TIWI ISLANDS REGIONAL COUNCIL BY-LAWS 2018

Several concepts organise the by-laws and determine operational mechanics. First, authorised person, defined by reference to an appointment under the Local Government Act 2008 (by-law 3), is the central enforcement actor. An authorised person may exercise any reasonable power necessary to give effect to these by-laws, subject to Council-imposed conditions (by-law 6). The text leaves the precise scope of appointment and conditions to the appointment instrument and Council policy, but the by-laws place investigative, preventive and remedial powers with authorised persons: issuing infringement notices (by-law 24), directing removal of litter and commercial waste (by-law 14), seizing dogs (by-law 21), inspecting waste loads at Council facilities (by-law 13(5)), and arranging destruction of dogs in specified circumstances (by-law 22).

Second, strict liability applies. By-law 7(1) brings Part IIAA of the Criminal Code into play, and by-law 7(2) declares every offence under the by-laws to be an offence of strict liability. The by-law’s note records that Part IIAA contains general principles of criminal responsibility, defences and burdens of proof, and elaborates common concepts used in offences. Within the by-laws themselves this has two practical effects. One, mens rea is not required for the statutory contraventions to be proved, subject to any defences available under Part IIAA. Two, the enforcement scheme therefore leans towards administrative expiation and summary enforcement via infringement notices rather than fault-based prosecutions. The regime also records maximum penalty units for court prosecutions (for example by-law 10(1) 15 penalty units; by-law 12 50 penalty units; by-law 18 20 penalty units).

Third, parallel tracks of enforcement are available. The by-laws create designated infringement notice offences and prescribe monetary amounts for expiation (by-law 23 and Schedule). At the same time the text preserves the ordinary criminal prosecution route: Part 5 explicitly provides that the existence of the infringement scheme does not prevent prosecution in court for an offence for which an infringement notice has not been given, and multiple infringement notices may be given for the same offence (by-law 28(1)(b),(c) and (2)). The infringement notice process is detailed so the notice must state the offence, prescribed amount, enforcement agency to which payment is payable, options to expiate within 28 days, and the right to elect court proceedings under the Fines and Penalties (Recovery) Act 2001 (by-law 25).

Fourth, property-based recovery is available. If someone fails to comply with a removal direction regarding litter or commercial waste, authorised persons may carry out the work and the Council may recover reasonable costs and expenses as a debt (by-law 14(4)-(5)). In addition, non-payment of infringement notices can lead to enforcement action under the Fines and Penalties (Recovery) Act 2001, which the by-laws list at 25(2)(c) and include examples of actions that agency law may take against a non-paying person.

Fifth, the by-laws establish a local administrative register and identity tokens for animals. The CEO must keep a dog register with specified data fields (by-law 16). For each registered dog the Council must issue a numbered dog-tag that corresponds with an entry (by-law 17(3)). Registered dogs must wear a suitable collar and dog-tag and owners must obtain replacement tags if lost (by-law 19). The register, tag and collar system is the primary compliance mechanism for dog control actions such as seizure for dogs without tags (21(1)(d)).

Sixth, conditional delegations and exceptions are embedded. Authorised persons act subject to Council-imposed conditions (6(2)), CEO has administrative responsibility for the register (16(1)), and the Council may determine days and hours for facility operation and the rules for entry (13(1),(3)). The Council may also authorise qualified persons to perform destruction of dogs if the CEO considers them suitably trained (22(4)(c)). Finally, the by-laws contain a transitional exemption preserving dogs registered before 1 September 2018 from new offences restricting numbers and registration (by-law 30).

These concepts together create a local regulatory system that mixes administrative recording and identity (register and tags), quick-expiation and low monetary penalties for minor breaches (Schedule), strict liability offences, targeted higher maximum penalties for more serious breaches (e.g. 50 penalty units for commercial waste offences), and operational discretion for authorised persons and the CEO.

The by-laws apply to every person in the Tiwi Islands Regional Council area and specify actors and responsibilities. By-law 5 expressly limits application to the Council area. Affected groups fall into several categories.

Residents and householders: People who own, keep, or otherwise have care and control of dogs in the Council area are directly affected. Owners must register dogs kept for more than three months (17(1)), ensure registered dogs wear collars and dog-tags (19(1)), comply with numerical limits on dogs on premises unless authorised (15, 18), and comply with any conditions imposed if a dog is declared dangerous (20). Owners can be subject to seizure of dogs under a range of grounds (21(1)) and to destruction in limited circumstances (22). Owners of properties are the persons liable for costs ordered by authorised persons for cleaning up litter or commercial waste on their land when directed (14(4)-(5)), because those costs are a debt to the Council by the person to whom the notice was issued.

Businesses and commercial operators: A person producing commercial waste is regulated separately. They are prohibited from leaving commercial waste except at a Council waste management facility (12) and must deposit commercial waste at the facility on the days and during the hours specified by Council (13(2)). They must also comply with entry and deposit rules for the facility and allow authorised persons to inspect loads proposed for deposit (13(1)-(5)). Commercial operators face the highest maximum penalties in the by-laws, up to 50 penalty units for deposit of commercial waste outside prescribed ways (12, 13(2), 13(4)).

Users of public places, visitors and meeting attendees: Members of the Council at meetings and other people attending meetings are regulated by the meeting-order provisions (8-9). Members may be called to order and required to apologise or to leave (8(2)-(3)), while non-members who interrupt a meeting must leave if requested by the chair (9(1)). Persons attending public places are directly affected by the litter and public-safety provisions prohibiting leftover or discarded waste that would endanger health (10-11).

Council staff and authorised persons: The CEO, authorised persons and the Council itself are active decision-makers. The CEO must keep the dog register (16(1)) and may approve persons to destroy dogs if suitably qualified (22(4)(c)). Authorised persons make enforcement judgments under the by-laws regarding litter removal directions (14), seizure of dogs (21), declaration of dangerous dogs and imposition of conditions (20), and issuance of infringement notices (24). The Council sets facility rules, hours and days (13), may impose conditions on authorised persons (6(2)), and may charge fees or waive them (29).

People subject to enforcement via the Fines and Penalties (Recovery) Act 2001: The infringement notice scheme links to that Act; persons who do not pay an expiation face enforcement measures listed in by-law 25(2)(c), including suspension of licences, seizure of property, wage garnishment, statutory charges on land, community work orders and, if a person contravenes a community work order, potential imprisonment. These are enforcement consequences dependent on non-payment and the application of the separate recovery Act.

Third parties engaging in transfers of dogs: Anyone proposing to transfer ownership of a dog declared dangerous must inform the transferee that the dog is dangerous before transfer (20(3)). That obligation places a duty on transferors to disclose the dog's status.

In short, affected parties include private households, commercial operators who generate waste, attendees at Council meetings, Council staff and authorised persons, and persons interacting with the Fines and Penalties enforcement regime. The by-laws concentrate obligations on dog owners and waste producers, expose individuals to strict liability offences for minor environmental and animal-control breaches, and create administrative duties for Council officers in maintaining registers, issuing tags and supervising authorised persons.

The by-laws set out specific duties for individuals, and procedural rights in the form of infringement notice options and certain administrative safeguards.

Duties

• Keep dogs within numerical limits and obtain authorisation if more than two dogs are kept on a premises for more than three months (by-laws 15 and 18(2)). The owner of an unregistered dog must not keep it for more than three months in the Council area (18(1)). The transitional clause preserves prior registrations so that pre-1 September 2018 registrations are not caught (30).

• Register dogs kept for more than three months, provide required information to the Council for the dog register, and ensure dogs wear suitable collars and issued dog-tags, replacing lost tags when necessary (16-19). The CEO is obliged to maintain the dog register in the manner determined by Council (16(1)), and the register must contain owner name and address, the usual premises address and any conditions imposed on keeping the dog (16(2)).

• Comply with local waste and litter obligations: do not leave litter in a public place outside a rubbish bin (10(1)); do not abandon litter that is likely to cause injury or endanger health (11(1)); do not leave commercial waste except at Council facilities and only in accordance with days and hours specified by Council (12, 13(1)-(2)); follow facility rules and directions on how commercial waste must be deposited (13(3)-(4)); allow authorised persons to inspect loads proposed for deposit (13(5)).

• If served with a written direction by an authorised person to remove litter or commercial waste, comply within the period stated by the authorised person (14(1)-(3)). Failure may lead to the Council carrying out removal and recovering costs and expenses as a debt (14(4)-(5)).

• If a dog is declared dangerous, comply with any conditions imposed on its keeping, which may include secure enclosures or leashing and control by a person capable of restraining it (20(2)). Inform any person to whom ownership is to be transferred that the dog is dangerous before transfer (20(3)).

• If an authorised person seizes a dog, the person must permit the authorised person to identify and locate the owner (21(2)).

Rights and procedural protections

• Where an authorised person believes on reasonable grounds an infringement notice offence has occurred, they may issue an infringement notice; the person served has 28 days to expiate the offence by paying the prescribed amount to the specified enforcement agency, or may elect to have the matter dealt with by a court under the Fines and Penalties (Recovery) Act 2001 by completing a statement of election provided with the infringement notice (by-law 25(2)(a)-(b)). The infringement notice must contain specified particulars including name and address if known, date and place of the alleged offence, a description of the offence, the prescribed amount and the enforcement agency (25(1)). This information gives the notified person the information needed to decide whether to pay or elect court.

• Payment methods are specified. For electronic payments the amount is not paid until credited to the Council’s bank account and cheques must clear on first presentation to be effective payments (26). This gives the Council a defined point at which payment is accepted.

• The Council may withdraw an infringement notice by written notice within 28 days of issuing the notice and before payment is made (27(1)-(2)). This preserves the Council’s power to reconsider and withdraw administrative penalties.

• The by-laws provide an explicit survival of prosecutorial authority: the existence of the infringement scheme does not preclude prosecution in court and multiple infringement notices can be issued for the same offence (28(1)-(2)). This means electing court is an option and the person may face prosecution where appropriate.

• Following destruction of a dog under specified grounds, the authorised person must take reasonable steps to identify and locate the owner and give written notice to that owner stating reasons for destruction (22(5)). This is an administrative notice requirement after a final, irreversible action.

Administrative duties

• The CEO must keep a dog register (16(1)) and is given a role in approving suitably trained persons who may destroy dogs if required (22(4)(c)). The Council must set rules, days and hours for waste management facilities (13(1)-(3)) and may impose conditions on authorised persons (6(2)). The Council can charge and waive fees for services under the by-laws (29).

In sum, duties fall heavily on dog owners and waste producers, while notified persons retain statutory options to expiate or elect court, and the Council and CEO carry administrative duties to register, issue tags, determine facility rules and supervise authorised persons.

The by-laws create a dual enforcement architecture combining criminal penalties, an infringement notice expiation scheme, administrative remedial powers and cost recovery. Enforcement tools and penalty magnitudes vary by offence.

Maximum penalties in court: Several by-laws specify maximum penalties expressed in penalty units. Examples include:

• Leaving litter in a public place outside a bin, maximum 15 penalty units (by-law 10(1)).
• Leaving litter likely to cause injury or endanger health, maximum 25 penalty units (by-law 11(1)).
• Leaving commercial waste other than at a Council facility, maximum 50 penalty units (by-law 12).
• The owner of an unregistered dog kept in the Council area for more than three months faces a maximum penalty of 20 penalty units (by-law 18(1)), and keeping more than two dogs without permission similarly attracts 20 penalty units (by-law 18(2)).
• Waste facility entry, deposit and compliance offences carry various maximum penalties as set out in by-law 13, with some offences carrying up to 50 penalty units.

Strict liability: By-law 7(2) declares offences against the by-laws to be offences of strict liability. That reduces the prosecutor’s burden to prove mens rea, subject to any defences provided under Part IIAA of the Criminal Code which the by-laws import via by-law 7(1).

Infringement notice and prescribed amounts: Part 5 sets out the infringement notice process. By-law 23 makes particular provisions listed in the Schedule into infringement notice offences and sets the prescribed amount as the monetary value of the specified number of penalty units (23(2) and Schedule). The Schedule prescribes relatively small amounts (expressed in penalty units): for example by-law 10 is set at 0.5 penalty units, by-law 11 at 1 penalty unit, by-law 12 at 4 penalty units, and by-law 18(1) at 0.5 penalty units. This creates a divergence between the statutory maximum penalty for court prosecution and the small monetary amounts available for expiation by infringement notice.

Issuing and content of infringement notices: An authorised person may issue an infringement notice if they believe on reasonable grounds that an infringement offence occurred (24). Notices must state specific details such as the name and address if known, date, time and place, description of the offence, the prescribed amount and the enforcement agency to which payment is payable (25(1)). Notices must also explain the right to expiate within 28 days, the right to elect court proceedings under the Fines and Penalties (Recovery) Act 2001 as per section 21 of that Act, and the potential enforcement actions that may follow if the notice is ignored (25(2)(a)-(c)).

Payment and withdrawal: Payment is only effected when funds are properly credited to the Council’s bank account for electronic payments, and cheques must clear on first presentation (26). The Council may withdraw an infringement notice within 28 days and before payment (27(1)-(2)).

Administrative remedial powers and cost recovery: Where a person is directed in writing by an authorised person to remove litter or commercial waste and fails to do so within the specified period, the authorised person may carry out or cause the work to be done, and the Council’s reasonable costs and expenses are recoverable as a debt from the person (14(4)-(5)). The debt recovery route is separate from the criminal penalty and infringement scheme and operates as a civil recovery of costs.

Seizure and destruction of animals: Authorised persons may seize dogs for a range of reasons (21(1)), and may arrange for destruction in narrow circumstances,if a dog is diseased, savage or destructive and in the authorised person’s opinion is an immediate and actual threat to public safety, or if a dog is diseased or injured and in the authorised person’s opinion it would be cruel to keep it alive (22(1)-(2)). Destruction must be humane (22(3)), may be carried out by specified categories of people (22(4)), and the authorised person must make reasonable efforts to notify the owner afterwards with reasons for the destruction (22(5)).

Link to Fines and Penalties (Recovery) Act: The infringement notice mechanism ties into the recovery Act and the enforcement measures described in by-law 25(2)(c), for example licence suspension, seizure of property, salary deductions, registration of statutory charges on land, community work orders and imprisonment for breach of a community work order. Those downstream enforcement tools are invoked under the recovery Act once the Council refers unpaid penalties to the enforcement agency.

Practical enforcement implications: The combination of strict liability, low prescribed expiation amounts for many offences, civil cost recovery for litter removal and powerful seizure and destruction powers for dogs concentrates enforcement discretion with authorised persons and administrative actors. Offences that attract relatively high maximum penalties in court are nonetheless assigned small prescribed monetary amounts for expiation in the Schedule, which encourages resolution via the infringement notice route for routine matters.

The by-laws reference and depend on several external instruments and statutory frameworks, establishing interaction points that affect enforcement, administrative procedure and the scope of delegated power.

Local Government Act 2008: The definition of authorised person is expressly by reference to a person appointed under section 112(1) of the Local Government Act 2008 (by-law 3). That means the appointment mechanism, qualification, delegation limits and formalities for authorised persons are governed by that Act. The by-laws therefore sit as subordinate rules that rely on the Local Government Act for the legal basis of enforcement officers and their delegated powers.

Criminal Code, Part IIAA: By-law 7(1) imports Part IIAA of the Criminal Code to apply to offences created by the by-laws. The by-law’s note explains that Part IIAA sets general principles of criminal responsibility, defences and burden of proof. Because Part IIAA is imported, any defences, presumptions and interpretive rules in that Part will influence how strict liability is applied and whether particular defences are available in prosecutions under these by-laws. The by-laws themselves declare offences to be strict liability offences (7(2)), but the precise legal contours of defences and exculpatory provisions will follow Part IIAA.

Fines and Penalties (Recovery) Act 2001: The infringement notice scheme is explicitly linked to the Fines and Penalties (Recovery) Act 2001. The by-laws require infringement notices to give the notified person information about election rights under section 21 of that Act and identify an enforcement agency as defined in that Act (25(1)-(2)). The by-laws also list examples of recovery actions that the enforcement agency may take if a person does nothing in response to an infringement notice, including licence suspension, seizure of property and statutory charges on land (25(2)(c)). Thus the practical enforcement consequences for unpaid infringements will be determined by the machinery of the recovery Act and the designated enforcement agency.

Interpretation Act 1978: By-law 3 contains a note that the Interpretation Act 1978 contains definitions and other provisions relevant to the by-laws. That means statutory interpretation, definitions of terms such as penalty unit, and commencement rules from the Interpretation Act may be applied when construing the by-laws.

Other territorial or federal laws not specified: The by-laws are tailored to the Tiwi Islands Regional Council area and do not purport to displace state or federal laws that operate in the same territory. For instance, animal welfare, biosecurity, dangerous dog declarations under other legislation, or issues arising under general criminal law might intersect with the by-laws’ provisions on dog destruction, seizure and dangerous dog declarations. The by-laws do not themselves describe how they interact with other animal welfare or public health laws, therefore practitioners should check those statutes when advising on overlap or pre-emption.

Regulatory and administrative interfaces: The by-laws make the CEO responsible for maintaining the dog register and for approving persons to destroy dogs if suitably trained (16(1), 22(4)(c)). Those administrative functions will therefore be performed within the constraints of the Local Government Act and any internal Council governance rules. The Council’s power to charge fees, and to determine facility rules, days and hours for waste management facilities, will interact with statutory procurement, financial management and administrative law principles that govern how local authorities must set fees, publish rules and exercise delegation.

In summary, the by-laws are embedded in a web of Territory law. They rely on the Local Government Act for authorised person appointments, import criminal responsibility concepts from the Criminal Code, and rely on the Fines and Penalties (Recovery) Act for enforcement of unpaid infringement notices. Practical enforcement and legal interpretation will therefore require reference to those external statutes.

The instrument itself includes an endnotes section recording its making and commencement details and indicates some formal amendments of a technical nature.

Key production details recorded in the endnotes are:

• The by-laws were made as Tiwi Islands Regional Council By-laws (SL No. 22, 2018).
• They were notified on 1 August 2018 and commenced, except for by-law 18(1), on 1 August 2018 as recorded at by-law 2 and endnote 2. By-law 18(1) (the provision making it an offence for the owner of an unregistered dog to keep it more than three months) commences later, on 1 September 2018 (by-law 2(2); endnote 2).

The endnotes also record that general amendments of a formal nature were made by the Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018) to by-laws 1, 3 and 25 (endnote 3). The note identifies these as general formal amendments rather than policy changes; the reprint indicates those amendments are of a formal nature and not further detailed in the instrument. The by-laws’ text includes internal commencement provisions reflecting a staggered start date for the dog-registration offence.

There is no further amendment history recorded in the provided text up to the reprint date of 1 September 2018. There are no later amending instruments set out in the text available here, and no notes of subsequent legislative amendments, suspensions or repeals. Practitioners should therefore check Territory legislative databases for any later amendments beyond the reprint date if they require the current state of the law.

The by-laws are drafted to allow Council-level operational controls to be set and adjusted administratively (for example, days and hours for waste facility use, facility rules, conditions on authorised persons and fees and fees waivers). Such operational changes do not require amendment of the by-laws themselves but do affect how the by-laws operate. The instrument therefore combines legislative provisions that change only by formal amendment together with Council-controlled operational levers that will change practice without formal legislative amendment.

The by-laws contain no recorded litigation history in the text provided. The instrument names no cases, and the endnotes do not identify any judicial attentions or declaratory proceedings. The by-laws themselves are recent at the reprint date, notified 1 August 2018 and with a limited staggered commencement for one clause on 1 September 2018 (endnote 2).

Because the text imports Part IIAA of the Criminal Code and references the Fines and Penalties (Recovery) Act 2001, litigation may in principle arise concerning the interaction of strict liability concepts from Part IIAA with specific defences, or concerning enforcement actions taken under the recovery Act. However, none of that litigation is recorded in this instrument.

If litigation were to occur it would likely concern issues such as:

• Whether a particular enforcement action by an authorised person was reasonable and within the conditions or powers imposed by Council (relating to by-law 6).
• The correct application of strict liability defences under Part IIAA to by-law offences (7).
• Procedural fairness around seizure or destruction of dogs that arguably did not meet the statutory tests in by-laws 21 and 22, including the adequacy of steps to identify and notify owners (21(2), 22(5)).
• Challenges to Council fee or facility-rule decisions that affect rights to access waste-management services under by-law 13, or disputes over cost recovery under by-law 14(5).
• Disputes about the adequacy of infringement notice content or timing, or the exercise of the Council’s power to withdraw a notice (by-laws 25-27).

Because none of these has been set out in the instrument, practitioners should search case law databases and Territory court records for any decisions involving the Tiwi Islands Regional Council by-laws or comparable by-laws in other Northern Territory councils that interpret the same statutory themes.

The by-laws contain several features that can create operational surprises or strategic issues for affected persons and for the Council when enforcing them. The following are concrete points drawn from the text.

Strict liability status: All offences under these by-laws are declared to be strict liability offences (by-law 7(2)), which means fault need not be proved. Defences available under Part IIAA of the Criminal Code may apply, but strict liability reduces the prosecution hurdle and increases the likelihood of successful infringement notices or convictions in less contested factual scenarios.

Divergence between maximum penalties and infringement amounts: Several offences attract relatively high maximum penalties if prosecuted in court (for example 20, 25 or 50 penalty units), but the Schedule prescribes very small monetary amounts for expiation via infringement notice. For example, by-law 18(1) carries a maximum penalty of 20 penalty units for unregistered dogs, but its infringement prescribed amount in the Schedule is only 0.5 penalty units. The practical result is that Council may resolve many breaches cheaply via expiation, while retaining much larger criminal penalties for court proceedings. This creates potential incentives for both parties: the Council may prefer expedient expiation, and recipients may prefer paying a small expiation sum rather than litigating.

Operational discretion and variable standards: Authorised persons have broad discretion to decide when to issue directions to remove litter, to seize dogs, to declare dogs dangerous and to arrange destruction where the authorised person forms certain opinions (by-laws 14, 20, 21, 22). The by-laws do not prespecify forms of identification that authorised persons must present when exercising powers, nor set out an appeal mechanism against particular administrative decisions. The degree of internal oversight depends on conditions Council imposes on authorised persons (6(2)) and how the CEO implements the register and training regimes.

Seizure and destruction powers: The authorised person may arrange destruction of a dog if, in their opinion, it is an immediate and actual threat to public safety, or if it would be cruel to keep a diseased or injured dog alive (22(1)-(2)). Destruction may therefore be carried out on the basis of authorised-person opinion, subject to the humane execution requirement (22(3)). After destruction the authorised person must identify and notify the owner (22(5)), but the sequence allows irreversible action before notification in urgent circumstances. Practitioners should note the narrow but final character of the destruction powers and the requirement that the method cause death quickly without unnecessary suffering (22(3)).

Low breach thresholds for seizure: Dogs can be seized for a variety of grounds including being at large or lacking a dog-tag (21(1)(d)-(e)). Owners who fail to ensure tags are attached risk seizure even where the dog may not be dangerous. The interplay between the register, tag issuance and obligations on owners to replace lost tags may catch forgetful owners.

Cost recovery as a debt: If an authorised person arranges removal of litter or commercial waste after a recipient fails to comply with a written direction, the Council can recover reasonable costs and expenses as a debt from the person to whom the notice was issued (14(4)-(5)). Debt recovery can be pursued via civil mechanisms and is separate from the criminal penalty framework, so non-compliance can lead to both criminal and civil consequences.

Infringement notice formality and consequences: The infringement notice must contain specified information including enforcement agency details and a statement of election form (25(1)-(2)). Failure to include required details could affect enforceability, but conversely, a recipient who ignores an infringement notice faces enforcement steps under the Fines and Penalties (Recovery) Act 2001 including serious measures such as suspension of licences or registration of a statutory charge on land (25(2)(c)). Practitioners should treat non-payment as an issue that escalates beyond the small initial monetary amount.

Transitional savings: By-law 30 preserves dogs registered before 1 September 2018 from being captured by the new numerical limits and registration offence. However, the saving is narrow: it does not exempt other obligations nor prevent seizure on other statutory grounds, and it applies only to persons keeping dogs registered before that date.

Council operational levers: Many operational decisions that materially affect compliance, facility days and hours, facility rules, conditions imposed on authorised persons, fees and waivers, are left to Council discretion (13, 6(2), 29). That means compliance expectations can shift administratively without legislative amendment, creating implementation risk for regulated parties unaware of local rule changes.

No explicit appeal or internal review: The by-laws set out the enforcement processes and the right to elect court proceedings, but they do not provide an internal administrative review or appeal mechanism against directions or seizure decisions. The available review route for many decisions will therefore be judicial review in the courts or electing to have the substance dealt with in a court under the recovery Act when faced with an infringement notice.

These features show that while the by-laws are operationally straightforward, they create significant enforcement discretion and mix small administrative penalties with potential civil cost recovery and serious recovery act consequences for non-payment. Parties should calibrate compliance and challenge strategies accordingly.

Compliance under the by-laws requires practical administrative steps for households, businesses, and Council officers. The following checklist maps the obligations in the text to concrete actions and recordkeeping to reduce enforcement risk.

For dog owners and keepers

• Register dogs kept in the Council area for more than three months. Submit the required details to the Council so the CEO can record owner name and address, the premises address where the dog is usually kept, and any conditions imposed under by-law 20(2) that will be recorded in the dog register (17, 16(2)). Keep a copy of the application and any acknowledgement from the CEO or Council.

• Ensure each registered dog wears a suitable collar and the issued numbered dog-tag corresponding to the entry in the dog register (17(3), 19(1)). If a tag is lost, obtain a replacement dog-tag promptly (19(2)). Keep receipts or proof of replacement tag issuance.

• If you intend to keep more than two dogs on the same premises for longer than three months, seek written authorisation from the Council before doing so (15). Retain a copy of any Council authorisation on the premises and produce it when requested by an authorised person.

• If a dog is declared dangerous, comply with every condition imposed by the authorised person, such as secure enclosures and leash and competent-handler requirements when off-premises (20(2)(a)-(b)). If you plan to transfer ownership of a dog declared dangerous, inform the prospective transferee of that status before transfer (20(3)). Keep documentary evidence of the disclosure.

• Keep contact details up to date in the dog register to facilitate prompt notification in the event of seizure or destruction (21(2), 22(5)). Promptly update the Council if you move premises where the dog is usually kept.

For businesses and commercial waste producers

• Do not leave, throw, deposit or abandon commercial waste anywhere other than at a Council waste management facility (12). Confirm with the Council the days and hours during which commercial waste may be deposited and the facility rules, and comply with them (13(1)-(3)). Obtain and retain a copy of facility rules.

• Permit authorised persons to inspect loads you propose to deposit at the facility (13(5)). Maintain records of waste carriers, loads and receipts for deposit at Council facilities to demonstrate compliance if challenged.

• If directed in writing by an authorised person to remove commercial waste from a public place or vacant land, comply within the period stated. If a direction requires immediate removal due to a public safety risk, act immediately (14(1)-(3)). Failure to comply may result in the Council doing the work and recovering costs as a debt (14(4)-(5)). Keep copies of any directions received and records of steps taken to comply.

For all persons in public places

• Use rubbish bins provided for that purpose when disposing of litter in public places. Avoid leaving, depositing or abandoning litter in places other than bins (10(1)). Do not deposit litter that is likely to cause injury or endanger health (11(1)).

Dealing with infringement notices

• If served with an infringement notice, check that it includes the items required by by-law 25(1) and the statement required by 25(2). The notice must identify the enforcement agency to which payment is to be made and include an election form for court proceedings under section 21 of the Fines and Penalties (Recovery) Act 2001.

• Decide whether to expiate by paying the prescribed amount within 28 days, or elect to have the matter dealt with in a court. If electing court, complete and return the statement of election in the form provided. Retain copies of all correspondence and the return receipt.

• Pay by electronic payment only after verifying funds are credited to the Council’s bank account, since payment is not effective until credited (26(1)). If paying by cheque, do not assume payment has been effected until the cheque clears on first presentation (26(2)).

Administrative and Council-facing actions

• If a Council officer or authorised person, ensure that conditions imposed on authorised person appointments are documented and complied with (6(2)). Maintain evidence of training, identity processes and operational procedures for exercising powers, particularly in delicate actions such as seizing or destroying animals.

• The CEO must ensure the dog register is maintained in the manner determined by Council and that issued dog-tags are matched to register entries (16(1), 17(3)). Maintain secure records and make register inspection procedures transparent where fees are charged (29).

• Council must determine and publish rules governing waste facility days, hours and entry rules. Publish these rules centrally and communicate them to local businesses, waste carriers and residents to reduce inadvertent non-compliance under by-law 13.

• Where the Council charges fees for services under the by-laws, provide clear schedules of fees and documented waiver or refund policies, in line with by-law 29(1)-(2). Provide receipts and retain fee schedules for audit and for evidence in potential disputes.

Records and evidence

• For both individuals and businesses, keep contemporaneous records (photos, dates, receipts, correspondence) of steps taken to comply with removal directions, registration, tag replacement and facility usage. Records will be crucial if an infringement notice is issued and the recipient elects court proceedings.

• Maintain documentation of any Council authorisations for exceeding dog limits or any written directions from authorised persons. That documentation is the primary defence to allegations of unauthorised conduct.

In short, compliance requires registration, identification, adherence to waste facility rules, responsiveness to written directions, proper handling of infringement notices and robust recordkeeping. Where ambiguity exists, seek written Council confirmations or authorisations and preserve documentary evidence to support compliance.
