What it does
This instrument is Tariff Concession Order (TCO) 1048997 made under section 269P of the Customs Act 1901. It declares that the goods specified in Column 1 of the Table are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 applies. The Order takes effect from 03.11.10 and is to continue in force until it is revoked under sections 269SC or 269SD of the Customs Act 1901, or until any date specified in Column 2. The operative notation in the Table is "Op. 03.11.10 - TC 1048997". The instrument is signed and dated in the Table area as "Dated 07 February 2011" by Wendy Knowles, Delegate of the Chief Executive Officer.
Mechanically, the TCO performs a narrow administrative function: it identifies a class of imported goods by tariff classification and by a detailed descriptive schedule of physical components, and declares that those goods are to be treated as falling within a particular item in Part III of Schedule 4 to the Customs Tariff Act 1995. The Table shows the tariff classification 8431.49.90 in Column 1, and in Column 2 the Schedule 4 item number presented as "50". The Table does not show an explicit calendar expiry date in the "Last date of effect" cell. Because the Order expressly continues until revoked under the cited sections of the Customs Act or until a specified date in Column 2, the absence of a calendar end date in the Table means the Order remains in force until revocation or amendment.
The Order is therefore a targeted, administratively-created tariff concession that attaches to particular goods described with component-level specificity and ties those goods to item 50 in Part III of Schedule 4 to the Customs Tariff Act 1995. The legal basis and the mechanisms for termination or revocation are stated in the Order itself, by reference to the specific provisions of the Customs Act cited in the opening paragraph and the Table.
