Plain English Summary
8/10 complexity
These regulations convert a very large set of road rules, vehicle-standards and licensing requirements into prescribed offences with specified fine levels (penalty units) and demerit points. They apply to drivers, riders, vehicle owners/registered operators, pedestrians, personal mobility device users and certain authorities. The instrument matters because it standardises how many traffic, registration, vehicle-safety and insurance breaches are enforced and punished, and links photographic detection and Registrar/agency powers to specific offences.
The Traffic (Compliance and Enforcement) Regulations 2017 (the regulations) prescribe a structured catalogue of traffic and vehicle-related offences, link those offences to penalty units and demerit points, identify which offences are treated as “prescribed offences” for specific provisions of the Traffic Act 1925 (the Act), name prescribed authorities for a specified Act provision, and rescind earlier instruments. Mechanically the instrument does the following.
Defines shorthand references used throughout (reg 3). It sets definitions for terms such as Act (Traffic Act 1925), DLVR (Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2021), MALC (Motor Accidents (Liabilities and Compensation) Act 1973), RR (Road Rules), VOR (Vehicle and Traffic (Vehicle Operations) Regulations 2024), VSR (Vehicle and Traffic (Vehicle Standards) Regulations 2024) and VT (Vehicle and Traffic Act 1999). Reg 3(2) also instructs how schedule cross-references to numbered provisions are to be read.
Prescribes, for the purposes of particular provisions of the Traffic Act 1925, which classes of offences are to be treated as “prescribed offences”: for example, reg 4 makes “a parking offence” a prescribed offence for s 9(3) of the Act; reg 5 prescribes parking, speeding and certain DLVR offences for s 43H(6A); and reg 7 specifies offences (including photographic detection detections) for s 54(1AA).
Implements Part IVB of the Act by listing, in Schedule 1, the offences that are “prescribed” for Part IVB, and by specifying for each prescribed offence the illustrative description (column 3), the penalty units (column 4) and demerit points (column 5) that apply (reg 6(a)-(c)). Reg 6(b) expressly states the column 3 descriptions are illustrative only.
Lists an extensive Schedule 1 (Offences) that groups offences by source legislation (Traffic Act 1925, Road Rules, Vehicle and Traffic Act 1999, DLVR, VOR, VSR, MALC, and others), and attaches penalties and demerit points to each enumerated item. The schedule differentiates by actor in many entries (rider of a bicycle; any other driver; individual; body corporate).

Prescribes authorities for the purposes of s 59(1A)(b) of the Act (reg 8): Aurora Energy Pty Ltd; Forestry Tasmania; Tasmania Water and Sewerage Corporation Pty Limited; Telstra Corporation Limited; departments administering specified environmental, nature conservation, national parks and water management Acts; and Transend Networks Pty Ltd.
Rescinds prior Traffic (Compliance and Enforcement) Regulations instruments listed in Schedule 2 (reg 9 and Schedule 2).
Leaves commencement to the day the making is notified in the Gazette (reg 2).
The instrument therefore converts a range of pre-existing offences across multiple traffic and vehicle statutes and regulations into a single, consolidated enforcement schedule tied to the Traffic Act’s enforcement machinery (notably Part IVB and related provisions), and establishes which corporate and public authorities are “prescribed authorities” under the Act for the specified purpose. The schedule also contains numerous amendment notations showing subsequent adjustments to items and subdivisions (see the amendment-history annotations throughout Schedule 1).
Main concepts
Several structural and legal concepts organise the instrument and are necessary for practical application.
Prescribed offence concept: The regulations operate primarily by prescribing which offences are “prescribed offences” under specific provisions of the Traffic Act 1925 (see regs 4, 5, 6 and 7). That is, the instrument does not create new criminal law in the substantive sense; it identifies which existing statutory offences (in the Traffic Act 1925, the Road Rules, the Vehicle and Traffic Act 1999 and subordinate regulations such as DLVR, VOR, VSR and MALC) are to be treated under particular Act provisions. For Part IVB the prescription is executed by referring to Schedule 1 (reg 6).
Schedule as authoritative mapping: Schedule 1 is the operational core. It lists items by source provision, provides an “illustrative” description for each offence (column 3) and, crucially, fixes penalty units and demerit points in columns 4 and 5 for each item. Reg 6(c) makes clear that the penalty units and demerit points specified in the Schedule apply to those prescribed offences for Part IVB; reg 6(b) qualifies the textual descriptions as illustrative only.
Photographic detection interaction: The regulations separately identify offences that may be “detected by means of a photographic detection device” (reg 7(b)) and include separate Schedule entries that expressly note photographic detection variants (several speed and red-light items, and seatbelt/driver restraint items). The instrument therefore accommodates automated detection and creates distinct Schedule entries with appropriate penalty/demerit outcomes where photographic detection is the detection method.
Actor differentiation and corporate v individual liability: The Schedule frequently distinguishes penalties between classes of actors , riders of bicycles, “any other driver”, individuals, and bodies corporate. Examples include TA 43G(3) entries that set a higher penalty unit amount for bodies corporate (item 12) or the separate entries for individual vs corporate registered operators under TA 51(3) items 13-15.
Cross-regulatory linkage: The instrument links subordinate regulation regimes (DLVR, VOR, VSR) and Acts (VT, MALC, TA) by using defined short-hands (reg 3) so that Schedule 1 can include offences originating in those regimes, bringing them within the enforcement framework the Act provides.
Prescribed authorities: Reg 8 names entities that the Traffic Act can treat as prescribed authorities for a specific purpose (s 59(1A)(b)), effectively listing public corporations and departments that the Act’s relevant provision will recognise.
Mechanically, the regulations serve as an index and penalty schedule, aligning a broad universe of road, vehicle and licensing legal obligations with enforcement outcomes (penalty units and demerit points) under the Traffic Act framework. The document therefore standardises how offences across multiple instruments map into the penalties and detection modalities contemplated under the Traffic Act, and identifies a set of authorities with roles under one Act provision.
Who it affects
The regulations affect a broad set of legal actors because they operate by prescribing offences and attaching penalties and demerit points to specific conduct. The primary affected groups, identified in the source, are:
Drivers and riders: The Schedule repeatedly addresses drivers of motor vehicles, motorcycle riders, and bicycle riders. Entries differentiate between “rider of a bicycle” and “any other driver” with different penalty units and demerit points (examples: speed items 16-35; red-light items 63-74; many give separate outcomes for bicycle riders). Personal mobility device users and users of wheeled recreational devices are specifically addressed in Subdivisions 41 and 41A (items 317-328W), so the regulation expressly affects those road users.
Owners and registered operators: Several Schedule items create offences for an owner or registered operator failing to provide driver information or otherwise comply with obligations (TA 51(3) entries for items 13-15). Registered operators also face duties under DLVR (registration, plates, inspection labels) and vehicle defect notices (DLVR items 554-564). The Schedule includes many offences that apply specifically to registered operators (for example, DLVR 89(1) item 543).
Bodies corporate and individual natural persons: Where the underlying legislation distinguishes liability, the Schedule reproduces that distinction. e.g., item 12 (TA 43G(3)) sets 4.25 penalty units for individuals and 8.5 for bodies corporate failing to comply with a notice of demand; items across the DLVR and VOR regimes likewise distinguish corporate obligations such as affixing and keeping inspection labels.
Vehicle operators and industry participants: Taxi, bus, truck, heavy vehicle, trade plate holders, ancillary certificate holders (driving instructors) and public passenger vehicle operators are explicitly addressed by many Schedule offences (DLVR and VSR entries on ancillary certificates, registration, vehicle inspection, vehicle standards, passenger-carrying bus requirements). For example, items 457-460 (VT 14(4)) regulate driving-instruction vehicles and their required equipment, and many VOR and VSR items set standards for heavy vehicle operation, loads, towing and exemptions (items 622-675, 676-731).
Authorities: The Schedule recognises decision-makers and enforcers in the system. Police officers and authorised persons are referenced in offences (e.g. RR 304(1) item 422 failing to obey police direction). The Registrar (of vehicle licensing) is an active decision-maker whose notices and requirements generate offences when ignored (numerous VT and DLVR entries, e.g. DLVR 58 items 532-538; VT 50 items 505-506). Reg 8 prescribes specific corporate/pubic bodies (Aurora, Forestry Tasmania, Telstra, Transend, department heads) for s 59(1A)(b) purposes, which will matter where the Act references prescribed authorities.
The administering department and regulated agencies: The instrument is administered in the Department of State Growth (noted at the end), implying that enforcement implementation, amendment proposals and operational interaction will be coordinated through that department.
Financially and behaviourally, those who “pay” fines, accrue demerit points, or face compliance obligations include drivers and riders who commit the listed conduct; owners and registered operators who fail statutory duties (e.g. to provide driver information or to present vehicles for inspection); and bodies corporate where higher penalties attach. Decision-makers who trigger enforcement outcomes include police/authorised officers, the Registrar and the Transport Commission when the Act or regulations vest them with notice or direction powers. The Schedule’s structure , mapping particular conduct to penalty units and demerit points , changes the cost calculus for each affected actor by making the enforcement consequences explicit and unified under the Traffic Act enforcement regime.
Key duties and rights
The regulations themselves do not introduce novel rights or duties in the substantive sense; instead, they specify which existing statutory duties and offences are to be treated as prescribed offences and fix their enforcement metrics (penalty units and demerit points). Still, from the Schedule and regulations the key operational duties and the legally-relevant outcomes are visible.
Key duties (as enforced by Schedule entries)
Provide driver information and cooperate with demands: Under TA 51(3) items 13-15, an owner or registered operator has the duty to provide driver identity or information when required (if the driver allegedly committed an offence under the Traffic Act 1925 or the Vehicle and Traffic Act 1999). Failure is penalised (individuals 2.25-4.25 penalty units; bodies corporate 5.25-7.75 or 8.5 in some entries).
Comply with notices and directions from the Registrar or Transport Commission: Several items penalise failure to comply with written notices from the Registrar (for inspections, return of licences, production of vehicles) and with Transport Commission notices regarding traffic hazards (see TA 41G items 5-6 concerning lights/reflectors constituting a traffic hazard). DLVR and VT entries (e.g. items 505-507, 532-538) establish duties to produce documents, return licences, and present vehicles for inspection within timeframes.
Display and maintain plates, labels and plates covers: Multiple DLVR items require a registered operator to keep number plates and inspection labels affixed and unobstructed (DLVR 89 items 543-550; DLVR 136 items 573-576). Offences include applying substances to number plates that prevent photographic detection (DLVR 89(3) item 546).
Observe vehicle standards and operational conditions: VSR and VOR items require compliance with vehicle standards, load restraints, dimensions, towing capacities, tyre pressures and other vehicle safety matters (e.g. VOR items 622-675 and VSR items 676-731). Using a vehicle that is unsafe or unroadworthy is expressly penalised (VSR Part 4 item 731: 4 penalty units).
Insurance and premium duties: Under MALC items 988-995, the use of uninsured motor vehicles, or use that increases premium liability without the required cover, attracts penalty units.
Observe driver and passenger restraint, helmet and mobile-device rules: RR items throughout the Schedule require seatbelts (RR 264-266 items 363-366), motorcycle and bicycle helmet obligations (RR 256 items 349-351; RR 270 items 376-378), and mobile-phone prohibitions (RR 299-300 items 413-414AB). Photographic detection variants are provided for some (items 17, 19, 69, 71, 363A, 365A, 414AB).
Comply with vehicle defect notices: DLVR items 554-564 prescribe offences for failing to comply with vehicle defect notices, removing defective labels without authorisation, or permitting use contrary to the notice.
Key rights and procedural features (as apparent from the text)
Illustrative descriptions only: Reg 6(b) states the column 3 descriptions in Schedule 1 are for illustrative purposes only. This means the precise legal content of the prescribed offence is the source legislation (the underlying Act or regulation), not the summarising text in the Schedule. Practitioners must therefore consult the underlying provision cited in column 2 for the definitive elements.
Photographic detection specification: Reg 7 identifies, for s 54(1AA) of the Act, which offences include photographic detection as a method; separate Schedule items also identify photographic detection variants. This clarifies that enforcement by automated devices is contemplated and that separate entries carry the corresponding penalty/demerit outcomes.
Distinct penalties by actor and by detection mode: The Schedule assigns different penalty-unit and demerit-point outcomes depending on who committed the offence (rider of bicycle, other driver, body corporate) and whether the offence was detected by photographic devices. This is a procedural feature that affects costs and points allocation.
Prescribed authorities list: Reg 8 expressly prescribes named authorities for s 59(1A)(b), which may influence which entities the Act treats as having particular statutory standing or recognition in the context of that section.
Rights to contest, administrative review, or court processes are not set out in the regulations text provided; those procedural mechanisms (appeal rights, court processes) are governed by the Act and other legislation not reproduced in this instrument. Because the Schedule references the underlying offences by their originating provisions, the legal elements and any defences remain those of the source provisions.
Penalties and enforcement
The regulations operationalise enforcement by tying each prescribed offence to a numerical sanction (penalty units) and where applicable, demerit points. The Schedule is the enforcement tariff.
Penalty ranges and notable magnitudes
Low-level penalties: Many minor regulatory contraventions (e.g. RR 168(1) disobey no parking sign item 215) carry 0.25-0.75 penalty units and zero demerit points. These typically cover pedestrian rules, parking time limits, some peripheral device and local offences.
Mid-level penalties: Common moving offences (e.g. many RR rule offences such as change-of-direction signalling or stopping offences) are in the region 0.75-1.25 penalty units and may carry demerit points (often 2-3) for drivers. For instance, RR 46(1) fail to give left change-of-direction signal is 0.75 penalty units and 2 demerit points (item 55).
Higher penalties: Speeding and red light and some vehicle-standards offences carry higher penalties. Speeding by 30-37 km/h is 3 penalty units and 5 demerit points (item 27), and exceeding speed by 45 km/h or more is 5.75 penalty units and 6 demerit points (item 33). RR 225 offences (possession of devices preventing speed measuring devices) are 5.75 penalty units (item 280). VSR item 731 (use of vehicle in unsafe and unroadworthy condition) is 4 penalty units (item 731).
Corporate exposure: Some entries set higher penalties for bodies corporate. Example: TA 43G(3) failing to comply with a notice of demand is penalised at 4.25 penalty units (individual) and 8.5 penalty units (body corporate) (item 12).
Vehicle dimensions/mass offences: VOR and VOR-related load/mass offences scale with the magnitude of the breach; VOR overmass items (633-637, 638-642) range from 0.75 up to 4.25 penalty units depending on how much the mass exceeds the limit. VOR and load-related offences that present heightened safety risk attract higher penalties (e.g. VOR 25(1) allow load to fall, item 645: 2.25 penalty units).
Demerit points
Demerit points are explicitly attached in many entries for driver conduct offences (particularly those involving safety, speed and restraint). The Schedule shows demerit points ranging from 0 up to 6 for the most serious speeding breaches (items 30-35), and 3 points for many mid-range safety breaches. The Schedule differentiates demerit point assignment by actor (bicycle riders often receive zero points for listed offences that impose small penalty units; other drivers typically incur demerit points).
Seatbelt and driver-restraint failures carry substantial demerit points (driver seatbelt failure RR 264(1) is 2 penalty units and 3 demerit points , item 363; photographic detection variant item 363A is the same).
Enforcement mechanisms implicit in the instrument
Police and authorised officers: Several Schedule items relate directly to directions by police or authorised persons and penalise refusal to obey their direction (RR 304(1) item 422). Many compliance offences require production of documents or vehicles for inspection to police/authorised officers or the Registrar (VT and DLVR items).
Registrar and written notices: The Registrar has power to require production/inspection and to issue written notices. DLVR and VT items penalise failure to comply with Registrar’s notices and to return documents/certificates/number plates within prescribed timeframes (e.g. DLVR 58 items 532-538).
Photographic detection devices: Reg 7 and multiple Schedule items explicitly provide for offences detected by photographic devices, and set specified penalty/demerit outcomes for those photographic detections (e.g. items 17, 19, 69, 71, 363A, 365A, 414AB). This formalises automated enforcement as a detection modality within the prescribed-offence schema.
Interaction with Part IVB and other Act enforcement machinery: Reg 6 prescribes offences for Part IVB of the Traffic Act and specifies the penalty units and demerit points applicable for those offences under that Part. That ties the Schedule directly into the Act’s enforcement architecture (reg 6(a)-(c)).
Practical enforcement impact
The consolidated Schedule produces a single reference for which conduct triggers monetary fines and demerit points under the Traffic Act regime, removing ambiguity about the penalty metric that applies for many subordinate offences. Because the Schedule contains some items with blank penalty-unit cells but subrows specifying actor-specific penalties, readers must consult the full table entries to determine the correct sanction.
The presence of photographic detection variants in Schedule 1 and reg 7 signals that automated enforcement is an explicit element of the regulatory enforcement mix; in practice this creates different procedural and evidentiary considerations for detection, notice and appeal than person-observed enforcement, although the regulations themselves do not supply those procedural rules.
How it interacts with other laws
The regulations operate as a cross-referencing enforcement instrument: they do not stand in isolation, but map offences from multiple Acts and subordinate regulations into the enforcement framework of the Traffic Act 1925 and related regimes. Key interactions apparent from the source follow.
Traffic Act 1925 (the Act): The regulations repeatedly reference specific sections of the Act and specifically prescribe offences for the purposes of those sections. Reg 4 prescribes “a parking offence” for s 9(3) of the Act. Reg 5 prescribes offences for s 43H(6A). Reg 6 prescribes offences for Part IVB of the Act and specifies penalties and demerit points for those prescribed offences (reg 6(a)-(c)). Reg 7 prescribes offences for s 54(1AA) of the Act. Reg 8 prescribes authorities for s 59(1A)(b) of the Act.
Vehicle and Traffic Act 1999 (VT) and DLVR 2021: The Schedule includes a full Division (Part 2, Division 1) devoted to VT offences (items 451-509 and beyond). Additionally, the DLVR is given a separate Division within Part 2 of the Schedule; numerous offences originate in the DLVR (items 510 onwards). The regulations therefore bring driver-licensing, registration and ancillary certificate rules from the DLVR/VTA regime into the common enforcement tariff.
Road Rules (RR): A large portion of Schedule 1 lists Road Rules offences (speeding, signalling, stopping, pedestrian and bicycle rules, etc.). Because reg 3 defines RR to mean the Road Rules (and reg 6 prescribes many RR offences for Part IVB), the regulations integrate routine driving-rule contraventions into the Traffic Act’s enforcement mechanisms.
Vehicle Operations (VOR) and Vehicle Standards (VSR) regulations (2024): Newer subordinate instrument regimes are incorporated by definition (VOR, VSR) in reg 3 and by prescription in Schedule 1 (items 622-675 for VOR; items 676-731 and following for VSR). That links vehicle dimensions, load, towing, vehicle standard and emissions rules to the Traffic Act enforcement system.
Motor Accidents (Liabilities and Compensation) Act 1973 (MALC): The Schedule includes offences linked to vehicle insurance and premium status under MALC items 988-995, integrating insurance-related obligations into the penalty schedule.
Procedural cross-links: Many DLVR and VT items reference obligations to comply with Registrar’s notices, return licences/certificates, affix plates, and produce documents. Those duties are statutory obligations under the VT/DLVR regimes, and the regulations simply fix the penalty metric where the Act’s enforcement machinery applies.
Rescission of earlier traffic compliance regulations: Schedule 2 lists the Traffic (Compliance and Enforcement) Regulations 2011 and subsequent amendment regulations that are rescinded. The 2017 instrument thereby supplants the previous instrument set, though the text also records numerous subsequent amendments and substitutions (see amendment history).
Illustrative text v underlying law: Reg 6(b) explicitly preserves the primacy of the underlying source provisions for offence elements by stating that column 3 descriptions are illustrative only. Practitioners must therefore read the originating statutory/regulatory provision cited in column 2 to determine the precise legal elements.
Net effect on legal architecture
The regulations are a consolidation and linking instrument that aligns various source offences under the Traffic Act’s enforcement provisions (and Part IVB specifically). They do not displace the substantive offences in the underlying enactments; instead they provide a common set of enforcement consequences and an administrative mapping between detection/enforcement modalities (including photographic detection) and penalties/demerit outcomes.
Amendment history
The text of the regulations is annotated with the secondary instrument amendment history that changed definitions, substituted divs/subdivisions, and updated Schedule entries across years. The instrument itself was notified in the Gazette on 26 July 2017 (final line of the instrument). Beyond the 2017 making, the schedule and other regulations show multiple subsequent amendment actions. The annotations in the source give the applied dates and S.R. instrument numbers where relevant; the following is a structured summary based on those annotations in the text.
2017 , Original instrument and early amendments:
The regulations are cited as Traffic (Compliance and Enforcement) Regulations 2017 (reg 1).
Several parts of Schedule 1 include amendment notes marking change by S.R. 2017 No. 63, applied 27 Sep 2017 (see numerous subdivision notes such as Subdivision 1 of Division 2 of Part 1).
2018 , Substitutions and amendments:
Regulation 3 subregulation (1) shows amendments by S.R. 2018, No. 57 (applied 20 Sep 2018) for some defined components (DLVR references).
Part 3 subdivisions were frequently substituted by S.R. 2018, No. 57 (applied 20 Sep 2018) before later rescission (see Part 3 notes).
VSR/VOR and VSR-related items show a 2018 S.R. 63 amendment in the Subdivision 11 control of emissions entries (applied 14 Nov 2018).
2020 , Amendments:
Regulation 3 subregulation (1) annotations include S.R. 2020, No. 74, applied 1 Dec 2020, affecting some defined terms.
Subdivision 45 and other entries indicate S.R. 2020 No. 74 applied 01 Dec 2020 (see notes near items under Subdivision 45).
2021 , Significant substitution and reclassification:
Regulation 4 was substituted by S.R. 2021, No. 29 (applied 01 Jun 2021) (reg 4 note).
Regulation 5 and 7 show amendments by S.R. 2021 No. 29 applied 01 Jun 2021 (reg 5 and reg 7 notes).
Division 2 of Part 2 of Schedule 1 (the DLVR-related Division) was substituted by S.R. 2021, No. 29 applied 01 Jun 2021; many DLVR entries carry that substitution annotation.
Several subdivisions were inserted or amended by S.R. 2021 No. 102 and S.R. 2021 No. 129 at end-of-year dates (applied 01 Dec 2021 and 22 Dec 2021 respectively) to add entries such as Subdivision 41A (personal mobility devices) and to amend Subdivision 43 entries.
2022 , Amendments and new VOR content:
Subdivision 4 of Division 2 Part 1 and other parts include amendments by S.R. 2022 No. 44 (applied 13 Jul 2022); Subdivision 13 shows amendments by S.R. 2022 No. 52 applied 01 Aug 2022.
Subdivision 3 of Part 3 shows amendment notes by S.R. 2022 No. 86 applied 01 Dec 2022.
2023 , Rescissions and further amendments:
Parts of Schedule 1 were rescinded by S.R. 2023 No. 38, applied 26 Jun 2023 (numerous Part 3 and other rescission notes).
Regulation 7 was amended by S.R. 2023 No. 32 applied 23 Jun 2023 (reg 7 note).
2024 , New VOR and VSR regulations and substitutions:
Regulation 3 shows amendments by S.R. 2024 No. 45 applied 18 Sep 2024 to add VOR and VSR definitions and other references.
Division 3 (Vehicle and Traffic (Vehicle Operations) Regulations 2024) entries in Schedule 1 include notes showing substitution or insertion by S.R. 2024 No. 45 applied 18 Sep 2024 (notably Subdivision 5 of Division 3 was substituted by S.R. 2024 No. 45; several items 652-669 and load limit road sign offences items 670-675 show the 2024 substitution).
Division 4 (Vehicle and Traffic (Vehicle Standards) Regulations 2024) and many VSR-linked Schedule entries were substituted and updated by S.R. 2024 No. 45 applied 18 Sep 2024 (items 676-731 and many subparts).
2025 , Further amendment:
Subdivision 41A (personal mobility devices) was amended by S.R. 2025 No. 61 applied 10 Dec 2025 (see top of Subdivision 41A annotations).
Administrative note: The instrument’s end text states “Notified in the Gazette on 26 July 2017” and that the regulations are administered in the Department of State Growth.
Practically, the amendment history shows active maintenance: the instrument has been used as the locus for updating the enforcement mapping across many subordinate instruments and to incorporate new regulatory regimes and technologies (photographic detection, PMDs, VOR/VSR). For precise legal history of any particular Schedule item, the annotation adjacent to that item in Schedule 1 gives the S.R. amendment instrument and applied date; practitioners should consult the official legislative database for the consolidated instrument and amendment instruments to determine the current text.
Litigation history
The regulations as provided contain no cases, judicial decisions or any litigation history. The source is the text of the regulations together with amendment annotations; it does not record court challenges, appeals or judicial constructions of the instrument. Therefore:
There is no litigation history recorded in this instrument text.
If a practitioner requires decisions interpreting how the Traffic Act or these regulations apply in contested proceedings (e.g., challenge to photographic detection evidence or to the application of demerit points), they must consult court databases and reported/unreported decisions; none are cited here.
Because the Schedule entries cross-reference existing statutory offences (e.g. provisions of the Traffic Act, VT, RR, DLVR, VOR, VSR, MALC), litigation that interprets those underlying provisions will affect how the Schedule is applied in practice. The Schedule’s column-3 descriptions are illustrative only (reg 6(b)), so judicial interpretation of the underlying statutory elements will determine factual proof and available defences.
Gotchas
Practitioners and compliance officers should note several non-obvious or easily-misread features in the instrument text.
Column 3 descriptions are illustrative only (reg 6(b)). The Schedule’s textual description in column 3 is not the legal definition of the offence; the source provision cited in column 2 is the definitive legal text. Do not rely on the Schedule’s description for elements , consult the underlying Act/regulation specified in column 2.
Photographic-detection variants: Reg 7 and multiple Schedule entries create separate items for offences detected by photographic devices. Those photographic variants often carry the same or different penalty/demerit outcomes (e.g. speed and red-light photographic entries). Consequence: enforcement evidence and notice procedures will differ from person-observed enforcement; ensure statutory notice procedures for photographic detection (as specified in the relevant underlying Act provisions) are followed.
Actor-specific bifurcation: Many offences have different penalties and demerit point consequences depending on the actor , “rider of a bicycle” vs “any other driver”, or individual vs body corporate. For composite situations (e.g. multiple occupants, company-owned vehicles), identify the correct actor before applying the penal metric. For example, TA 43G(3) has separate penalty levels for individuals and corporate entities (item 12).
Blank penalty cells in the table: Some table rows show blank penalty-unit cells followed by subrows for actor-specific penalties. The correct penalty is the one in the actor-specific subrow. Read the full row block carefully rather than only the primary line when assessing penalty exposure.
Overlap across regimes: The same conduct might contravene multiple source provisions or be described under multiple Schedule items. For instance, parking offences are referenced in reg 4 (for s 9(3)) and throughout Schedule 1 (many parking-related RR items). Practitioners must check which statutory regime’s enforcement mechanism is being used in a particular case (e.g. whether the Act’s Part IVB procedure is being invoked) and ensure penalties/demerit points apply under the correct prescription.
Prescribed authorities specification is narrow: Reg 8 prescribes a specific short list of authorities for s 59(1A)(b). If relying on s 59(1A)(b) to give effect to an entitlement or notice involving a “prescribed authority”, verify that the authority in question appears on that list; otherwise s 59(1A)(b) may not apply as anticipated.
Rescission of older instruments: Schedule 2 rescinds earlier Traffic (Compliance and Enforcement) Regulations instruments (2011 and subsequent amendments). If dealing with historical enforcement action, verify which instrument was in force at the relevant time because the Schedule rates and entries changed over time.
Multiple amendment annotations across Schedule: The Schedule includes many marginal notations referencing substituted or amended subdivisions with S.R. numbers and applied dates. For compliance and retrospective analysis practitioners must consult consolidated legislation to be sure which version was in force on a given date.
“Use” and “cause or permit” phrasing recurs: Many offences are framed as “use, or cause or permit the use of”, which catches not only the driver but also owners and persons who allow use by others. That extends enforcement exposure beyond the immediate driver to owners and registered operators (e.g. VOR and VSR items).
Photographic detection for seatbelt and driver restraint: Reg 7 and items 363A, 365A show that driver restraint offences may be enforced by photographic detection in specified circumstances; this can create evidence admissibility and identity issues (who is the driver) and generate owner/registered-operator duties (TA 51 style) to provide driver information.
These are not policy critiques but points where the regulatory mapping and drafting can create practical traps for the unwary , either by producing divergent metadata (illustrative descriptions), by generating multiple potential enforcement routes, or by extending liability to non-driving actors.
How to comply
Compliance must be organised at several levels: (1) individual road-user conduct, (2) vehicle/operator administrative compliance, (3) fleet and corporate governance, and (4) document-management and response to notices. The Schedule indicates a wide set of discrete duties: below is an actionable compliance checklist anchored to the instrument’s entries and references.
Keep the underlying provisions to hand
For any enforcement risk identified via Schedule 1, read the source provision cited in column 2 (reg 6(b) reminds that column 3 is illustrative only). Do not rely on the column 3 summary for the legal elements of the offence.
Operational driving and rider behaviour
Training and reminders: Ensure drivers and riders know the specific Road Rules relevant to their role: speed limits, signalling, seatbelt usage (RR 264-266), helmet rules for motorcycles and bicycles (RR 256, RR 270), mobile-phone prohibitions (RR 299-300), and the specific speed thresholds in the schedule (items 16-35). Many of these carry demerit points; repeated breaches risk licence suspension under existing demerit rules.
Photographic detection awareness: Because some offences are enforced by photographic devices (see reg 7 and Schedule photographic entries), instruct drivers that automated detection can trigger notices even where no on-the-spot police interaction occurs; ensure fleet procedures for responding to such notices are in place.
Vehicle- and fleet-level compliance
Plates, covers and identification: Ensure number plates are correctly affixed, unobscured and not treated with substances that prevent photographic detection (DLVR 89 items 543-547). Keep number plate covers compliant and clear.
Inspection labels and certificates: For vehicles subject to inspection programs, affix and keep inspection labels on vehicles as required (DLVR 136 items 573-576). Maintain records of inspections and ensure timely presentation when required.
Vehicle standards and load restraints: Maintain vehicles so they comply with VSR vehicle standards (items 676-731) and VOR/VOR load/towing/oversize rules (items 622-675). Use the Load Restraint Guide standards where referenced (VOR item 644) and ensure coupling and towing capacities are not exceeded (VOR 30-33 items 652-654). Review modifications through a vehicle standards compliance process to avoid contravention of DLVR 138/VSR requirements (items 583, 677).
Tyre pressures and mass/dimension monitoring: Implement checklists and asset-management routines to keep tyre pressure within published limits (VOR 7 item 622) and to monitor mass/axle loads to avoid graded mass penalties (VOR 19-20 items 633-642 and VOR 53 items 670-674).
Insurance and premium exposure: Verify motor vehicle insurance cover meets MALC requirements and that premium liabilities are not exceeded without appropriate upgrade permits (MALC items 988-995). Ensure changes in vehicle configuration or use that increase premium liability are notified and covered.
Administrative and documentary obligations
Carrying and producing documents: Drivers must carry Australian driver licences, restricted licences, foreign licences and ancillary certificates where required (DLVR 46A and items 490-493). Establish fleet-issued reminders and checklists to ensure licences and ancillary certificates are carried and produced on request.
Respond to Registrar notices promptly: The statutory timetable for producing vehicles, returning licences, or supplying information is enforced via Schedule offences (e.g. DLVR 58 items 532-538; VT 50 items 505-506). Put a legal-administration process in place to calendar, respond and produce documents within the specified period (often 7 days or 21 days in the Schedule entries).
Driver identification requests: For owner or registered operator obligations to provide driver information (TA 51(3) items 13-15), set administrative procedures to record hirings, fleet allocations, GPS/telematics, trip logs and to produce driver identity information when lawfully requested, because failure carries penalty units.
Vehicle-defect notices: Where a driver or registrar issues a vehicle defect notice (DLVR items 554-564), have an immediate operational escalation process to rectify the defect, document repairs, and ensure the vehicle is not used contrary to the notice. Maintain repair and inspection records.
Corporate governance and compliance frameworks
Liability mapping: Because many offences use “use, or cause or permit the use of” wording, owners and corporate managers can be liable for failures even where not personally driving. Review corporate policies and employment contracts, create compliance obligations for employees, and audit adherence to avoid owner/registered-operator exposure.
Delegation and authorised persons: Ensure authorised person interactions are handled by trained staff (responding to police or authorised officer directions referencing RR 304 or VT/DLVR inspection powers). Train employees to follow lawful directions to avoid separate “fail to obey” offences (item 422).
Records retention: Keep copies of registration, inspection, repair, and insurance documents for the statutory windows that are likely to be relevant to proceedings and Registrar inquiries. Many offences penalise failure to produce documents within 7 or 21 days (see DLVR and VT items).
Permit and exemption compliance: For operations under exemptions or permits (temporary upgrade permits, interchange trailer distinctions, farm vehicle rebates and distinctive plates), keep permit documents on board (VOR 52 item 669) and comply with permit conditions to avoid the specific “contrary to permit” offences (items 652-662, 593-596).
Practical checklists for immediate compliance steps
Weekly: inspection of plate covers and cleanliness, update driver allocation records, confirm any registrations/inspections due within 7-21 days.
Monthly: review telematics reports for speeding or mobile-phone use events, run demerit point reports, ensure driver licences and ancillary certificates are current.
On receipt of any enforcement notice: identify the source provision cited (Schedule column 2), verify the detection method (photographic or person observed), ascertain the timeline to respond (Registrar requirements, produce documents), and escalate to legal/compliance team.
Liaison with authorities and prescribed authorities
Where a notice involves a “prescribed authority” under reg 8 (Aurora, Forestry Tasmania, Tasmania Water and Sewerage Corporation, Telstra, departments named, Transend Networks), coordinate with those entities if they are counterparties in operations or infrastructure activities.
In short, compliance requires treating the regulations as a tariff overlay linking many operational legal duties to enforcement outcomes, implementing both behavioural and administrative controls, and maintaining records and response procedures for inspections, notices and photographic-detection notices. Because the Schedule entries are linked to underlying statutory provisions, confirm legal elements and evidentiary processes in the originating statutes before relying on the Schedule’s summary.
