Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms. \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. While it has been amended six times since 2016 (as shown in the Table of Amendments), these appear to be routine updates to fee amounts and structures rather than expansion into new substantive areas. It works alongside the Transfer of Land Act 1958, which governs how property ownership is recorded and transferred in the state.\n\n**What it does:**\nThe regulation creates a detailed price list for virtually every transaction handled by the Office of Titles (now part of Land Use Victoria). It covers:\n\n- **Property transfers**: Fees vary based on whether the transaction is on paper or electronic, and whether money changes hands. For sales with monetary consideration, fees include a base amount plus $2.34 per $1,000 of the purchase price (capped at roughly $3,510 plus the base fee).\n- **Mortgages and discharges**: Different fees apply for registering, varying, or discharging mortgages, with discounts for electronic lodgment.\n- **Searches**: Various fees for title searches, plan searches, and instrument searches depending on how you access them—through an information broker, regular online account, casual online search, or in person at the office.\n- **Caveats and priority notices**: Fees for lodging caveats (warnings that someone claims an interest in land) and priority notices (which protect pending transactions).\n- **Administrative changes**: Fees for correcting errors, updating addresses, replacing lost certificates, and other registry maintenance.\n\n**Who it affects:**\n- **Property buyers and sellers**: Anyone buying or selling real estate in Victoria pays these fees as part of settlement costs.\n- **Conveyancers and lawyers**: They lodge most of these documents on behalf of clients.\n- **Banks and lenders**: They register and discharge mortgages.\n- **Property researchers**: Anyone doing title searches pays the search fees.\n\n**Why it matters:**\nThese fees represent a significant cost of property transactions in Victoria. The regulation also incentivises electronic conveyancing by charging lower fees for digital lodgment compared to paper documents—part of Australia's broader shift to modernise property transactions."},"summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"Based on the limited text available, this appears to be a standard fees regulation made under the Transfer of Land Act 1958 (Vic), fulfilling its intended and narrow purpose of prescribing registry fees.
