Plain English Summary

1/10 complexity

This declaration prevents a specific group of telecommunications workers from being classified as "productivity employees" under the Commonwealth Superannuation Scheme (CSS).

Who it affects

Workers who were employed by OTC Limited on 31 January 1992
Who then became employees of the Australian and Overseas Telecommunications Corporation (AOTC) on 1 February 1992

What it does

These workers are explicitly excluded from being "productivity employees" under Part VIA of the Superannuation Act 1976
This means they do not receive superannuation contributions based on productivity agreements (employer contributions tied to workplace productivity deals), instead remaining under standard CSS contribution arrangements

Why it matters

During the 1992 restructuring of Australia's telecommunications industry, this declaration ensured these particular employees kept their existing superannuation arrangements rather than moving to a productivity-based contribution system
It determines how much money their employer must contribute to their retirement savings
