91Distribution of whole or part of balance of the Account

#### 91 Distribution of whole or part of balance of the Account (1) If: (a) the whole or a part of the balance standing to the credit of the Regional Broadband Scheme Special Account at a particular time is attributable to charge paid by particular carriers; and (b) a determination is in force under subsection (2); the Secretary may, on behalf of the Commonwealth, distribute to those carriers the whole or a part of the balance. (2) The Minister may, by legislative instrument, determine: (a) rules to be complied with by the Secretary in relation to the timing of distributions under subsection (1); and (b) a method to be applied by the Secretary in making distributions under subsection (1). (3) The Secretary must comply with a determination in force under subsection (2).
