What it does
The State Policies and Projects (Fees) Regulations 2023 (Tasmania) impose a cost-recovery fee structure on persons who propose projects of State significance under the State Policies and Projects Act 1993. The regulations replace any earlier fee arrangements for integrated assessments by creating a detailed, multi-component charge for each of six defined project stages, plus a separate upfront fee for the initial eligibility assessment. The initial fee is fixed at 17,000 fee units (regulation 4(1)) and covers the administrative costs of determining whether a project meets the criteria under section 16 of the Act to be declared a project of State significance. This fee is waived if the Minister considers the project on the Minister’s own initiative, rather than on application by a proponent (regulation 4(2)). The payment is due within 30 days after the order under section 18(2) of the Act is notified in the Gazette.
The primary financial burden falls on the proponent for each project stage that occurs. There are six stages, each assigned a portion factor between 0.2 and 0.5 (regulation 6(2)). These factors are multiplied by 60,000 fee units to produce a base amount for each stage. To that base amount are added four variable components: a chairperson component calculated at 790 fee units per cumulative working day, a delegate component at 510 fee units per day, a staff component with four pay-band levels (ranging from 290 to 510 fee units per day), and a consultant component with five levels (ranging from 560 to 2,810 fee units per day). The total fee for a stage is thus the sum of the base amount plus the hourly-driven components, all expressed in fee units rather than fixed dollar figures. Since fee units are indexed by other Tasmanian legislation (typically the Fees and Fines Act or similar), the actual dollar amount increases automatically over time, without further amendment to these regulations. The cumulative working period for each class of person is calculated by aggregating all hours worked on that stage and dividing by 7.35 for staff (reflecting a standard 7.35-hour working day under the Tasmanian State Service Award) and by 8 hours for all other persons (chairpersons, delegates, consultants). The result is rounded up to two decimal places (regulation 3(2)(c)).
