sec.103 Existing applications for former approvals
This section applies if— before the commencement, a person made an application to the chief executive under the expired regulation, section 37 for a former approval; and immediately before the commencement, the application had not been decided. The application— is taken to have been made under section 25 for a boat harbour approval of the same type; and must be dealt with under part 5, division 2. Anything done in relation to the application under the expired regulation is taken to have been done in relation to the application under part 5, division 2. (sec.103-ssec.1) This section applies if— before the commencement, a person made an application to the chief executive under the expired regulation, section 37 for a former approval; and immediately before the commencement, the application had not been decided. (sec.103-ssec.2) The application— is taken to have been made under section 25 for a boat harbour approval of the same type; and must be dealt with under part 5, division 2. (sec.103-ssec.3) Anything done in relation to the application under the expired regulation is taken to have been done in relation to the application under part 5, division 2.
