Unit Titles (Management) Regulation 2011

Several recurring legal concepts and operational mechanisms structure the regulation’s provisions. Understanding these is necessary to interpret duties, compliance obligations and limits on parties’ choices.

Owners corporation and units plan: The regulation presumes terms defined in the Unit Titles (Management) Act 2011 and the Unit Titles Act 2001, including the concepts of an owners corporation, a units plan and a unit. The regulation’s dictionary and signpost definitions direct the reader to those Acts for core definitions (see s 2 and Dictionary notes).

Maintenance plan and developer’s maintenance schedule: A maintenance plan is a document the Act requires; the regulation prescribes specific content (s 4A). That content is focused on systems and structures on common property that require maintenance and inspection to avoid damage or failure (s 4A(a)(i)-(vix)). The developer’s maintenance schedule must mirror this content and additionally include warranties, manuals and the names and contacts of manufacturers and installers where available (s 4B(a)-(d)). These function as both operational plans and information repositories to manage long-term common-property assets.

Default rules and alternative rules: The regulation declares the default rules for an owners corporation (s 7A) and enumerates those rules in Schedule 1. The default rules set baseline obligations for owners and occupiers: payment of rates and taxes (rule 1.2), repair and maintenance duties (rule 1.3), controls on erections and alterations (rule 1.4), animals and assistance-animal rules (rules 1.5-1.6), use of common property and nuisance controls (rules 1.7-1.11), and executive committee representative powers (rule 1.12). The regulation also prescribes the limited scope for alternative rules: they may only modify default rules 1.4, 1.5 and 1.6, and must contain particular material if they change contribution methods to general or sinking funds (s 7B(1)-(2)).

Insurance and financial thresholds: The regulation prescribes minimum public liability insurance levels of $10 000 000 for managers (s 5) and owners corporations (s 7). It prescribes $10 000 as an amount relevant to exemption from building insurance requirements (s 6). It also prescribes a corporate-register access fee cap of $10 plus GST (s 8) and caps recoverable legal costs in certain proceedings (s 9).

Voting and meeting procedures: The regulation authorises alternative voting mechanisms for owners corporations at general meetings, including teleconference, videoconference and pre-meeting electronic voting (s 10(1)). It imposes safeguards: owners corporations must ensure reasonable access to facilities and provide information about access in the notice of meeting (s 10(2)); it restricts amendments to motions decided wholly or partly by pre-meeting electronic voting and requires minutes to note any changes and provide the power to request a further general meeting if pre-meeting voting is partly used and the motion is amended (s 10(3)-(5)).

Auditor eligibility: The regulation prescribes acceptable auditor qualifications, including Australian professional bodies with public practice certificates and registered company auditors who hold current professional indemnity insurance (s 12). This aligns audit eligibility with recognised professional standards and insurance safeguards.

Executive committee representative powers: Schedule 1 rule 1.12 gives representatives the power to inspect units to investigate suspected breaches, to carry out maintenance required under the Act or rules and to do other things owners corporations are required to do. Entry is permitted at reasonable times, with prior notice required except in emergencies (rule 1.12(1)-(3)). The regulation defines “executive committee representative” as a person authorised in writing by the executive committee (Schedule 1, rule 1.12(4)).

Statutory interaction and reliance: The regulation repeatedly references the Act and other territory laws for operation and for signpost definitions, making it a primarily technical instrument setting parameters and procedure rather than creating freestanding rights or remedies. It also makes clear that criminal liability for offences is governed by the Criminal Code chapter 2 (s 4).

The regulation allocates roles, obligations and costs among a defined set of actors: owners corporations, unit owners and occupiers, developers, managers, executive committee representatives, auditors and service providers such as manufacturers and installers. Who pays and who decides are explicit in several provisions.

Owners corporations: They are responsible for adopting maintenance plans and ensuring the declared maintenance items are managed and inspected (s 4A). They must hold the prescribed minimum public liability insurance if the Act requires it (s 7). They decide by special resolution whether to grant permission for erections and alterations affecting units or common property, except where the regulation requires that permission not be unreasonably withheld for sustainability infrastructure (Schedule 1, rule 1.4(1)-(3)). Owners corporations adopt default or alternative rules; alternative rules are constrained by s 7B and may only modify certain default rules (s 7B(1)(a)). Owners corporations set reasonable access arrangements for pre-meeting electronic voting and provide information about access with the meeting notice (s 10(2)).

Unit owners and occupiers: Unit owners must pay rates, taxes and other amounts payable for their unit (Schedule 1, rule 1.2). They must keep their units in good repair and comply with territory laws (rule 1.3). A unit owner who keeps a pet must comply with the pet rules, including the limit of three animals other than caged birds or aquarium fish, supervision and cleaning obligations, and a 14-day written notice requirement to the owners corporation (rule 1.5(1)-(2)). Owners and occupiers may be required to allow entry to an executive committee representative for inspection or maintenance, subject to notice requirements (rule 1.12(1)-(3)). Owners or occupiers who wish to make erections, alterations or keep assistance animals should be aware of the permission, evidence and conditions rules in Schedule 1 (rules 1.4, 1.6).

Developers: Developers must produce a maintenance schedule containing the items set out in s 4A(a)(i)-(vix) and, where available, give warranties, manuals and installer/manufacturer details to satisfy s 4B(a)-(d). That places an information-provision obligation on developers at the creation or sale stage of units plans.

Managers: A manager is required to have minimum public liability insurance of $10 000 000 (s 5). The regulation prescribes this as the statutory minimum for managers acting under the Act.

Executive committee representatives: The executive committee is able to authorise representatives in writing to exercise inspection and entry powers under rule 1.12. That authorisation gives them the legal power to enter units at reasonable times with notice or without notice in emergencies (Schedule 1, rule 1.12(2)-(3)).

Auditors and accounting professionals: The audit qualification provision (s 12) prescribes who may conduct audits under the Act , members of Chartered Accountants Australia and New Zealand holding a Certificate of Public Practice, members of CPA with a Public Practice Certificate, members or fellows of the Institute of Public Accountants, and registered company auditors registered with ASIC who hold current professional indemnity insurance. That restricts who owners corporations may engage for statutory audits and imposes an insurance requirement for company auditors.

Insurers, manufacturers and installers: The regulation requires the inclusion of warranties and contact details in maintenance plans and developer schedules if reasonably available, making manufacturers and installers sources of information for common-property asset management (s 4A(b); s 4B(b)-(d)). Insurers are implicated by the statutory minimum insurance amounts for managers and owners corporations (s 5; s 7).

Other affected parties: Providers of electronic voting platforms and meeting-facility providers are relevant where an owners corporation adopts teleconference or pre-meeting electronic voting under s 10. Their role is procedural but consequential since owners corporations must provide reasonable access and information with notices.

Who pays and who decides: Unit owners pay rates, taxes and ordinary unit-specific expenses (Schedule 1, rule 1.2). Owners corporations decide on permissions, special privileges and withdrawal of permissions by special resolution (Schedule 1, rules 1.4(1)(a), 1.9(3)-(4), 1.10(3)). The regulation prescribes certain payment caps and fees that affect owners corporations’ transactional income (s 8; s 9).

The regulation sets out precise duties for several actors and recognises particular rights. The obligations are mostly administrative and procedural; compliance is often supported by documentary requirements.

Maintenance plan duties (s 4A): An owners corporation’s maintenance plan must include a plan for maintenance and inspection of systems, equipment, structures and other things on the common property if maintenance and inspection are reasonably required to avoid future damage or failure. The list of specific items includes exterior walls, guttering, downpipes and roof, pools and surrounds and pool fencing, HVAC systems, lifts, fire protection equipment including sprinkler systems and smoke detectors, security access systems, electric vehicle charging stations and associated infrastructure, embedded networks and micro-grids, solar panels and associated equipment and other sustainability infrastructure (s 4A(a)(i)-(vix)). The maintenance plan must also include, where provided by the developer or reasonably available, warranties, manufacturer maintenance manuals and the names and contact details of manufacturers and installers (s 4A(b)(i)-(iii)). Practically, the duty is to prepare and maintain a document that both plans maintenance cycles and records relevant warranty and contact information.

Developer’s schedule duties (s 4B): Developers must supply a maintenance schedule that contains the maintenance and inspection schedule required under s 4A for the listed items (s 4B(a)), include warranties and manuals (s 4B(b)-(c)) and the name and contact details of manufacturers and installers (s 4B(d)). This places an information disclosure obligation on developers to facilitate later asset management.

Insurance duties (s 5, s 6, s 7): Managers must hold public liability insurance of $10 000 000 (s 5). An owners corporation’s minimum public liability insurance is also $10 000 000 (s 7). The regulation prescribes $10 000 as the amount relevant to an exemption from building insurance requirements under the Act (s 6). Those duties translate into premium costs, policy procurement and administrative evidence obligations.

Default-rule duties (Schedule 1): Unit owners must pay rates, taxes and other amounts payable for the unit (rule 1.2). They must keep their units in good repair and carry out work required by territory law (rule 1.3). Owners must not carry out erections or alterations without express permission by special resolution and compliance with territory laws, except that permission for sustainability infrastructure must not be unreasonably withheld (rule 1.4(1)-(3)). Pet owners face limits and obligations including notification within 14 days (rule 1.5). Assistance animals may require evidence to be produced (rule 1.6). Rules 1.7-1.11 restrict uses that cause nuisance, hazard, or contravene law, and set noise standards subject to possible executive committee permission. Executive committee representatives have powers to inspect and enter units on reasonable notice or in emergencies and must be authorised in writing (rule 1.12).

Voting rights and process constraints (s 10): Owners corporations may adopt electronic or pre-meeting voting methods (s 10(1)). However, members must be given reasonable access to facilities and information about access must accompany the notice of the meeting (s 10(2)). Motions decided entirely by pre-meeting electronic voting may not be amended at the general meeting (s 10(3)). Motions decided partly by pre-meeting electronic voting may not be amended at the meeting where the effect is to change the subject matter (s 10(4)), and if partly decided by pre-meeting electronic voting and amended at the meeting, the minutes must be accompanied by a notice of change and a statement setting out the power to request a further general meeting (s 10(5)).

Rights to inspection and entry (Schedule 1, rule 1.12): Executive committee representatives have a right to inspect and enter units at reasonable times for specified purposes, subject to notice or emergency exceptions (rule 1.12(1)-(3)). The representative must be authorised in writing (rule 1.12(4)). This creates a limited regulatory right to enter private unit space for compliance, maintenance and enforcement purposes.

Alternative-rule constraints (s 7B): Where alternative rules propose a method for working out general fund or sinking fund contributions that is not proportionate to the unit’s proportional share, the alternative rule must set out the method and the underlying principle and be fair, taking into account the structure of the units plan, building features, unit uses and the burden imposed on units (s 7B(1)(b)(i)-(ii); s 7B(2)(a)-(d)). Alternative rules may only modify default rules 1.4, 1.5 and 1.6 (s 7B(1)(a)).

Audit rights and duties (s 12): The regulation prescribes who may act as auditor for statutory audit purposes. The names of acceptable professional designations are given, and registered company auditors must hold current professional indemnity insurance (s 12(a)-(d)). This prescribes both eligibility and an insurance safeguard.

Financial caps and procedural rights: The regulation caps corporate register access fees at $10 plus GST (s 8) and prescribes the amount recoverable as costs in certain legal actions as the lesser of $750 per unit and $10 000 (s 9). Those are financial rights and constraints that affect access to records and litigation economics.

Criminal liability (s 4): Offences under the regulation are subject to the Criminal Code chapter 2, which sets out general criminal responsibility, burdens of proof and defences (s 4). The regulation does not list its own pecuniary penalties directly for each contravention in the body text; instead it references the general operation of the Criminal Code and penalty units as defined in the Legislation Act (s 4 and prefatory material).

The regulation’s enforcement model is a mixture of administrative powers, statutory duties and criminal liability as framed by other instruments. The regulation itself does not set out a schedule of bespoke pecuniary penalties within its operative text; rather it links offences against the regulation to the Criminal Code and references the Legislation Act for the monetary value of penalty units.

Criminal Code applicability (s 4): Section 4 states that “other legislation applies in relation to offences against this regulation” and specifically notes that the Criminal Code chapter 2 applies to all offences (s 4 and accompanying notes). That imports the Code’s general principles of criminal responsibility including standards for intention, recklessness and strict liability, and the general defences the Code provides. The practical effect is that any offence under the regulation will be treated under the general criminal framework rather than by a bespoke subordinate-law sanction regime.

Penalty-unit values (prefatory material): The republication preface states that at the republication date the value of a penalty unit for an offence against this law is $160 for an individual and $810 for a corporation, referencing the Legislation Act 2001, s 133. Those monetary figures apply where penalty-unit-denominated sanctions arise. The regulation itself does not create distinct penalty unit counts for specific contraventions in the text provided; the prefatory note therefore supplies the present-day unit values that apply generally.

Administrative enforcement and processes: Several enforcement mechanisms are administrative in nature. For example, the executive committee representative has a right to inspect units and to enter and remain in a unit for as long as necessary to investigate suspected breaches, carry out required maintenance or do anything else the owners corporation is required to do (Schedule 1, rule 1.12(1)-(2)). Entry must be preceded by reasonable notice except where an emergency makes notice impracticable (rule 1.12(3)). An owners corporation may give written authority to a person to act as an executive committee representative (rule 1.12(4)). These powers give owners corporations direct enforcement and compliance options rather than requiring immediate recourse to courts or criminal process.

Owners corporation decision-making sanctions: The default rules permit the owners corporation, by special resolution, to give and withdraw permissions for certain uses (schedule 1, rules 1.4(1)(a), 1.9(3)-(4), 1.10(3)). Withdrawal of permission by special resolution is a governance mechanism; enforcement follows internal governance decisions which may then be supported by actions such as notices to owners or, if necessary, external legal proceedings.

Civil cost caps affecting enforcement economics (s 9): Section 9 prescribes amounts for the costs of taking legal action under the Act as the lesser of $750 for each unit in the units plan and $10 000. Where the Act or schedule conditions a party to pay the costs of legal action, that cap limits exposure and can alter enforcement behaviour by constraining recovery. It affects the economics of pursuing litigation to enforce by-laws and common-property obligations.

Record access and fee limitations (s 8): Section 8 prescribes a maximum fee of $10 plus GST for access to the corporate register. That limits revenue an owners corporation can generate when providing register access, potentially affecting the incentive to supply records promptly. However, the fee cap reduces the cost barrier for parties seeking corporate information as part of compliance or enforcement actions.

Insurance and risk allocation: The requirement that managers and owners corporations carry $10 000 000 public liability insurance (s 5; s 7) does not itself enforce compliance with rules but ensures that certain organisational actors have insurance capacity to meet liabilities that could arise from breaches, accidents or claims. Registered company auditors must hold current professional indemnity insurance (s 12(d)), which allocates risk for audit failures.

Procedural constraints on electronic voting (s 10): The regulation constrains the use of pre-meeting electronic voting by preventing amendment of motions resolved wholly by pre-meeting electronic voting and restricting amendments that change the subject matter for motions partly decided by pre-meeting voting (s 10(3)-(4)). The procedural safeguards, combined with notice and access requirements (s 10(2)), are intended to protect the integrity of decisions made through electronic means. Enforcement in this context would be procedural , minutes must reflect changes and a statement of rights to request a further meeting must be provided where required (s 10(5)).

Interaction with territory laws and statutory approvals: Several obligations tie compliance to other regulatory schemes. For example, alterations and erections must comply with applicable territory laws, such as development-approval requirements (Schedule 1, rule 1.4(1)(b)). Non-compliance with territory law may attract separate enforcement regimes beyond the regulation itself.

In sum, enforcement is achieved through a combination of the Criminal Code framework for offences, internal governance powers of owners corporations, statutory caps and procedural safeguards, and insurance and audit requirements that allocate financial risk. The regulation sets administrative and procedural enforceable duties; where criminal sanction is an option, the general criminal framework governs how that sanction is applied.

The regulation is explicitly integrative. It relies on and cross-references several other statutory instruments and legal regimes. The principal interactions are with the Unit Titles (Management) Act 2011, the Unit Titles Act 2001, the Criminal Code, the Legislation Act 2001 and territory laws regulating development and building. The regulation also interfaces with Corporations Act-related processes by prescribing auditor qualifications tied to ASIC registration.

Reference to the parent Act and the Unit Titles Act: The regulation is made under the Unit Titles (Management) Act 2011 and repeatedly points readers back to the Act for the substantive authority for many requirements (for example, s 4A references “Act, s 24(3)” and s 4B references “Act, s 25(2)”). The regulation’s Dictionary signposts definitions to the Unit Titles Act 2001 for concepts such as “unit” and “units plan” (see s 2 and Dictionary entries). This cross-referencing shows that the regulation sets operational detail that implements obligations, powers and definitions originating in the Acts.

Criminal Code and Legislation Act: Section 4 makes offences against the regulation subject to Criminal Code chapter 2, meaning the Code’s general definitions and principles apply to any criminal charge. The prefatory material and commentary to the republication specify penalty unit values under the Legislation Act 2001, s 133. Therefore, criminal procedure and penalty-unit valuation are supplied by those other instruments.

Territory law and development approvals: Schedule 1 rule 1.4(1)(b) requires that erections and alterations be in accordance with any applicable territory law, such as development approval requirements. Rule 1.3(2) also requires unit owners to carry out work required by a territory law. That imports the planning, building and safety regulatory ecosystem into the compliance obligations of owners and owners corporations.

Corporations Act and ASIC registration: Section 12(d) prescribes that a “registered company auditor” must be registered under the Corporations Act with ASIC and must hold current professional indemnity insurance. That links the regulation’s audit requirements to federal corporations law and ASIC’s oversight functions.

Insurance market interaction: The regulation’s $10 000 000 public liability prescriptive minimums for managers and owners corporations (s 5; s 7) interact with insurance markets by setting a baseline policy capacity that insurers must be able to underwrite. The $10 000 building insurance exemption threshold (s 6) may interact with building-insurance policy design and claims thresholds under broader insurance law or market practice.

Administrative and records law: The corporate register access fee limitation (s 8) interacts with the owners corporation’s recordkeeping and information-access obligations established in the parent Act. By prescribing a maximum fee, the regulation affects the practical accessibility of statutory records to stakeholders.

Electronic communications and meetings law: The voting provisions (s 10) intersect with corporate governance practice and communications law, by legitimising electronic voting mechanisms while setting procedural safeguards. Owners corporations using pre-meeting electronic voting must ensure reasonable access and provide accompanying information with meeting notices, which may interact with other statutory notice requirements in the Act.

Default rules and other statutory instruments: The default rules (Schedule 1) are adopted into the Act’s framework as the baseline rules for owners corporations; alternative rules are permitted but constrained by s 7B of the regulation, which itself is embedded in the Act’s dictionary for “default rules”. That establishes a hierarchy where the Act sets the legal framework, the regulation sets default content, and properly adopted alternative rules may depart from that content within the regulation’s limits.

In short, the regulation is not standalone; compliance requires concurrent attention to the Act, the Unit Titles Act, criminal law, territory law (including development and building laws) and professional regulation surrounding auditors and insurance. Practitioners should treat the regulation as detailed implementation guidance that must be read in the context of those other statutes.

The republication and endnotes record the regulation’s creation in 2011 and several subsequent amendments that added substantive content and updated operational settings.

Creation and initial commencement: The Unit Titles (Management) Regulation 2011 was made as part of the Unit Titles (Management) Act 2011 and taken to have been notified on 3 November 2011. Section 1 commenced on 3 November 2011 and the remainder of the regulation commenced on 30 March 2012 (see Endnotes: Legislation history).

Key amendment insertions in 2020: Several important provisions were inserted by the Unit Titles Legislation Amendment Act 2020 (A2020-4) and associated subordinate instruments. In particular, sections 4A (maintenance plan) and 4B (developer’s maintenance schedule) were inserted by A2020-4, s 143 (noted in the amendment history). The default rules Schedule 1 was inserted by A2020-4, s 146. Section 7A (declaring the default rules) and 7B (alternative rules requirements) were inserted by A2020-4, s 144. Section 10 (owners corporation alternative voting methods) was inserted by A2020-4, s 145. These 2020 amendments introduced the maintenance-plan regime, default rules and electronic-voting mechanisms that now form central parts of the regulation.

Temporary emergency provisions and expiry: A 2020 subordinate law (SL2020-17) inserted section 11 concerning exemptions for meetings during a public health emergency declaration period. The amendment history notes that s 11 was inserted by SL2020-17 but expired on 29 September 2022, indicating the temporary emergency measure has lapsed (see amendment history endnote).

Subsequent 2020 subordinate amendments: SL2020-43 inserted the audit qualification requirement provision (s 12) and made dictionary changes (SL2020-43 s 4). The amendment history records these insertions as part of the 2020 package of changes.

2023 amendments: The Unit Titles Legislation Amendment Act 2023 (A2023-24) amended Schedule 1, rule 1.4 (erections and alterations). The amendment history cites A2023-24 s 43 and s 44 as amending provisions affecting the alternative-rule constraints and Schedule 1, rule 1.4 respectively.

2025 technical amendments: The Statute Law Amendment Act 2025 (A2025-29) made further changes recorded in the amendment history. It shows that sch 3 part 3.96 commenced 26 November 2025 and that s 12 (audit qualification requirement) was amended by A2025-29 amdt 3.348 and the dictionary was amended by A2025-29 amdt 3.349. The republication date is 26 November 2025.

Republication record: The endnotes provide a chronology of republications and effective ranges: R1 effective 30 Mar 2012; R2 effective 1 May 2020; R3 effective 1 Nov 2020; R4 effective 30 Sep 2022; R5 effective 1 Jul 2023; and the current republication R6 effective 26 Nov 2025. Each republication entry in the endnotes lists the instrument that produced the amendment and the commencement dates for the amendments.

Nature of the 2020 package: The 2020 amendments (A2020-4 and associated SL instruments) introduced the maintenance plan/developer schedule regime, default rules, alternative rule constraints, electronic voting, and the audit qualification prescription. These are substantive reforms aimed at clarifying operational obligations for owners corporations, developers and managers.

Summary of amendment loci by section references: s 4A and s 4B (inserted A2020-4 s 143); s 7A and s 7B (inserted A2020-4 s 144; s 7B amended A2023-24 s 43); s 10 (inserted A2020-4 s 145); s 11 (inserted SL2020-17; expired); s 12 (inserted SL2020-43; amended A2025-29 amdt 3.348); Schedule 1 inserted by A2020-4 s 146 and amended by A2023-24 s 44; and dictionary amendments by A2020-4 s 147 and A2025-29 amdt 3.349.

Practitioner implication: The amendment history shows the regulation has been used to implement both structural governance measures (default rules and alternative-rule constraints) and operational matters (maintenance plans, insurance minima and voting procedures). The recent insertions and amendments should prompt practitioners to check effective dates carefully, since some provisions were temporary or phased in by different instruments, and to verify whether any future amendments or uncommenced provisions exist beyond the republication date.

The regulation’s republication does not record any reported litigation arising directly under its provisions. The text contains no case citations and the endnotes do not list judicial decisions or disputes concerning the regulation’s provisions. The absence of a litigation history in the republication indicates that no cases are recorded in this document as having interpreted, struck down or otherwise tested the regulation’s clauses.

That absence should not be read as legal certainty on all points. The regulation incorporates and interacts with other statutory regimes such as the Unit Titles (Management) Act 2011, the Unit Titles Act 2001, the Criminal Code, territory development and building laws, and company/audit regulation under federal law. Disputes about the application of default rules, the reasonableness of withheld permissions (for example, for sustainability infrastructure under Schedule 1, rule 1.4(3)), fairness of alternative contribution methods under s 7B(2), or the validity and process of pre-meeting electronic voting under s 10 may nevertheless arise and be adjudicated under the parent Acts or in civil courts.

Given the regulation’s emphasis on duties that touch private rights and obligations , such as owner entry, permission for alterations, and treatment of assistance animals , questions about procedural fairness, notice, and the limits of executive committee powers could become issues in litigation under the Act. Any litigation would therefore likely involve both the regulation and the Act’s provisions, and might implicate administrative law principles, contract and property law, and statutory construction issues.

Practitioners preparing litigation or advice should therefore treat the absence of recorded litigation in this republication as a signal to search case law databases and tribunal decisions for matters decided under the parent Acts or under related statutory frameworks, rather than as evidence that the provisions are uncontroversial or untested.

The regulation contains detail that can produce practical compliance traps, ambiguous drafting risks and transactional consequences. Below are specific points practitioners and compliance officers should watch closely, each grounded in the regulation’s text.

1. Maintenance-plan scope and “reasonably required” threshold (s 4A(a)): The maintenance plan must include maintenance and inspection for systems and structures on common property if maintenance and inspection are reasonably required to avoid future damage or failure. The “reasonably required” threshold is fact‑sensitive and may produce disputes about whether an item must be included. Practitioners should document the basis for including or excluding items from the plan.

2. Explicit asset list includes new technology items (s 4A(a)(vii)-(vix)): The list explicitly identifies electric vehicle charging stations, embedded networks and micro‑grids, solar panels and “any other sustainability infrastructure” (s 4A(a)(vii)-(vix)). Owners corporations and developers must account for evolving technologies. The textual numbering includes “(vix)” which appears to be non‑standard; treat the list as inclusive of the items named rather than relying on numbering consistency.

3. Developer information obligations are limited by availability (s 4A(b); s 4B(b)-(d)): The maintenance plan and developer schedule must include warranties, manuals and installer/manufacturer contacts “as provided by the developer or as reasonably available”. If the developer lacks those items, an owners corporation may face a documentation gap. Developers should proactively compile and hand over these materials to avoid gaps.

4. Insurance minima are high and identical for managers and owners corporations (s 5; s 7): The $10 000 000 public liability minimum increases premium cost and may affect the market for managers willing to accept appointments. Managers and owners corporations must budget for these premium costs and ensure documentary proof of cover is available for compliance and contracting.

5. Building insurance exemption threshold ($10 000) may be misunderstood (s 6): The regulation prescribes $10 000 as the amount relevant to an exemption from building insurance requirements. Parties should not assume the exemption applies beyond the limited statutory context; confirm the parent Act’s conditions for any exemption.

6. Alternative rules limited in scope (s 7B(1)(a)): Alternative rules may only modify default rules 1.4 (erections and alterations), 1.5 (pets) and 1.6 (assistance animals). Attempts to use alternative rules to alter other default obligations or to materially change governance outside those rules may be invalid. Proposed alternative rules that change contribution methods must include the method and principle and be “fair” taking specified factors into account (s 7B(1)(b)-(2)). The fairness requirement is multi-factorial and will require documentation justifying the method.

7. Contribution‑method fairness test is fact specific (s 7B(2)): The regulation requires fairness taking into account structure, building nature, unit uses and burdens on units. Implementing a non-proportional contribution method therefore requires evidentiary support and a justification narrative. Practitioners should prepare analyses of building features, unit use patterns and cost allocation effects.

8. Electronic voting limitations and amendment rules (s 10(3)-(5)): Pre-meeting electronic voting cannot be used where the meeting intends to amend motions decided wholly by pre-meeting voting, and amendments that change the subject matter are similarly constrained where pre-meeting voting is partly used. Owners corporations must ensure voting platforms and notice wording align with these constraints. Minutes must record any changes and provide information on the power to request a further meeting where required (s 10(5)).

9. Reasonable access and notice obligations (s 10(2); Schedule 1 rule 1.12(3)): Owners corporations must ensure reasonable access to electronic voting facilities and provide notice for entry to inspect units in most circumstances. Reasonableness is context dependent and may require providing physical access for those without technology or making facilities available during business hours. Non‑compliance with notice obligations may render inspections procedurally defective.

10. Pet rules and short notice window (Schedule 1, rule 1.5): A unit owner must notify the owners corporation in writing within 14 days of first keeping an animal. Failure to notify within that window could expose the owner to compliance action. The rule limits animals other than caged birds and aquarium fish to three and imposes supervision, containment and cleaning duties. Owners corporations wishing to impose stricter animal rules must do so via alternative rules but are limited to modifying rule 1.5 only, and must comply with the alternative-rules constraints.

11. Assistance animals and proof (Schedule 1, rule 1.6): Owners corporations may require evidence that an assistance animal is an assistance animal. This interacts with federal disability discrimination law in practice. The regulation permits a requirement for evidence but does not define the threshold for acceptable evidence; parties should seek guidance from the relevant Act and human-rights frameworks where disputes arise.

12. Executive committee representative entry powers require written authorisation (Schedule 1, rule 1.12(4)): Entry and inspection powers must be exercised by persons authorised in writing. Owners corporations should maintain a clear written authorisation register to avoid disputes about the legality of entry.

13. Corporate register fee cap and record access (s 8): The $10 plus GST cap on register access reduces cost recoupment for owners corporations. That cap may affect administrative choices about charging for copies or searches and should be built into fee schedules.

14. Recoverable legal costs cap (s 9): The cap on legal costs may make owners corporations more cautious about bringing litigation resolved by the Act if expected costs exceed the cap. Conversely, the cap lowers the cost barrier to some claimants. The cap is the lesser of $750 per unit and $10 000.

15. Audit eligibility and insurance requirement (s 12): The definition of acceptable auditors ties audit capacity to certain professional memberships and to ASIC registration plus professional indemnity for company auditors. Owners corporations must confirm auditors’ status and insurance before appointment.

16. No recorded litigation history in this republication: The absence of recorded cases in the document means there is no reported administrative or judicial construction of the regulation in the republication itself. Where interpretation risk exists , for example, what is “unreasonably withheld” for sustainability infrastructure , practitioners should plan for potential disputes and document decision-making processes.

These gotchas indicate areas where documentation, reasoned decision-making and record-keeping will reduce dispute and compliance risk. They also highlight the regulation’s emphasis on procedural integrity, insurance-backed risk allocation and specific asset management requirements.

Below are concrete, practicable steps owners corporations, developers, managers, auditors and unit owners can take to comply with the regulation’s prescriptions. Each step cites the relevant provision to ensure source‑grounded compliance.

1. Prepare and maintain a maintenance plan that addresses listed items (s 4A):

   • Include a schedule for inspection and maintenance for each item listed in s 4A(a)(i)-(vix): exterior walls, guttering, roofs, pools and surrounds, HVAC systems, lifts, fire protection equipment, security access systems, electric vehicle charging infrastructure, embedded networks, micro‑grids, solar panels and other sustainability infrastructure.
   • Where manufacturer warranties, maintenance manuals or installer/manufacturer contact details are available, include them in the plan (s 4A(b)(i)-(iii)).
   • Retain documentary evidence that the plan has been prepared, reviewed periodically and acted upon; document the factual reasons for including or excluding assets under the “reasonably required” test.

2. Developers to provide a developer’s maintenance schedule at handover or sale (s 4B):

   • Prepare a schedule that mirrors the maintenance-plan items (s 4B(a)), and provide any warranties, manuals and installer contact details available (s 4B(b)-(d)).
   • Where full information is not available, note what is missing and document efforts to obtain it; pass information to the owners corporation on formation.

3. Ensure required insurance coverage (s 5; s 7; s 12(d)):

   • Managers and owners corporations must procure public liability insurance with limits at least $10 000 000 (s 5; s 7). Maintain certificates of currency and include them in governance records.
   • For audit engagements, confirm that registered company auditors hold current professional indemnity insurance (s 12(d)). Obtain written confirmation of insurance levels and expiry dates.

4. Adopt default rules or valid alternative rules (s 7A; s 7B; Schedule 1):

   • If using default rules, adopt Schedule 1 verbatim where appropriate as the owners corporation’s default rule set (s 7A).
   • If proposing alternative rules, confine modifications to default rules 1.4, 1.5 and 1.6 only (s 7B(1)(a)). If the alternative rule changes contribution methods for general or sinking funds, set out the method and the underlying principle and ensure the method is “fair” by reference to s 7B(2)(a)-(d). Prepare and retain supporting analyses documenting fairness.

5. Manage permissions for erections and alterations and sustainability infrastructure (Schedule 1 rule 1.4):

   • Obtain a special resolution before granting permission to erect or alter structures on a unit or common property and ensure compliance with relevant territory laws such as development approvals (rule 1.4(1)(a)-(b)).
   • Do not unreasonably withhold permission for sustainability infrastructure. Develop and publish objective assessment criteria (safety, structural integrity, financial impact and equity of access) that align with the examples in rule 1.4(3), and record reasons when permission is granted or refused.

6. Pet and assistance-animal compliance processes (Schedule 1 rules 1.5-1.6):

   • Create a register of animals in units and require owners to provide written notice within 14 days of bringing a pet into a unit (rule 1.5(2)).
   • For assistance animals, require acceptable evidence where necessary (rule 1.6). Document the nature of requested evidence and preserve privacy and medical‑information safeguards as required by other applicable laws.

7. Electronic voting and meeting administration (s 10):

   • If adopting teleconference, videoconference or pre-meeting electronic voting, ensure systems are secure and provide reasonable access to members who lack personal facilities. Include information on how to access facilities with the notice of meeting (s 10(1)-(2)).
   • For pre-meeting electronic voting, ensure motions intended for pre-meeting voting will not be amended at the general meeting where prohibited by s 10(3)-(4). Where pre-meeting voting is partly used and a motion is amended at a meeting, ensure minutes are accompanied by the required notice of change and statement on the power to request a further general meeting (s 10(5)).

8. Legal costs budgeting and record-keeping (s 9):

   • Be aware that recoverable costs of taking legal action under the Act are capped at the lesser of $750 per unit and $10 000 (s 9). Budget dispute-resolution strategies accordingly and consider ADR or mediation before litigation if anticipated legal costs will exceed the cap.

9. Corporate register management (s 8):

   • When providing access to the corporate register, limit any fee to $10 plus GST. Keep clear invoices and receipts for register searches and copies to show compliance with the fee cap.

10. Executive committee representative authorisation and entry protocols (Schedule 1 rule 1.12):

    • Authorise representatives in writing to carry out inspections and maintenance duties (rule 1.12(4)). Maintain a list of authorised representatives, the scope of their authority and the dates and times of authorisations.
    • Provide reasonable notice before entry unless there is an emergency. Adopt a notice template and a record of attempts to give notice that can be produced if the exercise of entry powers is challenged.

11. Audit appointment procedures (s 12):

    • Confirm auditor eligibility against s 12(a)-(d) before appointment. Obtain written confirmation of the auditor’s professional standing and insurance. Retain audit engagement letters and certificates of professional indemnity where applicable.

12. Documentation and dispute-readiness:

    • For any decision that could be contested , withholding permission for an alteration, refusal of a pet application, adoption of an alternative contribution method, or entry into a unit , prepare written records explaining the factual and legal basis for the decision and how statutory criteria were applied.
    • Where “reasonableness” or “fairness” tests apply, prepare contemporaneous analyses that consider the factors the regulation requires (for example, s 7B(2)(a)-(d) for contribution methods).

13. Coordinate with territory and federal obligations:

    • Ensure alteration permissions require compliance with applicable territory laws and that development approvals are sought where necessary (Schedule 1, rule 1.4(1)(b)).
    • For auditor registration and insurer checks, coordinate with ASIC and professional bodies to verify credentials and insurance status.

14. Training and procedural manuals:

    • Provide training for executive committee members, managers and building managers so they understand notice requirements, entry protocols, pet notification obligations and the limits of alternative-rule drafting. Maintain a governance manual that cross-references the regulation’s sections.

Following these steps will assist in practical compliance. The regulation ties many obligations to facts on the ground and to other statutory regimes, so sound record-keeping, evidence of reasoned assessment and coordination with insurers, auditors and developers are central to meeting the regulation’s requirements.
