Superannuation (Public Sector) Act 1992

Definitions and statutory characterisations in this Act drive its legal mechanics. The main statutory concepts are:

• Contract officer. Defined in s 3(1) as an executive whose contract provides that he or she continues to be a member of a statutory superannuation scheme, or is otherwise the executive covered by the Part. The term is used throughout to mark persons whose status and superannuation entitlements are to be treated differently from ordinary staff.

• Statutory superannuation scheme. Defined in s 3(1) and (2) to include schemes under specified Victorian Acts (State Superannuation Act 1988; Transport Superannuation Act 1988; State Employees Retirement Benefits Act 1979) and additionally any scheme or fund specified by Order under the Public Administration Act 2004 (s 3(2)). That distinction matters because the Part’s rules apply only to “statutory” schemes as defined.

• Complying superannuation fund. Adopted from Commonwealth law (s 3(1)): a superannuation entity or fund within the meaning of s 10 of the Superannuation Industry (Supervision) Act 1993 which is a complying superannuation fund or complying approved deposit fund under Commonwealth taxation law. This ties the statutory framework to federal regulatory concepts for alternative funds.

• Employer. The Act imports the meaning of employer from s 24 of the Public Administration Act 2004 (s 3(1)), linking the identity and duties of the employing entity in this Part to the Public Administration Act.

• Right of return. Contracts may include a right for the executive to return to the public sector. The Act sets out special treatment where such a right exists, including continuity of prior deferred pensions but exclusion from claiming further benefit for previous service upon rejoining (s 8(a)-(b)), and preservation of medical classification for scheme entry (s 8(c)).

• Salary for superannuation purposes. The Act separates remuneration package from the salary base used to calculate contributions and benefits. The salary for statutory scheme purposes is the amount specified in the contract (s 12(1)), and unless the officer elects otherwise it must be equal to 70 per cent of the remuneration package (s 12(2)). Where the officer’s prior salary exceeded that 70 per cent amount, the officer may elect which salary applies (s 12(3)).

• Re‑characterisation rules. The Act defines when expiry or termination of a contract counts as resignation or retrenchment “for the purposes only of a statutory superannuation scheme” (ss 9 and 10). These rules hinge on whether a new contract offer was made, whether the offer was less favourable, and whether a right of return existed and was exercised.

• Administrative instruments and precedence. The Part is to be read as part of the Public Administration Act 2004 (s 4) and declared to prevail over inconsistent instruments and provisions (s 5). Orders under the Public Administration Act can specify which schemes apply to declared authorities and which provisions of this Part bind those authorities (s 3(2)).

These concepts create separable legal effects. For example, the “salary for superannuation purposes” concept allows employers and legislators to treat part of a total reward package as non‑pensionable, the “certification” mechanism in s 7(5) creates a unilateral employer record that is binding on scheme administrators, and the re‑characterisation rules change the triggering events for earlier accruals and benefit calculations without altering general employment law characterisations of resignation or dismissal. The Act is explicit that many of these recharacterisations are limited to purposes of statutory superannuation schemes (ss 9 and 10), which confines the legal fiction to the superannuation domain.

The Act targets a narrow but economically consequential population and the organisations that employ them. The affected parties are:

• Contracted executives in the Victorian public sector. These are executives employed under contract whose contracts specify superannuation arrangements. The Act distinguishes between executives who were public servants before appointment and those appointed from outside the public service (s 6). It applies to an executive whose contract provides that they continue to be a member of a statutory superannuation scheme (s 3 definition of “contract officer”).

• Employers in the public sector and declared authorities. Employers are defined by reference to s 24 of the Public Administration Act 2004 (s 3). The Act expressly contemplates application to declared authorities where an Order under the Public Administration Act specifies a scheme or fund as a statutory superannuation scheme and selects which provisions apply (s 3(2), s 13). For declared authorities specific protections on salary reductions apply (s 14).

• Administrators of statutory superannuation schemes. Administrators are the governing bodies that administer statutory schemes and are bound by certificates and notices provided by employers under s 7(5)-(7), s 11, s 12(4) and s 14(2). The Act removes certain freedoms of administrators by making employer certificates and revocations binding on them (s 7(7)).

• Complying private superannuation funds. Where a contract provides that an executive ceases membership of a statutory scheme, the contract must provide for membership of an alternative complying superannuation fund (s 7(4)). That places private complying funds as recipients of employer contributions and as holders of members’ entitlements for those executives.

• Executives with deferred pensions. The Act preserves existing deferred pensions acquired before entry into the contract (s 6(2) and s 7(3)), so people with accrued interests in statutory schemes remain stakeholders and may have rights to future payments under those schemes.

• Regulatory actors under Commonwealth law. The minimum employer contribution requirement for alternative funds is explicitly linked to the Commonwealth Superannuation Guarantee Charge Act 1992 through s 7(4). Therefore federal superannuation entitlements and compliance obligations remain relevant.

The Act therefore shifts some fiscal and compliance burdens from statutory scheme administrators to employing agencies and private complying funds. Employers are required to make certifications and notices, determine the salary base for superannuation, and administer contractual elections, while administrators must accept employer certificates and adjust benefit calculations. Executives are required to make informed elections about whether to remain in statutory schemes or be moved to a complying fund, and must be aware of how the 70 per cent salary rule and the re‑characterisation rules for resignation/retrenchment affect their entitlements.

The Act creates specific duties for employers and rights and choices for executives. Key duties and rights are as follows, with section references.

Duties of employers

• Contract content: Where a contract is entered under Part 3 of the Public Administration Act 2004, the employer must ensure the contract contains either a term that the executive ceases to be a member of a named statutory superannuation scheme or continues to be a member (s 7(1)). The executive must elect which term applies (s 7(2)).

• Alternative fund membership and minimum contributions: If the contract provides that the executive ceases membership of a statutory scheme, the contract must provide membership of an alternative complying superannuation fund and require employer contributions of at least the minimum under the Commonwealth Superannuation Guarantee Charge Act 1992 (s 7(4)).

• Certification to administrators: Employers must certify to the administrator of the statutory superannuation scheme that the executive is an exempt officer when the contract provides for cessation of membership (s 7(5)), and must revoke that certificate by notice if the officer ceases to be an executive or the contract provides for membership (s 7(6)). Certificates and revocations are binding on administrators (s 7(7)).

• Notifications: Employers must notify scheme administrators when a contract officer is to be treated as having resigned or been retrenched and has not reached the minimum retirement age (s 11). Employers must notify administrators of the officer’s salary for scheme purposes (s 12(4)). For declared authorities, employers must notify administrators of agreed salary arrangements (s 14(2)).

• Salary specification: The employer must ensure the contract specifies the amount to be treated as salary for scheme purposes (s 12(1)) and, absent an election under s 12(3), that amount must equal 70 per cent of the remuneration package (s 12(2)).

Rights and choices of executives

• Election on membership: The executive has an express election under s 7(2) whether their contract includes the term that they cease membership of a named statutory superannuation scheme or continue as a member, subject to s 6 (externally appointed executives cannot become members).

• Election of salary basis: Where the officer’s pre-contract salary for scheme purposes exceeded the 70 per cent of remuneration package that the contract specifies, the officer may elect in writing between those amounts as the salary for scheme purposes under the contract (s 12(3)).

• Right of return: Where the contract includes a right of return to the public sector, electing to exercise that right preserves a deferred pension or benefit (s 8(a)), but the returning executive is to contribute as if a new member and is not entitled to claim further benefit in respect of previous service (s 8(b)). The executive must also be taken to have the same medical classification for joining the statutory scheme as they had immediately before ceasing membership (s 8(c)).

Legal characterisations and administrative effects

• Resignation versus retrenchment: The Act specifies, for superannuation purposes only, when the expiry or termination of the contract is to be taken as retrenchment or resignation (ss 9 and 10). These determinations depend on whether a new contract was offered, whether terms were less favourable, whether the officer accepted, and whether a right of return existed and was exercised. These characterisations will determine treatment of entitlements under the relevant statutory scheme.

• Precedence and integration: The Part is to be treated as part of the Public Administration Act 2004 (s 4) and prevails over inconsistent laws, instruments or scheme provisions (s 5). That duty on administrators and employers modifies the hierarchy of applicable rules when they conflict.

Notably the Part imposes administrative duties and creates rights of election rather than creating new benefit entitlements or numeric contribution rates beyond the 70 per cent salary rule and the requirement to meet the Commonwealth minimum employer contribution. The binding effect of employer certificates on scheme administrators (s 7(7)) is a significant legal mechanism that transfers record‑keeping and evidentiary control to employers on matters of exemption.

The text of the Part supplied contains few express punitive provisions and instead establishes administrative duties and binding procedural mechanisms. The enforcement landscape implied by the Act is therefore predominantly administrative, reliant on statutory duties, certificate effects, notice requirements and the interaction with scheme administrators. Key enforcement features and gaps are:

Administrative enforcement mechanisms

• Binding certificates. The Act makes an employer’s certificate that an executive is exempt from the statutory scheme binding on scheme administrators (s 7(5)-(7)). That is an immediate administrative enforcement mechanism: once the employer certifies, administrators must treat the executive as exempt. The employer also has the duty to revoke the certificate in the circumstances specified (s 7(6)), and that revocation is likewise binding on administrators.

• Notification obligations. Employers must notify scheme administrators of resignations or retrenchments (s 11), of the officer’s salary for scheme purposes (s 12(4)) and of agreements under s 14 in relation to declared authorities (s 14(2)). These obligations create administrative records that enable scheme administrators to implement benefit calculations and to check compliance with statutory requirements.

• Prevailing provision. Section 5 states that if a provision of this Part is inconsistent with another Act, instrument or scheme provision, the Part prevails. That clause strengthens enforceability by subordinating conflicting rules and reducing the scope for administrators to resist the Part’s requirements on the basis of conflicting scheme rules.

Absence of express penalties in this Part

• The supplied text contains no express criminal penalties, fines, or civil sanction mechanisms in Part 2 for breach of the employer duties (for example, no penal provision for failure to certify, or for failing to notify). The Part instead relies on binding effects and record alteration to secure compliance. Where remedies are required, they would need to be sought under general administrative law, other provisions of the statutory schemes or under the Public Administration Act 2004 if it contains enforcement regimes relevant to employer breaches. The Part itself does not set out specific civil penalties or criminal offences.

Potential enforcement avenues outside the Part

• Administrative remedies through scheme administrators and the Public Administration Act 2004. Because this Part is to be read as one with the Public Administration Act 2004 (s 4) and uses definitions and order‑making powers in that Act (s 3(2)), enforcement and remedies in the Public Administration Act may be implicated. The supplied text references orders under the Public Administration Act that may designate declared authorities and specify application of this Part, which suggests enforcement and oversight functions under that Act could be available.

• Commonwealth superannuation obligations. The minimum employer contribution requirement in s 7(4) links employer obligations to the Commonwealth Superannuation Guarantee Charge Act 1992. Failure to meet Commonwealth superannuation guarantee obligations could attract enforcement and penalties under Commonwealth law independent of this Part.

Implementation risk and compliance gaps

• The reliance on employer certificates that are binding on administrators places significant evidentiary and compliance responsibility on employers. If employers fail to issue required certificates or to notify administrators, the Act does not itself state immediate statutory penalties. This creates an implementation risk where the practical enforcement response will depend on scheme administrators, internal public sector oversight, or separate statutory enforcement regimes.

• The Act leaves ambiguity about remedies if administrators or employers improperly apply or ignore the Part. The absence of express sanctions in Part 2 means affected parties may need to rely on existing remedies in the Public Administration Act, in the statutory superannuation schemes, or in general judicial review and contract or equity remedies.

In short, the Part relies primarily on administrative mechanisms (binding certificates, mandatory notifications, and statutory precedence) rather than on detailed penal provisions contained within the text supplied. Enforcement therefore will be exercised through the interaction of employer duties, administrator compliance, and other statutory enforcement regimes rather than via bespoke criminal or financial penalties in this Part.

The Act is explicitly designed as an interlocking instrument that sits with the Public Administration Act 2004 and Commonwealth superannuation law. The key statutory interaction points and legal dependencies are:

Integration with the Public Administration Act 2004

• Read together. Section 4 requires that this Part must be read as one with the Public Administration Act 2004 and as if the Act formed part of that Act. This instruction integrates the legal text, so the employer definition and order-making processes from the Public Administration Act are binding for the Part’s operation.

• Definitions and orders. The Act imports the definition of “employer” from s 24 of the Public Administration Act 2004 (s 3). Section 3(2) refers to an Order under s 23(1)(d) or s 104 of the Public Administration Act 2004 that may specify a scheme or fund for declared authorities and may select which provisions of this Part apply. That creates a delegated administrative route to extend the Part’s scope to declared authorities and to specify tailored applications.

Precedence over inconsistent instruments and laws

• Section 5 provides that if a provision of this Part is inconsistent with a provision of another Act, an instrument made under another Act, or a provision of a statutory superannuation scheme, the provision of this Part prevails. This clause sets the Part at a higher normative level for conflicts related to contractual treatment and the specific mechanisms covered, subject to constitutional limits and other applicable legal constraints.

Interaction with Commonwealth superannuation law

• Complying funds and SG minimum. The Part defines “complying superannuation fund” by reference to Commonwealth standards (s 3(1); referencing the Superannuation Industry (Supervision) Act 1993 and the Income Tax Assessment Act 1936 definitions). Section 7(4) requires that an alternative superannuation scheme provided under a contract must be a complying fund and that employer contributions must not be less than the minimum requirement under the Commonwealth Superannuation Guarantee Charge Act 1992. That creates direct compliance obligations that straddle state and federal law. Failure to meet the Commonwealth minimum will attract federal enforcement mechanisms independent of the Act.

Effect on statutory scheme rules

• Practical displacement. Because s 5 makes the Part prevail over inconsistent scheme provisions, statutory superannuation scheme rules that would otherwise treat an executive in one way can be displaced for the specific purposes covered by this Part. Administrators of statutory schemes are bound by employer certificates and notices under ss 7(7), 11 and 12(4), which means administrators must accept employer statements even where scheme rules might otherwise differ.

Administrative orders and declared authorities

• Orders under the Public Administration Act can specify that the Part applies to declared authorities and can select which provisions of the Part apply in relation to a specified scheme or fund (s 3(2)). Section 13 further specifies that, where s 6 is applied to a declared authority by such an Order, references to a member of staff of the public service are to be taken as references to staff of the declared authority. Section 14 imposes particular protections for declared authorities concerning reductions in superannuation salary bases. These provisions create a flexible interface between state administrative architecture and the Part’s substantive rules.

Limits and uncertainties in interaction

• The Act repeatedly restricts some of its findings to “for the purposes only of a statutory superannuation scheme” (see ss 9 and 10). That means characterisations like “retrenched” or “resigned” are statutory fictions for scheme calculation only and do not necessarily alter rights and obligations under general employment law, workers’ compensation law, or other statutory regimes. Users must therefore track the divergence between employment law characterisations and superannuation treatment.

• The Part does not displace Commonwealth constitutional pre‑eminence. While s 5 gives the Part precedence over inconsistent state instruments and schemes, it cannot operate to the extent it would conflict with Commonwealth law or constitutional limits. Because the Part explicitly relies on Commonwealth definitions and minimum contributions, it is intended to operate within the federal framework rather than in contradiction to it.

Overall, the Act is a state law instrument that deliberately ties into federal superannuation compliance and to the Public Administration Act 2004 administrative architecture, while asserting its own precedence over conflicting state schemes and instruments for the purposes it covers. Lawyers and compliance officers must therefore manage three layers: the Act’s contractual and administrative requirements, the Public Administration Act 2004 order‑making and employer definitions, and federal superannuation rules.

The endnotes supplied set out an amendment chronology and provide the statutory history affecting the Part’s current text. Key amendments and their mechanical effects on the Part are:

• Initial enactment. The Superannuation (Public Sector) Act 1992 received assent on 26 November 1992 and most of the Act commenced on 27 November 1992 as noted in the endnotes. Section 1 states the purpose to make further provision for superannuation in the public sector and to amend specified Acts (s 1).

• Public Sector Management (Amendment) Act 1993 (No. 97/1993). Amended specific subsections: s 46(1) affected ss 7(3), 11, and 12(2) (endnote table). The endnotes show amendments commenced across 1992 and 1993 as documented.

• Superannuation Acts (Miscellaneous Amendments) Act 1995 (No. 102/1995). Section 31 of that amending Act substituted provisions affecting s 12(2) and is recorded as commencing on 5 December 1995. The endnotes indicate s 12(2) was substituted by No. 102/1995 s 31.

• Superannuation Acts (Amendment) Act 1996 (No. 4/1996). This enactment inserted the definition of “complying superannuation fund” and repealed an obsolete definition among other changes (the table references s 119(1)(a)-(b) and s 119(2) etc.). Commenced on 30 June 1996 for the relevant sections.

• Superannuation Acts (Miscellaneous Amendment) Act 1997 (No. 50/1997). The endnotes record commencement and amendment details affecting s 9(2)(b)(i).

• Public Sector Reform (Miscellaneous Amendments) Act 1998 (No. 46/1998). This Act made a number of definitional and machinery amendments recorded in the endnotes; the table records amendments to definitions and to s 7, among others, commencing 1 July 1998 for the relevant schedule items.

• Public Sector Reform (Further Amendments) Act 1999 (No. 12/1999). This amending Act altered s 4 and related items via a schedule entry that commenced on 11 May 1999.

• Public Administration Act 2004 (No. 108/2004). This Act introduced significant structural interaction by requiring the Part to be read with the Public Administration Act 2004 and by shifting the workplace governance architecture. The endnotes show s 117(1)(Sch. 3 item 193) commenced on 5 April 2005 for the pertinent amendment entries. The Part’s integration and numerous references to the Public Administration Act flow from these amendments.

• Repeals. Part 3 (heading and ss 15-21) was repealed by No. 4/1996 s 119(4) and earlier amendments had altered Chapter headings and other mechanisms.

The amendment history shows a pattern of iterative refinement: initial framing in 1992, then a sequence of amendments through the 1990s that clarified definitions (particularly aligning state law with Commonwealth definitions of complying funds), adjusted the salary calculation mechanism (s 12), and anchored the Part in the revised Public Administration Act architecture from 2004. Important mechanical outcomes of amendments include the explicit incorporation of Commonwealth compliant fund concepts (post‑1996), substitution of the 70 per cent rule by s 12 amendments, and tighter integration with the Public Administration Act 2004. The endnotes provide the precise amending Acts and commencement dates for each recorded change; users should consult those amending statutes for the text of the changes when tracing legislative intent or historical operation.

The version of the Act supplied does not list any judicial decisions, case citations, or reported litigation concerning interpretation of this Part. The endnotes do not identify cases, and the body of the Act does not cite precedent. Accordingly, there is no litigation history contained in the supplied text to summarise.

Practical observations about potential litigation risk areas that the Part creates (based on the text)

• Characterisation disputes. Sections 9 and 10 create statutory characterisations of expiry or termination events as “retrenched” or “resigned” for superannuation purposes, differentiating outcomes depending on offer of a new contract, whether a new contract is less favourable, and whether a right of return exists. These statutory fictions are limited to superannuation purposes, but they create potential disputes over the facts (for example, whether an offer was “less favourable”), the timing of offers, and whether an officer accepted an offer. Courts or tribunals could be asked to determine the factual and legal status of offers and acceptances where scheme entitlements hinge on that classification.

• Employer certification and administrator compliance. Section 7(5)-(7) makes an employer’s certificate binding on scheme administrators. Disputes could arise where an employer issues or revokes a certificate in circumstances contested by the officer or where an administrator refuses to accept a certificate. The Act’s binding provision reduces administrator discretion, but an affected party could seek relief on grounds such as error, misstatement, or statutory interpretation.

• Salary base for contributions. Section 12 prescribes the salary for superannuation purposes, including the 70 per cent default rule and an officer’s election where prior salary was higher (s 12(3)). Litigation could arise over the construction of “remuneration package”, the calculation of the 70 per cent, whether particular components (bonus, fringe benefits) are included, and whether a valid election was made.

• Right of return consequences. Section 8 requires that a returning executive be treated as a new member and be precluded from claiming further benefit for previous service. Disputes could focus on the precise scope of the bar on claiming further benefits, or on the interaction with accrued deferred pensions preserved by s 8(a).

• Interaction with Commonwealth obligations. Section 7(4) requires employer contributions not less than the minimum under the Commonwealth Superannuation Guarantee Charge Act 1992. Disputes over whether contractual arrangements meet Commonwealth minimums may involve federal statutory interpretation and administrative enforcement rather than state law per se.

Because the supplied Act text provides no judicial interpretations, practitioners must rely on principles from general statutory interpretation, administrative law and employment law when advising clients. Any formal litigation history should be sought from case law databases and reported decisions where disputes in Victoria have been litigated under the Act or under the systems the Act affects. The Act’s design creates several concrete litigation risk points where statutory definitions, factual findings about offers, the binding nature of employer certificates and the calculation of the superannuation salary could generate legal disputes.

Practitioners and compliance officers must watch for several concrete traps and operational frictions that follow directly from the Act’s text.

1. The 70 per cent salary rule and remuneration composition (s 12(1)-(3)). The Act makes the contract‑specified amount the salary for scheme purposes and requires that amount to equal 70 per cent of the remuneration package unless the officer elects otherwise if their previous super salary exceeded the 70 per cent figure (s 12(2)-(3)). The term “remuneration package” is not defined in this Part. Employers and executives should clarify in contracts what components count toward the package (base salary, allowances, bonuses, car, fringe benefits, deferred remuneration). Without explicit contract language, parties will face uncertainty and potential disputes about the 70 per cent calculation.

2. Employer certifications are binding on administrators (s 7(5)-(7)). This shifts significant administrative and evidentiary responsibility to employers. A certificate that an officer is “exempt” triggers a binding administrative consequence. Employers must ensure that their certificates are correct and timely; the Act obliges them to revoke certificates in the enumerated circumstances. Failure to revoke when required may lock administrators into an incorrect status for a member.

3. “For the purposes only of a statutory superannuation scheme” carve outs (ss 9 and 10). The Act’s re‑characterisations of resignation and retrenchment apply only for superannuation purposes. That means a contractual or employment law determination of resignation or dismissal can remain different. Professionals must not conflate the superannuation characterisation with other statutory regimes (for example, unfair dismissal or redundancy payments under employment law).

4. Right of return trade‑off (s 8). Returning executives retain deferred pensions but rejoin as new members and cannot claim further benefit for prior service. That mechanism can create discontinuities in accruals and complicate benefit projections. The Act also preserves medical classification at rejoining (s 8(c)), but does not provide continuity of past accruals as contributory service. Executives may misunderstand the net effect of exercising the right of return.

5. Declared authorities and Orders (s 3(2), s 13, s 14). The Act allows Orders under the Public Administration Act 2004 to specify schemes and select which provisions of the Part apply to declared authorities. Where Orders are used, their terms may vary application materially. For declared authorities, s 14 protects executives from a reduced salary being used for superannuation purposes unless the executive elects the reduction. Employers must check whether the declared authority has an Order in place and which provisions have been applied.

6. Notifications and timing (ss 11, 12(4), 14(2)). Employers must notify administrators of retrenchment/resignation (s 11) and of the salary used for scheme calculations (s 12(4)). Late, missing or inaccurate notices can lead to misapplied benefit calculations and could be difficult to unwind once administrators rely on employer certificates and notices.

7. Interplay with Commonwealth SG law (s 7(4)). The Part requires employer contributions to alternative complying funds to be not less than the Commonwealth minimum. But the Part does not define how additional state contract terms interact with Commonwealth enforcement. Practitioners must ensure that contracts and contribution mechanisms satisfy federal rules and timing requirements (for example, reporting, contributions within specified deadlines) to avoid separate federal liabilities.

8. No express penalty regime in this Part. There are procedural duties but no express monetary penalties or criminal sanctions in Part 2 as supplied. Litigants may assume there are statutory financial penalties for failure to comply with certification or notification duties; the Act does not create them here. Enforcement will therefore depend on other statutory regimes and administrative processes.

9. Ambiguous terms and factual determinations. Words such as “less favourable” (ss 9 and 10), “offered” and “accepted” are factual and may be litigated. Employers should ensure offers, acceptances, and any modifications to contract terms are documented in writing and contemporaneously, to support the statutory re‑characterisations.

10. Administrator reliance on employer records. Because administrators are bound to accept certificates and notices, the quality of employer record keeping will determine administrators’ practical ability to properly calculate entitlements. Errors can have long‑term consequences for members’ accrued benefits.

In short, the Act concentrates procedural authority with employers and creates a statutory framework that can change the superannuation status of senior executives by contract. That design creates many administrative “gotchas” tied to drafting precision, timing of notices, accurate calculations of the 70 per cent figure, and careful handling of rights of return and declared authority Orders.

This section provides a step by step compliance checklist and drafting points for employers, scheme administrators and executives, tied to the Act’s sections.

For employers (public sector agencies and declared authorities)

1. Contract drafting and election clauses (s 7(1)-(2))

   • Draft the employment contract to include an express term either that the executive ceases to be a member of a named statutory superannuation scheme or that the executive continues membership. Ensure the executive signs the election in writing, and retain the signed election record.
   • If the executive is appointed from outside the public service, ensure the contract is consistent with s 6 (such appointees are not entitled to become members of statutory schemes). Document any deferred pensions preserved pursuant to s 6(2).

2. Alternative fund selection and employer contributions (s 7(4))

   • If the contract provides cessation of scheme membership, specify a complying superannuation fund by name and include mechanisms for employer contributions to be made to that fund.
   • Ensure employer contribution rates and timing meet the minimum requirements of the Commonwealth Superannuation Guarantee Charge Act 1992. Coordinate with payroll and finance to schedule contributions within federal deadlines.

3. Certification and revocation (s 7(5)-(7))

   • Prepare standard form certificates to issue to statutory scheme administrators when a contract officer is exempt. Retain contemporaneous copies and logs.
   • Implement an internal trigger and process to revoke certificates where the officer ceases to be an executive or the contract later provides membership of the statutory scheme. Revocations must be issued in writing and retained.

4. Salary specification for superannuation purposes (s 12(1)-(4))

   • Specify in the contract the amount to be taken as salary for superannuation purposes. Document the calculation of the remuneration package and the 70 per cent figure.
   • If the officer’s prior salary for scheme purposes was higher than the 70 per cent amount, provide a written election form allowing the officer to select which salary applies (s 12(3)). Retain the election or waiver in the employee file.
   • Notify scheme administrators in writing of the officer’s salary for scheme purposes (s 12(4)). Keep confirmations of delivery.

5. Notices on expiry or termination (ss 9, 10, 11)

   • Maintain records of offers of new contracts, including their terms and whether they were accepted. Record whether new contracts were less favourable in writing and store acceptance/rejection evidence.
   • Where a contract is to be taken to have expired and the officer is to be treated as retrenched or resigned for superannuation purposes, deliver the required written notice to the scheme administrator promptly (s 11).
   • For terminations during term, document whether the termination was by the officer or by the employer, whether the contract included a right of return, and whether that right was exercised (ss 10(1)-(4)).

6. Declared authorities (s 3(2), s 13, s 14)

   • Check whether the agency is a declared authority and whether Orders under the Public Administration Act apply. If so, verify which provisions of the Part are in force for that declared authority.
   • Where s 14 applies, if a contract officer’s salary is reduced, secure a written election from the officer to accept the reduced salary for superannuation purposes. If no election, use the greater of prior salary or actual salary for scheme calculations (s 14(1)). Notify scheme administrators of the agreed position (s 14(2)).

7. Record retention and compliance audits

   • Keep comprehensive records of certificates, revocations, notifications to scheme administrators, salary calculations, remuneration package compositions, contract offers and acceptance/rejection evidence.
   • Establish periodic audits to ensure contributions to complying funds meet Commonwealth minimums and that employer certificates and notices have been properly issued and lodged.

For scheme administrators

1. Acceptance of employer certificates and notices (s 7(7), s 11, s 12(4), s 14(2))

   • Implement procedures to accept and process employer certificates that an officer is exempt, per s 7(7). Record the certificate as the operative status for scheme membership.
   • Use the employer‑provided salary figure in scheme calculations once notified under s 12(4) or under s 14(2) for declared authorities.

2. Reconciliation and enquiries

   • Where certificates or notices are ambiguous, seek clarifying documentation from the employer, but note the statutory binding effect of s 7(7). Record any clarifications in your administrative files.

3. Interaction with deferred pensions and returns (s 6(2), s 7(3), s 8)

   • When an officer returns to the scheme pursuant to a right of return, preserve and pay deferred pensions as required (s 8(a)), but apply the new membership and contribution treatment for ongoing accruals (s 8(b)). Maintain medical classification continuity records (s 8(c)).

For executives

1. Election decisions (s 7(2), s 12(3), s 14(1))

   • Identify and exercise your election under s 7(2) in writing. Seek independent financial advice on whether remaining in the statutory scheme or moving to a complying fund better suits your retirement objectives.
   • If you previously had a higher salary for scheme purposes, understand the implications of electing between the pre‑contract higher salary and the 70 per cent amount (s 12(3)). Make the election in writing and keep a copy.

2. Right of return (s 8)

   • If your contract includes a right of return, understand that exercising the right preserves any deferred pension but will treat you as a new member for further accruals, and you will not be able to claim further benefit for previous service (s 8(b)). Confirm your medical classification is recorded to be the same as prior to departure (s 8(c)).

3. Monitor communications

   • Ensure the employer has provided the necessary notices to scheme administrators where the contract ends or where salary for superannuation purposes is specified. Keep copies of all certificates and notifications.

Cross‑cutting compliance points

• Coordinate with payroll and finance to ensure employer contributions to alternative complying funds are made and documented in compliance with Commonwealth SG requirements (s 7(4)).

• Track Orders under the Public Administration Act 2004 affecting declared authorities. A change in an Order can materially change an executive’s superannuation treatment and the employer’s obligations under this Part (s 3(2)).

• Document offers and negotiations thoroughly so that, if a superannuation characterisation (retrenched vs resigned) is later contested, there is contemporaneous evidence of the offers’ timing and terms (ss 9 and 10).

• Integrate contract clauses with administrative processes: certificates, revocations and notifications should be generated by a process that ties directly to payroll, human resources and legal sign‑off.

By converting the statutory requirements into precise contractual clauses, internal administrative templates (for certificates, revocations, notices and election forms) and workflow triggers for notification and contributions, employers can operationalise the Part’s duties and reduce the implementation risk created by the binding effect of employer statements on administrators.
