South Australian Motor Sport Regulations 2014

The Regulations rely on a set of defined concepts that shape rights, obligations and enforcement mechanics. The principal definitions are in regulation 3. "Act" means the South Australian Motor Sport Act 1984 (regulation 3). "Permitted entrant" is a central legal category: it covers persons entitled to be in the declared area by ticket or permit issued by or under the authority of the Board; persons admitted by the Board on payment of an admission fee; agents or employees of the Board; residents or invitees of residents; and others with a general or specific permit from or under the authority of the Board (regulation 3, definition of permitted entrant). The definition therefore ties entry rights mainly to the Board's issuance of tickets, permits or authorisations.

"Declared area" and "declared period" are pivotal operational limits: the Regulations apply only during the declared period and only within declared areas (regulation 4). The text does not restate the Act's mechanism for declaring areas or periods; it assumes the enabling Act provides that power, and makes the Regulations operative within those boundaries. "Resident" is defined as a person who has a permanent place of residence or business in a declared area for a motor sport event (regulation 3). The Regulations give residents and their invitees an entitlement to certain access "necessary for or incidental to" ordinary use or travel to/from the residence (regulation 5(2)), but they also specify that being a resident does not of itself make a person a permitted entrant if they are in the declared area for other reasons (regulation 5(3)).

Ticketing concepts: "ticket" means a ticket, pass or other document issued by or under the authority of the Board that confers the right to enter a declared area during the declared period or part of it (regulation 3). Tickets can be non‑transferable (regulation 13), and both permits and tickets may be subject to conditions imposed by the Board for Board‑promoted events or by the Minister for events promoted by others (regulation 11(1)). Those conditions must be stated on or referred to in the instrument, or published in the Gazette (regulation 11(2)). Reserved areas, blocks and seats can be established, and the Board (or authorised person) may issue tickets that confer entitlement to those reserved spaces (regulation 12).

Access control and safety conceptually underlying restricted areas and refreshment/no‑smoking regimes is the Board's safety judgement. The Board or persons authorised by the Board may designate restricted areas where it would be unsafe to allow general entry (regulation 9(1)). Such areas must be physically marked and carry a specified notice wording (regulation 9(2)). Similarly, parts of a declared area can be marked as refreshment areas with specific duty to prevent glass removal (regulation 17), and no‑smoking areas can be designated where smoking would be unsafe (regulation 18).

Enforcement and administrative concepts include "authorised persons" (regulation 20), who may be appointed by the Board or Minister and whose appointments can be conditional, varied and revoked (regulation 20(1)-(2)). All police are authorised persons by default (regulation 20(3)). Authorised persons have defined identification obligations (regulation 21), powers to request name and address evidence (regulation 22), to search receptacles prior to entry (regulation 23), and a broad set of other powers including preventing entry, requiring tickets to be produced, removal, confiscation and dismantling unauthorised structures (regulation 24).

Offences and penalties are a core conceptual pairing: the Regulations repeatedly set out conduct that will attract a maximum penalty of $1,250 and, where provided, an expiation fee of $105. Those monetary figures are the uniform deterrent and enforcement metric used across ticketing, access, conduct and possession offences (see multiple provisions such as regulations 5(1), 6, 7, 8, 9(3), 11(3), 12, 14-19, 23, 25-27).

Finally, the Regulations provide limited property procedure for confiscated items: authorised persons may confiscate specified items and the Minister may retain confiscated items for the purposes of proceedings or dispose of unclaimed items; owners have to make a written application for return before the expiration of one month from the end of the declared period to secure return (regulation 28).

These main concepts create a lexicon that assigns substantive power over access, spatial allocation, conduct rules and enforcement to the Board (and, where provided, the Minister), and arms authorised persons , including police , with a set of specified coercive tools during the declared period.

The Regulations affect a clearly delineated set of actors concentrated around the declared‑area event ecosystem. Primary decision‑makers are the Board (the statutory motor sport Board established under the Act) and, in specified circumstances, the Minister. The Board has authority to issue tickets, permits and authorisations; to impose conditions on those instruments for events it promotes; to designate restricted, reserved and refreshment areas and no‑smoking areas; and to appoint authorised persons or authorise persons to do those things (regulations 3, 9, 10, 11, 12, 17-19, 20).

Event promoters who are not the Board are affected because the Minister, not the Board, imposes conditions on permits, authorisations or tickets for non‑Board promoted events (regulation 11(1)(b)). Similarly, conditions imposed on members of the public attending licensed entertainments in declared areas are imposed by the Minister when the event is promoted by someone other than the Board (regulation 19(3)). That creates a bifurcated decision pathway depending on whether the Board promotes the event.

Attendees are a large affected class. The Regulations define "permitted entrant" (regulation 3) and make it an offence to be in a declared area unless the person is a permitted entrant (regulation 5(1)). Within the class of permitted entrants, "resident" and "invitee of a resident" have specific rights to access necessary for ordinary use of a home or business (regulation 5(2)), but residents lose that entitlement when they are in the declared area for other, unentitled reasons (regulation 5(3)). Ticket holders are specifically affected by the ticketing rules: non‑transferable tickets bind the ticket to the named person (regulation 13), and tickets may carry conditions which must be shown or published (regulation 11(2)).

Commercial actors operating within the declared area are affected. Persons authorised to sell alcoholic beverages must hold a licence under the Liquor Licensing Act 1997 to be exempt from the prohibition on bringing alcohol into the declared area (regulation 15(2)). Persons who wish to conduct entertainments for the public must hold a licence under regulation 19(1), and must observe any conditions attached. Vendors or others offering goods for sale in the declared area are constrained by regulation 16(b)(iii) and regulation 24(i)(v), which prohibit unauthorised sale and allow confiscation of things reasonably suspected of being offered for sale in contravention of Part 2.

People who erect structures, distribute printed matter, post posters or place signs inside a declared area are affected by the restrictions in regulation 16(b)(iv) and (v). Those items may be confiscated by an authorised person (regulation 24(i)). People intending to bring vehicles into the declared area are affected by regulation 7, which requires a permit or authorisation. Persons wanting to be on a motor racing circuit inside a declared area are restricted to drivers/occupants of racing cars, service vehicles, emergency vehicles, specific permit holders, support crew, or those entering under specific authorisation (regulation 8).

Authorised persons themselves are both actors and stakeholders: the Board or Minister appoints them (regulation 20(1)), they must be issued identity cards (regulation 21(1)) and they may exercise a suite of powers during the declared period, including the use of reasonable force where necessary (regulation 20(4)). All members of the police force are automatically authorised persons under regulation 20(3), with the consequence that police carry both the statutory authority and the operational responsibilities to enforce the Regulations.

Finally, the Minister is an affected decision‑maker who may impose or vary conditions for non‑Board promoted events, receive and dispose of confiscated property where unclaimed (regulation 28(2)), and in other respects has specified supervisory roles across the regulatory scheme. The Regulations therefore carve out roles for the Board, the Minister, authorised persons, police, ticket holders, residents and commercial operators, and attach duties and liabilities to each group within the bounded spatial and temporal scope of declared areas and declared periods.

The Regulations allocate a short list of express duties on attendees, organisers and authorised persons, and a narrow set of affirmative rights for residents and ticket holders.

Duties on attendees and entrants:

• A person must not enter or remain in a declared area unless the person is a permitted entrant (regulation 5(1)); that is the primary entry gate duty. The maximum penalty is $1,250 with an expiation fee of $105.
• A person must enter and leave the declared area only through approved entrances and exits (regulation 6). Approved entrances and exits are those "approved by the Board" (definition of approved entrance/exit, regulation 3). Breach attracts the same penalty and expiation fee structure (regulation 6).
• A person must not bring a vehicle into the declared area except in accordance with a permit or other authorisation issued by or under the authority of the Board (regulation 7).
• A person on a motor racing circuit must fall within the limited categories identified in regulation 8 to avoid a breach (driver/occupant of racing car, service vehicle, emergency vehicle, specific permit holder, support crew).
• A person subject to ticket conditions must not contravene those conditions (regulation 11(3)), and a ticket does not confer rights outside opening and closing times fixed in the Gazette unless expressly stated otherwise (regulation 11(4) and regulation 10).
• Ticket holders must not sell a ticket above the price fixed by or under the authority of the Board and must not sell imitation tickets (regulation 14).
• Persons must not bring alcoholic beverages into a declared area except in tightly delimited circumstances (regulation 15(1)-(2)), and must not consume unlawfully brought alcohol in the declared area (regulation 15(3)).
• People must not contravene the conduct rules set out in regulation 16, including prohibitions on certain items, erection of structures, unauthorised distribution or sale, damage to property, disorderly behaviour and blocking thoroughfares.

Duties on the Board and Minister:

• The Board must fix opening and closing times for declared areas by notice in the Gazette (regulation 10).
• The Board (for Board‑promoted events) or the Minister (for events promoted by others) may impose conditions on permits, authorisations and tickets, and those conditions must be stated on the instrument or published in the Gazette (regulation 11(1)-(2)).
• The Board or an authorised person must designate restricted areas, reserved areas, refreshment areas and no‑smoking areas and must mark them clearly and post the notices with specified wording (regulations 9(2), 12(3), 17(2), 18(2)).

Rights and limited entitlements:

• Residents and their invitees are expressly entitled to access that is necessary for or incidental to ordinary use of a place of residence or business in the declared area or for travel to/from that place (regulation 5(2)). This is a narrow statutory entitlement and it is expressly constrained by regulation 5(3) which excludes residents from being regarded as permitted entrants if their presence is for other reasons.
• A ticket holder has the right to be in the declared area only to the extent the ticket confers that right and the ticket's conditions are complied with; a ticket marked "non‑transferable" entitles only the person named or identified in the ticket to enter (regulation 13). Conditions must be made known either on the ticket or in the Gazette (regulation 11(2)).
• A person whose property is confiscated has a right to have it returned if a written application for its return is made before the expiration of one month from the end of the declared period (regulation 28(1)). Otherwise the Minister may retain property for prosecutions or dispose of it (regulation 28(2)).

Authorised person powers and duties:

• Authorised persons may be appointed by the Board or Minister and their appointment instruments may be conditional, varied or revoked (regulation 20(1)-(2)). All police are authorised persons automatically (regulation 20(3)).
• An authorised person must be issued with an identity card containing name, photograph and a statement that the person is an authorised person; if limitations exist on powers those limitations must be stated on the card (regulation 21(1)-(2)). The authorised person (unless a uniformed police officer) must produce the identity card or, if a police member, the certificate of identity, on request (regulation 21(3)).
• Authorised persons may inspect bags prior to entry (regulation 23), request names and addresses where there are reasonable grounds to suspect an offence (regulation 22), prevent entry, require production of tickets, remove persons and confiscate items as specified (regulation 24). They may use reasonable force where necessary (regulation 20(4)).

Procedural rights:

• The Regulations provide that conditions imposed on permits or tickets must be stated or referred to in the instrument or published in the Gazette (regulation 11(2)), which is a procedural constraint on imposition of conditions. The Board must fix opening and closing times by Gazette notice (regulation 10), which is an administrative transparency mechanism.

These duties and rights form a closed universe of compliance obligations and limited entitlements that attach during the declared period; they are primarily operationalised through ticketing, signage and the exercise of authorised person powers.

The Regulations are enforcement‑centric in design: the instrument sets out a uniform penalty framework and a range of enforcement powers available to authorised persons. Across nearly all substantive prohibitions the maximum penalty is $1,250, and most offences carry an expiation fee of $105 where applicable. Examples include: entering without being a permitted entrant (regulation 5(1)), failing to use approved entrance/exit (regulation 6), bringing vehicles without authorisation (regulation 7), unauthorised presence on a motor racing circuit (regulation 8), entering restricted areas without authorisation (regulation 9(3)), contravening permit/ticket conditions (regulation 11(3)), occupying reserved areas/seats without entitlement (regulation 12), selling tickets above fixed price or selling imitation tickets (regulation 14), bringing alcoholic beverages into declared area (regulation 15(1)), consuming unlawfully brought alcohol (regulation 15(3)), breaching the conduct rules in regulation 16, removing glass from refreshment areas (regulation 17(3)), smoking in designated no‑smoking areas (regulation 18(3)), breaching entertainment licensing conditions (regulation 19(4)), refusal to comply with authorised person directions (regulation 25), re‑entering within 24 hours after removal (regulation 26) and hindering an authorised person (regulation 27).

Authorised persons, appointed by the Board or Minister, and all police officers by designation, are the central enforcement agents (regulation 20). Their powers during the declared period are wide and include: preventing entry to persons not entitled (regulation 24(a)), enforcing approved entrance/exit requirements (regulation 24(b)), requesting production of tickets or other satisfactory evidence of entitlement (regulation 24(c)), removing persons from the declared area in specified circumstances (regulation 24(d)), requiring persons to vacate dangerous areas (regulation 24(e)), removing persons from restricted areas (regulation 24(f)), removing persons from reserved areas or seats where they lack appropriate entitlement (regulation 24(g)), confiscating imitation tickets, alcohol, glasses removed from refreshment areas, posters, printed matter, materials for erecting structures, animals, flares or anything sold or suspected of being sold in contravention of Part 2 (regulation 24(h)-(i)), and dismantling unauthorised structures (regulation 24(j)). Authorised persons must be able to produce identification (regulation 21), and may use reasonable force as is necessary to exercise their powers (regulation 20(4)).

Procedure for confiscated property is specified. An authorised person who confiscates something during the declared period must, subject to regulation 28, return it if the owner makes written application for its return before the expiration of one month from the end of the declared period (regulation 28(1)). The Minister may retain confiscated items for purposes of proceedings and may dispose of imitation tickets, certain printed matter, and unclaimed items as it thinks fit (regulation 28(2)).

The enforcement design creates an administrative enforcement pathway (expiation fees) alongside the criminal penalty route. The Regulations do not themselves specify detailed court procedures, evidentiary standards or appellate pathways; they provide offences and authorised persons’ powers and leave prosecution and court processing to the ordinary criminal justice processes. The presence of expiation fee amounts in many provisions creates an administrative option for settling contraventions without prosecution, but the Regulations also retain the maximum penalty as the prosecutable criminal sanction.

Practical enforcement implications flow from the broad discretionary powers afforded to authorised persons and the Board. Authorised persons are appointed by instrument and appointments may be conditional, varied and revoked (regulation 20(2)). That appointment power combined with the ability to search, confiscate and use reasonable force gives authorised persons direct operational control over compliance; the Regulations impose identification and production obligations on authorised persons (regulation 21) and procedural constraints on disposal of confiscated property (regulation 28) which frame but do not eliminate potential disputes about overreach or proportionality.

Finally, signage and Gazette publication mechanisms are embedded in enforcement. Restricted areas, refreshment areas, no‑smoking areas and reserved seating must be marked and display specified notices (regulations 9(2), 12(3), 17(2), 18(2)). The Board must fix opening and closing times by Gazette notice (regulation 10) and conditions on permits must be either in the permit/ticket or published in the Gazette (regulation 11(2)). Those publication and signage obligations are the primary transparency measures that underpin enforcement.

The Regulations are subordinate legislation made under the South Australian Motor Sport Act 1984 and operate within the scope and limits of that Act. The Regulations refer to the Act directly in their definitions (regulation 3) and prescribe names for a specific purpose under section 28(c) of the Act via regulation 3A. Thus the Regulations must be read and applied against the enabling Act. The regulatory scheme relies on statutory declarations of areas and periods under the Act; regulation 4 limits application to a declared area during the declared period, implying the Act supplies the core power to declare.

The Regulations expressly interact with at least one other statute. Regulation 15(2) creates an exception to the prohibition on bringing alcoholic beverages into a declared area for persons who hold a licence under the Liquor Licensing Act 1997 authorising the sale of alcoholic beverages in the declared area, or who are acting under an authorisation issued by the Board. That cross‑reference imports pre‑existing liquor licensing law and its regulatory controls into the event site framework. It means that any person seeking to sell alcohol within a declared area must consider and comply with the Liquor Licensing Act 1997 licensing requirements as well as the event licensing/authorisation under these Regulations (regulation 15).

The Regulations also implicitly interact with policing and identity regimes. All members of the police force are authorised persons by regulation 20(3), and a police member may produce a certificate of identity as the form of identification required by regulation 21(3)(b). That cross‑references existing police identification systems, and gives police officers dual status: as enforcers of ordinary criminal law and as statutory authorised persons under these Regulations.

The confiscation and disposal regime (regulation 28) intersects with procedural law governing property rights and criminal proceedings only to the extent provided: the Minister may retain items for purposes of proceedings and dispose of unclaimed items, but the Regulations do not set out a detailed property‑law regime beyond the one‑month claim window. Any retention for prosecution will necessarily involve ordinary criminal procedure, but the Regulations leave those interactions unelaborated.

The Regulations do not expressly oust other statutory or common law offences. For example, persons committing assault, theft, wilful damage or other general offences inside a declared area would still be subject to the general criminal law, but the Regulations themselves do not address duplication or exclusion of other offences. The text does not state that compliance with the Regulations displaces other statutory duties or civil liabilities; therefore actors should assume overlap with other legal duties outside the Regulations.

Finally, condition‑setting powers are allocated between the Board and the Minister depending on who promotes the event (regulation 11(1), 19(3)). That creates an interaction with the policy and administrative roles of the Ministerial office and the Board: for events promoted by others, the Minister is the appropriate regulatory gatekeeper for conditions attached to permits and public entertainments, whereas for Board‑promoted events the Board itself is the relevant actor. The Regulations thus sit in a regulatory architecture where other statutes and ministerial or Board policies will shape the detailed operation of the framework.

The Regulations replaced the South Australian Motor Sport Regulations 1999 and were originally made in 2014. The legislative history recorded in the instrument shows the principal regulations were made in 2014 (Gazette 28.8.2014 p4158; commencement 1.9.2014: regulation 2). The 2014 instrument is shown in the record as number 230 of 2014. The Regulations were varied by instrument number 81 of 2022 (Gazette 8.9.2022 p5896), which commenced on 8.9.2022 and effectuated a set of editorial and substantive variations (legislative history).

The 2022 variation made two recorded changes of note in the legislative history extract: regulation 2 was omitted under the Legislation Revision and Publication Act 2002 (date of omission 8.9.2022), and Part 1A was inserted by the 81/2022 instrument (regulation 3) on 8.9.2022. Part 1A contains regulation 3A, which prescribes certain names for the purposes of section 28(c) of the Act: World Solar Challenge; SA Motor Sport; ADL500. The Regulations’ legislative history therefore documents the insertion of that Part, the omission of regulation 2 as an editorial revision, and the notation that Schedule 1 was omitted under the Legislation Revision and Publication Act 2002.

The record also shows that the Regulations revoked the earlier 1999 Regulations (specified under "Legislation revoked by principal regulations"). The 2014 instrument thus superseded the 1999 framework. The statutory entries in the legislative history list "Principal regulations and variations" and identify only the 2014 and 2022 instruments in the short extract provided, with the 2022 instrument described as varying parts of the Regulations (for example insertion of Pt 1A).

Mechanically, these variations indicate that the most recent substantive addition visible in this extract is the prescription of event names under regulation 3A (inserted 8.9.2022). The legislative history does not document any other variations or repeals beyond those noted in the extract; where the instrument states "Provisions varied" the table indicates that Part 1 and regulation 2 and Schedule 1 have been omitted or varied under the Legislation Revision and Publication Act 2002 as of 8.9.2022, and Part 1A was inserted by the 2022 variation.

Readers should treat this legislative history as the text‑provided record: the Regulations record the 2014 commencement and the 2022 variation that added Part 1A and removed certain other provisions under the administrative revision regime. The Regulations as presented therefore reflect the consolidated form after those changes.

The Regulations themselves contain no notation of decided cases, reported judicial interpretations or litigation outcomes within the text provided. There are no cases named in the instrument and no section refers to judicial decisions. The "Litigation history" heading in the prompt's copy of the Regulations contains no entries beyond the legislative history of amendments. Thus, there is no litigation history recorded in the instrument that can be cited from this source.

Nevertheless, specific provisions of the Regulations identify areas where contested enforcement or legal challenge could plausibly arise in practice, even though no cases are recorded here. For example, the powers given to authorised persons to search bags prior to entry (regulation 23), to request identity and evidence of name and address (regulation 22), to confiscate items or dismantle structures (regulation 24(h),(i),(j)), and the authorisation to use "such reasonable force as is necessary" (regulation 20(4)) are the sorts of powers which in other contexts often produce factual and legal disputes about scope, necessity and proportionality. Disputes could also concern the scope of residents' access entitlements under regulation 5(2) versus the restriction in regulation 5(3) that denies resident status where the resident is present other than under the entitlement in 5(2) or other Board authority.

Property disputes about confiscation and return are prospective points of contention. Regulation 28(1) gives the owner a statutory right to return if there is a written application before the expiration of one month from the end of the declared period, but also gives the Minister discretion to retain items for purposes of proceedings and to dispose of unclaimed items (regulation 28(2)). Disputes could arise over whether an item was properly confiscated, whether the retention was justified for a particular prosecution purpose, or whether disposal was lawful in the circumstances.

Because the Regulations do not themselves canvass procedural remedies, appeal routes or administrative review mechanisms, any litigation that does occur would likely engage the usual criminal, administrative and civil law processes in South Australian courts and tribunals. The text, however, does not record any such cases. Practitioners looking for judicial interpretation should therefore check case law databases and court registries beyond this instrument to identify any subsequent litigation addressing these provisions. The Regulations provide the statutory text and the likely focal points for contestation, but not any recorded judicial answers within the instrument itself.

The Regulations contain a number of concrete operational traps and discretionary levers that can catch organisers, attendees and vendors if they do not pay attention to the text.

1. Narrow resident entitlement. Regulation 5(2) grants residents and their invitees an entitlement to access only "necessary for or incidental to" ordinary use of a residence or business in the declared area or travelling to/from it. Regulation 5(3) expressly denies that resident status equates to being a permitted entrant if the resident is in the declared area for other reasons. Practically, a resident who attempts to attend an event as a spectator without a ticket could be excluded and fined, despite living inside the declared boundary.

2. Gazette dependence. Several key rights and constraints depend on Gazette notices. The Board must fix opening and closing times by Gazette notice (regulation 10), and conditions on permits and tickets must be stated on the instrument or published in the Gazette (regulation 11(2)). If a ticket does not itself contain stated conditions and the conditions are not published in the Gazette, the enforceability of those conditions may be vulnerable to challenge. Organisers must therefore ensure that administrative publication obligations are satisfied.

3. Non‑transferable tickets. A ticket marked "non‑transferable" only entitles the named person to enter (regulation 13). Simple handovers may constitute an offence if the ticket is used by a person other than the identified individual.

4. Fixed ticket pricing yet opaque fixing power. Regulation 14(1) prohibits selling a ticket at a price greater than that fixed by or under the authority of the Board. The Regulations do not elaborate the mechanics of how prices are fixed, who publishes them or procedures for changes. Sellers and resellers risk penalty if they sell tickets above the Board‑fixed price, but the public record of the fixed price must be checked to avoid inadvertent infringement.

5. Search before entry is mandatory. Regulation 23 allows authorised persons to request inspection of any bag prior to entry, and a person must not enter until complying with the request. That creates a de facto requirement to submit to searches as a condition of entry; refusal could be an offence or result in denial of entry.

6. Broad confiscation powers and short claim window. Authorised persons may confiscate a wide list of items (regulation 24(h),(i)) and the owner has only until one month after the end of the declared period to make a written application for return (regulation 28(1)). Failure to make that written application will expose the owner to loss of property and the Minister’s discretion to dispose of items (regulation 28(2)). Event participants who inadvertently bring prohibited items may lose them with limited recourse.

7. Use of reasonable force. Regulation 20(4) authorises the use of "such reasonable force as is necessary" for effective exercise of powers. That creates a potential escalation point , authorised persons may use force , and organisers must ensure authorised persons are trained and instructions are clear to avoid unlawful use of force allegations.

8. Appointment conditionality and revocability. Appointments of authorised persons can be made subject to conditions and may be varied or revoked at any time (regulation 20(2)). That flexibility can produce inconsistent enforcement if appointment criteria and limitations are not recorded and made available for inspection, despite the identification card requirement in regulation 21(2).

9. Restricted and reserved areas require specific signage and wording. Failure to mark restricted areas with the specified "RESTRICTED AREA: ACCESS TO PERMITTED PERSONS ONLY" wording, or to mark refreshment exit signage as required, could undermine enforcement actions taken against entry, because the signage requirements are expressly laid out in regulations 9(2), 17(2) and 18(2).

10. Entertainment and liquor licensing overlap. A person conducting an entertainment in a declared area must be licensed under regulation 19(1) and may face conditions imposed by the Board or the Minister (regulation 19(3)), while selling alcohol requires a licence under the Liquor Licensing Act 1997 (regulation 15(2)). Multiple licences and conditions may be required and must be aligned; failure to obtain both could lead to parallel offences under these Regulations and under liquor licensing law.

11. Re‑entry ban after removal. Regulation 26 creates a 24‑hour prohibition on re‑entering a declared area after removal by an authorised person. This relatively short ban may catch out removed persons who attempt to return within a day and face a penalty for doing so.

12. Broad behavioural prohibitions with subjective terms. Regulation 16(2) prohibits behaviour that is "disorderly, offensive or indecent" and defines those terms in part by examples such as "riotous", "obscene" or "threatening, abusive or insulting". These semi‑subjective standards leave room for differing assessments by authorised persons and subsequent dispute.

These are practical "gotchas" that arise directly from the wording and structure of the Regulations. Organisers and participants need to anticipate them and build operational procedures that ensure Gazette publication, clear ticket conditions, compliance with signage and licensing, careful delegation and training of authorised persons, and robust record‑keeping for appointments and confiscations.

Compliance requires attention at three levels: organisers/Board/Minister, authorised persons and staff, and attendees/vendors. Below is a practical checklist mapped to the Regulations with the key actions and documentary safeguards.

For the Board and event promoters:

• Declare and publish opening and closing times: ensure the Board fixes an opening time and a closing time for each day of the declared period and publishes that in the Gazette as required by regulation 10. Where a permit or ticket might otherwise be ambiguous about times, ensure an express term clarifying whether entry before opening or after closing is permitted (see regulation 11(4)).
• Make ticket conditions explicit: any condition attached to a permit, authorisation or ticket must be stated in or referred to on the document, or published in the Gazette (regulation 11(2)). Ensure tickets incorporate or reference the conditions and keep copies of Gazette notices showing published conditions.
• Set up signage and demarcation: restricted areas must be designated by markings and signs with the precise wording required (regulation 9(2)); refreshment areas and no‑smoking areas have specified sign text and placement obligations (regulations 17(2), 18(2)). Reserved areas, blocks and seats must be clearly differentiated by signs or markings (regulation 12(3)). Use the exact prescribed wording to avoid procedural challenge.
• Ticket design and control: if selling non‑transferable tickets, clearly mark them "non‑transferable" and ensure the ticket identifies or names the permitted entrant (regulation 13). If tickets have seat or reserved block entitlements, ensure the ticket matches the reserved allocation and can be produced on demand (regulation 12).
• Authorised persons appointment and documentation: appoint authorised persons by instrument, record any conditions on appointments (regulation 20(1)-(2)), and issue identity cards containing name, photograph and a statement that the person is an authorised person and setting out any limitations on power (regulation 21(1)-(2)). Maintain a register of appointments, identity card numbers, and conditions so authorised persons can produce their card on request (regulation 21(3)).
• Training and rules of engagement: train authorised persons on the scope of powers in regulation 24, the limitations on use of force (regulation 20(4)), procedures for requesting name/address evidence (regulation 22), and bag inspection rules (regulation 23). Emphasise de‑escalation and documentation of incidents to reduce risk of contested enforcement.
• Liquor and entertainment licensing: if alcohol will be sold, ensure the seller holds an appropriate Liquor Licensing Act 1997 licence authorising sale in the declared area, or the Board issues an authorisation under regulation 15(2). Those permitted to sell should be accompanied by documentation proving the licence or authorisation. Likewise, obtain any licence to conduct an entertainment under regulation 19(1) and comply with conditions (regulation 19(2)-(4)).
• Reserved seating and pricing controls: if the Board fixes ticket prices or authorises pricing, publish or communicate fixed prices clearly to avoid breaches of regulation 14(1). Monitor secondary sales and establish controls to prevent permitted sellers from selling above fixed prices; consider contract provisions with authorised sellers to prohibit resale above fixed prices.

For authorised persons and stewards:

• Identification on demand: carry the identity card required by regulation 21 and be prepared to produce it to any person in relation to whom you exercise powers. If your powers are limited, the limitation must be stated on the card (regulation 21(2)-(3)).
• Pre‑entry inspection procedures: follow regulation 23: prior to entry request inspection of bags and do not permit entry until the inspection is complied with. Keep a log of refusals and the action taken.
• Confiscation and documentation: when confiscating items under regulation 24(h)-(i), record the grounds for confiscation, the item's description, the owner's details if known, and give or publish instructions on how the owner can claim the property. Be aware of the one‑month claim period under regulation 28(1). Retain records of items returned and items forwarded for disposal under regulation 28(2).
• Removal and re‑entry: when removing a person, record the time and basis of removal and advise the person of the 24‑hour re‑entry prohibition under regulation 26. Document any enforcement action to provide a record for potential disputes.
• Reserved and restricted areas enforcement: ensure signage is in place before preventing entry to restricted areas or reserved seating (regulations 9(2), 12(3)). Use reasonable grounds and record reasons when removing people from restricted areas (regulation 24(f)).
• Use of force: when exercising the power under regulation 20(4), ensure force used is proportionate, necessary and documented; medical or independent witness records should be collected where force is used.

For attendees, residents and invitees:

• Bring a valid ticket or permit and know whether it is non‑transferable and whether it contains conditions. Produce it on request to authorised persons (regulation 24(c), regulation 13).
• Use only approved entrances and exits, and comply with directions of authorised persons. Do not bring prohibited items (e.g. cans, bottles, animals, flares, materials for erecting structures) unless you hold the necessary permit or board authorisation (regulation 16(1)(a)).
• If you are a resident, be aware your entitlement under regulation 5(2) is limited to ordinary use of your residence or travel to/from; use beyond that may leave you subject to the general permitted entrant rule.
• Comply with refreshment, smoking and alcohol rules: do not remove glass from refreshment areas (regulation 17(3)), do not smoke in no‑smoking areas (regulation 18(3)), and do not bring wine, beer or other alcoholic beverages into the declared area unless captured by the limited exceptions in regulation 15(2). Do not attempt to sell tickets or goods contrary to the Board's fixed price or sale rules (regulation 14).
• Cooperate with bag inspections and identity requests and do not provide false name or address information if required under regulation 22.

For vendors, entertainers and structure erectors:

• Obtain the licences required by regulation 19 for entertainments and by the Liquor Licensing Act 1997 for alcohol sales (regulation 15(2) and regulation 19). Ensure you have any Board authorisation if the Board is to permit sale or entertainment.
• Do not erect structures, place posters, distribute printed matter or sell goods without express authorisation from the Board under regulation 16. Obtain written permits that are clear about location, duration and conditions and ensure the permit or authorisation can be produced on request.
• Be prepared to comply with conditions attached to licences and permits and ensure staff have copies of the written authority and understand the reserved area signage and seating allocations.

Record‑keeping and administrative tips:

• Keep a central file of Gazette notices relating to opening/closing times and published permit/ticket conditions (regulations 10 and 11(2)).
• Maintain appointment instruments, identity card records and a register of authorised persons with stated conditions (regulation 20(1)-(2), regulation 21(1)-(2)).
• Keep an incident log for searches, removals, confiscations, claims for return of property and any use of force (regulation 23, regulation 24, regulation 28).
• Provide clear on‑site signage matching the required wording where restricted, refreshment and no‑smoking areas are designated (regulations 9(2), 17(2), 18(2)).
• Ensure staff working in ticketing, entry control, hospitality and security understand the intersection with Liquor Licensing Act 1997 obligations where alcohol is sold (regulation 15(2)).

Taken together, compliance is a mix of legal documentation (Gazette notices and written conditions), clear signage and spatial demarcation, robust appointment and identification systems for authorised persons, and operational policies for searches, confiscations and incident documentation. The Regulations centralise functional control in the Board and provide an administrative and criminal enforcement architecture , compliance therefore requires early coordination with the Board (or Minister where relevant), accurate publication of conditions and disciplined on‑site operational procedures.
