What it does
These Regulations prescribe numerical interest rates for specific financial years for use under subsection (3) of section 90 of the Superannuation Act 1922-1965. Mechanically, regulation 3 declares that "the rate specified in the second column of the Schedule to these Regulations opposite to a financial year specified in the first column of that Schedule is the prescribed rate of interest in respect of that financial year" (reg 3). The Schedule therefore supplies the binding per‑cent‑per‑annum figures to be applied when an entitlement, liability or statutory calculation invokes s 90(3) of the Superannuation Act 1922-1965.
The instrument contains three short regulations: a citation provision (reg 1), a commencement mechanism (reg 2) and the core prescription of rates (reg 3). The citation provision allows the Regulations to be referenced as the Superannuation (Prescribed Rates of Interest) Regulations (reg 1). Commencement is not by a fixed date in the Regulations themselves; instead reg 2 provides that the Regulations "shall come into operation on the date to be fixed by the Treasurer by notice published in the Gazette under subsection (1) of section 69 of the Superannuation Act 1965." That means the Treasurer’s Gazette notice determines the operative date for the whole instrument.
The Schedule lists annual rates for financial years beginning 1 July 1957 through the financial year ending 30 June 1976. Each Schedule entry pairs a specified financial year with a rate expressed as a decimal per cent per annum (for example, financial year commencing 1 July 1957 , 4.471). The compilation indicates the Schedule has been amended over time by a series of Statutory Rules (see Notes and Table of Statutory Rules). The compilation itself was prepared on 8 June 2004, taking into account amendments up to SR 1976 No. 201. The Regulations do not in themselves set administrative practice on apportionment, rounding, calculation periods or payment mechanics; they supply the numeric rates to be used where s 90(3) requires a "prescribed rate of interest." Any enforcement, penalty or procedural detail will be found in the parent statute or other legislative instruments, not in these Regulations, which are narrowly focused on rate prescription.
