What it does
The Tariff Concession Revocation Order 86/2006, made by a delegate of the Chief Executive Officer under section 269SD(2) of the Customs Act 1901, revokes Tariff Concession Order 0509683. That earlier order had been made on 23 September 2005 in respect of goods described in TABLE A of the revocation order. The revocation takes effect from 18 July 2005. In place of the revoked order, the instrument makes Tariff Concession Order 0616830. The new order applies to the goods described in TABLE B and has effect from the same date of 18 July 2005.
The goods covered by the new order are parts for marine thrusters comprising any of the following items: fuseholders, fusers, tunnels, switches, serial-parallel switch box, control cables, solenoids, control panel joystick, anodes, gear house or propellers. These goods fall within Customs Tariff classification 8412.90.90. The order states that the goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 applies, namely item 50. As a result, importers of goods that match the description may enter them at the concessional rate provided by that schedule item rather than the general rate that would otherwise apply to heading 8412.90.90.
The order is a single-page instrument that contains two tables. TABLE A sets out the revoked description under classification 8412.29.00 together with the schedule 4 item number and the last date of effect. TABLE B sets out the replacement description under classification 8412.90.90 with the same schedule 4 item number and no last date of effect shown. The delegate signed the order on 9 September 2006. The practical outcome is that the concessional treatment previously available under the revoked order continues, but only for goods that satisfy the revised description and classification in the new order.
