The current version is significantly narrower, focusing almost exclusively on executive officers under contract (Part 2). The original purpose mentioned making 'further provision for superannuation in the public sector' generally and amending three specific superannuation Acts, but the surviving provisions are now tightly focused on contract executives only. The repeal of Part 3 reduced the Act from a more comprehensive public sector superannuation measure to a specialized piece dealing with employment contract transitions."},"complexity_factors":["Multiple cross-references to other Acts (Public Administration Act 2004, State Superannuation Act 1988, Transport Superannuation Act 1988, State Employees Retirement Benefits Act 1979, Commonwealth Superannuation Industry (Supervision) Act 1993, Income Tax Assessment Act 1936, Superannuation Guarantee Charge Act 1992)","Conditional logic in sections 9 and 10 with multiple nested scenarios (expiry vs termination, with/without right of return, offer of new contract vs no offer, acceptance vs non-acceptance)","Defined terms section with 6 defined terms including complex nested definitions (e.g., 'complying superannuation fund' references two Commonwealth Acts)","Repealed Part 3 (sections 15-21) leaving structural gaps","Interaction between deemed resignation/retrenchment rules and actual employment law concepts","Salary calculation rules with percentage-based defaults and election overrides (section 12)"],"plain_english_summary":"**What this law does:**\n\nThis Act sets special superannuation (retirement savings) rules for **executive officers working on contracts** in the Victorian public sector. It plugs gaps between employment contracts and the main public sector super schemes.\n\n**Who it affects:**\n\n- **Senior public servants on fixed-term contracts** (executives appointed under the *Public Administration Act 2004*)\n- **Employers** (government departments and declared authorities)\n- **Superannuation scheme administrators** (the bodies running the State Super, Transport Super, and State Employees Retirement Benefits schemes)\n\n**Key things the law covers:**\n\n- **Choice of super fund**: Executives can choose to stay in the government super scheme or leave it for a private \"complying superannuation fund\" (a fund that meets Commonwealth tax and regulatory rules). If they leave, the employer must pay at least the minimum super guarantee into the new fund.\n\n- **No double-dipping**: People hired from outside the public service can't join the government super scheme—they must use a private fund.\n\n- **What happens when contracts end**: The law creates \"deemed\" (assumed) resignation or retrenchment rules. Depending on whether the executive quits, is sacked, or the contract simply expires—and whether they have a \"right of return\" to the public service—the law pretends certain things happened for super purposes. This determines what benefits they can claim.\n\n- **Salary calculations**: Super contributions are based on 70% of the executive's total remuneration package, unless they were earning more before—then they can choose the higher amount.\n\n- **Protection for deferred benefits**: Even if someone leaves the government scheme, they keep any pension or benefit they've already earned (they don't lose what's already accrued).\n\n**Why it matters:**\n\nWithout these rules, executives on contracts would fall into a grey area—neither fully in nor out of the public super system. This law ensures they either stay in the defined benefit scheme under clear terms, or move to private super with minimum protections, while protecting their past entitlements."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
