What it does
This Act refers specified matters relating to terrorist acts from the State Parliament to the Parliament of the Commonwealth for the purposes of section 51(xxxvii) of the Constitution. The referral is limited and conditional in form: section 5(1) identifies two discrete reference streams. First, it refers to the Commonwealth the matters to which the text in Schedule 1 (the text intended to become Part 5.3 of the Commonwealth Criminal Code) relates, but only to the extent that the Commonwealth will make laws by including that text in the Commonwealth Criminal Code (section 5(1)(a)). Second, it refers the matter of terrorist acts and actions relating to terrorist acts to the Commonwealth, but only to the extent that laws will be made by way of express amendments of the terrorism legislation or the Commonwealth criminal responsibility legislation (section 5(1)(b)).
The referral is time-limited and conditional. Section 5(5) makes clear the references have effect only from commencement until the day fixed under section 6 as the day on which the references are to terminate; the Governor may fix that day by proclamation subject to a minimum notice requirement (section 6(1)-(2)). The Governor may also revoke a proclamation provided the revocation occurs before the fixed day (section 6(3)-(4)).
The Act does not itself create Commonwealth offences or enforcement machinery. Instead it supplies a constitutional mechanism by which the Commonwealth may, if it chooses, enact the Schedule 1 text into the Commonwealth Criminal Code or make express amendments to Commonwealth terrorism or criminal responsibility legislation (section 5). The Act defines key terms (section 4), assigns interim administrative responsibility to the Minister for Justice and Industrial Relations and the relevant department until administrative arrangements are changed (section 7), and sets a commencement mechanism by proclamation (section 2). Schedule 1 is identified as the text intended to form Part 5.3 of the Commonwealth Criminal Code; the schedule is the source text that the Commonwealth is invited to adopt "in the terms, or substantially in the terms" (definitions in section 4 and operation under section 5(1)(a)).
