What it does
This instrument is the Vehicle Standard titled Australian Design Rule 80/00 - Emission Control for Heavy Vehicles (ADR 80/00). It commences the day after registration (cl 0.2.1) and repeals any pre-existing instruments and amendments that bear the same name and that were made under s 7 of the Motor Vehicles Standards Act 1989 and were in force at commencement (cl 0.3.1-0.3.2). Mechanically, the Standard prescribes exhaust emissions requirements for engines used in heavy vehicles in order to reduce air pollution (cl 1.1). It does this by specifying which technical standards an engine must meet to be "accepted as complying" with ADR 80/00 (see cl 4.1-4.3 and cl 6).
The Standard applies to vehicles in categories M and N with a gross vehicle mass greater than 3.5 tonnes (cl 2.1). It phases in application by fuel type and whether the vehicle is a "new model" or not, using specified commencement dates (cl 2.2 and cl 2.3). It contains a carve out for certain "special omnibuses" within the ME category by reference to pre-existing approvals under s 10A(1) of the Motor Vehicle Standards Act 1989 (cl 2.4). The Standard accepts compliance via a set of specified technical routes: Appendix A (with tables and Annex I references) for diesel, LPG and natural gas engines (cl 4.1-4.2); specified United States Code of Federal Regulations provisions for petrol engines (cl 4.3); and a number of internationally recognised instruments are treated as alternative but equivalent technical standards (cl 6.1-6.4).
A small number of procedural clarifications are included. Administrative processes associated with EC or US EPA approvals are stated not to apply to this Standard (cl 5.1). Where ADR 79/01 is used as an alternative compliance route, clause 4.2 of ADR 79/01 applies regardless of fuel type (cl 5.3). The Standard also states precedence rules: to the extent of any inconsistency, the applicability dates in clause 2.2 prevail over dates in Appendix A (cl 2.5). Vehicles already complying with ADR 80/01 are exempt from complying with this Standard (cl 2.6).
