#### 33 Operation of Act 33 Operation of Act > > (1) Nothing in this Act limits any powers or rights that the Crown or a Minister has apart from this Act. > > > (2) A requirement of this Act that provisions be included in the constitution of a company does not have effect to the extent that the requirement or the provisions are inconsistent with a law of the Commonwealth. > > > (3) A requirement of this Act that provisions be inserted in the constitution of a company does not have effect to the extent that the requirement or the provisions are inconsistent with a law of a place (other than New South Wales), where the company is a subsidiary of a State owned corporation and the company is or is to be incorporated under the law of that place. > > **s 33:** Am 1989 No 195, Sch 1; 2001 No 34, Sch 4.58 \[17\].
