What it does
This instrument prescribes emissions limits and the technical testing regime for light vehicles in Australia, as the Vehicle Standard (Australian Design Rule 79/03 , Emission Control for Light Vehicles) 2011 (ADR 79/03). It sets scope, applicability dates and key technical equivalences, and identifies which parts of the underlying Appendix A testing and conformity framework are to apply, and which are excluded or varied.
Mechanically, the Standard requires that vehicles “which comply with the emissions limits and technical requirements of Appendix A” and complete “all the applicable tests specified in paragraph 5.2 of Appendix A” (as varied by Part 5 of this Standard) will be accepted as complying with ADR 79/03 (clause 4.1). The Standard applies to M and N category vehicles with Gross Vehicle Mass less than or equal to 3.5 tonnes (clause 2.1). Applicability for “new model vehicles” begins from 1 November 2013; a “new model vehicle” for clause 2.2 is defined by the date the vehicle is available in Australia in a condition enabling lawful affixation of an identification plate (clause 2.2, 2.3; definition in clause 3.1).
The Standard explicitly excludes a number of procedural and administrative parts of Appendix A from applying to this vehicle standard (clause 5.1). That list includes application and approval procedures (Sections 3 and 4 of Appendix A), conformity of production and in-service conformity sections (Sections 8 and 9), penalties for non-conformity (Section 10), and various appendices that set out conformity verification and in-service checking procedures. Clause 5.3 then qualifies that, despite those exclusions, the requirements and procedures set out in those appendices are nevertheless “deemed acceptable” for demonstrating compliance with the conformity requirements of this vehicle standard. The Standard also provides targeted technical variations and exemptions: for example it permits the use of ADR 79/02 particulate test procedures in lieu of Annex 4a, with an associated particulate mass limit of 5 mg/km (clause 5.4), exempts diesel vehicles from the particle number limit in column L6 of Table 1 of paragraph 5.3.1.4 of Appendix A (clause 5.5), and limits Type VI testing for flex fuel ethanol vehicles to the petrol (E5) reference fuel (clause 5.6, as substituted by Amendment 1).
