The text relies on a set of express definitional building blocks and recurring operational concepts. Key definitions are collected in clause 3 and are used throughout table 5 and table 6. Three concepts are central.

Protection zone and geographic delimitation. The Southern Sydney Protection Zone is a notional maritime area defined by coordinates that trace a line commencing and ending at the mean low water mark and running through a sequence of geodesic points (clause 6(1)). Coordinates are in the Geocentric Datum of Australia 2020. The zone is expressly bounded by Australia’s international jurisdictional limits: the Declaration applies to the extent consistent with Australia’s jurisdiction under international law (clause 5). The zone therefore operates within domestic jurisdictional reach.

Nominal cable location and submerged plant items. Clause 7 supplies nominal alignment coordinates for cables (Australian Japan Cable and Tabua Cable in the supplied text). The Declaration uses the notion of submerged plant items, defined as the electro‑optic electronic components of a submarine cable system installed at intervals to manage signal (clause 3, “submerged plant items” and examples). Several restrictions turn on proximity to a cable’s submerged plant items: for example, item 7(e) of table 6 requires that a new cable, pipeline or equipment not approach or cross less than 500 metres from a submarine cable’s submerged plant items, determined following consultation with each cable carrier.

Activity classification: prohibited versus restricted. Clause 8 lists activities that are outright prohibited in the zone subject to narrow exceptions (clause 8(1), table 5). Prohibited activities include specific fishing gear and methods capable of contacting the seabed, towing or operating such gear, scuttling a ship, and establishing spoil grounds (table 5 items 1 to 5). Clause 9 establishes the broader category of restricted activities, with each restricted activity accompanied by a condition or conditions that, if satisfied, permit the activity (table 6 items 1 to 17). Examples of restrictions are spatial limits (for example, many fishing activities are limited to waters less than 500 metres from low water mark), gear specification limits (hook types, breaking strains, trap dimensions, weights), and procedural constraints (prior notice, information exchange, consideration of cable carrier representations).

Protocol to cable carriers. The instrument assigns a pivotal role to cable carriers. Clause 3 defines “cable carrier” for different cable ownership or nomination scenarios. For many restricted activities the responsible entity must provide each cable carrier with particulars and location not later than 21 days before the activity and must comply with reasonable written requests for information within seven days, and consider and respond to reasonable representations (see table 6 items 7, 8, 9, 10, 12, 13, 14). These procedural steps create a consultative process in which cable carriers can provide information and representations that entities must heed, and they are the primary recipients of pre-activity notices.

Operational limits and technical thresholds. The restricted-activity conditions use repeatable technical thresholds: distance from low‑water mark (500 metres), water depth (100 metres), maximum breaking strains for ropes and lines (850 kilograms and 50 kilograms in specific contexts), maximum shot weight (20 kilograms), anchor weights and trip release mechanisms (item 17), and seismic pressure wave limits at electro‑optic devices (2.0 bar in item 12(d)). These thresholds translate the protection objective into measurable compliance metrics that entities must design operational plans to meet.

Cross-references and statutory context. The Declaration repeatedly cross-refers to the Telecommunications Act 1997 and Schedule 3A; several defined terms are drawn from clause 2 of Schedule 3A to the Act, including “conduct”, “installation”, “line”, “ship”, “submarine cable”, and “network unit” (see clause 3 notes and specific definitions). The instrument therefore functions as a delegated legislative instrument that operates within the statutory framework created by Schedule 3A of the Act.

Textual anomaly to note. The instrument’s internal text contains a potential inconsistency: the definition of “nominal location” in clause 3 refers to the Australian Japan Cable or Southern Cross Cable specified in section 7, while section 7 as provided lists coordinates for the Australian Japan Cable and the Tabua Cable (clause 3 definition, clause 7). The source text therefore requires careful reading to determine which cable designations are operative.

The Declaration creates obligations and constraints that fall on a range of identifiable parties. The principal affected groups are cable carriers, commercial fishers and fishing-gear operators, maritime commercial operators and ship masters, companies and persons conducting exploration, exploitation or other seabed-disturbing works, civil engineering contractors, research institutions, Commonwealth and State agencies involved in managing fishing or ocean disposal points, and defence forces conducting exercises.

Cable carriers. The definition of “cable carrier” in clause 3 assigns operational standing to the carrier that owns or jointly owns a cable, a carrier named in a nominated carrier declaration, carriers who held protection zone installation permits where relevant, or carriers of adjacent network units (clause 3, “cable carrier”). Cable carriers receive pre-notice of many restricted activities (table 6 items 7, 8, 9, 10, 12, 13, 14) and have the right to make reasonable written requests for information and to make reasonable representations regarding likely damage or impediments to efficient operation, maintenance or repair.

Fishing industry and recreational fishers. Multiple items target fishing methods and gear. Table 5 prohibits use of mid-water trawls, any fishing gear capable of contacting the seabed, demersal longline, Danish seine and Scottish seine (clause 8(1), table 5 item 2). Table 6 governs permitted use of nets anchored to the seabed, pots and traps, demersal droplines and longlines, and other gear subject to depth and equipment constraints (for example, breaking strain limits, hook types, and maximum sizes) (clause 9, table 6 items 1 to 5, 11, 16). These constraints directly affect commercial and recreational operators whose routes or grounds lie within the zone. The rules distinguish hand-harvest methods and certain gear configurations as permissible under spatial or equipment constraints.

Maritime operators and ship masters. The Declaration affects ship anchoring practices. Table 6 item 17 restricts lowering, raising or suspending an anchor beyond 500 metres from the low-water mark unless specific weight and trip-release or area conditions are met (clause 9, table 6 item 17). Shotlines and shot weight limits are regulated (item 16). Towing of objects used in prohibited activities is prohibited outright in table 5 item 3. Ship masters and operators must therefore alter anchoring and mooring plans, and towing or deployment of equipment, when in the zone.

Resource and infrastructure developers. Entities planning to install, maintain or remove electricity cables, oil or gas pipelines and any like cables or associated equipment, and those exploring for or exploiting non-biological resources, must follow the notice-and-consult process (table 6 items 7 and 12). They must provide particulars and location 21 days before the activity, comply with reasonable written requests for information within seven days, and consider and respond to representations by cable carriers (table 6 items 7 and 12). Item 7 contains a substantive spatial constraint that new infrastructure must, to the greatest extent practicable, minimise the path across the zone and must not approach submerged plant items less than 500 metres (item 7 parts d and e). These requirements affect marine contractors and proponents seeking permits and project approvals.

Research and civil engineering practitioners. Research that involves contact with the seabed, and many civil engineering works, are treated as restricted activities (table 6 items 5 and 14). These activities are permitted in certain nearshore areas (waters less than 500 metres from low-water mark) or otherwise subject to the 21 day notice/7 day response process and the “not likely to damage or impede” standard. Universities, private research organisations and government science agencies will need to factor the process and physical constraints into fieldwork planning.

Government departments. The Department of Primary Industries and Regional Development (the NSW department defined via section 4 of the Fisheries Management Act 1994 as in force from time to time) is explicitly given a narrow exemption when installing, managing or removing a fish aggregating device within 100 metres of specified points, provided the activity is contracted or conducted by or on behalf of that Department (clause 8(2), table 5A). Commonwealth or State authorities that designate ocean disposal points and spoil grounds are affected by the prohibition on establishing such grounds in the zone (table 5 item 5), and the Declaration cross-references such designations in defining “ocean disposal point” and “spoil ground” (clause 3 definitions).

Defence entities. The Declaration allows the use of explosives within limited circumstances, including exercises conducted by or with the Australian Defence Force within a declared Firing Practice Area (table 6 item 15(c)). Where explosives are otherwise used in resource exploration or construction works, the activity must satisfy the item 15 conditions.

Third parties providing information or making representations. Cable carriers will receive notifications and are entitled to make reasonable requests and representations; entities are obliged to comply or respond. This creates a de facto stakeholder engagement network among carriers, proponents, and other maritime actors.

Who decides and who pays. The Declaration places decision responsibilities on the entity responsible for an activity, with specified procedural duties to notify and to respond to cable carriers' requests (table 6 items 7, 8, 9, 10, 12, 13, 14). The economic costs , compliance time, engineering redesign, additional equipment, rerouting, or delay , fall primarily on those entities proposing restricted activities and on fishers changing gear or fishing grounds. Cable carriers bear the cost of engaging with notices and making representations, and they gain a privileged informational and consultative role.

The Declaration creates concrete duties for persons proposing to carry out restricted activities, and confers informational and consultative rights on cable carriers. These duties and rights are expressed in table 6 and explained in clause 3 definitions and other provisions.

Duties of responsible entities

• Prior notice. For specified restricted activities the entity responsible must, not later than 21 days before the activity, provide each cable carrier with the particulars of the activity and the location (table 6 items 7, 8, 9, 10, 12, 13, 14). Item 12 (exploration/exploitation) also requires particulars of expected commencement date and duration. The content required is not exhaustively defined beyond these elements, but the notice is an express precondition to carrying out the activity.

• Information flow and response timeline. The entity must comply with any reasonable written request for information from a cable carrier within seven days of receiving the request (table 6 items cited above). The seven day window is a built-in short timeframe; the text characterises requests as “reasonable”.

• Consider and respond to representations. The entity must consider and respond to any reasonable representations made by a cable carrier in relation to the likelihood of damage or an impediment to efficient operation, maintenance or repair of submarine cables (same items). The duty is to consider and respond, not to accede. The standard is again “reasonable”.

• Physical and technical constraints. Numerous items prescribe concrete operational constraints the entity must observe when conducting an activity, for example:

  • Do not approach or cross a submarine cable’s submerged plant items less than 500 metres from the cable, determined following consultation with each cable carrier (item 7(e)).
  • Minimise a new cable or pipeline path across the zone “to the greatest extent practicable” (item 7(d)).
  • Respect breaking‑strain limits and gear specifications such as maximum trap rope breaking strain of 850 kilograms and prohibition on wire in certain mainlines, use only circle‑type hooks for demersal droplines in certain areas, etc. (items 2 and 3).
  • Seismic surveys that would result in pressure waves of 2.0 bar or more at the seabed in the location of electro‑optic devices must have grid lines adjusted so pressure at electro‑optic devices is reduced to less than 2.0 bar (item 12(d)).

• Spatial constraints. Many activities are permitted only within waters less than 500 metres from the low‑water mark unless other conditions are satisfied (items 1 to 6 and 11 to 17 are explicitly connected to that spatial threshold in table 6). Some activities are further constrained by water depth criteria (for example item 16 and 17 require the ship to be operating in waters less than 100 metres deep in specified circumstances).

Rights and procedural standing of cable carriers

• Notification recipient. Cable carriers are entitled to receive the 21 day pre-activity particulars and location for a range of activities (table 6 items listed above).

• Request information. Cable carriers may make reasonable written requests for information; the responsible entity must comply within seven days (table 6 items).

• Make representations. Cable carriers may make reasonable representations about likely damage or impediments to efficient operation, maintenance or repair. Entities must consider and respond (table 6 items).

• Determination of submerged plant items. Where distance standards reference submerged plant items, the metric is to be determined following consultation with each cable carrier (item 7(e)). This grants cable carriers an instrumental role in mapping the critical points and measuring compliance distances.

Limited exemptions and special cases

• Department of Primary Industries and Regional Development. Clause 8(2) creates a narrow exemption for installation, management or removal of a fish aggregating device within 100 metres of two specified coordinates (table 5A) provided the activity is contracted or conducted by, or on behalf of, the Department.

• Fishing exceptions for restricted activities. Clause 8(3) preserves that certain fishing operations may perform activities otherwise prohibited under table 5 if they are listed as restricted activities in table 6 (for example certain pot, trap and dropline uses subject to gear limits).

Procedural vagueness and standards

• “Reasonable” qualifiers. The instrument repeatedly uses “reasonable written request for information” and “reasonable representations” without elaborating objective tests or decision criteria. The duty is to respond and consider, not necessarily to comply with the representation.

• “Greatest extent practicable”. Item 7(d) requires minimisation of the path across the Protection Zone to the greatest extent practicable, a contextual standard that factors in feasibility, costs and technical limits but is not numerically defined.

Recordkeeping and mapping implications

• Datum and coordinates. The instrument requires coordinate use in the Geocentric Datum of Australia 2020 (clause 6 note). Accurate mapping of nominal locations (clause 7 tables) and of submerged plant items will be required to demonstrate compliance.

Scope of legal duties

• The Declaration establishes statutory conditions for conduct in the zone. The provided text does not include explicit rights to compensation or administrative review within the Declaration itself. The duties operate alongside the Telecommunications Act 1997 and Schedule 3A, which the instrument references for interpretive definitions and the statutory foundation.

The Declaration sets operational rules but, in the text provided, it does not itself specify penalty amounts, enforcement agencies or enforcement procedures. The instrument repeatedly cross-references Schedule 3A to the Telecommunications Act 1997 and therefore must be read together with that statutory framework for enforcement detail. The Declaration’s own text supplies prohibition and restriction regimes that would, in practice, be enforced under the authorising Act.

What the Declaration contains, and what it does not

• Contains. The instrument identifies forbidden conduct (clause 8, table 5), identifies conduct that is permitted only subject to meeting specified conditions and procedural pre-conditions (clause 9, table 6), and sets out notice, information and response timelines tied to cable carriers. The set of measurable technical constraints (distances, weights, breaking strains, hook types and pressure thresholds) supplies the objective standards that enforcement bodies would likely use to determine contravention.

• Does not contain. The Declaration as provided contains no express penalties, pecuniary fines, or criminal offences that attach directly to breaches. It also does not name the enforcement agency or prescribe enforcement processes such as inspections, directions, infringement notices, or administrative sanctions. It does not specify whether contraventions are offences under the instrument itself or actions that attract administrative responses under the Telecommunications Act 1997 or other statutes.

Where enforcement will be found. Because the Declaration is drafted for application under clause 9 of Schedule 3A to the Telecommunications Act 1997 (see clause 6 first line) and porque many defined terms are taken from clause 2 of Schedule 3A (see clause 3), the enforceability, available remedies and statutory penalties are to be located in the Act and Schedule 3A rather than in the Declaration’s text. Users must therefore consult Schedule 3A and the main body of the Telecommunications Act 1997 for the enforcement architecture, including possible offences, civil remedies, and enforcement powers entrusted to particular agencies.

Practical enforcement mechanisms suggested by the instrument

• Administrative preconditions create monitoring points. The 21 day notice requirement creates an administrative checkpoint. If an entity fails to provide notice to cable carriers for an activity that requires notice, it will be operating outside the procedural conditions in table 6 and potentially expose itself to regulatory action under the Act.

• Inspectable technical thresholds. Measurable limits such as 500 metre buffers from low‑water mark and from submerged plant items, maximum line breaking strains, weights for shots and anchors, the requirement for trip release mechanisms, and the 2.0 bar seismic pressure threshold provide concrete metrics inspectors can use to determine compliance.

• Information exchange for dispute handling. The requirement to consider and respond to reasonable representations creates a documented trail of engagement between cable carriers and proponents. That trail will be relevant to regulators or courts asked to determine whether an activity met statutory conditions.

Uncertainty and implementation risk

• Absence of penalty text in the Declaration creates legal uncertainty for parties relying on the instrument alone. Parties must consult Schedule 3A and the Act to determine the consequences of non-compliance.

• Qualifiers such as “reasonable” and “greatest extent practicable” introduce enforcement discretion. Regulatory bodies will need to interpret these standards in context, and that interpretive exercise will shape enforcement outcomes.

• The Declaration gives cable carriers substantial procedural influence without being prescriptive about dispute resolution. Where developers and cable carriers disagree about the sufficiency of representations or information, the instrument does not prescribe an internal resolution mechanism.

Recommendation for practitioners

• Always pair reading of this Declaration with Schedule 3A to the Telecommunications Act 1997 and other relevant Commonwealth or State instruments to locate the enforcement regime. The Declaration sets the substantive operational constraints; the Act supplies enforcement mechanics.

The Declaration is expressly framed as a statutory instrument that must be read in the context of the Telecommunications Act 1997 and related instruments. The text cross-references provisions and definitions in clause 2 of Schedule 3A to the Act and invokes external definitions and instruments in multiple places.

Primary statutory cross-reference: Telecommunications Act 1997 and Schedule 3A. The instrument repeatedly references the Act. Several defined terms are taken from clause 2 of Schedule 3A to the Act (for example “Australia”, “Australian waters”, “conduct”, “installation”, “line”, “ship”, “submarine cable”, and “network unit”) (clause 3). The opening language of clause 6 refers to clause 9 of Schedule 3A as the statutory hook for declaring a protection zone. Clause 7 similarly states it is “for clause 8 of Schedule 3A to the Act” when setting nominal locations. Table 6 contains notes explicitly linking items to paragraphs of Schedule 3A (for example Note 1: Items 1 to 6 and 11 to 17 relate to paragraph 11(3)(g) of Schedule 3A; Note 2: Items 7 and 8 relate to paragraph 11(3)(d); Note 3: Item 9 relates to paragraph 11(3)(e); Note 4: Item 10 relates to paragraph 11(3)(f)). Those cross-references indicate the Declaration is a delegated instrument that operates as part of the statutory structure established by Schedule 3A.

State law interaction: Fisheries Management Act 1994 (NSW) and Department of Primary Industries and Regional Development. Clause 3 defines “Department of Primary Industries and Regional Development” by reference to section 4 of the Fisheries Management Act 1994 (NSW), as in force from time to time. Clause 8(2) then creates a narrow exemption for fish aggregating devices where the activity is done by or for that Department. This is a direct nexus between Commonwealth delegation and State agency functions in the fisheries and resource management space.

Acts Interpretation Act 1901 and Legislation Act 2003. Clause 3A provides that references to other legislative instruments are references to them as in force from time to time and directs users to section 10 of the Acts Interpretation Act 1901 for references to Commonwealth Acts. The clause also references subsection 13(1) of the Legislation Act 2003 for application of the Acts Interpretation Act. Clause 3A also recalls section 589 of the Telecommunications Act concerning instrument references. These drafting cross-references indicate that definitions, repeal, amendment and interpretation will follow general legislative rules. Practically, this means that definitions and referenced instruments may change over time and users must consult current versions.

Maritime and international law boundary. Clause 5 limits the Declaration’s geographic reach by stating it applies to the extent consistent with Australia’s jurisdiction under international law. This creates an interface between domestic regulation of cables and international maritime law principles, including jurisdictional limits over territorial sea, exclusive economic zone and continental shelf. The Declaration therefore operates within the domestic jurisdictional envelope and acknowledges limitations beyond Australian waters.

Interaction with environmental and other statutory regimes. The Declaration regulates activities that are also likely to be regulated under other Commonwealth or State laws, such as environmental approvals for seabed-disturbing activity, fisheries controls, navigational safety rules, and petroleum or mineral exploration legislation. For example, exploration for resources is regulated under item 12 and will likely intersect with other approvals that regulate environmental impacts and resource rights. The instrument’s procedural obligations do not displace other statutory requirements; they are additional layers that proponents must satisfy.

Administrative coordination and overlapping duties. The Declaration creates duties to notify cable carriers and to consider their representations. At the same time, proponents will routinely have to satisfy permit and approval requirements from other agencies. The 21 day notice windows and seven day response windows will therefore have to be coordinated with statutory approval timelines from other regulators to avoid temporal conflicts and delays.

Spatial data and surveying standards. Clause 6 requires coordinates in the Geocentric Datum of Australia 2020. This interacts with other mapping and surveying obligations under Commonwealth and State law. Entities submitting location particulars will need to present them in the specified datum to avoid coordinate misalignment.

Gap areas and further legal research required. Because the Declaration operates by reference to Schedule 3A, practitioners must consult the Telecommunications Act 1997 and Schedule 3A to identify the enforcement authority, penalties, and mechanisms for dispute resolution and review. The Declaration’s relation to environmental approvals, maritime safety law and petroleum/mineral tenures must be considered on a project-specific basis because those regimes are not set out in the Declaration.

The Declaration identifies itself by name in clause 1 as the Submarine Cable (Southern Sydney Protection Zone) Declaration 2007. The text provided contains no express schedules of amendment, no marginal notes indicating subsequent variations, and no consolidating amendment history embedded in the instrument text. The instrument also contains a clause (3A) that treats references to other legislative instruments and instruments “as in force from time to time”, which indicates that references will operate against a backdrop of possible subsequent amendments to those external instruments.

What the text explicitly shows

• Instrument name and base year. Clause 1 gives the instrument its name and the year 2007. That is the only explicit temporal marker present.

• No in‑text amendment record. The provided text does not list amending instruments, no dates of commencement other than the year in the title, and no rewritten clauses or tracked changes. The instrument’s content as provided appears to be the operative consolidated text, but without an appended schedule of amendments.

Implications for practice

• Confirm currentness on the Federal Register of Legislation. Clause 3A note 2 reminds users that Commonwealth Acts and legislative instruments are registered on the Federal Register of Legislation. Practitioners must check that online register for any amending instruments or versions that post‑date the 2007 title. The Declaration’s cross-references to provisions in the Telecommunications Act 1997 and Schedule 3A mean that changes to those instruments could alter the practical effect of this Declaration.

• Changes in external definitions matter. Because several definitions reference clause 2 of Schedule 3A to the Act and other statutes, amendments to those external provisions may affect the Declaration’s meaning even if the Declaration text itself is unchanged. Clause 3A(a) and (b) confirm references to other instruments are to be read as in force from time to time.

• Potential internal inconsistency. As noted in the Main concepts section, the definition for “nominal location” in clause 3 refers to the Australian Japan Cable or Southern Cross Cable specified in section 7. Section 7 lists the Australian Japan Cable and the Tabua Cable. This textual mismatch is present in the instrument as provided and may have been a drafting oversight or may reflect an amendment not captured in the provided text. Checks against the instrument’s registered version and any amending instruments are warranted.

Recommended steps before advising clients

• Retrieve the current consolidated version from the Federal Register of Legislation and compare versions chronologically to identify any amendments or corrigenda.

• Check Schedule 3A to the Telecommunications Act 1997 for any amendments that change the authorising powers, enforcement or definitions referenced by this Declaration.

• Where a project relies on nominal cable locations or on procedural timelines, confirm whether any map or spatial dataset maintained by the relevant Commonwealth agency updates cable positions or submerged plant item locations since 2007.

The Declaration as provided contains no litigation docket, citations, or references to judicial decisions. It does not name any case law, nor does it reproduce any judicial interpretation of its provisions. The instrument itself is silent about disputes and judicial review processes.

What the Declaration tells us directly

• No cases named. There are no case references or litigation summaries in the instrument text.

• Procedural rights not detailed. The instrument prescribes duties such as notice, information responses and consideration of representations, but it does not itself provide a dispute resolution or appeal mechanism. Those mechanisms are likely to be found in the authorising legislation , Schedule 3A to the Telecommunications Act 1997 , or other general administrative law remedies.

Practical consequences and steps for researchers

• Search primary and secondary sources. To establish whether the Declaration has been litigated or interpreted by courts or tribunals, researchers must search the Federal Register of Legislation for amending instruments, the AustLII or other legal databases for cases citing the Declaration or Schedule 3A, and administrative decisions or regulatory determinations that apply it. None of that material appears in the text provided.

• Anticipate points likely to attract litigation. The Declaration contains several discretionary and evaluative standards such as “reasonable written request for information”, “reasonable representations”, and “not likely to damage or impede the efficient operation, maintenance, or repair”. These standards often generate disputes in practice, and any litigation would likely turn on how regulators and courts construe “reasonable” and “not likely to” in the specific technical and operational context. The specification of buffer distances and engineering limits could produce litigation about measurement methodology and datum alignment.

• Consider judicial review avenues. If entities are regulated under the Declaration and wish to challenge an administrative decision that relies on it, judicial review proceedings in the Federal Court or administrative tribunals are the typical routes. The Declaration itself does not proscribe or prescribe particular remedies.

Advice for practitioners needing litigation history

• Do not rely solely on the text supplied. Obtain case law and tribunal decisions citing the Declaration or Schedule 3A to the Act. That requires searching legal databases, the Federal Court register, and administrative tribunal decisions.

• Record-keeping importance. Where parties follow the procedural duties (21 day notices, seven day responses, records of representations and responses), preserved documentation will be the primary evidentiary foundation in any subsequent dispute.

The Declaration contains several drafting features and operational conditions that can create practical traps for proponents, carriers and resource users. These are points where attention to detail is essential and where ordinary practice might lead to non-compliance or dispute.

1. Textual inconsistency on “nominal location”. Clause 3’s definition of “nominal location” refers to the Australian Japan Cable or Southern Cross Cable specified in section 7, but clause 7 supplies coordinates for the Australian Japan Cable and the Tabua Cable (clause 3 definition; clause 7 tables 3 and 4). This mismatch between "Southern Cross" and "Tabua", present in the instrument as provided, must be checked against the registered version. Practitioners should not assume which cable the definition intends without confirming the consolidated instrument.

2. Multiple definitions derived from Schedule 3A. Important terms such as “submarine cable”, “network unit”, “installation”, “line” and “ship” are imported from clause 2 of Schedule 3A to the Act (clause 3 notes). That means the precise scope of these words can change if Schedule 3A is amended. Always cross-reference the current wording of Schedule 3A when advising clients.

3. The 21 day / 7 day timing structure. For many activities (items 7, 8, 9, 10, 12, 13, 14 of table 6) a party must provide particulars and location not later than 21 days before the activity and must comply with any reasonable written request for information within 7 days. Practically, this imposes tight timelines for coordination with cable carriers. Planning calendars must internalise those windows. Failure to meet the 21 day window will mean the statutory preconditions are not met.

4. “Reasonable” and “not likely to” standards. The instrument repeatedly uses evaluative standards: “reasonable written request”, “reasonable representations”, and “not likely to damage or impede the efficient operation, maintenance, or repair” (table 6). These are not defined numerically. This introduces room for disagreement about what level of detail satisfies a cable carrier’s request or what amounts to likely damage. Entities should plan for robust technical documentation to pre‑empt disputes.

5. Determination of protection distances depends on consultation. Item 7(e) requires that whether a new cable or pipeline approaches or crosses a submarine cable less than 500 metres from submerged plant items must be determined following consultation with each cable carrier. This places the onus on proponents to consult and on carriers to provide sufficient location details. If carriers decline to provide precise submerged plant item locations, the determination may be stalled. Parties should plan to fund or obtain carrier-provided location data early.

6. Seismic-pressure threshold application is technical. Item 12(d) requires alteration of grid lines if a planned seismic survey would result in pressure waves of 2.0 bar or more arriving at the seabed in the location of electro‑optic devices. Calculating expected seabed pressure from pressure-wave modelling is technical and potentially contentious. Entities must model pressure arrival values with appropriate methods and document adjustments.

7. Gear specification and breaking strain limits are precise and require testing or certification. Several items set breaking-strain caps (850 kilograms and 50 kilograms) and ban the use of wire in specific components (table 6 items 2, 3, 16, 17). Fishers and operators must be able to demonstrate compliance with equipment specs. Reliance on manufacturers’ specs may be necessary.

8. Spatial limits interact with low‑water mark, depth and datum issues. The 500 metre limit from low‑water mark and depth limits (100 metres) are defined against tidal datum and bathymetric measurements. Clause 6 uses mean low water mark for boundary definition and specifies Geocentric Datum of Australia 2020 for coordinates. Practitioners should ensure all mapping is referenced to that datum and that low‑water mark determinations are consistent with statutory mapping practice.

9. Narrow Departmental exemption for fish aggregating devices. Clause 8(2) allows installation, management or removal of fish aggregating devices within 100 metres of two specified points where conducted by or on behalf of the Department of Primary Industries and Regional Development. This is a narrow carve-out and does not permit third parties to rely on it. Misunderstanding the beneficiary of that exemption risks unlawful activity.

10. No penalties in this text; enforcement in the Act. The instrument does not set out penalties or enforcement mechanisms. Relying on the Declaration alone without consulting Schedule 3A and the Telecommunications Act 1997 risks missing the enforcement process and consequence framework.

11. Administrative overlaps. Proponents must meet these Declaration conditions in addition to any approvals under environmental, fisheries or resource legislation. Expect co‑ordination complexity and potential timing mismatches between statutory authorisations and the 21 day notice requirement.

12. Localised permitted exceptions to otherwise prohibited activities. Clause 8(3) and the structure of table 6 allow some activities that would otherwise be prohibited under table 5 to proceed as restricted activities when their specific item in table 6 applies. Misreading the cross-reference could result in overbroad prohibitions being applied.

Mitigation recommendations. To avoid these “gotchas” implement early mapping, secure carrier engagement at project inception, prepare technical evidence for gear and pressure modelling, maintain records demonstrating compliance with datum and low‑water mark standards, and confirm the current consolidated statutory text and any amending instruments before planning works.

Compliance with this Declaration requires a combination of spatial verification, procedural observance, technical mitigation, stakeholder engagement and documentation. The following is a practical compliance checklist derived from the Declaration’s text and a recommended timeline for entities proposing activities in the Southern Sydney Protection Zone.

Step 1: Confirm geographic scope and datum

• Verify whether the proposed activity lies inside the Southern Sydney Protection Zone by mapping the area set out in clause 6(1)(a) to (c) using the coordinates provided. All coordinates are given in the Geocentric Datum of Australia 2020; use that datum for geospatial analysis (clause 6 note).

• Identify the nominal cable locations in clause 7 tables (Australian Japan Cable table 3 and Tabua Cable table 4) and map any other known submarine cable assets that may be in the area. Do not assume the cable list is exhaustive without cross-checking with cable carriers or maritime datasets.

Step 2: Classify the activity under the Declaration

• Determine whether the proposed activity is listed as prohibited under clause 8 table 5. If it is, confirm whether any narrow exceptions apply (for example clause 8(2) fish aggregating device exceptions and clause 8(3) interactions with restricted activities).

• If the activity is not prohibited, identify which item in table 6 applies and read the precise restrictions and exceptions attached to that item. Key checks include whether the activity must be confined to waters within 500 metres of the low‑water mark, whether it is time‑sensitive, and whether technical limits apply (breaking strains, anchor weights, shot weights, hook types, pressure thresholds, water depth).

Step 3: Prepare the 21 day notice and accompanying particulars where required

• For activities covered by items that require pre-notice (table 6 items 7, 8, 9, 10, 12, 13, 14), assemble particulars and location information at least 21 days before the planned activity. Item 12 also requires expected commencement date and duration.

• Content to include in particulars. The Declaration specifies particulars and location but does not prescribe a format. Practical content should include:

  • precise coordinates (Geocentric Datum of Australia 2020) of the activity footprint and transit corridors,
  • methods and equipment to be used,
  • depth profiles and distances from nominal cable locations and any known submerged plant items,
  • risk assessment of likely damage or impediment to submarine cables and mitigation measures,
  • schedule including expected commencement date and duration (for item 12),
  • contact details for on-scene coordinators,
  • diagrammatic maps overlaying nominal cable locations and proposed works.

Step 4: Engage cable carriers promptly and document communications

• Provide the 21 day notice to every cable carrier as defined by clause 3. Identify the correct carrier using the cable carrier definition that depends on whether the cable is a network unit, installed after commencement of Schedule 3A, or connected to an adjacent network unit (clause 3, “cable carrier”).

• Expect and track written requests for additional information. You must comply with any “reasonable written request for information” within seven days (table 6 items). Record the date and content of every request and response to demonstrate compliance with the seven day obligation.

• Consider and respond to representations. If a cable carrier makes “reasonable representations” about likely damage or impediment, document how the representations were considered and detail the response. This record will be essential if the sufficiency of engagement is later questioned.

Step 5: Implement technical mitigation measures

• Respect distance and equipment thresholds. Ensure gear, anchors, trap ropes and shotlines conform to the specified breaking strain and weight limits, and that anchor trip release mechanisms are used where required (table 6 items 2, 3, 16, 17).

• For pipeline or cable installation, minimise route across the Protection Zone to the greatest extent practicable (item 7(d)) and ensure a minimum separation of 500 metres from submerged plant items following consultation with cable carriers (item 7(e)).

• For seismic surveys, model pressure wave propagation to determine whether pressure waves of 2.0 bar or more would arrive at the seabed at electro‑optic device locations. If so, adjust grid lines to reduce that pressure to less than 2.0 bar (item 12(d)). Keep modelling methodology, software parameters and results in project records.

• For fishing operations, adhere to hook-type and line specifications, and hand-harvest only where required. Ensure pot or trap dimensions and trap rope breaking strain conform to item 2.

Step 6: Address spatial and tidal measurement requirements

• Use mean low water mark as the reference for the 500 metre spatial limit (clause 6 and table 6). Ensure bathymetric or tidal surveys underpin determinations of whether waters are more than 500 metres from low water mark and whether water depth is less than 100 metres where that threshold applies.

• Reference all coordinates to Geocentric Datum of Australia 2020 as required (clause 6 note).

Step 7: Maintain contemporaneous records and evidence

• Keep copies of all pre-notice submissions, cable carrier communications, technical reports, modelling outputs, equipment certificates (breaking-strain tests, anchor trip device specifications), maps in the prescribed datum, and internal approvals. These records evidence compliance with the Declarational duties and the seven day response obligations.

Step 8: Coordinate statutory approvals

• Do not assume satisfying the Declaration’s requirements discharges other statutory obligations. Seek and synchronise any environmental, fisheries, navigational, petroleum or resource development approvals required by other Commonwealth or State agencies. Time the 21 day notices so they do not conflict with other approval timelines.

Step 9: If in doubt, consult relevant agencies and carriers early

• Engage cable carriers as early as possible to obtain submerged plant item locations or advice on technically preferable routes and to reduce the likelihood of representations that require major design changes. Early engagement is particularly important where the 500 metre buffer from submerged plant items could force route redesign.

• Where the activity could be captured by multiple items (for example exploration and pipeline installation), seek clarification about which items apply and whether multiple notice obligations arise.

Step 10: Legal and operational audit before commencing works

• Before commencing operations, run a compliance audit to ensure all procedural obligations were satisfied within the timing windows and that technical mitigation measures meet the thresholds in table 6. Retain audit outputs and sign-offs to show due diligence.

Special cases and practical tips

• Fish aggregating device exception. If the proposal is for a fish aggregating device within 100 metres of the two coordinates in table 5A, confirm contracting or conducting is on behalf of the Department of Primary Industries and Regional Development; otherwise the exception does not apply (clause 8(2)).

• Anchor exceptions and Table 7 area. Item 17 provides an alternative anchor weight exception for a bounded area whose coordinates are in table 7. If you plan to anchor heavier than the 20 kilogram limit specified in item 17(a)(i), ensure your operation is within the table 7 polygon and document the precise anchorage location.

• Documentation quality matters. Because the Declaration uses qualitative standards such as “reasonable” and “greatest extent practicable”, robust and detailed technical, navigational and safety evidence will strengthen a party’s position if challenged.

Where to look for enforcement and penalty details

• Consult the Telecommunications Act 1997 and Schedule 3A for enforcement mechanisms, offences and penalties that may apply to contraventions of this Declaration. The Declaration operates as part of that statutory architecture and enforcement is implemented under the Act.

Summary checklist

• Map zone and nominal cable alignments using Geocentric Datum of Australia 2020.
• Classify activity as prohibited, restricted or permissible under clause 8/9.
• If restricted and notice is required, send particulars and location at least 21 days before the activity.
• Be prepared to comply with reasonable written information requests within seven days.
• Consider and respond to cable carrier representations and document the response.
• Observe all technical and spatial constraints in table 6.
• Coordinate other statutory approvals and maintain comprehensive records.

Following these steps aligns operations with the instrument’s procedural and technical requirements and reduces the likelihood of regulatory or operational conflict with cable carriers and the authorities.
