What it does
This notice creates a time-limited, statewide exemption for a narrowly defined class of trailers described as "light aircraft pig trailers" from two specific provisions of the Vehicle Operations Regulations, subject to an enumerated set of conditions. The operative exemption is in clause 5(2): regulations 13 and 14(3) of the Vehicle Operations Regulations do not apply to a person using, or causing or permitting the use of, a light aircraft pig trailer, but only if the trailer and its use meet the conditions listed in clause 5(3). The notice takes effect on 1 December 2024 and the exemption remains in force for three years from that date (clause 2; clause 4(c)). The exemption applies across the whole State and at all times of day (clause 4(a)-(b)).
Mechanically, the notice does four things. First, it defines the items to which the exemption can apply: "light aircraft", "light aircraft pig trailer" and a related technical term "down force" (clause 3(1) and clause 5(1)). Second, it disapplies two specified regulatory provisions for users of the qualifying trailers (clause 5(2)). Third, it sets out a list of mandatory conditions that must be satisfied for the exemption to be available, covering towing vehicle class, permissible loads, mandatory down force while being towed, limits on rear overhang and combined length, signage and lighting obligations, daytime headlight use, a daylight red-flag requirement and night marker requirements linked to an external schedule in the Vehicle Operations Regulations (clause 5(3)(a)-(k)). Fourth, it includes a grandfathering clause exempting certain pre-existing registered trailers from one of the dimensional requirements (clause 5(4)).
The notice does not amend the Vehicle Operations Regulations or the Vehicle and Traffic Act. Instead it operates as an exemption notice that alters the application of particular regulatory provisions to the specified class of trailers while the notice is in force (clause 5(2); clause 4). It also expressly imports definitions from the Vehicle and Traffic Act 1999 and the Vehicle Operations Regulations where those instruments define terms used in this notice (clause 3(2)). The Acts Interpretation Act 1931 is declared applicable to interpretation of the notice (clause 3(3)). The Transport Commission made the notice at its meeting of 13 November 2024; the Commission’s seal was affixed on that date and the notice was gazetted on 20 November 2024 (signature and publication statements at the end of the instrument).
