What it does
This instrument, IMMI 16/115, made by the Minister for Immigration and Border Protection under subregulations 2.07(5) and 2.07(6) of the Migration Regulations 1994, performs two discrete mechanical tasks for the Maritime Crew (Temporary) (Class ZM) visa. First, it revokes the previous instrument IMMI 15/126 (which itself specified forms and lodgement arrangements). Second, it specifies new approved forms and the place and manner in which an application for that visa must be made. The instrument is tied to the commencement of the Migration Amendment (Temporary Activity Visas) Regulation 2016; it takes effect immediately after that amending regulation does. The schedule is a table with four columns: item and visa (Item 1227, Maritime Crew (Temporary) (Class ZM)), class of person (two separate rows), forms (Column 3), and place and manner of application (Column 4). The class of person is split into two categories. The first category is applicants who provide an email address and consent to electronic communication regarding the application. For those applicants, the approved forms are either “1273 (Internet)” or “1273”. The place and manner for Form 1273 (Internet) is an internet application. For Form 1273, the applicant must either post the application with correct prepaid postage to the Department of Immigration and Border Protection, Maritime Global Processing Centre, GPO Box 9984, Brisbane QLD 4001, Australia, or have the application delivered by courier to the Department of Immigration and Border Protection, Maritime Global Processing Centre, 299 Adelaide Street, Brisbane QLD 4001, Australia. The second category covers all other applicants (those who do not provide email and consent, or who do not qualify for the first category). For those applicants, the only approved form is 1273 (not the internet version), and the manner is the same postal or courier delivery to the same Brisbane addresses. The instrument does not change the substantive eligibility criteria for the Maritime Crew visa; it only governs the lodgement channel and the approved form. It is a legislative instrument registered on the Federal Register of Legislation (F2015L01765 for the revoked instrument; the current one does not show a registration number in the text provided but is dated 16 November 2016). The revocation of the 2015 instrument means that from its commencement, the new arrangements replace the old ones, and any application not conforming to the new form or manner may be invalid under the Regulations.
