#### 117C Compliance with performance benchmarks Scope (1) This section applies if an instrument under section 117B is applicable to a carriage service provider (the first provider). Provider must meet or exceed minimum benchmark (2) The first provider must meet or exceed a minimum benchmark set by the instrument. Contravention caused by another provider (3) For the purposes of determining whether the first provider has met or exceeded a minimum benchmark set by the instrument, if: (a) the first provider has contravened a standard in force under section 115; and (b) the contravention is wholly or partly attributable to one or more acts or omissions of another carriage service provider; the first provider is taken not to have contravened the standard.
