathway for conduct that otherwise would breach State regulation. Practically, obtaining an APVMA permit changes which legal duties apply to a person.
• Agvet Code: The term “supply” is given the meaning in the Agvet Code of Western Australia by reg 2(1), and reg 6(1) references a “reserved chemical product within the meaning of the Agvet Code of Western Australia” when defining low‑risk chemicals. This signals that the Regulations are designed to be used alongside the Agvet Code and that product classification under the Code affects which State rules apply.

Medicines and Poisons Act 2014

• Definition of “prescribe”: The Regulations define “prescribe” to mean “to issue a prescription in accordance with the Medicines and Poisons Act 2014” (reg 2(1)). This cross‑reference indicates that prescribing mechanics, including who may issue prescriptions and the form they take, are governed by the Medicines and Poisons Act and that compliance with that Act is a prerequisite for the State veterinary chemical regime to recognise prescriptions.

Veterinary Chemical Control and Animal Feeding Stuffs Act 1976 (the Act)

• The Regulations sit under the Act and operationalise sections of it. They reference the Act for inspector appointment (section 37 referenced in reg 49) and for certificates of analysis (section 47 referenced in reg 50). Enforcement and offence provisions in the Regulations are tied to offences under the statutory framework of the Act.

Commonwealth/state interface and permits

• APVMA permits can override the State Part 2 obligations (reg 22(2)). The Regulations therefore create a deference mechanism to Commonwealth authorisations, which can be used to permit otherwise unauthorised possession, use or supply of veterinary chemical products. Practitioners should treat APVMA permits as pre‑emptive legal instruments in these contexts, with the caveat that the Regulations still apply to other aspects not covered by a permit.

Other statutes and administrative processes (implied interactions)

• Administrative approvals: The Regulations confer discretion on the CVO and the Director to grant prior written permissions (regs 7 and 9). Those authorities and their processes will be governed by general administrative law principles and possibly by internal Departmental policies not reproduced in the Regulations. The Regulations do not specify decision criteria or appeal mechanisms, so affected persons will need to rely on the broader administrative law framework for challenging or seeking review of decisions.
• Food safety and trading laws: The withholding period mechanics (reg 18-21) intersect operationally with food safety regulations and market rules, though the Regulations do not cross‑reference specific food safety statutory instruments. Compliance with withholding periods is an explicit statutory duty that affects when animals or animal products can enter the food supply.
• Poisons and controlled substances: Because “prescribe” ties to the Medicines and Poisons Act 2014, there is an overlap where controlled substances, their prescriptions and legal distribution are regulated under that Act. Practitioners must therefore ensure they concurrently comply with the Medicines and Poisons Act when prescribing human pharmaceuticals or other controlled products for veterinary use.

Forms and evidentiary mechanics

• Forms 3 and 4 (regs 49-50; Schedule 6) provide procedural bridges between State evidentiary processes and administrative actions. A Form 4 certificate of analysis is intended to support prosecutions under the Act, while the Form 3 certificate of appointment validates an inspector’s authority.

Transitional and repeal interactions

• The Regulations repeal earlier State instruments (reg 51) and preserve existing approvals, declarations and records from the former regulations (reg 52). For entities operating under approvals granted under the former regulations, the Regulations provide continuity in legal status.

In practice, regulated parties must coordinate compliance across a matrix of laws: State veterinary chemical rules, the Agvet Code, the Medicines and Poisons Act for prescriptions, Commonwealth Agvet regulation via the APVMA for permits and potentially food safety laws for withholding and market access. The Regulations rely on these external instruments for definitions, authorisations and exception routes and thereby sit within a multi‑layered regulatory environment.

The Regulations include a compilation table and express amendment references within the text. The compilation table and inline amendment notes indicate the following mechanical amendment history and structural changes.

Original and subsequent promulgation

• The Veterinary Chemical Control and Animal Feeding Stuffs Regulations 2006 were published 8 December 2006 and commenced on that date (Compilation table entry for 2006).

Amendments recorded in the compilation table and inline notes

• 2011 amendment: Veterinary Chemical Control and Animal Feeding Stuffs Amendment Regulations 2011 published 30 August 2011. The compilation table records commencement of parts of that instrument on 30-31 August 2011 and an amendment note at regulation 22 indicating an amendment published 30 Aug 2011 p. 3504 (see reg 22 amendment note). The exact operational effect in the text provided is not elaborated beyond the insertion of reg 22(2) recognising APVMA permits; the inline note after reg 22 shows an editorial amendment acknowledged by Gazette 30 Aug 2011 p. 3504.
• 2013 amendment: Veterinary Chemical Control and Animal Feeding Stuffs Amendment Regulations 2013, published 5 February 2013 and mostly commenced 1 May 2013. The 2013 amendment materially deleted Parts 3 and 4 and Schedules 1-5 and Forms 1 and 2 (see the notes “Parts 3 and 4 (r. 23-48) deleted: Gazette 5 Feb 2013 p. 830” and “Schedules 1-5 deleted” and “Forms 1 and 2 deleted” references). Regulation 1 citation was amended (Gazette note), and Forms 3 and 4 were retained and amended (Form 3 amended: Gazette 5 Feb 2013 p. 831; Form 4 amended: Gazette 5 Feb 2013 p. 831). The 2013 amendments therefore restructured the instrument and pruned material previously present.
• 2017 amendment: Agriculture and Food Regulations Amendment (Poisons) Regulations 2016 Pt. 5 published 17 January 2017 and commenced 30 January 2017. The inline note at reg 2 shows an amendment reference: Gazette 17 Jan 2017 p. 405; SL 2016 changes the definition of “prescribe” to reference the Medicines and Poisons Act 2014 (reg 2(1) includes “prescribe, in relation to a veterinary chemical product, means to issue a prescription in accordance with the Medicines and Poisons Act 2014 for the product.”). This amendment links State veterinary chemical prescribing concepts with the Medicines and Poisons Act regime.
• 2022 amendment: Agriculture and Food Regulations Amendment (Veterinary Practice) Regulations 2022 Pt. 7, SL 2022/98, commenced 18 June 2022. Multiple provisions are noted as amended by SL 2022/98 r. 18. The 2022 instrument appears to have updated definitions and headings and possibly substance in Divisions 1 and 2; the inline annotations show many regs annotated “amended: SL 2022/98 r. 18.”

Structural changes

• Substantial deletions: Parts 3 and 4 (regulations 23-48), Schedules 1-5 and Forms 1 and 2 were deleted by the 2013 amendments. The retained Schedules include Schedule 6 (Forms), which contains Forms 3 and 4 and the certificate texts. The deletions indicate a consolidation or simplification of the regulatory instrument at that time; the Regulations now focus on Part 1, Part 2 (Division 1-4), Part 5 and Part 6 with Schedule 6 retained.
• Amendments adjusting definitions and cross‑references: The 2017 and 2022 amendments updated cross‑references (e.g. to the Medicines and Poisons Act 2014) and modernised terminology (e.g. label restraint, label precaution, reserve chemicals) and structural headings (many regs annotated as “amended: SL 2022/98 r. 18”).

Transitional preservation

• Reg 52 provides transitional provisions preserving any approvals, declarations, records or other acts in existence under the former regulations at the time the new Regulations came into operation. A certificate of appointment in a former prescribed form remains taken to be in the prescribed form for section 37(2) purposes (reg 52(2)-(3)). This ensures continuity for persons appointed or authorised under earlier instruments.

Practical consequences of amendments

• Post‑2013 the instrument is more focused on veterinary chemical control processes (statements, records, withholding) and less encumbered by possibly obsolete schedules. Repeals of prior regulations could change the operational environment for some licence or approval holders, but reg 52 preserves existing acts and approvals.
• The 2017 link to Medicines and Poisons Act 2014 incorporated a newer prescription regime, which had the practical effect of aligning prescribing definitions with the State poisons framework.
• The 2022 amendments (SL 2022/98) appear to have modernised several provisions; the text provided shows many regs annotated as amended on that date.

Sources in the instrument

• The compilation table at the end of the Regulations provides the primary statutory record of amendments, publication pages and commencement dates, and each regulation carries internal amendment notes indicating the Gazette or Statutory Instrument that altered it. For example, reg 2 carries amendment notes for 2013, 2017 and 2022.

What the amendment history does not show

• The instrument’s text does not provide policy rationales for each amendment beyond what appears in the Office of the Parliamentary Counsel’s Gazette annotations. It also does not include administrative guidelines for how CVO or Director permissions are to be processed, nor does it include any recorded judicial interpretation of the amended provisions.

For practitioners, the relevant operational takeaway is to check the current consolidated text and the compilation table when determining applicable obligations and to be aware that key structural and definitional changes were implemented in 2013, 2017 and 2022.

The Regulations themselves do not include case law or a litigation history. The text provided contains no references to judicial decisions, prosecutions or appeals relating to the Regulations. Accordingly, the instrument as supplied records no litigation history that can be cited or summarised.

Practical implications of an absence of litigation history in the instrument

• No guidance in the Regulations: Without case law embedded in or attached to the instrument, the statutory text is the primary source for interpreting duties, rights and penalties. Practitioners must therefore rely on the plain wording, internal definitions and cross‑references to other statutes (for example the Medicines and Poisons Act 2014 and the Agvet Code).
• Potential sources of case law outside the instrument: Enforcement and interpretation disputes (for example about whether a veterinarian’s statement properly authorised a non‑veterinarian’s use, or whether a person complied with identification requirements in reg 19) would arise in Western Australian courts or tribunals, but any such precedents are not recorded in this instrument. To ascertain whether litigation has tested particular provisions, a search of relevant Western Australian criminal, administrative and civil databases would be required.
• Enforcement practice and prosecutorial discretion: In the absence of recorded judicial guidance in the instrument, enforcement agencies and courts will develop practice through prosecutions and administrative decisions. That practice could shape how strictly provisions like reg 14(5) (label restraints) or reg 18 (withholding period precedence) are interpreted. The Regulations’ precise documentary requirements (for example the list in reg 10(2)) offer inspectors concrete standards for evidence, which is likely to influence case selection and prosecutorial strategy.

Areas likely to generate litigation if contested

• Meaning of “single” animal: The Regulations define “single” in reg 2(4) with a two‑limb test that may be factually complex. Disputes about whether a use was on a “single” animal versus a group could be litigated if a prosecution or enforcement action is contested.
• Conflict between label and veterinarian statement on withholding periods: Reg 18(2) gives precedence to the veterinarian’s written statement over the label when the withholding periods differ. Litigation could arise if inspectors or other authorities challenge a withholding period used by a vet as inconsistent with food safety standards or if a buyer alleges non‑disclosure.
• CVO and Director authorisations and procedural fairness: If the CVO or Director refuses to grant prior written permissions (regs 7 and 9) or imposes conditions, the procedural fairness of those decisions could be contested under administrative law, though the Regulations themselves do not provide administrative appeal mechanics.
• Use of unregistered products: Cases involving use of human pharmaceuticals or agricultural chemicals as veterinary products on trade species animals might test the boundaries of the “unregistered product” definition and the exceptions in reg 6 and reg 14(6).

What the reader should do to find litigation

• Check legal databases, tribunal records and Western Australian court judgments for prosecutions under the Veterinary Chemical Control and Animal Feeding Stuffs Act 1976 and its Regulations.
• Review Departmental enforcement bulletins and APVMA publications where applicable, because prosecutorial practice and regulatory guidance sometimes appear outside formal judgments.

In short, the Regulations as provided contain no litigation history. Potential areas of dispute exist where factual interpretation matters (single animal, label v statement withholding, CVO/Director discretion), and practitioners should search case law and administrative decisions if precedent is required for particular operational questions.

This section summarises common pitfalls, traps for the unwary and operational mismatch risks that the text of the Regulations creates. Each item is grounded in specific provisions.

1. Injection use strictly controlled (reg 3 and reg 14(5)(b))

• Pitfall: Assuming a veterinarian can inject any registered product. The Regulations bar injection unless the approved label specifically gives instructions for injection (reg 3). Reg 4(2) reiterates that off‑label use does not allow injection unless the label authorises it. Even a veterinarian’s written statement cannot authorise a use by injection if the label does not (reg 14(5)(b)). Practically, using the syringe as a matter of convenience without label authorisation is a $5,000 offence.

2. The “single” animal definition narrows use of unregistered products (reg 2(4) and reg 5)

• Pitfall: Treating “single” in everyday terms. The Regulations define “single” by reference to unique identification and whether a vet individually deals with the animal (reg 2(4)). If the treated animal is one of a group and not uniquely identified, the “single” exception for use of unregistered products does not apply. Ambiguity at the farm gate over identification practices can convert a lawful treatment into an offence.

3. Vet’s statement is both enabling and limiting (regs 10 and 14)

• Pitfall: Believing a vet’s written statement permits any off‑label use. A veterinarian must include a comprehensive list of particulars in the statement (reg 10(2)), and non‑veterinarians may use products only strictly in the way stated (reg 14(2)). However, statements cannot be used to override label restraints or label precautions (reg 14(5)(a)), nor to permit injection when the label does not (reg 14(5)(b)). Failure to include the items listed in reg 10(2) or pass the statement to the usual person in charge (reg 15) attracts fines.

4. Withholding period conflicts: statement v label (reg 18)

• Pitfall: Assuming label always trumps. If a veterinarian’s written statement contains a withholding period that differs from the label, the vet’s statement is the applicable withholding period (reg 18(2)). This creates a practical risk: substituting a shorter vet‑specified withholding period might superficially enable earlier marketing of products but could increase liability if residues later exceed permitted levels. Conversely, a vet’s longer withholding period delays market access and may have commercial consequences.

5. Antibiotic use on bees requires Director approval (reg 9)

• Pitfall: Any antibiotic use on bees, hives or equipment by anyone, including veterinarians, requires prior written approval of the Director (reg 9(1)). Using antibiotics without that approval is an offence (reg 9(2)). Apiarists and vets must therefore factor in obtaining Director approvals before treating bees with antibiotics.

6. APVMA permits change the rulebook (reg 22(2))

• Pitfall: Overlooking APVMA permits as a lawful route. The Regulations exempt persons from Part 2 compliance when they possess, use or supply a product in accordance with an APVMA permit (reg 22(2)). People who assume State rules always apply may miss an opportunity to obtain a Commonwealth permit that provides a lawful alternative pathway.

7. Record retention and production obligations are strict and multi‑actor (regs 10(3), 16(1), 17(3), 19(4), 20(3))

• Pitfall: Underestimating documentary load. Veterinarians must retain copies of statements for three years (reg 10(3)). Recipients and users must retain statements and records for three years (regs 16(1), 17(3), 19(4), 20(3)). Inspectors may require production and take copies (regs 11(1), 16(2), 17(4), 19(5), 20(2)). Failing to produce on request is a separate offence with a $1,000 penalty (regs 11(2), 16(3), 17(5), 19(6)). Paperless or informal recordkeeping systems may not meet inspection requirements.

8. Supply by veterinarians restricted to professional practice (reg 8)

• Pitfall: Treating a veterinary business as just another retail channel. Vets must prescribe or supply products “in the course of the practice of his or her profession and for the purpose of dealing with a particular condition of an animal under the care of the veterinarian” (reg 8). This limits outside‑clinic sales or dispensing not tied to a treatment under their care.

9. Buyer notification when withholding applies (reg 20)

• Pitfall: Selling animals while a withholding period applies without written notice. If a treated animal is supplied before the withholding period elapses, the supplier must give the buyer written notice of treatment details and withholding period (reg 20(2)); both parties must retain copies for three years (reg 20(3)). The obligation attaches to the supplier and the buyer as recordkeeper.

10. Label restraint/precaution wording matters (reg 2(1), 14(1) and 14(5))

• Pitfall: Assuming ambiguous labelling can be effectively ignored. The Regulations define a label restraint and label precaution and forbid using a veterinarian’s statement to authorise conduct contrary to a label restraint or label precaution (reg 14(5)(a)). The specific words on a label (for example “do not”, “should not”, “must not”, “only”) have operational significance.

11. Certificates and analysis: formalities matter (regs 49-50; Forms 3-4)

• Pitfall: Relying on informal confirmations. The Regulations prescribe forms (Form 3 for inspector appointment and Form 4 for certificate of analysis) (regs 49-50). A defence or proof question in enforcement may turn on whether the correct formality was observed.

12. CVO and Director permissions: unspecified process and timing (regs 7 and 9)

• Pitfall: Expecting quick administrative approvals. The Regulations require “prior written permission” from the CVO or Director before certain uses (regs 7 and 9) but do not set statutory deadlines or appeal routes. Operational planning should include lead time for obtaining these permissions and contingencies if permission is refused or delayed.

13. Interaction with Medicines and Poisons Act 2014 (reg 2(1))

• Pitfall: Ignoring prescription mechanics. The Regulations define “prescribe” by reference to the Medicines and Poisons Act 2014 (reg 2(1)), so prescriptions must meet that Act’s requirements; failing to satisfy that Act potentially undermines compliance under these Regulations.

These “gotchas” highlight that compliance is technical and documentary as well as substantive, and that fines attach both to substantive misuse and to failures to co‑operate with inspections or keep required records. Practitioners and regulated parties should translate each gotcha into specific operational controls.

This section gives practical, source‑grounded steps to reduce legal risk and satisfy the Regulations’ requirements. Each suggested control maps to specific provisions cited. The approach is compliance by design: policies, documentation templates, responsibilities and escalation routes.

1. Vet practice policies and template statements (reg 10)

• Create a template for the veterinarian’s written statement that contains every item required by reg 10(2): species; amount; dosage; frequency; treatment period; manner of administration; presence and length of withholding period (if any); location and identification of the animal; identifying details; name of recipient; and owner name and address. Ensure the template requires the vet to attest to the withholding period used where it differs from the label (reg 18(2)).
• Ensure the vet gives the written statement to the person for whom the product is prescribed or supplied at the time of supply, and retain a signed copy in a central practice file for at least three years (reg 10(3)). Maintain an audit trail with date/time stamps.

2. Recordkeeping systems (regs 10(3), 16(1), 17(3), 19(4), 20(3))

• Maintain secure digital or physical record systems that preserve statements and treatment records for three years. Records must include product name, active constituent (if product unnamed), dosage, dates, animal identifiers and treatment details per regs 17(1)-(3) and 20(2).
• For treated animals, implement identification systems that meet reg 19: ensure animals are identifiable during treatment and withholding, either individually or as a clearly defined group. Retain identification logs for three years.

3. Guidance on off‑label and unregistered product use (regs 4-7, 14)

• Veterinarians: before using off‑label or unregistered products on trade species animals, check whether label instructions for injection or use exist. If off‑label use is contemplated on trade species animals, confirm whether the label mentions instructions for a major trade species animal or whether the use will be on a single major trade species animal or a non‑major trade species animal (reg 4(1)). If ambiguity exists, consult the CVO for prior written permission (reg 7).
• Non‑veterinarians: do not use unregistered products on trade species animals unless the use is authorised in a vet’s written statement (reg 14(6)). For registered products, only use off‑label in exact accordance with a vet’s written statement, and do not rely on statements to override label restraints or to permit injection where the label does not (reg 14(5)).

4. Low‑risk chemical route (reg 6)

• If considering an unregistered product constituted wholly of a low‑risk chemical (bicarbonate soda; common salt; or a reserved chemical product under the Agvet Code), document the absence of a pharmacologically equivalent registered product being reasonably available, and record the rationale that justifies use under reg 6(2).

5. Permits and authorisations (regs 7, 9, 22)

• CVO permission: When intending to use registered products other than as stated on the label or intending to use an unregistered product on a trade species animal, obtain prior written permission from the CVO (reg 7). Maintain a file documenting the request and the written permission.
• Director approval for bees: For any use of antibiotics on bees, hives or apiary equipment, secure the Director’s prior written approval (reg 9). Treat any use without that approval as an offence.
• APVMA permit: Where appropriate, obtain an APVMA permit to operate under Commonwealth authorisation; if a permit applies, confirm in writing that the APVMA permit covers the intended possession, use or supply and retain a copy as evidence that Part 2 obligations are displaced for that product (reg 22(2)).

6. Supply practices and vet dispensing (reg 8)

• Ensure prescriptions and supplies by veterinarians are part of clinical care “in the course of the practice” and are linked to a recorded clinical condition for an animal under the veterinarian’s care (reg 8). Avoid ad hoc retailing of veterinary chemicals that is not tied to clinical practice.

7. Buyer notifications and sales processes (reg 20)

• Implement a written notice form for sales of trade species animals where a withholding period is active. The notice must state the withholding period or date it elapses, product name or active constituent, animal identification details and the date of treatment (reg 20(2)). Keep copies for three years (reg 20(3)).

8. Inspection readiness (regs 11, 16, 17, 19, 20)

• Train staff to respond to inspector requests promptly and to produce statements and records on demand. Designate a compliance officer responsible for managing inspector interactions and maintaining certified copies of Forms 3 or other appointment evidence (reg 49) if requested.
• Establish a procedure for handing copies to an inspector; document the chain of custody for any documents copied by an inspector.

9. Withholding period decision logic (reg 18)

• When preparing a vet’s written statement, clearly state the withholding period and, if it differs from label guidance, document the scientific or professional basis for the veterinarian’s determination because reg 18(2) makes the vet’s statement the applicable withholding period when there is a difference.
• For buyers and sellers, ensure the withholding period is tracked in inventory and sale systems to prevent accidental slaughter, harvest or sale before the period elapses (reg 21).

10. Handling of bee antibiotic treatments (reg 9)

• Apiarists should incorporate the Director approval requirement into their treatment planning. Maintain documentary evidence of the Director’s written approval alongside antibiotic stock records.

11. Use of human pharmaceuticals or agricultural chemicals (reg 2(1), reg 13)

• Treat these products as unregistered veterinary chemical products. Non‑veterinarians should not use them on trade species animals except where a vet’s statement permits it under reg 14(6). Vets should ensure the prescription complies with the Medicines and Poisons Act 2014 (reg 2(1) definition of “prescribe”).

12. Audit and review

• Conduct periodic compliance audits focused on: existence and accuracy of vet statements (reg 10), retention and accessibility of three‑year records (regs 10, 16, 17, 19, 20), proper identification of treated animals (reg 19), and buyer notice records (reg 20). Document corrective actions and improvements.

13. Legal advice and administrative appeals

• If CVO or Director permission is refused or delayed, seek advice on administrative review avenues under Western Australian administrative law. For complex situations involving cross‑jurisdictional permits (APVMA), obtain both Commonwealth and State‑level regulatory advice.

14. Templates and standard operating procedures to reduce error

• Use standardised templates for vet statements, buyer notices, treatment logs and identification tags to ensure all required fields from reg 10(2), reg 20(2) and reg 17(1) are consistently filled.
• Record retention: implement automatic retention rules in practice management software for three years; if paper records are used, maintain an indexed filing system.

Adopting these concrete controls, mapped to the relevant Regulations, will address most of the documentary and procedural obligations created by the Regulations and reduce the risk of substantive breaches that carry $5,000 fines and documentary non‑compliance fines of $1,000.
