This Declaration allows certain staff of the Dairy Research and Development Corporation to join the Commonwealth’s Public Sector Superannuation (PSS) scheme.

Who is eligible Directors and employees of the Corporation who:

were already working there on 1 November 1991, or started between that date and when this Declaration was officially published (October 1992);
chose to become PSS members under standard election rules (not under transfer provisions); and
are still employed by the Corporation.

When coverage begins Superannuation coverage starts from the later of:

1 November 1991; or
the actual day the person started work with the Corporation.

This effectively backdates PSS membership for these staff to their start date (or November 1991, whichever is later), provided they opted in.

I, RALPH WILLIS, Minister of State for Finance, make the following Declaration under the Superannuation Act 1990.

Citation

This Declaration may be cited as the Superannuation (PSS) Membership Inclusion Declaration No. 8.

[NOTE: This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss.46a and 48.]

Interpretation

In this Declaration:

“the Act” means the Superannuation Act 1990;

“the Corporation” means the Dairy Research and Development Corporation.

Inclusions

(1) Section 6 of the Act applies to a person who:

(a) is a director or an employee of the Corporation; and

(b) either:

(i) was a director or an employee of the Corporation on 1 November 1991; or

(ii) became a director or an employee of the Corporation after 1 November 1991 and before the day on which this Declaration is notified in the Gazette; and

(d) has elected, except under section 8 of the Act, to become a member of the Superannuation Scheme before the day on which this Declaration is notified in the Gazette.

(2) Section 6 of the Act applies to a person mentioned in subclause (1) from the commencement of:

(a) 1 November 1991; or

(b) the day on which the person became a director or an employee of the Corporation;

whichever is the later.
