This Declaration may be cited as the Superannuation (PSS) Membership Inclusion Declaration No. 8.\n\n\\[NOTE: This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss.46a and 48.\\]\n\nInterpretation\n\n2. In this Declaration:\n\n“the Act” means the Superannuation Act 1990;\n\n“the Corporation” means the Dairy Research and Development Corporation.\n\n  \nInclusions\n\n3. (1) Section 6 of the Act applies to a person who:\n\n(a) is a director or an employee of the Corporation; and\n\n(b) either:\n\n(i) was a director or an employee of the Corporation on 1 November 1991; or\n\n(ii) became a director or an employee of the Corporation after 1 November 1991 and before the day on which this Declaration is notified in the Gazette; and\n\n(c) has not ceased to be a director or an employee of the Corporation; and\n\n(d) has elected, except under section 8 of the Act, to become a member of the Superannuation Scheme before the day on which this Declaration is notified in the Gazette.\n\n(2) Section 6 of the Act applies to a person mentioned in subclause (1) from the commencement of:\n\n(a) 1 November 1991; or\n\n(b) the day on which the person became a director or an employee of the Corporation;\n\nwhichever is the later.\n\n\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\n\nNOTE\n\n> Note: 1.
