Sports Anti-doping Act 2005

The Act defines several core concepts that determine its scope. A Victorian athlete is any person who competes, has been selected to compete, or trains (or receives State support for training or competing) in a Victorian sporting competition, either as an individual or a team member (s 3(1)). Importantly, this excludes a Commonwealth competitor as defined in the Commonwealth Act, so there is no double coverage. A Victorian sporting competition is defined broadly: it covers competitions held wholly or partly in Victoria, as well as those held wholly outside Victoria if at least one competitor participates as a member of, or in association with, a Victorian sporting organisation (s 3(1)). Victorian sporting organisation means a sporting organisation recognised by the Victorian Minister as the sporting organisation for a sport in Victoria, and of which the athlete is a member or with which the athlete is associated in his or her capacity as an athlete (s 3(1)). State support is a crucial gateway concept: a person is receiving State support if for the purpose of taking part in (or coaching, training or treating others in) sporting activities, they receive funding from the State, use facilities provided or funded by the State, or are a member of or associated with a sporting organisation that receives funding, uses funded facilities, or receives advice from the State (s 5). This definition is extremely wide: an athlete training at a council-owned oval used by a club that receives a small grant may be captured. The policy itself must be consistent with the World Anti-Doping Code but may include any provisions the Minister considers necessary to support the Code’s purpose and intent (s 6(3)). The concept of a Code compliant anti-doping policy appears only in the context of withdrawal of support guidelines (s 6(3)(c)). ASDA’s functions include making known information about testing procedures, the possibility of being asked to supply a sample, and the consequences of a positive test or non-compliance (s 9(2)). These consequences are not specified in the Act; they would be set by the policy, the sporting organisation’s rules, or the Code. The Act also defines Commonwealth Administrative Review Tribunal (as amended in 2025) to ensure Victorian athletes have access to merits review of ASDA decisions via the same tribunal as Commonwealth competitors (s 12). The definitions section incorporates terms from the Commonwealth Act by reference unless the contrary intention appears (s 3(2)), meaning the Victorian Act piggybacks on the Commonwealth’s definitions of sporting competition, sporting organisation, and other terms.

The Act directly affects three main groups. First, Victorian athletes as defined in s 3(1): anyone competing in, selected for, or training for a Victorian sporting competition, plus anyone receiving State support for those purposes. This includes elite athletes, state representatives, grassroots participants who use funded facilities, and even support personnel such as coaches and trainers who receive State support (s 5). Because ‘State support’ is defined so broadly, many community-level athletes and club members can fall within scope even if they never undergo a test. The Act does not require their consent to be covered; they are covered by virtue of participation in a Victorian competition or receipt of State support. Second, Victorian sporting organisations are affected because ASDA may only act in relation to their athletes if an agreement is in place (s 11(1)). This places a compliance burden on organisations to negotiate and maintain an agreement with ASDA. Failure to have an agreement does not exempt athletes from anti-doping obligations under the Code or the organisation’s own rules, but it means ASDA cannot exercise state-granted testing powers under this Act. The organisation must also cooperate with the Minister during consultation on the policy (s 7). Third, ASDA itself is affected: the Act confers functions and powers on it (ss 9, 10), but also conditions those powers on the existence of agreements and potentially limits their exercise by the terms of those agreements. ASDA can charge fees for its services (s 10(2)), which may be passed on to organisations or athletes. The Victorian Minister is directly affected: obliged to prepare, maintain, and publish the policy (ss 6, 8), consult with selected organisations (s 7), and potentially issue guidelines for withdrawal of State support. The Commonwealth Administrative Review Tribunal gains jurisdiction over Victorian athletes (s 12), which may increase its caseload. Indirectly, the Act affects anyone who provides State funding or facilities, including local councils, state agencies, and schools, because their funding decisions may sweep athletes into the definition of State support. The Act also affects support personnel (coaches, trainers, treaters) who receive State support (s 5(b)), potentially exposing them to testing and information obligations, though the Act does not specify consequences for them. The regulation-making power (s 14) could extend the practical impact further, for example by prescribing detailed testing procedures or facility requirements.

The Act imposes clear duties. The Victorian Minister must prepare and maintain a Victorian sports anti-doping policy (s 6(1)). The policy must be consistent with the World Anti-Doping Code (s 6(3)(a)). The Minister must consult with Victorian sporting organisations considered appropriate before preparing or amending the policy (s 7). The Minister must publish the policy and any amendments on an appropriate government internet website (s 8(1)), and must publish any withdrawal-of-support guidelines in the Government Gazette as well as online (s 8(2)). ASDA has the function of making known information about testing procedures, the possibility of sample supply, and consequences of positive tests or non-compliance (s 9(2)). ASDA may charge reasonable fees for services (s 10(2)). Critically, ASDA may perform its functions or exercise its powers under this Act in relation to a Victorian athlete only if there is an agreement in place between ASDA and the athlete’s Victorian sporting organisation about the performance of those functions and powers (s 11(1)). This is a statutory condition precedent: no agreement, no ASDA action under this Act (though ASDA may still act under Commonwealth law for Commonwealth competitors). The agreement may provide that ASDA must perform functions and exercise powers in the way and subject to conditions stated in the agreement (s 11(2)). This gives sporting organisations some negotiating power over the terms of testing. The Commonwealth Administrative Review Tribunal has the jurisdiction, functions and powers under this Act in relation to a Victorian athlete as it has under the Commonwealth Act for a Commonwealth competitor (s 12). This confers a right of merits review on Victorian athletes for ASDA decisions made under this Act, but the scope of that right depends on the Commonwealth Act and the Tribunal’s enabling legislation. The Act does not specify a right to be heard or to legal representation; those stem from general administrative law and the Tribunal’s procedures. Victorian athletes do not have a statutory right to refuse a sample; the consequences for non-compliance are referenced in s 9(2)(b) but are set out in the policy, the Code, or by the sporting organisation. Athletes have no right under this Act to challenge the policy itself; the policy is an executive instrument with no statutory provision for individual challenge. The Act creates no private right of action for athletes against ASDA or sporting organisations. The regulation-making power (s 14) may create additional duties or permissions, but none are yet prescribed.

The Sports Anti-doping Act 2005 itself creates no criminal penalties, infringement notices, or civil pecuniary penalties. Enforcement under this Act is indirect and institutional. The primary enforcement lever is the withdrawal of State support. Section 6(3)(c) allows the Victorian sports anti-doping policy to authorise the Minister to issue guidelines for the withdrawal of State support from any person sanctioned under a code-compliant anti-doping policy. This means an athlete, coach, or official who is found to have breached a sporting organisation’s anti-doping rules (which conform to the World Anti-Doping Code) may lose government funding, access to state-funded facilities, or eligibility for support. Because ‘State support’ is defined broadly in s 5 to include funding, facility use, and membership in funded organisations, withdrawal could be devastating: a state-funded scholarship, training centre access, or even club-level funding could be cut. However, the guidelines themselves are not in the Act; their content is left to ministerial discretion, with only publication requirements (s 8(2)). This creates significant uncertainty for athletes about what conduct might trigger loss of support. The Act does not provide an appeal mechanism against withdrawal of support decisions; the only merits review avenue is for ASDA decisions (s 12), not for ministerial guideline applications. Testing-related consequences are not specified in the Act: ASDA’s function includes making known the consequences that follow a positive test or non-compliance (s 9(2)(b)), but those consequences flow from the Code, the sporting organisation’s rules, and potentially the policy. The Act does not itself impose sanctions like disqualification, ineligibility, or fines. Enforcement of testing duties relies on the agreement between ASDA and the sporting organisation (s 11), which may include provisions for disciplinary action. The practical enforcement burden falls on sporting organisations: they must adopt code-compliant policies, cooperate with ASDA, and enforce sanctions. The Act gives no enforcement powers to police or state agencies. ASDA’s power to charge fees (s 10(2)) could act as a deterrent: organisations may pass costs to athletes. The regulation-making power (s 14) could theoretically prescribe offences for hindering testing or sample collection, but no such regulations are noted in the provided text (and the Explanatory details endnote is empty). The Commonwealth Act may contain its own penalties for interfering with ASDA officers, which would apply by virtue of the Commonwealth functions. Overall, the Act relies on a cooperative, contract-based enforcement model rather than state-imposed sanctions, with the ultimate penalty being loss of state support rather than criminal punishment.

The Act is explicitly designed to operate alongside the Commonwealth Australian Sports Drug Agency Act 1990 (the Commonwealth Act). Section 3(2) provides that terms used in this Act and the Commonwealth Act have the same meaning unless the contrary intention appears. This imports the Commonwealth’s definitions of sporting competition, sporting organisation, and other terms, ensuring consistency. The Act also explicitly excludes Commonwealth competitors from the definition of Victorian athlete (s 3(1)), so there is no overlap in coverage: an athlete who is a Commonwealth competitor falls under the Commonwealth regime, not this state Act. The Act confers on ASDA the same functions and powers in relation to Victorian athletes as it has for Commonwealth competitors (s 9(1), s 10(1)). This means ASDA’s testing standards, sample handling, and laboratory procedures under Commonwealth law automatically apply to Victorian athletes. The World Anti-Doping Code is the substantive standard: the Victorian policy must be consistent with the Code (s 6(3)(a)), and the Code-compliant anti-doping policies referenced in s 6(3)(c) are those of sporting organisations that conform to the Code. The Act thus aligns Victoria with international anti-doping standards without directly incorporating the Code as state law. The Administrative Review Tribunal Act 2024 (Cth) replaces the former Administrative Appeals Tribunal; the 2025 amendment to s 12 updates the reference, confirming that Victorian athletes have access to Commonwealth merits review. This interaction means decisions by ASDA under the Victorian Act are reviewable at the Commonwealth level, potentially creating jurisdictional complexity. The Act repeals the Sports Drug Testing Act 1995 (Vic) (s 13), ending the previous state-level testing regime. The Act does not interact with the Crimes Act 1958 (Vic) or other criminal statutes; it creates no offences. The Interpretation of Legislation Act 1984 (Vic) governs aspects like headings and notes as per the Endnotes. The Act’s regulation-making power (s 14) could interact with occupational health and safety laws or health practitioner regulation if regulations prescribe facility requirements. There is no interaction with Victorian privacy laws mentioned in the source; however, ASDA’s collection of samples and personal information may engage the Privacy Act 1988 (Cth) or Privacy and Data Protection Act 2014 (Vic), but the Act is silent on data protection. Sporting organisations’ own rules, employment contracts, and funding agreements will also interact practically with this Act, but are not statutorily harmonised. The absence of a penalty provision means the Act interacts with the general law of contract: athletes who sign membership agreements with code-compliant policies will be contractually bound to submit to testing, with breach consequences under those contracts.

The Act has a sparse amendment history. The provided version (Version No. 004) incorporates amendments as at 22 October 2025. The only amendment shown in the Table of Amendments is the Statute Law Revision Act 2025 (No. 41/2025), assented on 21 October 2025 and commencing on 22 October 2025. That Act amended section 3(1) by repealing the definition of Commonwealth Administrative Appeals Tribunal and inserting a new definition of Commonwealth Administrative Review Tribunal (s 3(Sch. 1 item 27.1)). It also amended the heading of section 12 and the section itself to replace references to the Commonwealth Administrative Appeals Tribunal with the Commonwealth Administrative Review Tribunal (s 3(Sch. 1 items 27.2, 27.3)). This amendment reflects the Commonwealth’s replacement of the Administrative Appeals Tribunal with the Administrative Review Tribunal under the Administrative Review Tribunal Act 2024. No other amendments have been made to the Act since its enactment in 2005. The Act commenced on 12 October 2005, the day after Royal Assent on 11 October 2005 (s 2). The original Act repealed the Sports Drug Testing Act 1995 (s 13). There are no other commencement dates or transitional provisions in the source. The Endnotes indicate there are no explanatory details at the date of publication, suggesting no substantive explanatory memoranda beyond the second reading speeches. The Minister’s second reading speech was delivered in the Legislative Assembly on 17 August 2005 and in the Legislative Council on 4 October 2005. The long title of the Bill confirms the Act’s purpose to re-enact with amendments, confer functions on ASDA, and repeal the 1995 Act. The Act has therefore remained largely unchanged for 20 years, with only a minor machinery amendment in 2025 to update the tribunal name. This stability may reflect that anti-doping law is primarily driven by the World Anti-Doping Code and Commonwealth legislation, with this Act serving a narrow coordinating function. The lack of amendment over two decades also raises questions about whether the Act has kept pace with changes in the Code, testing technology, and athlete rights, though the Act’s reliance on the policy and regulations for detail may have allowed flexibility without statutory amendment.

The provided source does not reference any litigation history, case law, or judicial interpretations of the Sports Anti-doping Act 2005. The Explanatory details endnote is empty, there are no case references in the Act text, and no schedules list legal proceedings. This does not necessarily mean no litigation has occurred; it means the source material supplied does not contain such information. Given the Act’s limited scope as an enabling statute that confers functions on ASDA and mandates a policy, it is plausible that most disputes involving Victorian athletes occur under the Commonwealth Act, the World Anti-Doping Code, or the rules of sporting organisations rather than directly under this state Act. The provision for merits review via the Commonwealth Administrative Review Tribunal (s 12) means that ASDA decisions concerning Victorian athletes are reviewable at that level, and any such tribunal decisions would be under the Commonwealth’s jurisdiction, not reported as Victorian case law. Additionally, withdrawal of State support under the policy guidelines (s 6(3)(c)) could give rise to judicial review in the Victorian Supreme Court under the Administrative Law Act 1978 (Vic) or common law, but the Act does not provide for this explicitly. The Act’s silence on litigation avenues means affected persons must rely on general administrative law principles. Any challenge to the Victorian sports anti-doping policy itself would likely face hurdles because the policy is a non-statutory instrument prepared by the Minister with consultation but not requiring parliamentary approval. The absence of any noted litigation history in the source material may indicate that the Act operates largely uncontroversially beneath the Commonwealth regime, or that private resolution through sporting organisations’ internal processes absorbs most disputes. Practitioners advising Victorian athletes should be aware that while this Act itself has not generated significant case law, disputes about testing, sanctions, or loss of support may still arise under collateral legal frameworks. The lack of litigation history does not immunise future actions, particularly if the Minister issues rigorous withdrawal-of-support guidelines without procedural fairness safeguards.

Several features of the Act may catch out the unwary. First, the definition of ‘Victorian athlete’ is deceptively broad. It captures anyone who receives State support for training or competing, and State support is defined to include being a member of any sporting organisation that receives any funding or uses any state-provided facility (s 5(e)). This means a junior club athlete whose local council donates a field or provides a small grant to the club could technically be a Victorian athlete, even if they never compete at a state level. The Act does not require the athlete to be aware of this status. Second, the agreement requirement in s 11(1) is a double-edged sword. It protects athletes and organisations by ensuring ASDA can only act where there is a negotiated agreement. However, if an organisation fails to enter into an agreement, ASDA cannot test its athletes under this Act, but the organisation may still be expected by its national body or the Code to have anti-doping policies. The organisation could face pressure from funding bodies or the Minister to sign an agreement, and an athlete who refuses testing could still be sanctioned by the organisation’s own code-compliant policy. The agreement is a precondition for ASDA action, not for anti-doping compliance generally. Third, the policy and guidelines are not set out in the Act. The Minister can issue guidelines for withdrawal of State support without parliamentary scrutiny (s 6(3)(c), s 8(2)). An athlete could lose funding or facility access based on a guideline published only in the Government Gazette, with no right of appeal under this Act. Fourth, the Act does not define ‘drugs’ or ‘doping methods’. It relies on the Commonwealth Act and the World Anti-Doping Code for substantive prohibitions. This means the list of prohibited substances can change via Code amendments without Victorian parliamentary involvement. Fifth, ASDA’s power to charge fees (s 10(2)) is limited only by the requirement that fees be ‘reasonable for the expense incurred’. There is no cap, no independent oversight of fee-setting, and no provision for fee waivers for impecunious athletes. Organisations may pass these fees to athletes as a condition of participation. Sixth, the lack of temporal or geographical limits in the regulation power (s 14(2)(b) allows regulations to differ by time, place, or circumstances) means regulations could impose different testing regimes on different sports, regions, or seasons without amending the Act. Seventh, the repeal of the Sports Drug Testing Act 1995 (s 13) is total and without savings provisions. Any transitional protections or procedures under the old Act are extinguished. Eighth, the Act does not address whistleblower protection or coercion: there is no protection for an athlete who reports doping, and no prohibition on an organisation pressuring athletes to waive rights. Ninth, the interaction with employment law is unaddressed: an athlete who is also an employee of a sporting organisation may be subject to testing under both employment contract and this Act’s regime, with potential conflicts over consent and privacy. Tenth, the exclusion of Commonwealth competitors (s 3(1)) means an athlete who is both a Commonwealth competitor (e.g., in a national squad) and a Victorian athlete could fall under both regimes for different competitions, potentially facing duplicate testing or conflicting sanctions.

Compliance with the Sports Anti-doping Act 2005 involves different obligations for different actors. For Victorian sporting organisations, the central requirement is to negotiate and maintain an agreement with ASDA under s 11. Without such an agreement, ASDA cannot perform its functions or exercise its powers under the Act in relation to the organisation’s athletes. The organisation should review the terms of any proposed or existing agreement, focusing on conditions about testing procedures, sample collection, notification of athletes, and cost recovery. The agreement may specify how ASDA must perform its functions, so organisations should consider negotiating provisions that protect athletes’ procedural fairness, such as advance notice, chain-of-custody documentation, and rights to have a representative present. Organisations should also ensure their own anti-doping policies are ‘code compliant’ (consistent with the World Anti-Doping Code), because the Minister’s guidelines for withdrawal of State support reference such policies (s 6(3)(c)). Organisations must also participate in ministerial consultation when the policy is prepared or amended (s 7). Practically, organisations should maintain records of all members who are Victorian athletes, tracking their State support status, and should inform athletes of their obligations under the Act and the organisation’s policies. For the Victorian Minister, compliance is straightforward: prepare and maintain the policy (s 6(1)), consult with selected organisations (s 7), publish the policy on a government website (s 8(1)), and publish any withdrawal-of-support guidelines in the Government Gazette and online (s 8(2)). The policy must be consistent with the World Anti-Doping Code (s 6(3)(a)). The Minister should document consultation processes to avoid procedural challenge. For ASDA, compliance involves only acting within the constraints of the Act: ensure an agreement exists under s 11 before exercising powers against a particular organisation’s athletes; charge only reasonable fees for expenses incurred (s 10(2)); and provide information about testing procedures and consequences as required by s 9(2). ASDA should also comply with the Commonwealth Act and the Administrative Review Tribunal Act regarding review rights. For Victorian athletes, compliance is not defined by this Act directly, but by the policies of their sporting organisation and the Code. However, to avoid loss of State support, athletes should familiarise themselves with the Victorian sports anti-doping policy and any ministerial guidelines. Athletes should cooperate with sample collection if approached by ASDA under a valid agreement, as refusal may lead to sanctions under the organisation’s code-compliant policy. Athletes who are also Commonwealth competitors should ensure they know which regime applies in a given context. All parties should monitor the Government Gazette and the designated government website for updates to the policy and guidelines, as these can change without legislative amendment. Organisations should also consider the regulation-making power (s 14): if regulations are made prescribing testing facility standards or procedures, they will be binding. A prudent organisation will obtain legal advice on the terms of the s 11 agreement and the interaction with other laws such as privacy, employment, and contract law. There is no compliance checklist in the Act; each entity must interpret its duties from the statutory language and any subordinate instruments. Directors of sporting organisations should note that while the Act imposes no penalties for non-compliance, failure to have an agreement could expose the organisation to criticism from funding bodies and potentially from athletes who face testing delays or disputes.
