This Policy establishes two interrelated conceptual frameworks: a precinct-based planning framework for the Western Sydney Employment Area (Chapter/Part 2) and a Statewide framework for signage and advertising (Chapter/Part 3). The Policy relies on maps, zoning, consent authority allocation, development control plans and defined assessment criteria.

• Maps and spatial application. The Policy is map-dependent. Land Application Maps, Land Zoning Maps, Heritage Maps, Transport and Arterial Road Infrastructure Plan Maps and Land Reservation Acquisition Maps are adopted by the Minister and may be amended (s 2.5; ss 2.2, 2.9, 2.42, sch 4 definitions). The land subject to the Western Sydney Chapter is the land identified on the Land Application Map, but the Chapter excludes land marked "X" within the Broader Western Sydney Employment Area (s 2.2).
• Zoning and land use tables. The Western Sydney Chapter sets out specific zones (IN1, IN2, E2, SP2, RE1, RE2) and attaches objectives and a Land Use Table which differentiates development that is permitted with consent, permitted without consent (often Nil) and prohibited (ss 2.8-2.10; Land Use Table entries). The Chapter requires the consent authority to have regard to the zone objectives when determining DA applications (s 2.10(2)).
• Development control plans. A central design of the Policy is that a DCP must be prepared for land before consent is granted in most cases (s 2.17(1)). Schedule 2 prescribes mandatory content for DCPs including traffic, infrastructure, staging, biodiversity, flooding, urban design, subdivision layout and heritage conservation (Schedule 2, cl 1-8). A DCP may be prepared by 60% of owners (s 2.17(3)), the Minister may act in place of relevant planning authority (s 2.17(4)), and the Policy preserves certain existing precinct plans as alternatives where they were in force (s 2.18).
• Consent authority allocation and concurrence. For the Western Sydney Chapter the local council is the consent authority unless the Act provides otherwise and Ministerial approvals are required for State significant development (s 2.4). For signage, the consent authority is generally the local council, but TfNSW, or the Minister for Planning in certain transport corridor contexts, are named consent authorities for advertisements on transport corridor land, rail corridors or specified tollways/freeways (ss 3.10, 3.14). Several provisions require referral or concurrence from TfNSW for development above cost thresholds or for advertisements visible from classified roads (ss 2.34, 2.35, 3.15-3.16).
• Prescriptive standards and "must not" tests. The Policy uses mandatory "must" and "must not" formulations. Examples include "must not grant consent unless satisfied that" provisions for ESD (s 2.19), building heights (s 2.20), rainwater harvesting (s 2.21), and public utility infrastructure availability (s 2.24). For signage, consent authorities cannot grant consent unless the signage is consistent with the Chapter objectives and Schedule 5 assessment criteria, and TfNSW concurrence is required for specified cases (ss 3.6, 3.11, 3.16).
• Prohibitions and thresholds. The Policy imposes explicit prohibitions: advertising is prohibited in environmentally sensitive areas, heritage areas (with narrow exceptions), waterways, residential zones and national parks, among others (s 3.8). It sets numeric thresholds for advertisement size and height (20 sqm, 45 sqm; 8 m above ground) and links thresholds to procedural consequences such as the requirement for an impact statement and TfNSW concurrence (ss 3.15-3.17). Zone-specific land use prohibitions and retail floor area caps for industrial retail outlets and neighbourhood shops are set out (s 2.29).
• Conservation and environmental tests. The Western Sydney Chapter foregrounds biodiversity and heritage: DCPs must address biodiversity and provide rehabilitation management where appropriate (Schedule 2, cl 4). Clearing native vegetation in E2 or RE1 zones requires development consent and a set of specified satisfactions (s 2.43). Heritage item and Aboriginal place protections impose notification and assessment obligations, and permit consents only where the consent authority has considered heritage impacts (s 2.42).

The signage Chapter treats certain advertisement consents as time-limited (ss 3.12, 3.19) and requires that, where the Minister is the consent authority for transport corridor advertising, assessment include public benefits in accordance with Guidelines and that arrangements consistent with the Guidelines exist for those benefits (ss 3.11(2)(b)(iii), 3.11(3)).

Conceptually the Policy is a mixed regulatory instrument: it combines land use zoning and development standards for an identified employment precinct with a State-level overlay that standardises signage controls, thresholds and processes. Its mechanisms rely on ministerially approved maps, mandatory DCPs, technical assessment criteria set out in Schedules (Schedule 2 DCP content, Schedule 5 signage assessment criteria), and a combination of local council, TfNSW and Ministerial decision-making depending on location and type of proposal.

The Policy allocates obligations and decision-making across multiple actors; the operational effects are concentrated on landowners and developers within the Western Sydney Employment Area, local councils and State transport and planning agencies. Principal affected parties under the text are:

• Relevant local councils. Councils are the primary consent authority for development in the Western Sydney Employment Area (s 2.4) and are the default consent authority for advertisements within a local government area (s 3.10(a)). Councils must not grant consent for most development without a DCP being in force unless the Secretary determines otherwise (s 2.17(1)). Councils are therefore responsible for preparing, adopting and enforcing DCPs consistent with Schedule 2 content (s 2.17; Schedule 2).
• Developers and landowners in the Western Sydney Employment Area. Landowners seeking subdivision, industrial, warehouse, service or other development must satisfy the consent authority against the range of Chapter tests: ESD measures, building heights, infrastructure availability, landscape and off-street parking requirements, and DCP consistency (ss 2.19-2.24, 2.17). Subdivisions generally require consent except for narrowly defined minor works (s 2.12). A DCP may be prepared by 60% of owners for their precinct (s 2.17(3)), which is a procedural route for developers to initiate planning controls.
• Transport for NSW (TfNSW) and other State transport bodies. TfNSW is the designated consent authority for advertisements on vessels and for some transport corridor advertising contexts (s 3.10(b), (e)). TfNSW must be consulted or give concurrence for developments in Transport Investigation Areas, Mamre Road precinct developments over a cost threshold, and for large advertisements visible from classified roads; delays in TfNSW response are statutorily treated as deemed concurrence after 21 days in at least one sign-related provision (ss 2.34(2)-(3); 2.35; 3.15-3.16). For large or high ads, applicants must provide impact statements addressing Schedule 5 criteria (s 3.15).
• Local communities and residents. The Policy imposes specific protections where employment-area development is within 250 metres of residential land: design compatibility, storage and screening, noise minimisation, hours of operation, off-street parking and landscaping must be addressed and be satisfactory to the consent authority (s 2.22). For signage, the Policy prohibits advertisements in residential zones and other sensitive zones, subject to exceptions, limiting commercial visual intrusion in those areas (s 3.8).
• Environmental and heritage stakeholders. The Policy requires that heritage impacts be assessed and notified to the Heritage Council for archaeological sites, and requires consultation with local Aboriginal communities for development in Aboriginal places of heritage significance (s 2.42(7)-(8)). Clearing of native vegetation in certain conservation zones is controlled and requires the consent authority to be satisfied of avoidance, minimisation and compensation measures (s 2.43).
• State acquisition authorities and land acquisition claimants. Section 2.27 designates the State authority that will be the "relevant acquisition authority" under owner-initiated acquisition provisions of the Land Acquisition (Just Terms Compensation) Act 1991 for various land types on the Land Reservation Acquisition Map. Transport for NSW and Penrith City Council are named authorities for particular classifications (s 2.27(2)).
• Public authorities and infrastructure providers. The Policy contains carve-outs preserving the ability for public authorities to carry out exempt infrastructure development under other SEPPs (s 2.32). It also protects the use of existing Crown buildings by the Crown (s 2.32(2)). Public agencies that own or manage transport and rail corridors are specifically engaged in consent decisions for advertising on their land (ss 3.10, 3.14).

Concentrated beneficiaries and decision-makers include owners of industrial land who can benefit from an employment-focussed zoning regime and large advertisers who can access transport corridors subject to Guidelines and Ministerial oversight. The Policy also places procedural burdens and discretion with councils and TfNSW, and requires developer compliance with DCPs, environmental and heritage tests, and sign assessment criteria.

Who pays and who decides. Developers and landowners bear compliance costs: preparing impact statements, heritage or biodiversity assessments, DCP compliance and potentially contributing to public benefits for transport corridor advertising. Consent authorities , typically local councils, TfNSW in certain transport contexts and the Minister for Planning in specified cases , decide. The Minister retains powers over maps, the ability to act as planning authority in DCP matters, and to approve the Guidelines referenced in the signage Chapter (s 2.5; s 3.2, s 2.17(4)).

The Policy imposes a set of duties on consent authorities, applicants and landowners, and preserves a small set of rights or permitted pathways for applicants. These duties and rights are specified in operational language and are concentrated in a few recurring forms: mandatory preconditions for consent, notification and consultation obligations, mapping and DCP requirements, and numeric and technical standards for development and signage.

Consent authority duties

• Require and scrutinise DCPs. Consent authorities must not grant consent to development unless a DCP has been prepared for that land, except where the Secretary determines otherwise or where designated existing precinct plans apply (s 2.17(1)-(2); s 2.18). DCPs must include the Schedule 2 matters (Schedule 2 cl 1-8).
• Satisfy substantive tests before consent. The consent authority "must not grant consent" to development unless it is satisfied about a range of matters: ecologically sustainable development measures (s 2.19), non-adverse building heights (s 2.20), rainwater harvesting connections where required (s 2.21), residential-edge compatibility and screening (s 2.22), public utility infrastructure availability (s 2.24), and more specific tests for flood prone land, earthworks, and clearing native vegetation (ss 2.40-2.43, 2.41). For signage, consent authorities must ensure that signage satisfies the objectives in s 3.1(1)(a) and the assessment criteria in Schedule 5 before granting development consent for signs (ss 3.6, 3.11). When the Minister rather than council is the consent authority, the Guidelines supplement the Schedule 5 criteria and public benefits become a required factor in the assessment (s 3.11(2)).
• Consult or refer to State bodies. Where the Policy requires it, consent authorities must refer applications to the Secretary or to TfNSW, and must take those bodies' comments into account before determining the application (ss 2.25-2.35; ss 3.15-3.16). For example, development in Transport Investigation Areas must be referred to the Secretary; large advertisements near classified roads require TfNSW concurrence (ss 2.25(2), 3.16(2)).
• Keep assessment records. The consent authority must keep a record of assessments made under the exceptions to development standards section (s 2.26(4)).

Applicant and landowner duties and constraints

• Obtain development consent where required. Much development is listed as "permitted with consent" or "prohibited" in the Land Use Table; permitted without consent entries are Nil in many zones, so applicants must obtain consent in most cases (Land Use Table entries; ss 2.8-2.10; see also ss 2.12 on subdivisions).
• Provide impact statements and technical documentation. Advertisements with a display area greater than 20 square metres or higher than 8 metres require an impact statement addressing Schedule 5 criteria (s 3.15(2)(a)). Applications for development in Transport Investigation Areas or the Mamre Road Precinct that have estimated development costs above $200,000 require TfNSW concurrence and therefore documentation addressing transport compatibility (ss 2.34(1)-(3); 2.35(1)-(2)).

Advertising approvals are time-limited (generally up to 15 years, s 3.12) and roof/sky advertisements have a shorter maximum duration (10 years, s 3.19(2)). Special promotional advertisements and building wrap advertisements are time-limited and capped for corporate branding/product image area (ss 3.23-3.24).

Rights and specific permissive pathways

• Additional permitted uses for identified land. Schedule 1 grants extra permitted uses for particular lots , for example, a waste facility for general solid waste at former Wallgrove quarry (Schedule 1 cl 1) and pipelines in specified Erskine Park/Horsley Park locations (Schedule 1 cl 3).
• Exempt development carve-outs. The Policy recognises exempt development regimes under other instruments; for example, the Policy does not override exempt development under SEPP (Infrastructure) for public authorities and excludes some transport-corridor signage from consent requirements when displayed by public rail authorities under specific conditions (s 2.32; s 3.30).

The Policy itself frames obligations in prohibitory and mandatory terms, but it does not set out a dedicated schedule of monetary penalties or specify enforcement processes in the manner of an offence schedule within this text. Enforcement follows from the Act's development consent regime and the consent authority powers conferred by the Act, as the Policy repeatedly uses the Act as its legal vehicle and cross-references Act provisions (see s 1.3 note; many sections operate "for the purposes of this Chapter" subject to the Act).

Key enforcement mechanisms apparent within the Policy text

• Consent requirement and refusal. The primary enforcement mechanism is the consent regime. Where the Policy provides that a person "must not" undertake conduct except with development consent (for example s 2.14 demolition requires consent; s 2.12 subdivision except specified exemptions; s 3.9 requirement for consent for advertisements), non-compliance renders the development unauthorised and exposes an operator to Council enforcement under the Act for carrying out development without consent. Conversely, failure to obtain required concurrence or to submit required impact statements can be a ground to refuse consent; if an advertisement is displayed without satisfying required procedures, enforcement action under the Act would follow.

What the Policy does not itself prescribe

• It does not include an internal fines or penalty schedule. The Policy contains prohibitions and "must not" prescriptions but leaves the Act to prescribe offences, penalties and enforcement processes. Readers should therefore look to the Environmental Planning and Assessment Act 1979 and associated regulations for precise enforcement powers, penalty amounts and appeal rights that apply where development proceeds without consent or contrary to a consent.
• It does not create an express private right of action or compensation regime beyond the acquisition-related provisions that reference the Land Acquisition (Just Terms Compensation) Act 1991 (s 2.27 and related notes). Where a developer or landowner believes a consent authority has wrongly exercised powers under the Policy, the Act's merits review and judicial review pathways will be the available legal remedies; the Policy itself contains no separate litigation or penalty clauses.

Practical enforcement implications for practitioners

• Compliance is effectively policed by consent and refusal decisions, and by the intersection of the Policy's mandatory tests with the Act's enforcement tools. For practitioners advising clients, the immediate enforcement risk arises when development proceeds without required consents, or when signage is displayed in prohibited areas or contrary to conditions. The Policy's specific "must be satisfied" provisions supply clear refusal grounds that councils or State agencies can rely upon.
• Administrative and contractual risk. The Policy's suspension of certain covenants for the purpose of enabling development (subject to exceptions, s 2.7) can change contractual entitlements on a site; parties should check whether a right that they rely upon is excluded from the suspension list. Where the Policy disapplies or prevails over local instruments (s 2.6; s 3.5), affected parties should expect potential reworking of contractual risk allocation tied to planning approvals.
• Enforcement by transport agencies for advertising. For advertisements in transport corridors the consent authority may be the Minister or TfNSW, and the Policy requires consistency with Guidelines and possibly design review panel advice (s 3.14(2)-(3)). This creates an additional compliance track beyond local council enforcement for large or corridor-based advertising. Failure to secure required concurrence or to meet Guidelines may amount to a refusal ground or enforcement action if display proceeds.

The instrument itself does not quantify penalties but establishes legally enforceable constraints via prohibitions, time-limited consents and mandatory preconditions for consent.

The Policy is densely cross-referenced to other environmental planning instruments, State statutes and the Act, with explicit provision for precedence, suspension and carve-outs. The interactions in the text are operational, mapping what the Policy overrides, where it defers to other regimes and where it requires congruence with other statutory obligations.

Priority and inconsistency rules

• SEPP prevails over local plans to the extent of inconsistency. Section 2.6(2) states that "this Chapter prevails over LEPs" where there is any inconsistency between this Chapter and a local environmental plan or deemed environmental planning instrument that applies to the land. That creates a direct primacy of State planning policy over local instruments within the Western Sydney Employment Area.
• Signage Chapter prevails to the extent of inconsistency. Section 3.5 provides that, in the event of inconsistency between the signage Chapter and another environmental planning instrument, this Chapter prevails to the extent of the inconsistency, though it does not override an explicit prohibition in another instrument on displaying signage (s 3.5 note).
