Transfer of Land (Fees) Regulations 2016

The Regulations revolve around a small number of structural concepts that determine how a given lodgment or application is priced. First, the Regulations use fee units as the basic building block for many fees. The explanatory details state the Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004; the value of a fee unit is fixed annually by the Treasurer and published before 1 June in the preceding financial year (explanatory details). For the financial year commencing 1 July 2024 the fee unit is $16.33 and calculations may be rounded to the nearest 10 cents (explanatory details). The Schedule thus lists many fees as a multiple of fee units (for example 6.65 fee units, 13.30 fee units, 41.88 fee units).

Second, the Schedule distinguishes fee types by delivery and service channels. The Regulations define “information broker search”, “regular online search”, “online search” and “in person search” (reg 5). The Schedule then prices folio searches, instrument searches, plan searches, final search statements and registry information supply differently depending on the channel (see items 13, 14, 80-85 and 82-83). There is also explicit differentiation between paper and electronic lodgments for a number of instruments (notably transfers, mortgages, discharges, and certain applications), with electronic lodgment typically attracting a lower base fee unit component (for example item 19(a) versus 19(b), item 23(a) versus 23(b), items 47 and 51).

Third, the Schedule applies ad valorem calculations (a per‑$1,000 charge) for transfers and certain easements and caps the amount payable. Several items prescribe a base fee plus $2.34 per whole $1,000 of consideration, with rounding to the next higher whole dollar and a stated cap that limits the total paid to a maximum of $3,510 plus a base fee unit sum (items 5, 19 and 21 among others). The Regulations also prescribe that if there is more than one consideration the highest one is used for the per‑$1,000 calculation (items 5 and 19).

Fourth, the Regulations make use of precise temporal and content definitions that affect whether a search is a “final search statement” (instruments lodged within 125 days prior to the date of the statement) and what a “folio search statement” and “folio history search statement” contain (reg 5). These definitions matter because the applicable fee differs for a standard folio search, folio history search, final search statement or instrument search depending on the channel used (see items 80, 80A and 83).

Fifth, the Schedule contains procedural and niche items that support Registrar operations: fees for certification of copies or searches (0.63 fee units, items 13, 15, 84-85), fees for applications to amend folios under court or VCAT orders (item 71 and 72), fees for registering successors or recording notices (multiple items), and fees for approvals and licences relating to approved forms (items 87-90). There are also high‑value items charged where a more complex or consequential Registrar function is performed, such as an application to amend boundaries or to remove title descriptions (items 69 and 73 at 41.88 fee units).

Finally, the Regulations are explicitly derivative: they operate by reference to particular sections of the Transfer of Land Act 1958 (Column 2 of Schedule 1) and by reference to other statutes where applicable (reg 7(2) for the Religious and Successory Trusts Act 1958, and the Monetary Units Act 2004 for fee unit valuation , explanatory details). The Regulations also record their own amendment history and the Subordinate Legislation Act 1994 sunset provision in the endnotes, which affects the instrument’s continuity beyond its ten‑year life.

Together these concepts convert statutory land‑registration activities into a tariff schedule tied to delivery channel, monetary consideration, fee unit valuation and specific procedural categories defined in the Regulations.

The Regulations create costs and administrative steps for every party who interacts with the Registrar under the Transfer of Land Act 1958. The immediate payers are applicants and persons lodging instruments with the Registrar: purchasers and transferees (item 19), mortgagees and mortgagors (items 47, 51), persons creating or surrendering easements (items 21-22, 72-73), trustees, legal personal representatives and surviving joint proprietors applying to be registered (items 25-27), acquiring authorities and statutory authorities seeking folios or vesting orders (items 30, 24), judgment creditors and other persons seeking recordings or removals of court processes (items 28-29A), and caveators and persons lodging or withdrawing caveats (items 11, 37, 46, 60, 70).

Third‑party search consumers are affected: information brokers who are licensed to access and make available land registration information (definition in reg 5) are listed separately from regular online users, online searchers and persons attending in person. The Schedule charges different fees for information broker searches, regular online searches, online searches and in‑person searches for plan searches, folio searches, folio history statements, instrument searches and final search statements (items 13-15, 80-85). That means private search businesses, conveyancers, banks, mortgage insurers and other institutional users will experience different cost structures depending on their channel and licence arrangements.

Registrars and the Office of Titles are affected administratively because the Regulations prescribe how they must calculate and collect fees, how to classify different search types and the circumstances in which ad valorem charges apply. The Regulations also affect the Treasurer and finance officers because the fee unit value is set under the Monetary Units Act 2004 and the Treasurer must publish the fee unit’s value annually (explanatory details).

Service providers involved in electronic lodgment networks are specifically referenced: the Schedule contains a fee for “registry information supply” that is “access to land registration information of the Office of Titles supplied to a person for the purpose of creating an instrument for lodgment in an electronic lodgment network” (definition, reg 5; item 81). That directly impacts software vendors and e‑conveyancing network participants who require certified registry data to prepare instruments for electronic lodgment.

Other affected parties include persons who lodge niche applications: owners seeking boundary amendments or folio corrections (items 69, 73), persons recording restrictive covenants or acquisitions of rights (items 55-57), trustees in bankruptcy applying to be registered (item 27), and persons seeking licences to print and sell approved forms (items 87-89). Finally, the Regulations include a general fall‑back and catch‑all: the prescribed fee for lodgment of an instrument or application for which no fee is specified is 6.65 fee units (reg 7(1)). That provision ensures that parties in unforeseen or uncommon transactions still pay an administratively determined fee.

In short: anyone who applies to or lodges an instrument with the Registrar under the Transfer of Land Act, and intermediaries who access title information (brokers, online users, e‑conveyancers), bear the financial burden created by the Schedule. The Treasurer and the Office of Titles are organisationally involved because they set the monetary unit and supply the services whose prices are prescribed.

The Regulations impose a clear obligation on those seeking Registrar services: to pay the prescribed fee listed against the relevant section or description in Schedule 1. Regulation 6 makes the link between an Act section and the prescribed fee: “for the purposes of a section of the Act specified in Column 2 of Schedule 1, the prescribed fee is the amount specified in Column 4 of Schedule 1 opposite the description of that section specified in Column 3 of Schedule 1” (reg 6). Regulation 7 establishes two express duties: to pay 6.65 fee units where no schedule provision applies (reg 7(1)), and to pay 6.65 fee units for lodgment of an application under the Religious and Successory Trusts Act 1958 (reg 7(2)).

The Regulations do not create new substantive proprietary rights; they operate alongside the Transfer of Land Act by fixing fees for the exercise of existing statutory rights to apply to the Registrar. Thus the Regulations functionally attach a monetary cost to statutory and procedural entitlements under the Act: the right to lodge transfers, caveats, mortgages, priority notices, folio searches and applications to correct or amend the Register remains (as those rights exist under the Act), but the Regulations require payment for the Registrar to process or record those instruments.

Specific duties derived from the Schedule include:

• Calculating ad valorem charges: where the fee includes $2.34 per whole $1,000 of consideration, the fee‑payer must calculate the charge using the highest consideration if there are multiple considerations (items 5 and 19). The amount is rounded up to the next higher whole dollar and the Schedule prescribes a statutory cap (the total fee not to exceed $3,510 plus the base fee unit component) (items 5 and 19). Those procedural calculation rules are duties placed on the payer or their agent so that the correct fee accompanies lodgment.

• Choosing the correct lodgment channel: paper versus electronic lodgment affects the base fee charged for a range of items. For example, the fee for a transfer with monetary consideration is the sum of 6.65 fee units plus the ad valorem charge if lodged in paper, and 6.04 fee units plus the same ad valorem charge if lodged electronically (item 19). The payer must therefore know whether the instrument will be lodged electronically, and which set of fees applies.

• Determining whether a search or statement meets the specialised definitions: a “final search statement” has a temporal requirement (instruments lodged within 125 days prior to the date of the statement) (reg 5), and that definition affects which item and fee apply (item 83). Users must therefore apply the definitions in reg 5 when selecting the correct Schedule item.

• Paying the correct fee unit multiple and applying rounding: because many fees are expressed as fee units, the payer must multiply the fee unit amount by the current fee unit dollar value (Monetary Units Act 2004) and apply the rounding rules set out in the explanatory details, which allow rounding to the nearest ten cents (explanatory details).

Rights implicit in the Regulations include the administrative right to request and obtain Registrar services subject to payment: making applications for folio amendments (items 71-75), applying for vesting orders and recording vesting orders (items 24, 32), registering successors in law and recording dispositions (items 34, 33), lodging caveats and priority notices (items 11, 63), and obtaining certified folio or plan searches (items 13, 15, 84-85). These are not new statutory rights created by the Regulations but rather the pricing of statutory processes available under the Transfer of Land Act.

The Regulations do not themselves set explicit refund, waiver or concession rules for fees, nor do they attach administrative penalties directly to non‑payment within the text. They also leave procedural details about acceptance and processing to the Registrar and the parent Act. Consequently a practical duty for users is to ensure that fee calculations, channel choices and the correct Schedule items are used so the Registrar can accept the lodgment without administrative friction.

The Regulations are primarily a tariff instrument and do not themselves prescribe criminal offences, pecuniary penalties or enforcement procedures within their text. The Regulations specify the prescribed fees for particular lodgments and applications (reg 6; Schedule 1) and provide fallback fees (reg 7), but they do not contain provisions that create enforcement mechanisms such as infringement notices, penalty units or time‑based sanctions. The instrument was made under s 120 of the Transfer of Land Act 1958 (reg 2), and enforcement of Registrar processes more broadly is governed by the Act and administrative practice, not by the fee schedule itself as published here.

Nevertheless, the Schedule establishes practical enforcement levers used in administration. The Registrar’s acceptance of a lodgment or application is practically conditioned on payment of the prescribed fee designated for that Act section or description. If the correct fee is not paid, ordinary administrative outcomes will include refusing to accept lodgment or returning documents unprocessed, or requiring rectification before processing can proceed. Those operational responses flow from the Registrar’s procedural control over lodgments under the Transfer of Land Act; the Regulations make clear what payment is required but leave operational enforcement (acceptance, return, hold) to Registrar practice and to the parent Act. The Regulations do not themselves set out the Registrar’s procedural consequences for non‑payment.

A number of Schedule items set out calculation and cap rules that, if misapplied, can lead to underpayment. For example, ad valorem fees require use of the highest consideration where multiple considerations exist, and require rounding up to the next higher whole dollar with an overall cap (items 5 and 19). Incorrect arithmetic or failure to apply the cap would lead to a shortfall in the fee tendered. The Regulations do not prescribe a statutory interest or penalty on shortfalls; administrative responses will be exercised under the Registrar’s delegated powers and the Transfer of Land Act.

The explanatory details instruct on fee unit valuation and rounding: the fee unit amount for a given financial year is published by the Treasurer and the calculated fee may be rounded to the nearest 10 cents (explanatory details). Failure to use the correct fee unit value or rounding convention again produces an administrative incompatibility between tendered payment and prescribed charge.

In summary: the Regulations themselves do not create penalties or an enforcement framework; they prescribe the fee schedule. Enforcement and penalty mechanics are left to the parent Act, Registrar practice and ordinary administrative controls (acceptance/refusal of lodgment). Users should assume that non‑payment or incorrect payment will impede lodgment and must manage calculation and payment precisely to avoid administrative refusal or corrective steps by the Registrar.

The Regulations operate as subordinate law under the Transfer of Land Act 1958 and interact directly with a small set of other statutes by reference and administrative linkage. The foundational authorisation is regulation 2, which records that the Regulations are made under s 120 of the Transfer of Land Act 1958. Schedule 1 is keyed to particular sections of the Transfer of Land Act (Column 2), so the Regulations function as a fee schedule for statutory processes created by that Act (reg 6; Schedule 1).

The Regulations refer to the Monetary Units Act 2004 for the valuation of fee units and for calculation of dollar amounts. The explanatory details make clear that fees are provided by reference to fee units within the meaning of the Monetary Units Act 2004, that the fee unit value for the 2024-25 financial year is $16.33, and that the Treasurer fixes the fee unit for future years and publishes it in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year (explanatory details). Therefore, any change to the Monetary Units Act’s procedures or to the Treasurer’s determination will directly change the dollar amount of the fees prescribed in the Schedule.

The Regulations also reference the Religious and Successory Trusts Act 1958, prescribing a specific fee for applications under that Act (reg 7(2)). They note that the Transfer of Land (Fees) Interim Regulations 2015 are revoked (reg 4), and the endnotes reference the Subordinate Legislation Act 1994 , specifically the Regulations’ sunset provision under that Act (endnote 1: the Regulations will sunset ten years after making on 19 April 2026, pursuant to s 5 of the Subordinate Legislation Act 1994). Consequently the Subordinate Legislation Act 1994 affects the Regulations’ lifecycle.

The Interpretations of Legislation Act 1984 and the Interpretation of Legislation Act provisions applicable to Statutory Rules are referenced in the endnotes and explanatory details (section headed “INTERPRETATION OF LEGISLATION ACT 1984 (ILA)” and subsequent explanation). Those references clarify how headings, notes, examples, punctuation and provision numbers are to be treated as part of the Statutory Rule and affect interpretation. The explanatory details also cite section 54A and section 39B of the ILA in relation to style changes and the construction of schedules.

The Regulations thus interact with other legislation in three practical ways:

• Authorisation and scope: the Transfer of Land Act provides the substantive powers and procedural activities the fees price; the Regulations cannot expand or reduce those substantive statutory powers, only price them (reg 2; reg 6).

• Valuation and indexing: the Monetary Units Act 2004 determines the dollar equivalent of fee unit multiples appearing in Schedule 1, and the Treasurer’s annual determination determines year‑to‑year fee changes (explanatory details).

• Lifecycle and parliamentary control: the Subordinate Legislation Act 1994’s sunset rule affects the Regulations’ continuity; the document’s endnotes record that the instrument will automatically sun‑set after ten years unless renewed (endnote 1).

In addition the Schedule’s distinctions between electronic and paper lodgment intersect with any legislative scheme or operational rules governing electronic lodgment and e‑conveyancing networks. The Regulations define “registry information supply” as access for the purpose of creating an instrument for lodgment in an electronic lodgment network (reg 5); any separate legislation, contractual arrangements, or standards governing e‑conveyancing platforms will affect which channel applies and therefore which Schedule item is chargeable.

Finally, Schedule 1 has itself been amended by a series of Statutory Rules listed in the Table of Amendments, meaning the Regulations’ interaction with other laws is dynamic and subject to periodic revision by subordinate instruments (Table of Amendments).

The Regulations were made on 19 April 2016 and commenced on 1 July 2016 (reg 3; endnote 1). The Schedule records that Schedule 1 has been amended repeatedly; the explanatory details and Table of Amendments specify those subordinate instruments. The Schedule itself contains an annotation that it was amended by S.R. Nos 27/2017, 68/2018, 31/2019, 74/2021, 47/2023 and 39/2024. The Table of Amendments gives the dates of making and commencement for each amending Statutory Rule as follows:

• Transfer of Land (Fees) Amendment Regulations 2017, S.R. No. 27/2017: made 9 May 2017, commenced 1 July 2017 (reg 3 of that SR).

• Transfer of Land (Fees) Amendment Regulations 2018, S.R. No. 68/2018: made 29 May 2018, commenced 1 July 2018.

• Transfer of Land (Fees) Amendment Regulations 2019, S.R. No. 31/2019: made 14 May 2019, commenced 1 July 2019.

• Transfer of Land (Fees) Amendment Regulations 2021, S.R. No. 74/2021: made 29 June 2021, commenced 1 July 2021.

• Transfer of Land (Fees) Amendment Regulations 2023, S.R. No. 47/2023: made 6 June 2023, commenced 1 July 2023.

• Transfer of Land (Fees) Amendment Regulations 2024, S.R. No. 39/2024: made 28 May 2024, commenced 1 July 2024.

The Schedule’s footnote also records that the instrument revokes the Interim Regulations 2015 (reg 4). The endnotes include interpretative guidance about style changes authorised by the Interpretation of Legislation Act 1984 and practical notes on how headings, examples, punctuation and provision numbers are to be treated as part of the Statutory Rule (endnote 1, section “INTERPRETATION OF LEGISLATION ACT 1984 (ILA)”). The explanatory details section specifically documents the fee unit mechanism and the current value of the fee unit for the 2024-25 year, which is an administrative modification derived from the Monetary Units Act 2004 and not a change to the text of the Regulations themselves.

Taken together the amendment history shows an annual or near‑annual pattern of amendments tied to financial years and to operational adjustments. The presence of multiple amending Statutory Rules indicates the Schedule is actively managed and updated by successive subordinate instruments rather than being a static list. Users should consult the Table of Amendments and the current consolidated text to ensure they are using the latest Schedule items and fee unit values. The endnote also warns of the statutory sunset date: the Regulations will sun‑set ten years after the date of making (19 April 2016), i.e. 19 April 2026, under the Subordinate Legislation Act 1994, unless the sunset is otherwise addressed by subsequent legislative action.

The text of the Regulations and the associated endnotes do not record any litigation history. There are no cases, judicial decisions or administrative appeals cited in the instrument itself, and the document includes neither a list of authorities nor reference to disputes concerning the Regulations. The endnotes, Table of Amendments and explanatory details treat the instrument as a statutory fee schedule and administrative tool without accompanying case law citations.

Practically, fee schedules of this kind tend to generate disputes about fee classification, calculation (particularly ad valorem calculations and caps), and acceptance of lodgments when fees are incorrectly tendered. But the Regulations themselves do not record such litigation or decisions. There is therefore no litigation history reported within the legislation text you supplied.

For practitioners, the absence of cited litigation in the Regulations means that any interpretive disputes will be resolved by reference to (a) the text of these Regulations and the Transfer of Land Act 1958, (b) any administrative directions or Registrar practice notes published by the Office of Titles, and (c) relevant case law on the parent Act or administrative decisions taken under it, none of which are contained within the Regulations’ text. Users requiring case authority should therefore search external databases or Registrar determinations for any decisions that address particular fee classification or calculation points; the Regulations themselves do not supply those authorities.

The Schedule contains multiple specific rules and calculation steps that, if overlooked, will produce incorrect fee payments. The following practical pitfalls are grounded in the Regulations’ text.

1. Ad valorem calculation mechanics and cap: Several items impose an ad valorem component of $2.34 per whole $1,000 of consideration (items 5, 19, 21). The Schedule requires the calculation to use the highest consideration where there is more than one consideration, requires rounding up to the next higher whole dollar, and imposes an overall cap such that the total fee must not exceed $3,510 plus a base fee unit component (items 5 and 19). Misapplying “whole $1,000” (rounding down or not using the highest consideration) or failing to apply the cap can lead to significant overcharges or underpayments.

2. Multiple lodgment channels with different fees: The Schedule differentiates between paper and electronic lodgments for many items (for example items 19, 20, 23, 25, 26, 47, 51, 60, 61, 69 and others). For monetary transfers the paper base is 6.65 fee units and the electronic base is 6.04 fee units (item 19). Choosing the incorrect channel or failing to confirm whether electronic lodgment rules apply will cause errors in the fee tendered.

3. Fee units and annual variability: Almost all fee amounts expressed in the Schedule are multiples of fee units: 6.65, 13.30, 41.88 fee units and so on. The dollar equivalent depends on the fee unit value fixed by the Treasurer under the Monetary Units Act 2004 and published annually (explanatory details). The Schedule itself does not list dollar amounts, so users must apply the correct year’s fee unit value; the explanatory details note the fee unit for the 2024-25 year is $16.33. Using the wrong fee unit value is a common operational error.

4. Rounding rules: The explanatory details permit rounding to the nearest 10 cents for calculated amounts. In contrast, the ad valorem items require rounding up to the next higher whole dollar for the per‑$1,000 calculation (items 5 and 19). There are therefore different rounding rules to apply in different contexts; confusion between them will cause incorrect totals.

5. Definitions that change applicability: “Final search statement” is defined as a statement of instruments lodged for registration or recording within 125 days prior to the date of the statement (reg 5). Users must confirm that the instruments fall within this 125‑day window to use the lower fee item for a final search statement (item 83). Likewise, “information broker search” applies to licensed brokers and attracts a lower or different fee than a casual online search (reg 5 and items 13, 14, 80-83). Misclassifying the search channel is a practical gotcha.

6. Per‑parcel fees: Some items charge per parcel created or per parcel basis, notably item 68 for cancelling a plan of building subdivision and registering a new plan (6.65 fee units per parcel then 12.95 fee units per parcel). Failure to account for per‑parcel multipliers will underprice or underpay fees for subdivision work.

7. Multiple adjacent or duplicated item numbers: The Schedule contains non‑linear numbering and some adjacent identifiers (for example 29 and 29A, 63 and 63A, 76 and 76A/B). Practitioners must be careful to pick the exact item that matches the Act provision , for example distinguishing between removal of a recording under 52(6) and removal by a judgment creditor under 52(6A) (items 29 and 29A).

8. Caps that sit alongside base fee units: For transfers and easements the cap on the ad valorem component is described as “the total fee not to exceed the sum of $3510 plus 6.65 fee units” (items 5 and 21). Be clear whether that cap applies to the total fee or only to the ad valorem portion. The Schedule’s language ties the cap to the total fee payable, and the base fee unit still applies as an additive component within that cap formula in the items that state it.

9. Miscellaneous fallback fee: If a lodgment or application is not covered by an explicit Schedule item or by another Act or Regulation, reg 7(1) prescribes 6.65 fee units. That catch‑all is administratively useful but requires practitioners to confirm there is indeed no applicable Schedule item before applying it.

10. Sunset risk: The Regulations will sun‑set ten years after the day of making (19 April 2016), i.e. on 19 April 2026, under the Subordinate Legislation Act 1994 (endnote 1). That may not directly affect day‑to‑day fee computations in the near term, but it is a legislative lifecycle risk if no replacement or extension is in place. Users should monitor whether the Schedule is continued, re‑made or replaced before that date.

11. Interaction with e‑conveyancing: “Registry information supply” is defined specifically for use in electronic lodgment networks and is priced accordingly (reg 5; item 81). Parties who are preparing instruments via third‑party software need to understand how registry data supplied for instrument creation is charged and whether that cost is borne by the software supplier, the conveyancer, or the client.

12. Certification fees and small‑value items: Certification of folio and instrument searches is 0.63 fee units (items 13 and 15 and 84-85), which are small amounts but routinely required by some transactions. Forgetting that certification tests attract separate fees will lead to ancillary fee shortfalls at lodgment.

Being aware of these concrete pitfalls and the precise textual prescription in each Schedule item will reduce operational errors in fee calculation and avoid Registrar rejections or retrospective adjustments.

Complying with the Regulations requires a sequence of confirmatory steps, accurate arithmetic and attention to channel definitions. The following checklist is grounded in the Regulations’ text and is intended as a practical compliance workflow.

1. Identify the Act provision and Schedule item

• Before preparing payment, identify the specific Transfer of Land Act section under which the lodgment or application is being made. Use Column 2 of Schedule 1 to match the Act section to the Schedule item (reg 6; Schedule 1).
• If no Schedule item matches, apply the fallback in reg 7(1): lodgment for which no fee is specified is 6.65 fee units.

2. Determine the correct description and sub‑item

• Read Column 3 carefully: confirm whether the description captures monetary versus non‑monetary consideration, whether the lodgment is a transfer, mortgage, caveat, vesting order, lease variation, priority notice, etc.
• Check whether the item includes different fees based on lodgment channel (paper vs electronic), per parcel charges, or ad valorem calculations.

3. Establish the lodgment channel

• Confirm whether the lodgment will be made electronically via the Office of Titles’ e‑conveyancing arrangements, via an approved information broker or regular online agreement, or in person. The Schedule defines these channels and charges different fees (reg 5; items 13-15, 80-85).
• For electronic lodgment, ensure the instrument meets any electronic form and network requirements separate from these Regulations.

4. Calculate fee unit multiples and convert to dollars

• Multiply the fee units shown in Column 4 by the current fee unit value fixed under the Monetary Units Act 2004. The explanatory details state the fee unit for the 2024-25 financial year is $16.33, but the Treasurer fixes the fee unit for each year and publishes it before 1 June in the preceding year (explanatory details).
• Apply rounding conventions: the explanatory details allow rounding of the calculated fee to the nearest 10 cents. For ad valorem components the Schedule prescribes different rounding (see step 5).

5. Calculate ad valorem components carefully where applicable

• If the Schedule item includes a per‑$1,000 charge (for example $2.34 per whole $1,000), identify the consideration to be used. Use the highest consideration if multiple considerations exist (items 5 and 19).
• Calculate the per‑$1,000 charge on whole $1,000 amounts and round up to the next higher whole dollar as the item directs. Then apply the statutory cap where stated: the total fee must not exceed $3,510 plus the stated base fee unit component in the relevant items.
• Add the base fee unit element to the calculated ad valorem charge to reach the total payable.

6. Account for per‑parcel and per‑instance multipliers

• For items that charge “per parcel” or per extension (for example item 68, item 12 in some contexts), multiply the per‑parcel fee by the number of parcels affected.

7. Confirm certification and ancillary fees

• If certified folio or instrument copies are required, include the certification fee in the calculation (0.63 fee units in items 13, 15, 84-85).
• For searches include the correct channel fee (information broker, regular online, online, or in person).

8. Prepare payment in the prescribed form

• Prepare payment in the Office of Titles’ accepted payment methods (not specified in these Regulations). Ensure the fee is tendered with the lodgment to avoid administrative return. Where electronic lodgment is used ensure the e‑conveyancing platform processes the payment accurately.

9. Record and retain computation details

• Retain the calculation steps, fee unit value used (including date and Treasurer’s publication), rounding performed, and the Schedule item number relied on. This supports any subsequent Registrar query and provides an audit trail.

10. Monitor Schedule changes and the fee unit

• The Schedule is amended periodically (see Table of Amendments). Always consult the latest consolidated Regulations and the Treasurer’s published fee unit for the current financial year before calculating fees.
• Be aware of the sunset date recorded in the endnotes: unless further subordinate or primary legislation extends it, these Regulations sunset on 19 April 2026. Keep watch for any replacement or renewal instruments that maintain continuity of the fee regime.

11. Special cases

• For instruments or applications under the Religious and Successory Trusts Act 1958, reg 7(2) prescribes 6.65 fee units.
• For licences and approvals relating to approved forms, include the small application fees prescribed in items 87-90.

12. Use appropriate professional channels where necessary

• Where the transaction involves complex calculation (multiple considerations, large considerations close to the cap, per‑parcel subdivision), conveyancers, solicitors or settlement agents should be engaged to validate calculations and to ensure the correct Schedule items are applied.

13. Be mindful of Registrar practice

• The Regulations do not set out procedural consequences for non‑payment or incorrect payment. If the Registrar returns documents for incorrect fees, correct and resubmit promptly. Maintain correspondence and receipts in case of queries.

Following this procedural workflow, and keeping the Treasurer’s fee unit and the consolidated Schedule under active review, will ensure compliance with the Regulations’ pricing rules and reduce the risk of lodgment delay or administrative return.
