Superannuation (Lyell McEwin Employees) Regulations 2009

Several legal and administrative concepts are introduced or clarified by the regulations. These are the building blocks for how contributions, accounts and benefits operate for the named contributors.

• Contributor defined by name and continuity: The regulations explicitly extend the meaning of “contributor” in the Act to include each person named in Schedule 1 (r 6(1)). Regulation 4 then confirms that a contributor continues to be a “new scheme contributor” for the Act’s purposes. This establishes the target population for all following bespoke rules.

• Rollover accounts and account mechanics: New section 20ABAA (inserted by r 8) requires the Board to maintain rollover accounts in the name of every contributor (s 20ABAA(1)). Those accounts are to be debited with payments that, under the Act, are charged to them (s 20ABAA(2)). At each financial year end the Board must vary the balance of any rollover account with a rate of return determined by the Board (s 20ABAA(3)), with guidance to “have regard to” the Fund’s net rate of return on monies held in rollover accounts (s 20ABAA(4)). If a balance must be determined before the Board has set the year’s rate, an estimated rate may be applied and that estimate is not adjusted later (ss 20ABAA(5)-(6)). The regulations define “rollover account” in amended s 4(1)(4).

• Source of contributions and contingency: Section 23 is rewritten to fix contribution rates for each named contributor per Schedule 1 until the contributor reaches age 60 (s 23(1) and Schedule 1). Contributions are to be paid to the Treasurer from the Lyell McEwin Employer Account (s 23(2)) unless, following actuarial advice and Board notice, the Treasurer directs contributions to be paid by deduction from the individual’s salary (s 23(3)). The “Lyell McEwin Employer Account” is defined in amended s 4(1)(3) as the account kept at Treasury pursuant to an arrangement under s 5 of the Act with the Central Northern Adelaide Health Service Incorporated, linking the employer-side funding mechanism into the statutory architecture.

• Benefit formulas with date and service caps: Part 4 replacement (r 11) specifies benefit components in retirement, retrenchment, resignation, disability, total and permanent disablement, and death (ss 26-30). For retirement/retrenchment/resignation (s 27), total and permanent disablement and death before 60 (s 29), and death after 60 (s 30), benefits are made up of a rollover component (credit of rollover account) and a second component determined by formulae that use FS (actual or attributed salary immediately before termination), M (a months-based multiplier with caps that depend on dates and age thresholds), and P (an employment proportion factor tied to full/part-time status around 1 January 1999). The regulations therefore embed temporal caps and historical employment proportions in the benefit calculation.

• Transition to retirement draw down arrangements: Section 26A allows contributors who have reached 55 and their preservation age to apply for a draw down benefit when they enter an agreed arrangement that reduces hours or alters duties (s 26A(1)). The Board determines a maximum draw down benefit using variables FS, NS and SP (s 26A(3)(a)), and the contributor elects the investment vehicle for the draw down benefit (either the Superannuation Funds Management Corporation of South Australia or another entity providing a non-commutable income stream) so that the contributor receives only pension/annuity payments while remaining employed (s 26A(3)(b)). Draw down payments are not commutable (s 26A(5)), though there are hooked redemption and rollover routes in certain situations (ss 26A(6)-(6)(c), (9)-(11)).

• Administrative discretion and review: The Board has multiple discretionary functions: determining rates of return for rollover accounts (s 20ABAA(3)-(4)), deciding dependants for payment purposes (s 26A(11); ss 29(4), 30(3)), reviewing and terminating disability status (s 28(9)), and establishing terms for investments when investing draw down benefits with SFMC (s 26A(4)). The Treasurer also has decision power to reimburse Consolidated Account or special deposit account by charging specific Fund divisions or Lyell McEwin Employer Account (amendment to s 20B(2)), and to direct that contributions be paid from payroll where the Employer Account may be unable to meet payments (s 23(3)).

• Interaction with Commonwealth prudential law and preservation rules: The regulations expressly insert “SIS Act” into the Act’s definitions (r 6(5)) and state that provisions of the SIS Act relating to preservation will be taken to apply to a retiring contributor (s 27(3)(a)). That ties preservation treatment to Commonwealth superannuation regulation for at least the retirement context.

These concepts show a structure that separates the rollover balance (a named, individually maintained account with Board-set returns) from the formula-derived benefit component which in turn is charged first to the contributor’s contribution account and then to the Lyell McEwin Employer Account (see ss 27(1), 29(1), 30(1)). Several provisions cap or index entitlements by service or date, and the Board and the Treasurer have conditional powers to shift funding sources or determine account returns. All of these mechanics are set out in the regulations’ text.

The regulations apply to a narrowly identifiable and small group. Regulation 3 defines “contributor” for these regulations as a person whose name appears in Schedule 1. Schedule 1 lists three named individuals and a specific percentage contribution rate next to each name (Elizabeth Louise Bice , 5.7%; Agnelo Francis De Sousa , 6.0%; Norman Bruce Willoughby , 5.8%). Regulation 4 confirms each contributor continues to be a “new scheme contributor” under the Act. Therefore these regulations do not purport to create a general scheme but instead tailor the operation of the Act for the specific named contributors.

Who pays: The primary fund source for making contributions on behalf of a contributor is the Lyell McEwin Employer Account (s 23(2)), which is defined as an account kept at Treasury maintained pursuant to the s 5 arrangement under the Act with Central Northern Adelaide Health Service Incorporated (r 6(3)). Practically, this places primary payment responsibility on the employer-side account, not on the individual contributor. However the regulations also create a backstop: if after actuarial advice the Board forms the view the Employer Account may not meet its obligations and serves notice on the Treasurer, the Treasurer may direct that contributions be paid by individual contributors by deduction from salary (s 23(3)). That introduces a conditional shift of payment burden to contributors.

Who decides: Administrative decision-making lies primarily with the Board and the Treasurer. The Board maintains rollover accounts and determines year-end rates of return for them (new s 20ABAA(1), (3)-(4)), receives and determines applications for transition-to-retirement draw down benefits (s 26A(1)-(3)), sets terms for investments with the Superannuation Funds Management Corporation of South Australia when investing draw down benefits (s 26A(4)), reviews disability status and can terminate it (s 28(9)), and exercises broad discretion about payouts to dependants on death (s 26A(11), s 29(4), s 30(3)). The Treasurer has a reimbursement mechanism when paying benefits charged against contributor or rollover accounts (amended s 20B(2)) and a direction power to shift contribution payment method (s 23(3)).

What behaviours change: Named contributors must make contributions at the fixed rate shown opposite their name in Schedule 1 until they reach age 60 (s 23(1)), although the primary payer is the employer account (s 23(2)). Contributors who wish to access transition-to-retirement draw down benefits must enter an arrangement with their employer that reduces hours or alters duties and be able to show the arrangement relates to intended retirement (s 26A(1)(b)-(c)), and must apply to the Board in a manner and with material the Board may specify (s 26A(2)). Contributors receiving disability pensions are not required to make contributions while receiving that pension (s 28(11)). If the Board deems the Employer Account unable to continue funding, contributors could be obliged to have contributions deducted from salary (s 23(3)), which would affect take-home pay and payroll procedures.

Other affected parties: The Central Northern Adelaide Health Service Incorporated is linked to the Lyell McEwin Employer Account by reference (r 6(3)); the Treasurer is tied into funding directions and reimbursements (amended s 20B, s 23(3)); the Superannuation Funds Management Corporation of South Australia may be the recipient of draw down benefit investments (s 26A(3)(b)(i)); and the Board acts as the decision-maker on investment, disability, and distribution questions. The Fund’s divisions are also implicated because the Treasurer may charge “the relevant division of the Fund” to reimburse accounts when certain payments are made (amended s 20B(2)(a)).

Geographic and institutional scope: All operations contemplated by the regulations are embedded in the Act and within South Australian public finance and superannuation institutions; Commonwealth instruments are referenced only insofar as “SIS Act” is inserted as a defined term (r 6(5)) and preservation provisions of the SIS Act are taken to apply on retirement (s 27(3)(a)). The regulations therefore affect the named individuals, the employer account at Treasury, the Board and Treasurer, and associated institutional actors named above.

The regulations impose specific duties on contributors, the Board and the Treasurer and confer particular rights on contributors and dependants. These follow directly from the statutory text.

Duties of contributors:

• Contribution obligation: Each listed contributor “will make contributions to the Treasurer at the rate set out in Schedule 1” until reaching age 60 (s 23(1)). The schedule specifies a fixed percentage for each named contributor. Although s 23(2) provides that contributions will be paid to the Treasurer from the Lyell McEwin Employer Account, s 23(3) contemplates a shift to payroll deduction if the Board, after actuarial advice, forms the view the Employer Account may not meet obligations and serves notice on the Treasurer.
• Application requirements for draw down benefits: A contributor wishing to access a transition-to-retirement draw down benefit must apply in the form and with the information specified by the Board (s 26A(2)). The Board may require particulars to be supplied in order to be satisfied of the employment arrangement and its connection to retirement (s 26A(2)(b)).
• Non-contribution during disability pension: A contributor receiving a disability pension is not required to make any contribution during the period they receive that pension (s 28(11)). This is cast as a duty relaxed rather than a continuing obligation.

Rights of contributors:

• Entitlement to benefits: Contributors who retire, are retrenched, become totally and permanently disabled, or die, receive superannuation payments composed of two components: a rollover component that equals the credit of the contributor’s rollover account, and a formula-based component charged first to the contributor’s contribution account and then to the Lyell McEwin Employer Account (ss 27(1), 29(1), 30(1)). The regulations therefore guarantee (subject to the account balances and formula calculations) certain entitlements on these events.
• Transition-to-retirement access: Contributors meeting the age and preservation-age thresholds and entering the specified employment arrangement may apply for a draw down benefit; if the Board is satisfied an application is valid, an entitlement arises and the Board determines the draw down benefit and the investment route (s 26A(3)). The contributor also has an election as to whether the draw down is invested with the Superannuation Funds Management Corporation of South Australia or another entity providing a non-commutable income stream (s 26A(3)(b)(i)-(ii)).
• Preservation and SIS Act linkage: On retirement, the SIS Act provisions relating to preservation are taken to apply to the contributor and subject to compliance with those requirements the contributor is entitled to immediate payment of benefits under the section (s 27(3)). That protects contributors’ access to benefits subject to Commonwealth preservation rules.

Duties and powers of the Board:

• Account maintenance and returns: The Board must maintain rollover accounts (s 20ABAA(1)), debit them with payments charged to them (s 20ABAA(2)), and at each financial year end vary balances by a rate of return it determines (s 20ABAA(3)). In determining the rate, the Board should regard the net rate of return achieved by investment of money held by the Fund in rollover accounts (s 20ABAA(4)). The Board may estimate a rate for interim balance calculations; that estimated rate is not subject to later adjustment (ss 20ABAA(5)-(6)).
• Determination and administration of draw down benefits: The Board determines the draw down benefit and the terms for investing a draw down benefit with the SFMC (s 26A(3)-(4)). It receives and may insist upon applications and supporting material (s 26A(2)). The Board also has discretion to redeem investments under specified conditions (s 26A(6)(b), (9)-(11)).
• Disability review and termination: The Board determines whether a contributor is totally disabled for the purposes of the disability pension (s 28(8)) and may review and terminate disability status (s 28(9)). The Board’s satisfactions and reviews are central to disability pension rights.
• Discretion over distributions on death: On a contributor’s death, the Board is empowered to redeem investments and pay to dependants or the estate in such shares as the Board thinks fit (s 26A(11); see also ss 29(4), 30(3)).

Duties and powers of the Treasurer:

• Reimbursement mechanism: Where a payment or part of a payment is to be charged against a contributor’s contribution account, rollover account or the Lyell McEwin Employer Account, the Treasurer may reimburse the Consolidated Account or a special deposit account by charging either the relevant division of the Fund or the Lyell McEwin Employer Account (amendment to s 20B(2), r 9).
• Direction to change payment source: If the Board, having taken actuarial advice, forms the view the Lyell McEwin Employer Account may not be able to meet the payment of contributions and serves written notice on the Treasurer, the Treasurer may direct that contributions be paid by individual contributors by payroll deduction rather than from the Employer Account (s 23(3)).

Rights of dependants and estates:

• On death, payments may be made to dependants or to the estate at the Board’s discretion (s 26A(11); ss 29(4), 30(3)). “Dependant” is defined in the Act as amended by the regulations to include spouse, children and any person whom the Board thinks was dependent on the contributor on the entitlement day (r 6(2)).

Other duties and operational requirements:

• The Board must have regard to Fund investment performance when choosing rollover account return rates (s 20ABAA(4)).
• Contributors who were part-time on 1 January 1999 are taken for contribution calculation purposes to be receiving a full-time equivalent salary (s 23(3a)). Those whose contributions and benefits were based on a higher salary prior to 1 January 1999 are taken to have made an election under s 4(4) in respect of the reduction (s 23(3b)).

In summary, the regulations allocate operational duties to the Board for account maintenance, require the Treasurer to retain an ability to direct payment-source changes and reimburse public accounts, and fix contribution obligations and benefit entitlements for the named contributors. The Board’s discretionary powers over rates of return, disability status, and distributions to dependants are central to how those rights will be administered.

The regulations themselves do not introduce new civil or criminal penalties expressly in their text. They amend and substitute provisions of the Act, and enforcement, penalty and contravention regimes for matters governed by the Act remain located in the Act itself unless expressly altered here. The regulations’ changes are largely administrative and entitle certain payments and account treatments rather than prescribing offences or sanctioning enforcement mechanisms within the regulations text.

What the instrument does provide in enforcement-relevant terms:

• Funding and reimbursement mechanics that affect how benefits are paid: The amendment to s 20B(2) (r 9) clarifies the Treasurer’s power to reimburse the Consolidated Account or special deposit account by charging the relevant division of the Fund with amounts charged against a contributor’s contribution account or rollover account, or by charging the Lyell McEwin Employer Account (amended s 20B(2)(a)-(b)). This creates a specific administrative flow for government payments and reimbursements but does not itself set penalties.
• Board discretion that can terminate eligibility: The Board may, after a review, terminate a contributor’s status as totally disabled and thereby stop disability pension payments (s 28(9)(a)-(c)). The practical effect is an administrative enforcement lever, the Board can end benefit payments when the statutory criteria are no longer met. The decision is made by notice in writing to the contributor and is based on the Board’s satisfaction about capacity to work or consent from the contributor (s 28(9)).
• Direction to change payment source: If the Board considers the Lyell McEwin Employer Account may be unable to meet payment obligations and serves notice, the Treasurer may direct that contributions be paid by deduction from salary (s 23(3)). That is an enforcement-adjacent power because it reassigns the payment method to a payroll deduction, changing the mechanism by which contributions are collected and enforced against contributors by employers.

What the regulations do not do or specify:

• No new penalty offences: There is no provision in the regulations text that creates a new offence, imposes fines, or prescribes administrative penalties. Any misconduct or contravention consequences would therefore fall to the Act’s pre-existing enforcement and penalty provisions (which the regulations modify in their application to the named contributors as described elsewhere but do not themselves cite or reproduce).
• No procedural enforcement regime for appeals: The regulations describe Board powers and discretions (for example, determining rollover account returns, reviewing disability status, making payment decisions to dependants), but they do not set out appeal routes, merits review processes, or judicial review mechanisms within these regulations. Those remedies, if any, must be sought under the Act or general administrative law avenues.

Operational enforcement risks and considerations:

• Administrative decisions with practical effect: The Board’s determination of a rate of return for rollover accounts (s 20ABAA(3)-(6)) and its ability to fix terms and conditions when investing draw down benefits (s 26A(4)) effectively regulate account outcomes and the pace and quantum of payments to contributors. Those decisions may be challenged under administrative law principles in the absence of specified internal appeal channels, but the regulations themselves do not provide the route.
• Funding shortfalls and compulsory deduction direction: The Treasurer’s power to direct payroll deduction (s 23(3)) transfers the enforcement method for collection to employers and payroll systems. That is an enforcement mechanism by operational compulsion rather than penalty.

In summary, penalties and explicit enforcement mechanisms are not added or altered in a way that the regulations record as new offences or fines. The instrument relies on the Act’s existing enforcement architecture and creates administrative powers (Board determinations, Treasurer directions and reimbursement charge mechanisms) that have enforcement-like effects on payment flows and eligibility. Any sanctions for non-compliance with duties imposed by the Act and these regulations will depend on the Act’s general provisions and the exercise of administrative powers described in the regulations.

The regulations explicitly interact with the parent Superannuation Act 1988 (the Act) throughout. They modify the Act’s application to the named contributors and insert new sections into the Act (for example, s 20ABAA). The regulations also incorporate a Commonwealth statute as a defined reference point and intersect with public finance arrangements at Treasury. The text identifies and operationalises these interactions.

• Modifying the Act: Regulation 5 states the purpose of Part 2 as modifying the Act for contributors listed in Schedule 1. Multiple amendments in r 6-12 are direct amendments to the Act’s sections. For instance, the regulations amend the Act’s definitions in s 4(1) (r 6), insert the new rollover account section after s 20A (r 8), change payment-of-benefits rules in s 20B (r 9), rewrite s 23 on contribution rates (r 10), and substitute the whole of Part 4 with a bespoke Part 4 for Lyell McEwin contributors (r 11). These changes mean the Act’s ordinary provisions operate in a modified way for the named contributors as specified.

• Commonwealth prudential law and preservation rules: The regulations insert “SIS Act” (Superannuation Industry (Supervision) Act 1993 (Cth)) into the Act’s definitions (r 6(5)) and expressly state that the SIS Act provisions relating to preservation of benefits will be taken to apply to, and in relation to, contributors on retirement (s 27(3)(a)). This links the State-regulated scheme elements to Commonwealth prudential and preservation regimes for at least the retirement context, creating a compliance overlap where contributors and administrators must observe SIS Act preservation requirements when making retirement payments under s 27.

• Treasury and public account interaction: The Lyell McEwin Employer Account is an account kept at the Treasury pursuant to an arrangement under s 5 of the Act with the Central Northern Adelaide Health Service Incorporated (r 6(3)). The amended s 20B(2) (r 9) gives the Treasurer an express mechanism to reimburse the Consolidated Account or a special deposit account by charging either a relevant division of the Fund or the Lyell McEwin Employer Account. Those provisions link the scheme’s payments to public finance accounts and Treasury administration, meaning that payments and reimbursements interact with state budget processes.

• Superannuation Funds Management Corporation of South Australia: Section 26A(3)(b)(i) contemplates investing a draw down benefit with the Superannuation Funds Management Corporation of South Australia. That introduces an interface with a state investment vehicle and the terms and conditions to be applied are to be determined by the Board (s 26A(4)). The purchaser/provider relationship and investment governance will therefore interact with SFMC’s own rules and mandates.

• Employer and payroll law: Section 23(3) allows a Treasurer direction switching payment of contributions from the Lyell McEwin Employer Account to deduction from salary. That produces direct operational interaction with employer payroll systems and the legal duties of employers to make deductions and remit contributions. Where a direction is given, payroll practice and potentially employment contracts will be implicated because contribution deductions will affect take-home pay.

• Act provisions not reproduced: The regulations do not restate the Act’s general enforcement, administrative, appeals, or investment rules; they operate as modifications and supplements. For example, s 17(4)(a) of the Act is amended to expand the source of moneys “by or on behalf of the contributors” (r 7), but the broader fiduciary or prudential duties the Act imposes remain in the Act as enacted.

• Repeal of earlier regulations: The instrument revokes the earlier Superannuation (Lyell McEwin Employees) Regulations 1999 (Schedule 2). That revocation directs administrators and affected parties to the 2009 regulations as the operative subordinate instrument for these contributors.

Thin or absent cross-references:

• The regulations reference the SIS Act and SFMC but do not incorporate their operative texts; compliance with those statutes or entities’ rules will require external reference.
• The regulations make the Board and Treasurer central decision-makers but do not set out appeal or review processes; those interactions will depend on the Act and general administrative law.

In short, the regulations create a tightly integrated framework that modifies the Act for particular contributors while linking payments and preservation treatment to Commonwealth prudential rules, integrating Treasury and employer account mechanisms, and involving state investment entities. Compliance therefore requires navigating the Act as modified by these regulations, the SIS Act preservation provisions in the specific circumstances, and public finance arrangements at Treasury.

The regulations present a compact amendment record within their own text and a brief legislative history recorded at the end. The instrument as enacted on 27 August 2009 (Gazette p 3874) commenced 1 September 2009 (r 2). Schedule 2 expressly revokes the Superannuation (Lyell McEwin Employees) Regulations 1999; r 12 deletes sections 45 and 46 of the Act as part of the package. The principal regulations are recorded as 2009 No 225 in the legislative history note.

Specific amendments effected by the 2009 instrument:

• Definitions amended and expanded: Regulation 6 makes multiple amendments to s 4(1) of the Act, adding the named contributors to the definition of “contributor” (r 6(1)), creating a statutory definition of “dependant” in relation to a contributor (r 6(2)), defining the Lyell McEwin Employer Account (r 6(3)), defining “rollover account” (r 6(4)), and inserting “SIS Act” as a defined term (r 6(5)). Each change is a targeted textual amendment to the Act’s interpretative section.
• Fund source language amended: Regulation 7 alters s 17(4)(a) to substitute the phrase so the Fund’s moneys are “by or on behalf of the contributors” rather than “by contributors” (r 7). That change potentially broadens the possible sources of contribution crediting to the Fund’s accounts.
• New statutory section inserted: Regulation 8 inserts new s 20ABAA (Rollover accounts) after s 20A, establishing the rollover accounts and the mechanism for determining and applying a rate of return.
• Rewriting of payment-of-benefits reimbursement: Regulation 9 replaces s 20B(2) to provide the Treasurer with an express mechanism to reimburse public accounts by charging either the relevant division of the Fund or the Lyell McEwin Employer Account depending upon whether payments are to be charged to contribution accounts, rollover accounts, or the Employer Account.
• Substantive rewrite of contribution rates and payment source: Regulation 10 deletes and substitutes subsections of s 23, fixing contribution rates per Schedule 1, placing payment responsibility primarily on the Lyell McEwin Employer Account, and providing the conditional direction mechanism to switch to payroll deductions (s 23(3)). It also introduces special treatment for part-time employees as at 1 January 1999 (s 23(3a)-(3b)).
• Substitution of Part 4: Regulation 11 deletes existing Part 4 of the Act and substitutes a bespoke Part 4 that applies only to the contributors to whom these regulations apply (s 26). This replaced Part 4 sets out specific entitlements and definitions for retirement, transition-to-retirement, disability, total and permanent disablement, and death benefits (ss 26A-30).
• Repeal of sections: Regulation 12 deletes sections 45 and 46 from the Act, though the instrument does not set out the text of those deleted sections.

Legislative history note at the end records:

• Principal regulations: Year 2009, No 225, Gazette 27.8.2009 p 3874.
• Commencement: 1.9.2009 per r 2.

There is no further amendment history recorded in this instrument itself. Any subsequent amendments to the Act or regulations after 2009 are not shown in the provided text. Practitioners should therefore treat this instrument as a standalone 2009 modification package: it replaced the 1999 instrument, rewrote significant sections of the Act for the named contributors, inserted new account and benefit mechanics, and established the current operative regime for those contributors as at 1 September 2009.

The regulations do not record any litigation, cases or judicial interpretations within their text. There are no cases, appeals, or authorities cited in the instrument. Accordingly, the instrument itself provides no litigation history or examples of judicial treatment of its provisions.

What this means practically:

• No precedents supplied: Because the regulations contain no references to cases or prior adjudication, any legal questions about interpretation, exercise of discretion by the Board or Treasurer, or conflicts with Commonwealth law (for example, how the SIS Act preservation provisions apply in practice) will have to be resolved by reference to broader statutory interpretation principles and, if litigated, through fresh litigation that is not recorded in the instrument.
• Administrative decisions may be subject to judicial review: Several provisions grant the Board significant discretion (for example, determining rollover account returns, terminating disability status, deciding dependent entitlements on death, rejecting applications for draw down benefits where minimum thresholds are not met). While the regulations do not specify appeal mechanisms, decisions of administrative actors may be subject to judicial review on public law grounds. The regulations themselves do not elaborate on whether internal review mechanisms exist; reliance will be on the Act’s general provisions or administrative law avenues.
• Potentially litigable areas identified by the text: The Board’s discretion over what persons are “dependants” (r 6(2); referenced in s 26A(11), s 29(4), s 30(3)), the Board’s calculation and communication of rates of return and the use of estimates that are not adjusted later (s 20ABAA(3)-(6)), and the Treasurer’s power to redirect contribution sources upon notice from the Board (s 23(3)) are the kinds of administrative choices that have factual and legal consequences and could give rise to challenge. The regulations do not supply precedent for these.

For present purposes, a researcher or practitioner should note that the regulations are silent on litigation history; any case law affecting interpretation or operation must be sought from court databases and records post-dating the enactment or from cases arising under the parent Act where these amendments were implicated. The absence of litigation in the text does not imply immunity from dispute; it simply records that no cases are named in the instrument itself.

The regulations include several non-obvious mechanics and discrete drafting choices that can have practical consequences. These are items lawyers, trustees, employers, payroll officers and contributors should note carefully because they create legal risk, timing mismatches, or administrative burdens.

• Very small, specified cohort: Only the names contained in Schedule 1 are covered (r 3 and Schedule 1). If a person thinks they are covered but is not named, the bespoke provisions do not apply. Conversely, the named contributors are subject to tightly tailored rules that differ from the general scheme under the Act. Practitioners must confirm actual inclusion in Schedule 1 before advising or administering.

• Rollover account returns can be estimated and not later adjusted: Under s 20ABAA(5)-(6), if the Board has not yet determined the rate of return for a financial year when a balance must be determined, it may apply an estimated percentage rate of return and that balance will not be adjusted when the rate is later determined. This creates a potential mismatch between an interim balance and the eventual determined return. Contributors or administrators relying on interim balances could find final outcomes differ, and no retrospective adjustment is required by the text.

• Board-determined “rate of return” can be negative: Section 20ABAA(7) clarifies that “rate of return” can be positive or negative. Rollover account balances can therefore be reduced at year end by a Board-assessed negative return. Contributors should not assume rollover accounts are protected against negative adjustment.

• Contributions sourced from Employer Account but potentially switched to payroll deduction: Section 23(2) places initial payment responsibility on the Lyell McEwin Employer Account. However s 23(3) allows a switch,if after actuarial advice the Board forms the view the Employer Account may not be able to meet payment obligations and serves notice, the Treasurer may direct that contributions be deducted from salary. That moves the payment burden to contributors and requires employer payroll systems to be ready to implement the direction. The switch is conditional but triggered by actuarial advice and Board view, not by a statutory default event. Employers must therefore be alert to notice events and be prepared to implement payroll deductions.

• Contribution rates fixed until 60: Schedule 1 fixes contribution rates for each named person “until he or she reaches the age of 60 years” (s 23(1)). No mechanism is provided in the regulations for changing those fixed rates prior to age 60. If circumstances change (for example, legislative reform or employer financial pressure), the schedule’s fixity is a constraint unless further regulation or amendment occurs.

• Transition-to-retirement formulas and minimums: Section 26A contains a maximum draw down benefit calculation that depends on FS, NS and SP and then requires the draw down be invested so the contributor receives a pension or annuity. If the maximum draw down benefit is insufficient to obtain a non-commutable income stream, the Board must either set the draw down to the minimum required or reject the application if minimum required exceeds SP (s 26A(12)). That means an applicant may have an entitlement denied not because of merit but because of minimum product thresholds set by the market/provider, and the Board is required to reject applications in some circumstances. Contributors should therefore assess product market minimums before applying.

• Non-commutability, but redemption routes exist with conditions: Draw down payments are “not commutable” (s 26A(5)) but the contributor can, in certain circumstances, terminate the investment and pay the balance into the rollover account (s 26A(6)(a)) or redeem investment in due course (s 26A(6)(b), (9)). If a contributor dies, the Board may redeem the investment and distribute proceeds to dependants or estate at its discretion (s 26A(11)). These carve-outs mean “non-commutable” is not absolute, and the Board’s discretion will determine practical outcomes in redemption or death scenarios.

• Board discretion in dependants and distributions: Several provisions allow the Board to determine which dependants receive death benefits and in what shares (s 26A(11); ss 29(4), 30(3)). There are no objective distribution rules in the regulations, leaving distribution outcomes highly dependent on Board assessment. That creates potential uncertainty for families and estates.

• Caps and historical date anchors in benefit formulae: The benefit calculations in ss 27(2), 29(2) and 30(2) use “M” defined by months since 31 December 1998, with caps at 144 or 204 months depending on age thresholds and dates such as “reached the age of 65 years on or before 31 December 2010.” These calendar anchors and caps mean different cohorts receive different multipliers, and benefits depend on historical employment tenure relative to fixed dates. Calculators and advisers must implement the date logic precisely to avoid miscalculations.

• Employment status around 1 January 1999 affects P: The variable P uses an employment-proportion metric tied to full-time status on 1 January 1999 and subsequent changes. Section 23(3a) confirms part-time employment that existed on 1 January 1999 is treated as full-time for contribution calculation purposes. That historical employment snapshot affects both contribution and benefit calculations and may lead to complexity in reconstructing employment histories.

• Absence of internal appeal or review pathways in the regulations: The regulations give the Board many discretionary functions (rates, disability status, distributions, investment terms) but do not specify internal review processes. Affected persons relying on review remedies must therefore look to the Act or general administrative law for redress. This lack of procedural detail can delay dispute resolution.

• Repeal and replacement complexity: The regulations revoke the 1999 instrument and delete s 45 and 46 from the Act (r 12). Administrators must ensure historical entitlements transitioned correctly under the new rules, particularly for contributors with ongoing disability pensions (s 28(10) treats a pension existing immediately before 31 August 2009 as taken to be a pension under the new section). Transition handling may require careful record reconciliation.

Each of these “gotchas” flows directly from the statutory text; administrators, trustees and contributors should plan operational processes, record-keeping and legal reviews around these items rather than assuming broad parity with the general scheme under the Act.

Compliance requires aligning administrative processes, payroll, trustee decisions, record-keeping and applicant materials with the mechanics the regulations set out. Below are practical steps and checklists grounded in the text.

1. Confirm coverage and contribution rate

• Verify whether a person is a “contributor” under these regulations: check Schedule 1 (r 3 and Schedule 1). Only named persons are covered. Confirm the exact contribution percentage noted opposite the name (s 23(1) and Schedule 1).
• Ensure your payroll and HR systems record the contributor’s birth date and that contribution obligations continue until age 60 (s 23(1)).

2. Establish and reconcile rollover accounts

• The Board must maintain rollover accounts in the name of each contributor (s 20ABAA(1)). Trustees or Board administrators should ensure these accounts are set up, that their debits are correctly charged when payments are made (s 20ABAA(2)), and that year-end procedures include varying balances by the Board-determined rate of return (s 20ABAA(3)).
• Implement a procedure for interim balance calculations where the rate of return has not been determined; apply an estimated rate where necessary and document that estimated rate because it will not be adjusted later (s 20ABAA(5)-(6)).

3. Investment return determination and documentation

• The Board should document how it determines the annual rate of return for rollover accounts and have regard to the net rate of return achieved by investment of money held by the Fund in rollover accounts (s 20ABAA(4)). Keep investment records that show connection between Fund investment performance and the rate chosen.

4. Contribution payment flows and contingency planning

• By default, contributions are to be paid to the Treasurer from the Lyell McEwin Employer Account (s 23(2)). The employer and Treasury must coordinate account reconciliation and remittances.
• Prepare for the contingency in s 23(3): obtain actuarial monitoring so the Board can promptly form a view on the Employer Account’s capacity. If the Board serves written notice, the Treasurer may direct contributions to be deducted from salary; employers must be ready to implement payroll deductions and notify contributors appropriately.

5. Transition-to-retirement applications

• Contributors seeking draw down benefits under s 26A must meet age and preservation criteria and enter an employer arrangement that reduces hours or duties (s 26A(1)). Board administrators should prepare application forms and a checklist for supporting evidence as per s 26A(2).
• The Board must evaluate FS, NS and SP to determine the maximum draw down benefit (s 26A(3)(a)); implement consistent actuarial/administrative methods to calculate these variables.
• Provide contributors clear information on available investment routes: the SFMC or another provider offering a non-commutable income stream (s 26A(3)(b)). Document election forms and investment terms.

6. Non-commutable payments and redemption pathways

• Implement processes to handle the limited commutation and redemption options in s 26A(5)-(6) and (9). If a contributor elects to end the investment and roll the balance into the rollover account, ensure the rollover account is (or can be) re-established and that the account adjustment required by s 26A(7)(a) is performed.

7. Disability pension administration

• The Board sets and reviews disability status and may terminate status (s 28(8)-(9)). Ensure medical and occupational evidence protocols are in place. Record decisions, reasons and notice communications to contributors.
• For contributors receiving disability pensions, contributions are not required over the period of receipt (s 28(11)). Payroll systems must reflect non-deduction during pension receipt.

8. Benefit calculation on termination events

• Implement benefit calculators that use FS, M and P as defined across ss 27, 29 and 30. The definitions of M include date-based caps tied to 31 December 1998 and 31 December 2010; P depends on employment status around 1 January 1999 (s 23(3a)-(3b)). Ensure historical employment records are available to determine P precisely.
• On retirement, retrenchment, resignation, TPD or death, benefits are composed of the rollover component (credit of rollover account) and the formula component that is charged first to the contributor’s contribution account and then to the Lyell McEwin Employer Account (ss 27(1), 29(1), 30(1)). File documentation showing which accounts were charged and the steps taken to reimburse public accounts when necessary (amended s 20B(2)).

9. Death and dependant distributions

• Maintain up-to-date nomination and family status records. The Board has discretion to pay dependants or the estate and to decide shares (s 26A(11); ss 29(4), 30(3)). Prepare Board procedures and criteria for assessing dependants under the definition inserted into s 4(1) (r 6(2)).
• For investments held when a contributor dies, prepare to redeem and distribute per the Board’s discretion (s 26A(11)).

10. Recordkeeping, reporting and inter-agency coordination

• Document Board determinations of rates of return, actuarial advice that triggers Treasurer directives (s 23(3)), and communications between Board and Treasurer per ss 20B(2) and 23(3).
• Coordinate with Treasury (Lyell McEwin Employer Account), the Superannuation Funds Management Corporation of South Australia (for draw down investments) and employers for payroll deductions and remittances.

11. Legal and advisory review

• Because many provisions confer Board discretion and some procedural ambiguity exists (for example, the Board’s criteria for dependants, appeal pathways), trustees and administrators should keep legal counsel involved when exercising discretion, denying applications (s 26A(12)(b)) or terminating disability status (s 28(9)).
• Where applicable, check the interaction with SIS Act preservation rules (s 27(3)(a)) to ensure retirement payments requiring preservation compliance are processed correctly.

12. Communication with contributors

• Provide contributors with clear written notices about contribution rates (Schedule 1), whether their contributions are being paid from the Employer Account or deducted from salary (and when a Treasurer direction is issued under s 23(3)), the nature of rollover accounts and possible negative returns, and the non-commutable nature of draw down payments alongside the exceptions and redemption options.

Following these concrete steps, each grounded in a specific regulatory provision, will align practice with the legal requirements the regulations impose. Administrators should also monitor for any subsequent amendments to the Act or regulations and for any Board-made policies or rules that standardise application of the discretionary powers the regulations create.
